The following action was taken by the Southold Town Planning
Board, Monday, April 14, 1986.
RESOLVED that the Southold Town Planning Board refer the
following comments to the Board of Appeals with regard to the
application of John and Gloria Shirvell at Cutchogue:
1. The lots proposed do not conform to the two-acre
zoning.
2. It is noted that while alot of the surrounding
lots are less than the proposed lots, quite a few of the
surrounding lots are larger than the proposed lots.

Gentlemen:
The applicant and wife are the owners of a certain real property
situated in the Town of Southold and described in the attached exhibits.
The subject premise consists of 1.01 acres with 170' frontage on
Billard Road and approximately 253' on Pine Tree Road. The dwelling
is located on the easterly side of the property. After purchasing the
property in 1980, I learned that the house was to be originally located
on the westerly side. However the builder was forced to remove the
foundation because of structural defects, resulting in a very rough
grading on the westerly corner.
In 1983 I was forced to retire because of a total and permanent
disability. Various neighbors and other residents of the area have
suggested that I do something with the corner lot. They are surprised
when I inform them that it is not a separate lot.
However the feasibility of a Set-Off would allow relief from the
economic hardship caused by my premature forced retirement.
A check of the Exhibits will show that the properties directly
across Billard Road and Pine Tree Road are on lots of less than 1 acre
and many on less than a half acre. The sale or construction of a
dwelling on Parcel B would conform to the character of the immediate
area and community.
