Keith, Secretary, Mattituck I T Sanford Hanauer, Mattituck Garrett Strang reported that the Planning Board staff had requested that a member of the Committee review applications upon receipt to ascertain and request missing requirements. Discusssion was postponed until a meeting with greater representation. A permanent structure sensitive to the adjoining building is recommended. Raynor : In reference to Item 3 in your letter to us dated September 15th, 1983 , we propose the following alternative to the removal of the concrete island north of the central ingress and egress . We will install four (4) vertical pipe bumpers filled with concrete , spaced as shown on the attached drawing . The bumpers will protrude four feet above the top of the island, be painted yellow, and will be driven four feet into the ground for anchorage purposes . In addition to the bumpers , a directional sign will be placed at the south center of the island with a directional arrow indicating automobiles to bear right . And, to remove the interior channelization at the main entrance to the shopping center. We have reviewed the proposals indicated in your letter and have authorized S & E Realty to construct a single sixteen foot wide intersection type roadway to be used as an exit only. The function of this exit is to relieve any stacking which may occur at the main entrance. This easterly exit is not to be used as a main exit, but as a alternate exit as indicated. In addition, you also requested the removal of the raised island directly opposite the main entrance/exit to the shopping center. The purpose of this island is to provide channelization for vehicles entering the parking lot. The removal of this and would expose the vehicles which are parked directly in line with the entrance to vehicles entering the parking lot. We enclose herewith two (2) copies of an engineering drawing by Teas and Barrett which indicates the size, location and configuration of the additional means of egress from the shopping center for which permission was granted by your department . Subsequent to your correspondence, the Suffolk National Bank requested that an additional means of egress be provided on the west side of the site for use of their customers exiting from the drive-in facility. The drawing being submitted indicates this means of egress as well as the one previously referred to. Ms . Scopaz: Are you protesting the twelve foot poles? Mr. DeAndro: Yes, exactly. Ms. Scopaz: Apparently Sky Electric has asked that they be allowed to put fourteen foot poles and they have been sent a letter saying that the light and pole be twelve feet in height. Mr. DeAndro: I 'm from Sky Electric one of the contractors doing the Suffolk County Pole length for Southland Corporation . Mr. Orlowski: We are going to go with the twelve foot. Mr. DeAndro: Was there a reason, only because I noticed, we have been out here a few different nights to layout the lighting SOUTHOLD TOWN PLANNIN( IOARD 31 FEBRUARY 2 1992 C and there were numerous other locations with poles quite a bit higher then twelve feet and I did come here . Mr. Ward: Now you know why we want twelve foot. Mr. McDonald: You didn' t have the advantage of being here earlier but one of the decisions we did today was to tell all of the eople to take down their thirt foot and put up a sh� or`t�'—' one. We on' t have control of the pre-existe rig ut our policy is to try and a scale that is more in keeping with the rural character of the Town. Mr. DeAndro: I fully understand that, but what happens is, in this case bringing down the level to a twelve foot pole you are forced to put maybe a power flood type fixture in pushing the light to cover a parking lot area. Where the architectural design throughout the country is a shoe box type fixture which contains a light almost like a flashlight coming down directly on the parking area or the site area. It is not a power flood whereas the higher you go up to put a power flood it would be a nuisance, almost a eye sore. Mr . Ward: Obviously, going with twelve foot poles , it may be an extra pole or two and it may mean lower wattage to make your even distribution. C Mr. DeAndro: My main concern is that would be fine in some cases , but where you have a parking area where you can' t cover the total gap unless you mount a power type flood to push the light across the parking lot area was our concern. Obviously, the higher level in which we bring the light up, we are not creating more light, we are using the same type of fixture, but we get more of a overall light over the parking area and I think that was our concern. I have some photographs. Mr'. Orlowski: Are you saying twelve foot won' t do it? Mr. DeAndro: Actually, the original sketch was a three foot concrete base with a seventeen foot pole. They do make a fourteen foot pole which is available which would take about . four weeks to get. We have used seventeen foot poles throughout and I understand that Southold is a little bit more concerned about making it look like a commercial type area. Fourteen foot poles are available. Mr. McDonald: For installation on a three foot high concrete pad? Mr. ward: We're talking mounting heights, not higher poles. We ' re talking twelve foot mounting heights. Mr. DeAndro: I understand that and actually I am not even sure those poles are available for that mounting height. Mr. McDonald: But it is taking place on a wider scale except with Southold so Southold wasn' t evaluated on its own merits, it was the fact that it was designed with the fact that it would be adequate for the average site. Mr. DeAndro: It was a twenty foot pole mounting height. what I an looking to do is try and find a happy medium. Smithtown has a height requirement of eighteen foot and we were able to meet that. other areas do not achieve building height and our concern is to keep the lighting contained to the parking area. Mr. McDonald: Is the lighting insufficient on these sites already? Mr. DeAndro: Well, out in Greenport there was one incident where someone was mugged or assaulted in the parking lot area. Mr. McDonald: The security is not the question, I mean the in store security. Mr. DeAndro: No, inside the store is not a problem. I think what is happening is the total program with Southland ( Corporation is that they are finding that there is more and more working women in the field today so what is happening is that they want to light up the parking lot area. Not necessarily brighter because a lot of them have X000 watt metal floods type of situation which has a low wattage type of lamp—ou-c- laz Mly , more of an even li-glI£ing roug ou a parking lot areas. This way working women on their way back from work want to stop and feel a little bit more secure in the parking lot areas, I think that was one of the main concerns and also they are just trying to improve the overall look. V Y, Mr. McDonald: I see, it is to come. Mr. DeAndro: Right, in other words, I would do it as soon as I could. Mr. Orlowski: Maybe, we can just order a bunch of twelve foot poles and forget about it. Mr. DeAndro: Well, the twelve foot pole would be alright except for the fact that in Southold and Greenport we have three foot bases already installed there. My concern is that we would have to go for a nine foot pole. You are probably wondering why do we install the basis to begin with? I did come by and we had a tight schedule. They had appropriationsby the end of December and they have the installations in and they did come by and at that time there were no restrictions in Southold Town and there C was no building permit required for installation of outside lighting. I was advised that there wasn't a perceivable problem to request a site plan waiver and proceed. Generally, it probably wouldn' t have been a problem if there was something in writing at the time stipulating that there was a twelve foot limit on the poles. At the time, there wasn' t anything available. Mr. McDonald: What are the stock sizes made? Are they available essentially in any length? Mr. DeAndro: Right now, there is fourteen foot and seventeen foot pole available. The two sizes. They did send someone out to inspect the sites. Mr. McDonald: So a fourteen foot would have a seventeen foot total height and the seventeen foot would have a twenty foot total height. Mr. DeAndro: Well, I have got about six inches of the base actually buried into the ground. Everyone talking. Mr. 'McDonald: I don' t think the building is higher than twelve feet, is it? Mr. Rich Artmar - Mattituck Saltaire - I live on the northern dead end of Wavecrest so I certainly have an interest in this whole project. I haven' t been opposed to the development of that property from the beginning because when I moved in there I felt that it was going to eventually be developed, especially the way things were booming back in the late 70 ' s and early 80 ' s and I followed this along the last few years and I was pleased to see that the Board indicated to Mr. Matthews to shift it and cluster it to the south and I saw those site plans in the file and thought that things were going to proceed along those lines. I believe that was last summer that I looked at those. Then, I was surprised to see that that wasn' t proceeding as planned and I guess it comes back to the question that was asked before. Why have things been reversed now, flipped and is Mr. Matthew' s previous application, does he have to file an application when he files those site plans? Is that present application in effect at this point? The southerly clustered site plans because you said before he hasn' t revised anything, just looked at it. PROTECTIVE LIABILITY INSURANCE COVERAGE Permittee must have protective liability insurance coverage in accordanc% with Department requirements. (See Infor- mation on Protective Liability Insurance Required for Highway Work Permits and/or Special Hauling Permits, Form PERM-27). Expiration of, or lack of, liability insurance automatically terminates the permit. Insurance coverage may be provided by furnishing the Department with one of the following: a. A Certificate of Protective Liability Insurance for Permits on State Highways (Form PERM 17, NYSDoT). b. A $2.50 remittance (check drawn on a New York State Bank or Certified) for coverage under the Departmental Blanket Policy. c. An Undertaking may be furnished by Public Service Corporations and Government Units only and must include the wording required by the Department. 2. COMPENSATION INSURANCE AND DISABILITY COVERAGE The applicant is required to have compensation insurance and disability coverage as noted inthe provisions ofthe Workmen's CompensationLawand Acts amendatory thereof forthe entire period ofthe permit,or the permitis invalid. 3. NOTIFICATIONS Notify Commissioner,through Regional Office,one week prior to commencing work, except emergency work by public service utilities which should be reported the next work day. Work must start within 30 days from date of permit. Notify area gas distributors 72 hours prior to any blasting. Notify Utility Companies with facilities in work area (permission must be obtained before doing work affecting utilities' facl!it es) before starting work. Notif• lane owners of abutting lands, before disturbing trees. Notify De:paitment of Transportation at conclusion of work and return original copy of permit to Regional Office. Annual Maintenance Permit Notifications: Notify by telephone the District or Resident Office, one week in advance, each time regular maintenance work is to be performed. In emergencies, notification by telephone should be made the next work day. 4. SITE CARE AND RESTORATION An Undertaking, a bond or certified check in an amount designated by the Department of Transportation may berequired bytheRegionnl Office, before a permit is issued, to guarantee restoration of the site to its original condition. If the Department is obliged to restore the site of its original condition, the costs to the Department will be deducted from the amount of the permittee's guarantee deposit at the conclusion of the work. The permittee is responsible for traffic protection and maintenance, including adequate use of signs and barriers during work and evening hours. Anyone working within the R.O.W.will wear ai. orange vest and hard hat. No unnecessary obstruction is to be left on the pavement or the right of way or in such a position as to block warning signs during or between work hours. No work shall be done to obstruct drainage or divert creeks, water courses or sluices onto the right of way. All falsework must be removed and all excavations must be filled in and restored to the satisfaction of the Regional Traffic Engineer. 5. COSTS INCURRED BY ISSUANCE OF THIS PERMIT All costs beyond the limits of the protective liability insurance, surety deposits, etc., are the responsibility of the permittee. The State shall be held free of any costs incurred by the issuance of this permit, direct or indirect. 6. SUBMITTING WORK PLANS The applicant will submit work plans and/or a map as required by the Department. This shall include such details as measurements of driveways with relation to nearest corner, positions of guys supporting poles and a schedule of the number of poles and feet of excavation necessary for completion of the work on the State right of way. A description of the proposed method of construction will be included. Plan work with future adjustments in mind, as any relocation, replacement or removal of the installation authorized by this permit and made necessary by future highway maintenance, reconstruction or new construction, will be the respon- sibility of the permittee. The permittee must coordinate his work with any state construction being conducted. 7. TRAFFIC MAINTENANCE Traffic shall be. maintained by the permittee on the highway, in a safe manner, during working and non-working hours until con- struction is completed. Suitable safeguards, to reduce conditions dangerous to life, limb and property to a minimum, must be pro- vided by the permittee (including flagmen when requested by the Departmentl. 8. COST OF INSPECTION AND SUPERVISION If, in the accounts kept by the Department, costs of supervision are found to be exceedingly high, the Department re- serves the right to bill the permittee for actual expenses incurred by the supervision and inspection of the permittee's project. 9. SCOPE a. Lreus Covered Permits issued are for highways, bridges and culverts over which the New York State Department of Transportation has jur,sdiction. The Chairman informed him that as soon as he submits the change of zone to the Town Board, it will be forwarded to _ the Planning Board for their recommendation, The Chairman once again said that 14 units per acre was too great a density. Mr. Driscoll stated that he could drop it to 12 units, but no less, he stated his opinion that this density would be better, in regard to water, than having 100 families on 1 acre lots, The Chairman said that this was not true because on 1 acre lots one family would only be using h of the water, the rest of it is available for flushing action, which means that the water supply would be safe for at least 100 years. The Chairman informed them that their first step is to petition the Town Board for a change of zone. Mr. Driscoll inquired what zoning would be int their favor to petition the Town Board for a proposition such as this. The Chairman stated that at the present time B-2 would be the most favorable, but said that there is no assurance that the Town Board will not change the density in this zone in the near future. Mr, John J, Jones presented the Planning Board with a preliminary site plan for proposed Cutchogue Shopping Center to be located on north side of Main Road (immediately east of Sterling Nursery) , Cutchogue, New York. The total land area is 236,288sq, ft, (5,2acres) , total building area is 44,364sq, ft. The plan showed 361 parking stalls (Town requirement being 202). The Board questioned the loading area on the east side of the building as to its efficiency, Mr. Joseph Martirano, Real Estate Manager for Hills Supermarkets, explained the dock method of loading to be used= which the Board felt was efficient. The property is presently zoned "B" Business, so no change of zone will be required. Mr, Jones stated that they own half of the right- of-way (Sterling's) adjoining the property on the west and north, and would be willing to pave the entire surface if this would be satisfactory with the Sterlings, The architecture of the buildings will be colonial. The proposed plan showed plantings and landscape, The principal tenant will be Hills Supermarkets there will be several smaller satelite stores, and a movie theatre, The Chairman suggested that there may be a problem in regard to drainage. Mr, Jones stated that this will be no problem as the drainage will be all built in. Artie Melusino stated that the entire area will be self drained according to the Town of Southold specifications, and that their engineer will work in conjunction with the Town engineer. Mr, Jones requested the Planning Board to grant preliminary approval of the site plan as submitted, The Chairman informed Mr, Jones that a decision will possibly be reached later in the evening by the Board, ' Southold Town JP.(- tg Board - April 212 1970 Request for information on the Master Plan was received from Southampton College, Said request placed in file. Notice was received from PLI News (Practicing Law Institute) in referenpe to interstate land sales, Howard Terry reported on his inquiry to Easthampton and Southampton Towns in reference to steps they have taken for "scenic easements". They have not actually entered into any contract agreements, The Chairman reported that he had spoken with Mr. Newman of the County Planning Commission, who thinks that Brookhaven Town may have contracts. Mr, Newman is going to try to get a copy of the contracts for us. The Town Board is favorable towards contracts for "scenic easements" and feels that we should move ahead on this. The Board discussed again the proposed Cutchogue Shopping /enter. On motion by Mr, Coyle,, seconded by Mr, Moisa,, it was RESOLVED that the Southold Town Planning Board grant preliminary approval to the site plan for the proposed Cutchogue+ shopping Center, to be located at north side of Main Road,, Cutchogue, New York.
