The planning Board is in receipt of your letter of May
20, 1971. llowever, this letter does not directly answer the
important question on the dredging. At the last planning
Board meeting the Board was informed by you that you did not
dig a canal or widen the existing drain up to Eugene's Road.
The Board informed you that if this was the case, they had
no objections to your operation in this area. You will re-
call that when you first approached Mr. Terry on dredging
this pzoperty he told you that this Board had no jurisdiction.
The Board discussed it at that time and felt that as long as
there were no canals there would be no problem.
Your letter states that the Mosquito Commission granted
you permission to clean out the gutter on the south side of
Eugene's Road. thereby indicating that you did perhaps widen
and deepen the canal. We have a witness who states definitely
that he saw YGlur contractor widening this stream. If this is
the case, then you are definitely in violation of the "Rules
and Regulations for the Subdivision of Land." Thereby, any
plans which you mi9ht have to subdivide or develop this land
would be automatically compromised. The Board would be happy
to have you appear at our next meeting to carefully review
this situation.
Please bear in mind that the position of this Board does
not affect any flllin9. whether it be carted in or dredeJed fill
from underwater areas, but it is very important that you not
dig into the bog.

Attention: Mr. John Wickham
Gentlemen:
At the planning Board Meeting of May 13, 1971, I stated that I had applied
at the office of Mr. Harold Terry for a permit to devert a drainage ditch on
the north side of Eugene Road. Mr. Terry replied saying that the Planning
Board had no juristriction over it, therefore no permit is needed from us.
I went to see Mr. Dean of the Highway Department who has juristriction.
He informed me that the work was not obstructing the roads and there is no
need for a permit; since the work is being done on my land. I was then advised
to contact the Mosquito Commission Control Office. They sent Mr. Van Nostrand
to inspect the job site and at that'time I requested to dig out the big gutter
and he said by all means do so.
later I received a letter dated April 14, 19711 granting the approval of
relocating the drainage from the Mosquito Commission. Since then I have filled
my land not knowing I need a permit to do so.
later again, I applied for a permit to dredge the channel from my property
to the existing channel and after one refusal they granted me the permit with
the understanding not to destroy my neighbors wet land.
I also applied again to the Mosquito Commission Control to grant me per-
mission to clean out the big gutter on the south side of Eugene Road.
Then I asked them to mail the original letter to the Planning Board and
to mail me a copy. After receiving the copy of the letter, I contracted the
dredging company. The dredging is being done nO~l without any siL-nificant
changes of the shore line.
With great appreciation and respect, I thank each and everyone on the
Planning Board for giving me the chance to explain. Thank you again.

The undersigned applicant hereby applies for (tentative) (iinal) approval of a subdivision plat

Dear Mr. Wickham:
We have received the application and survey for the minor subdivision
of stephen Mitacchione located at the South side of Eugene's Road, Cutch-
ogue, New York, which you sent to us on December 10, 1971. In your cover-
ing letter, you requested our cOlIIDIents and recollllllendations. In reviewing
the submission, it was quickly noted that the lots as layed out, are ex-
tremeIs- squeezed and while they meet our current standards, they will not
meet our new standards which are to go into effect, possibly on January. 1,
1972. Since the plots will not be built upon prior to our new standards
become effective it would be our reconnnendation to revise the plot density
so th~t they will comply.
Even if the plots were built upon with our cUITent standards, there
would be no room for any alterations to the system if such a need arose.
While we can appreciate the desire of the owner in obtaining as many
lots as posBible, we do not feel that this area is adequate for three
homes. The water supply is limited, the so11 is fill over marsh and the
property is located at the head waters of Eugene's Creek with limited di-
lution from tidal action. The more sewage disposed of on this site, the
more you increase the problem of fertilization of the creek.
Our recommendation would be to divide the plot into two building lots.

SUFFOLK COUNTY HEALTH DEPARTMENT PROCEDURE AND REQUIREMENTS FOR APPROVAL
TO CONSTRUCT ON INDIVIDUAL LOTS
Effective illlrnediately, the following procedure is to be followed for the approval
to construct on individual lots:
1. Applicant is to complete three copies of Health Department form s-15. If the
lot being built upon is part of a subdivision approved by the Health Department
after January 1, 1960, nothing further is required unless, upon review, conditions
exist that necessitate additional information being supplied prior to processing.
2. If the lot is part of an old fiied map (prior to 1/1/60) or if the plot is not
part of any subdivision map, then the following procedure is to be followed:
A. Complete three copies of Health Department s-15 form for all pertinent data.
B. Attach survey of plot by licensed surveyor, This survey is to contain the
following information:
1. Lot location and dimensions
2. Elevations of all comers and center-line street elevations at property
comers.
3. Locations of all existing wells and cesspools on adjacent properties,
including lots across the street and all lots within 100 feet from
property lines of applicant I slot.
4. Test hole data showing soil conditions to a depth of 14 feet or to
ground water.
5. Location of all surf,ace water within 200 feet of the applicant's lot.
3. On lots where the survey shows existing wells within 100 feet of the proposed
sewage disposal system, the applicant must produce either a notarized agreement be-
tween the two parties signed by the affected home owner allowing the applicant to
install a new well on his plot, said well to comply with Health Department Stan-
dards or a notarized waiver lligned by the affected home owner releasing the appli-
cant and the Department of Health from any responsibility concerning the existing
well. If a notarized agreement or waiver cannot be obtained, Health Department
approval will not be grantEld. In no case will applications be approved with a
horizontal separation between wells and sewage disposal system of less than 65
feet.
4. Prior to final approval being granted to the applicant, copies of bacteriologi-
cal and partial chemical analysis together with a well drillers certificate for the
relocated well must be submitted to this office.
