Dear Mr. Olsen:
The following resolution was adopted by the Southold Town Planning Board at a
meeting held on Monday, November 3, 1997:
WHEREAS, Anne Olsen is the owner of the property known and designated as
SCTM# 1000-97-5-4.4, located on Rt. 25 in Cutchogue; and
WHEREAS, a professional office is a permitted use in this General Business (B)
zone; and
WHEREAS, an examination has been made of all uses and the existing parking
was determined to be adequate for all uses; and
WHEREAS, the proposed addition of an additional professional office will not be
a more intensive use of this property; and
WHEREAS, any violation of the conditions of this resolution may be grounds for
rescinding this waiver; be it therefore
RESOLVED, that the Southold Town Planning Board grant a waiver of site plan
requirements.

Enclosed herewith please find an Application for Waiver of
Site Plan Requirements . This property is owned by my wife,
Anne H. Olsen. The easterly half of the downstairs is
occupied by me for my law practice. The westerly half is
leased by James Preston, CPA.
The property is a lot on an improved subdivision of John
Meisner. I am enclosing herewith a copy of updated
Certificate of Occupancy Z19286 issued on August 13, 1990 .
As I indicated to you, I anticipate that my son, David Olsen
who is completing his last year of law school will be
joining my practice. Accordingly, I will need additional
office space for my growing practice.
When I first constructed this building the 2nd floor was
designated as storage space, since I did not, and do not
have an elevator.
I do not intend on utilizing the 2nd floor for any other
purpose other than conjunction with my existing law
practice.
Accordingly, I request that a Waiver of Site Plan be issued
so that I can submit an Application for a Building Permit to
the Soutnold Town Building Department.

Dear Mr. -Olsen:
With regard to your office building at Main Road, Cutchogue,
the Board has made a review at the request of the Building
Department for a recommendation on the issuance of a certificate
of occupancy.
The Board noted that there is significant stormwater runoff from. your
property on to Main Road, creating a drainage problem on the
corner.
It is the intent of the ordinance that on-site drainage be
maintained to keep stormwater from running off the property.
Therefore, the Planning Board requests that you have a drainage
plan prepared and submitted for review.

I am in receipt of your letter dated April 6, 1987 and I must take issue
with your statement that "there is significant stormwater runoff from your
property on to Main Road, creating a drainage problem on the corner."
With all the heavy rain that we have been having lately I have watched
carefully to see if water was running off my property on to the Main Road
and have not found that to be the case. I do not have an asphalt driveway
but rather stone and gravel providing natural drainage. I also have a
catch basin at the entrance of my driveway as required and approved by the
Planning Board in its original site plan approval.
I have done everything in accordance with the requirements of the Town and
honestly am not aware of any drainage problems that has been created by my
project. In fact, I believe that there has been over the years a drainage
problem at the end of Harbor Lane long before my project has commenced and
from my own observation it appears that the water comes from the State
Road itself from west to east and now collects in front of the Harbor Mall
project, east of my office where it now has no where to drain. Accordingly,
I ask the Board to reconsider its letter of April 6, 19

DESCRIPTION
This report discusses an alleged water runoff problem in
the vicinity of the subject location. An inspection of the
existing surface conditions was made on April 13, 1987 in the
p.m. at which time it was raining. There was a sizable puddle
of water in the street in front of the property just East of
the subject location. This puddle was on the Main Road (Route
25) , opposite the intersection of Hobart Lane. Both the subject
property and the property just East are newly developed with
curbing as specified by the New York. State Department of Trans-
portation. There curbs were described and put in place as provided
by the site plans.
The subject property slopes down to the South until it
meets the street. The access and parking areas are paved in
a bluestone over loam which is a pervious surface. There are
drainage devices at the point of egress and ingress to this
property. The grate which is •it the property side of the sidewalk
is set some 2 to 3 inches lower than the sidewalk and drive
apron.

on the day of inspection some of the gravel was displaced onto
the sidewalk and apron, however, the water running off from
the upland side did not overflow the sidewalk indicating that
it did not reach the right of way.
The roadway slopes downward from the West and East to a
low point which is near the vicinity intersection of Hobart
Lane and is the area which was flooded.
DISCUSSION
On the day of inspection was noticed to be flowing on the
pavement at the curb (gutter) from both the West and Ea:,'..
The street drain which is to the East of the low point in the
road, is higher in elevation than the low point, therefore,
was relatively ineffective in capturing all the water from the
East. and none of the water from the West.
Since the private property drainage is set lower than the
sidewalk, and no water appeared to be overflowing the sidewalk,
it can only be concluded that virtually all the water reaching
the puddle is from the street. The remedial action recommended
is drywell system at the low point or an additional invert
to be installed at the low point connected to the existing leaching
system.
