Box 194 (5161734199 Cutchogue, New York 11935 June 22, 2002 Mr. Ed Forrester, Code Enforcement Officer Town Of Southold Southold Town Hall Main Street Southold, NY 11971 Dear Mr. Forrester, Thank you for your courtesy and the information regarding my query of permitted uses for parcel #97-5-4.2, located on the west side of Cox Lane in Cutchogue directly across from part of my property located on the east side of the lane. The Master Plan indicates that the parcel is zoned B business and you additionally noted that it is a 'contractor's yard'. Accordingly, a sand and gravel and stone business appears to be a permitted use. (I would ask whether a `contractor's yard' implies a storage facility for the contractor's materials or does it also permit a retail 'to the public' business?) You informed me that since this sand and gravel business is an additional usage or a change of usage of the parcel, that Mr. Kaelin must apply to the Planning Board for approval. Mr. Kaelin had not approached the Board at the time I spoke to you. You indicated that Planning Board approval might be predicated on Mr. Kaelin putting up a living screening of evergreens. Further, you said a public hearing will be called and I would be personally informed of the time and place of the hearing. Whether this is a permitted use or not, I expressed and hereby reaffirm my disapproval of this type of business as being inappropriate for Cox Lane, one of Southold's more rural and agriculturally attractive lanes. Cox Lane is the most convenient and most used route to the Landfill; therefore it is seen by a far larger number of visitors and residents than most other lanes in Southold. To allow this type of business to open in this location, at a time when Southold is so aware of the potential loss of its scenic beauty, seems, at the least, counterproductive to the Town's plans for open vistas. Even a cosmetic line of covering evergreens along one of the Town's scenic lanes is not at all attractive. Again, thank you. He has asked us to record the Deed immediately upon obtaining approval of the site plan for the proposed building. Mr. Kaelin has also asked us to advise you that he in- tends to apply to the Zoning Board of Appeals for permission to redivide the property and obtain a Variance for insufficient rear yard set-back of the building.
