As you know, the Planning Board approved and endorsed the minor subdivision in 1990. However, the subdivision was not recorded in the County Clerk's office during the required time period. Over the years, the Planning Board has received correspondence from Mr. Kaufman and his agents in regard to the filing of the subdivision with the County Clerk's office and the problems doing so due to time frames involving the Health Department's approval. The Planning Board understands the unusual circumstances involving the filing of this subdivision, and has decided to accept the Certified Copy of the subdivision for purposes of satisfying the Planning Board's filing requirement. For your information, the map was filed as a miscellaneous map. So there is no confusion, and if the question ariaes this afternoon, according to the records department of the County, the primary difference between this filing and the other type is that this map will not be forwarded to the Suffolk County Police Department(presumably to update records for emergency purposes),your Planning Department or the Tax Assessor's office. The necessity of delivery to the Tax Assessor's office has been obviated in this case by Mr. Kaufman's filing of the deeds and the assignment, already accomplished, of tax lot numbers to each parcel. The filing as I have done it has accomplished the Planning Board's ultimate purpose here, the subdivision has obtained all the necessary approvals, has been filed as a part of the public record with the County, and separate tax lots have been assigned. If there is any question, I would be happy to address the Board on Mr. Kaufman's behalf. Please note, it is imperative to me and my clients, the contract vendees of one of the parcels,to have the Planning Board issue something in writing acknowledging the filing of the map in satisfaction of the requirement. PLANNING BOARD I am responding to your letter of June 23,1995.1 have contacted the various professionals involved in creating this subdivision and believe that the following scenario applies: 1 .The planning board approved the subdivision and signed the mylar. 2.It was noticed that the health department stamp was about to expire.A new mylar was prepared and submitted to the health department. After this was re-stamped it was signed again by the planning board. 3.The new mylar together with appropriate covenents was submitted to the County by Aquabogue Abstract. 4.The mylar was never returned by the county and they now claim not to have any knowledge of it. As you know these lots have had seperate tax map numbers for four years and one of the lots has had title transferred to another name. Will the ability to build on these lots be affected? This has caused us to run into delays. 2) The first water test on the Kaufman property did not meet Suffolk County Department of Health Service specifications. Upon entering into a second attempt, we have established good water on this property. All of this, as well you know, is a very time consuming. 3) After receiving approval from the Health Department on water, they requested preparation of specific covenants and restrictions with .regard to one lot on the Kaufman subdivision. The preparation of these has been completed and we are awaiting return of same from the principal who has executed these. Upon receipt of these covenants , the Health Department will approve and stamp the maps. Please note that these constraints placed upon these subdivisions have caused a great tiine-lapse, none of which was the result of failure to process. we have pursued diligently to satisfy all requirements and for that reason I am requesting a final extension to get the approved maps to your office.
