BE IT RESOLVED that the Southold Town Planning Board authorize the Chairman to endorse the final surveys dated January 27, 1992. This subdivision received conditional final approval on January 11, 1993. Ail conditions of approval have been met. Enclosed please find a copy of the map which was endorsed by the Chairman. The mylar maps, which were also endorsed b~ the Chairman, must be picked up at this office and filed in the office of the County Clerk. Any plat not so filed or recorded within sixty (60) days of the date of final approval, shall become null and void. Please contact this office if you have any questions regarding the above. Henry Raynor: I am representing Francis Greenberger. I don't think we are 381 square feet west but we might be west of that location. The Board is well aware that this is a four lot subdivision on fifteen and one half acres and the Planning Board has given us a Negative Declaration under State Environmental Quality Review Act and has approved the sketch plan on this proposed subdivision. We presently have the Suffolk County Department of Health Services approvals and they have been updated in our (inaudible). The fire well has been located on the southwest corner of this proposed subdivision as per specification of the Cutchogue Fire District. Covenants and Restrictions requested by the Suffolk County Department of Health Services have been filed and have been recorded in the County Clerk's Office as well as the covenants and restrictions required by your Board which has been filed and also recorded in the County Clerk's Office. Through an omission, the liber and page do not appear with regard to the Planning Board's covenants and restrictions so I will see that that is amended and added within the next few days. I have reference to the Planning Board's letter of December 15th as there remain two items outstanding. The inspection fee based on the bond estimate and the performance guarantee at a amount of $70,125.00. I would request the Board consider holding signature of this map for up to sixty days. The reason being the applicant has proceeded to finish all the upgrading on this subdivision and commencing the end of this week or the first part of next week we will have all the drainage facilities installed. It is my understanding that he meant (inaudible). We are in hopes that the guarantee and the performance guarantee could be reduced with regard to major capitol construction. I would also request that the Plannin~ Board consider along with the Town Engineer a revision of the paving specifications as it is obvious from the map that this roadway will only be utilized by four lots. This provision of course, is provided for under 106-51. I also believe that the map as you see it before you with the exceptions noted is in complete conformity with the code under Section Al06 and we would request approval with the conditions so forwarded. A draft Declaration of Covenants and Restrictions is to be prepared containing the following: The following terms and conditions shall apply to all land lying within the scenic easement: No structure or building shall be placed within the easement area. The terms "structure" and building" shall be interpreted as including swimming pools; patios; garages; sheds and other storage buildings; structures for the housing of domesticated animals; the storage of boats, trailers, recreational vehicles; and the placement of fences, retaining walls and bulkheads. The entire easement area shall remain in its natural state. The easement area shall not be filled with soil, sand, brush or other debris. D. Any disturbance to the land within the easement shall be redressed by the restoration of said land to its prior state within sixty (60) days of the disturbance or of the date the disturbance was reported to the Planning Board. There shall be no further subdivision of any lot in perpetuity. These covenants and restrictions can be modified only at the request of the then owner of the premises with the approval of a majority plus one of the Planning Board of the Town of Southold after a public hearing. This has caused us to run into delays. 2) The first water test on the Kaufman property did not meet Suffolk County Department of Health Service specifications. Upon entering into a second attempt, we have established good water on this property. All of this, as well you know, is a very time consmming. 3) After receiving approval from the Health Department on water, they requested preparation of specific covenants and restrictions with regard to one lot on the Kaufman ~ubdivision. The preparation of these has been completed and we are awaiting return of same from the principal who has executed these. Upon receipt of these covenants, the Health Department will approve and stamp the maps. Please note that these constraints placed upon these subdivisions have caused a great ~e.~lapse, none of which was the result of failure to process.
