Dear Mr. Hall:
The following action was taken by the Southold Town Planning Board,
Monday, June 24 , 1985 .
RESOLVED that whereas, a formal application by Lucy and Richard
Miraglia for the approval of a subdivision plat entitled "Ronald
Strain" located at Ctatchogue was submitted to the Planning Board
on July 3 , 1984 and, filing fee was paid on July 3 , 1984 , and
WHEREAS, a public hearing was held on said subdivision application
and plat at the Town Hall, Southold, New York, on June 10, 1985 at
7 :30 p.m. , and
WHEREAS, the requirements of the Subdivision Regulations of the
Town of Southold have been met by said subdivision plat and
application,
NOW, therefore, be it RESOLVED that the application of Lucy and
Richard Miraglia for approval of said subdivision plat entitled
"Ronald Strain" prepared by Donack Associates dated August 3 , 1984 ,
be approved and the chairman be authorized to endorse approval on
siad subdivision plat.

A special meeting of the Southold Town Planning Board was held 2 : 00 _
p.m. , Friday, September 9, 1983 at the home of Bennett Orlowski.
Present were:
Chairman Henry E. Raynor, Jr.
Member G. Ritchie Latham, Jr.
Member Bennett Orlowski, Jr.
On motion made by Mr. Latham, seconded by Mr. Orlowski, it was
.� RESOLVED that the Southold Town Planning Board approve a set-off
(106-13) on the property presently owned by Richard Miraglia, to be
conveyed to Lonald E. Strain for a one-family residence subject to
the following conditions:
( 1) The two flag-lot configuarations to be eliminated and
i a right-of-way, in a minimum width of 25 ' to be desig-
nated on the map to assure access to the two rear ad-
joining parcels in the event this property is further
subdivided in the future.
(2) Receipt of filing fee in the amount of $50, payable to
the Southold Town Clerk.
Vote of the Board: Ayes: Raynor, Latham Orlowski
On motion made by Mr. Latham, seconded by Mr. Orlowski, it was
RESOLVED that the Southold Town Planning Board approve a set-off
(106-13) as indicated on the map of William and Richard Gillooly,
dated September 1, 1983 , located at Orient, with a condition that
covenants and restirictions be filed stating no further subdivision
Will be made on the one-acre business property in the future.

NEGATIVE DECLARATION
Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review Act and 6NYCRR Part 617 , Section
617 . 10 and Chapter 44 of the Code of the Town of Southold, notice is
hereby given that Southold Town Planning Board as lead agency for
the action described below has determined that the project will not
have a significant effect on the environment.
DESCRIPTION OF ACTION
The Minor subdivision of Ronald Strain as applied for by
Richard Miraglia, is located at Cutchogue and contains 4 lots on
8 .6 acres .
The project has been determined not to have a significant
effect on the environment for the following reasons :
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
Because there has been no correspondence from the Department
of Environmental Conservation in the alotted time it is
assumed that they have no objections or concerns .
The Suffolk County Department of Health Services has no
objection to our status of lead agency, they are in
agreement with our initial determination and there is
no record of an application to their department. The
Health Department maintains jurisdiction over final location
of disposal and well systems and the applicant should not
undertake to construct any water supply or disposal system
without Health Department approval.
The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations .

8. Comments:
The Health Department's primary environmental concern
pertaining to development is that the applicant comply with
the requirements of the Suffolk County Sanitary Code especially
Article V and VI , and relevant construction standards for
water supply and sanitary sewage disposal . These considerations
are to be reviewed completely at the time of application. Full
consideration in placement of water supply wells and disposal
systems is given to state and town wetland requirements. The
Health Department maintains ,jurisdiction over final location
of disposal and well systems and the applicant should not
undertake to construct any water supply or disposal system
without Health Department approval .
Other portions of the Suffolk County Sanitary Code also
apply to commercial development such as Article XII. The
Lead Agency is requested to forward a copy of this form to
the applicant with its findings.
