Mr. Orlowski: Good.evening. I'd like to call this meeting to order. The Board to
set Monday, March 20th, 2000, at 7:30 p.m. at the Southold Town Hall, Main
Road, Southold, as the time and place for the next regular Planning Board
Meeting.
Mr. Cremers: So move.

PUBLIC HEARINGS:
Hearings Held Over From Previous Meetings:
Mr. Orlowski: Summit Estates, Section 4 - Section 4 of this major subdivision is
for one 4.3739 acre lot (Lot #33). The property is located off Shipyard Lane in
East Marion. SCTM#1000-38-7-p/o 10 (a.k.a. SCTM#1000-35-8-5.3).
We have yet to hear from the applicant on our questions. What is the pleasure
of the Board?
Mr. Ward: Mr. Chairman, I'd like to Order the following resolution:
BE IT RESOLVED that the Planning Board hold the final hearing for Summit
Estates, Section 4, open until such time that Conditions Number 3, 4, and 5 of
the approval in regard to the public hearing in accordance with Condition
Number 11 of the Declaration of Covenants and Restrictions are fulfilled to the
satisfaction of the Planning Board.

MAJOR AND MINOR SUBDIVISIONS, LOT LINE CHANGES AND
SET OFF APPLICATIONS
Setting of Final Hearings:
Mr. Orlowski: Christopher L. Raffert¥ & Jeanne A. May - This lot line change is
to subtract .17 of an acre from a 2,60 acre parcel and add it to a 2.89 acre
parcel. SCTM#1000-9-9-29.4 & 29.5.
Mr. Cremers: Mr. Chairman, I'll offer the following:
BE IT RESOLVED that the $outhold Town Planning Board, acting under the
State Environmental Quality Review Act, do an uncoordinated review of this
unlisted action. The Planning Board establishes itself as lead agency, and as
lead agency makes a determination of non-significance, and grants a Negative
Declaration.

Sketch Determinations:
Mr. Orlowskh Laurel Links - The Laurel Links, Ltd. Project includes both a
subdivision and site plan application. The subdivision application consists of a
proposal for 31 lots on a total of 222.85 acres:
* Lots Numbered 1 - 29 are clustered residential lots
* Lot Number 30 is a Golf Course
* Lot Number 31 is a Golf Course Maintenance Area
The project is located in Mattituck on SCTM#1000-125-3-13, 15, 17;
SCTM#1000-125-4-21, 24.1 and SCTM#1000-126-7-1.
What is the pleasure of the Board?
Mr. Cremers: Mr. Chairman, I'll offer the following resolution:
WHEREAS, the Laurel Links project includes both a subdivision application and
a site plan application; and
WHEREAS, the subdivision application consists of a proposal for 31 lots; Lots
29 are clustered residential lots, Lot 30 Js a 2.39 acre parcel shown as a Golf
Course Maintenance area, Lot 31 is a 154.66 acre parcel shown as a Golf
Course; and
WHEREAS, the site plan application consists of the Golf Course Maintenance
Area which is to be located on Lot 30 and the Golf Course, which includes a club
house, parking areas, a pool, tennis courts, maintenance buildings, a pump
house, a halfway house and a Superintendent's Residence, all to be located on
Lot 31; and
WHEREAS, the Planning Board and the Planning Board's Consultant, Charles
Voorhis of Nelson, Pope & Voorhis, LLC, have reviewed the EAF Part I!1 which
was submitted in connection with the above-referenced project; and

WHEREAS, the EAF Part III indicates that implementation of certain mitigation
measures will occur during the site plan and subdivision review process; and
WHEREAS a list of the mitigation items and the recommended mechanisms by
which each mitigation should be implemented is included in the report dated
February 17, 2000, prepared by Charles Voorhis; and
WHEREAS, the Planning Board will ensure that the implementation of certain
design, maintenance and operational practices, as outlined in the February 17,
2000 report, are incorporated into the project by including the design,
maintenance and operational practices as part of any approval of the subdivision
or site plan; and
WHEREAS, for the record, as per a letter dated March 1, 2000, from Howard
Young, of Young and Young, there was a typographical error in regard to the
area of the Golf Course Lot (Lot #31). The correct area is 154.66 acres, and the
correction in no way effects the yield or any other aspect of the project. All future
plans will reflect the corrected lot area; be it therefore
RESOLVED that the Southold Town Planning Board, acting under the State
Environmental Quality Review Act, assumes lead agency, and as lead agency
makes a determination of non-significance, and grants a Negative Declaration.
The reasons supporting the Negative Declaration are outlined in the Negative
Declaration.

Mr. Ward: Mr. Chairman, I'd like to offer the following resolution pertaining to the
subdivision application:
WHEREAS, the Yield Plan dated April 21, 1998, shows 29 residential lots in
addition to the Golf Course lot for a total of 30 lots; and
WHEREAS, one of the 29 lots shown on the Yield Plan dated April 21, 1998 (Lot
#3 on Yield Plan) is proposed as Golf Course Maintenance on the Cluster Plan

dated January 19, 2000 (Lot #30 on Cluster Plan) and therefore can not be
counted as part of the density for a residential lot; and
WHEREAS, since the subdivision proposal is for a total of 31 lots: 29 residential
lots in addition the Golf Course lot (Lot #31 on Cluster Plan) and the Golf Course
Maintenance lot (Lot #30 on Cluster Plan), the yield shown on the cluster
subdivision plan exceeds the Yield Plan by one (1) lot; and
WHEREAS, the Planning Board reviewed this fact, and determined that for
density purposes, there was sufficient area within the Golf Course parcel to
allow for another 2 acre residential lot; and
WHEREAS, the Planning Board decided that they would not require that the
Yield Plan be revised to show the additional 2 acre lot, but that they would
require that the applicant revise the cluster plan to include an additional 2 acres
of Open Space to account for the density of the additional 2 acre lot; and
WHEREAS, the original cluster plan was revised, and the Cluster Plan dated
January 19, 2000, includes an additional 2 acres of Open Space; and
WHEREAS, for the record, as per a letter dated March 1, 2000, from Howard
Young, of Young and Young, there was a typographical error in regard to the
area of the Golf Course Lot (Lot #31). The correct area is 154.66 acres, and the
correction in no way effects the yield or any other aspect of the project. All future
plans will reflect the corrected lot area; be it therefore
RESOLVED that the Planning Board accepts the Yield Plan dated April 21,
1998, for purposes of calculating density.

Resolution #3 pertains to the subdivision application:
WHEREAS, the applicant presented the preliminary subdivision plans for the
Laurel Links subdivision prior to the Planning Board making a Sketch Plan
Determination; and

WHEREAS, as per correspondence dated November 16, 1999, from Charles
Cuddy, the applicant acknowledges that the preliminary time frame did not start
by the submission of the Preliminary Map; and
WHEREAS, the Zoning Board of Appeals granted a Special Exception (Appl. No.
4624, December 10, 1998) for a golf course, a golf club house, and related golf
facilities and amenities, including but not limited to tennis courts and a swimming
pool, subject to 3 conditions:
That the Board of Appeals reserves the right to reopen the public
hearing on the application in the event that the Lead Agency issues a
Positive Declaration under SEQRA.
That a steel gate shall be located across the proposed emergency
access and shall not extend 100 ft. past the proposed
Superintendent's driveway area.
That no construction or work vehicles shall use the proposed
emergency access, and the emergency access shall only be used for
fire and other emergency purposes (not for general public or private
use); and
WHEREAS, for the record, as per a letter dated March 1, 2000, from Howard
Young, of Young and Young, there was a typographical error in regard to the
area of the Golf Course Lot (Lot #31). The correct area is 154.66 acres, and the
correction in no way effects the yield or any other aspect of the project. All future
plans will reflect the corrected lot area;
BE IT THEREFORE RESOLVED that the Southold Town Planning Board grant
sketch approval on the map dated January 19, 2000 with the following
conditions:
There shall be no further subdivision of any lot within the subdivision,
including the Golf Course Lot (Lot #31), in perpetuity. This restriction must
be included in a Declaration of Covenants and Restrictions.
The emergency access shall be 15' wide and shall be used for access to
the Superintendent's House and for emergency purposes only. All
conditions of the ZBA decision shall apply to the emergency access.
Open Space Parcel "B" shall be revised so that the outermost boundary of
the open space parcel is at least 75' feet from the wetland area.

Mr___~Orlowski: John Tuthill - This proposal is for a clustered set-off of a 0.574
acre lot from an existing 35.918 acre parcel. The parcel is located on the
southwest corner of the intersection of Main Road & Rackett's Court in Orient.
SCTM#1000-17-6-6, 13 & 14.
Mr. Cremers: Mr. Chairman, I'll offer the following resolution:
WHEREAS, the proposed set-off application is to set-off a 0.574 acre lot from a
35.918 acre parcel; and
WHEREAS, there is an existing dwelling on the proposed 0.574 acre (25,015 sq.
ft.) lot; and
WHEREAS, the property is located in the Low Density Residential R-80, Zoning
District, in which the minimum lot area requirement is 80,000 sq. ft.; and
WHEREAS, the Planning Board has allowed the application to be processed as
a cluster subdivision; and
WHEREAS, a covenant and restriction will be placed on the remaining land
noting that 54,985 sq. ft. (the difference between 80,000 sq. ft. and 25,015 sq.
ft.) must be excluded from the yield for any future development of the remaining
parcel; and
WHEREAS, a scenic easement will exist on all but 0.798 acres of the remaining
parcel, be it therefore
RESOLVED that the Southold Town Planning Board grant sketch approval on
the map dated December 17, 1999, with the following conditions:

Access to the building area on the remaining parcel is shown from Main
Road. The map is to be revised so that access to this area is over
Rackett's Court, not Main Road.
A Declaration of Covenants and Restrictions must be recorded prior to any
final endorsement of the set-off noting that 54,985 sq. ft. (the difference
between 80,000 sq. ft. and 25,015 sq. ft.) must be excluded from the yield
for any future development of the remaining parcel. In addition, this
notation must be shown on the final map.

BE IT RESOLVED that the Southold Town Planning Board, acting under the
