Subject property is 22.75 acres, zoned Agriculture-Conservation and used as a vineyard. The subject application is for the development of only two parcels, one parcel is 2 acres in size the second parcel is almost 3 acres in size, both parcels are proposed for residential use. The owner wishes to subdivide land for his two children to build their own homes. The 22.75 acre property is in agricultural production, therefore the water use has been limited to agricultural cultivation and production. The two lots on 22.75 acres will be served by private wells which will be the subject of Suffolk County Health Department review and approval. The water supply and development of the parcel is substantially less than zoning allows. The balance of the property will remain in agricultural production which has minimal impact on the environment and water use . Indicate the source of water supply, nearest public water main, nearest public well field, and adjacent private wells (if known). The location of the proposed private wells on the proposed lots have not been located yet, however there is sufficient land to meet the Health Department standards. The Department of Health and the U.S. Geological Services requested permission to place three ground-water monitoring wells on the agricultural parcels to monitor the water quality. The proposed action involves the subdivision of a 22.755 acre parcel into 3 lots with the following lot sizes: Lot 1 - 17.896 acres, Lot 2 - 2.0 acres, and Lot 3 - 2.859 acres. The site contains a portion of NYSDEC designated freshwater wetland SO-52 in the southern portion of the site. This document analyzes the site and area resources including topography, soils, water, land use, zoning and transportation and other available information. The site has also been inspected for environmental/planning constraints. In addition, the full EAF Part I submitted with the application has been corrected and is attached herein. Location and Site Overview The overall project site is located on the north side of Main Road (Rte. 25), 927.99 feet west of Bridge Lane in Cutchogue, Town of Southold, County of Suffolk. The subject properties can be more particularly described as SCTM number 1000-97-01-12.6, 12.7 & 12.9. The parcel contains a total of 125.34 feet of road frontage along Main Road (Rte. 25) to the south and 379.90 feet of frontage along the Long Island Railroad (LIRR) to the north. This review will discuss the proposed project and its potential impact on the land resources. Proposed Project The proposed project involves the subdivision of a 22.755 acre parcel into 3 lots. The proposed lots have the following lot sizes: Lot 1 - 17.896 acres, Lot 2 - 2.0 acres, and Lot 3 2.859 acres. Lots 2 and 3 are proposed for residential development and 14.813 acres of the development rights within Lot 1 have been purchased by the Town and no additional development is proposed within this lot. Lot 1 consists of SCTM #1000-97-01- 12.7 & 12.9 which requires a lot line change to incorporate these tax lots into one parcel. Lots 2 & 3 require the subdivision of SCTM #1000-97-01-12.6. Access to Lots 2 & 3 is provided via a proposed 25' right of way extending along the northern perimeter of Lot 2 eastward to Bridge Lane. It should be noted that the right of way will transect SCTM #1000-85-02-1.3, which is also owned by the applicant. The Planning Board has indicated that the development rights have been sold to the Town of Southold on 14.8 acres of the property and that conditional sketch plan approval is granted to the subdivision map dated January 22, 2001 subject to the lot-line change between proposed Lot 1 and the tax pamel to the north and east (SCTM #1000-97-01-12.4), which must be completed with the Planning Board. The Planning Board has previously asked that the correct acreage of the development right intact within Lot 1 be corrected and that the topographical lines and location of the nearby house and buildings be shown for the area of the proposed right of way. Additionally, the Planning Board has recognized that the site does not contain sufficient area to contain the required recreation area. Therefore, there is no recreational area or open space associated with this proposed subdivision. Land Use and Zoning The project site is located in an area that contains a mix of residential, municipal, agricultural, commercial and undeveloped vacant land. The dominant land use in the general area is residential and agricultural, and the proposed application is consistent with surrounding uses. The site currently contains a winery/tasting room and a dwelling within the southern portion of Lot 1 and a newly constructed concrete block building within proposed Lot 2. The development rights on a total of 14.813 acres has been purchased by the Town. Agricultural and scattered residential land uses are located north, east and west of the site, with a municipal use located to the south on the south side of Main Road (Rte 25). Page 2 gliese Subdivision ~ Cutchogue EAF Part 1 Review NP&V g01116 The site is zoned Agricultural Conservation (A-C) District, which requires a minimum lot size of 80,000 SF, or just slightly less than 2 acres. Therefore, the proposed residential Lots 2 and 3 meet the required lot size, and it is expected building envelope is expected to mcct the majority of the other zoning and dimensional requirements, particularly under a flag lot configuration. Maximum permitted lot coverage within thc A-C zoning district is equivalent to 20% of the lot area, with a livable floor area of 850 s.f. per dwelling. Residential development of the subdivided property should not require zoning variances, and each lot could be developed in accordance with the current site zoning under a flag lot configuration. A-C zoning is located to the north, west and east, with R-80 zoning located to the south. A-C is the dominant zoning classification within the general area, with a multitude of zoning classifications west of the site on both sides of Main Road (Rte. 25). With respect to land use, the proposed project is similar to the residential developments in the surrounding area and will maintain a large portion of the existing agricultural use, both which are allowable uses within the A-C zoning district. Furthermore, the project is in harmony with the Watershed and Farm Protection studies and initiatives by retaining a large contiguous area of agricultural farmland. The land use and zoning impacts of the proposed project are expected to be minimal. Traffic Generation The proposed use would be expected to slightly increase traffic generation upon full establishment of the site as compared to existing conditions. The future development of the land is not anticipated to generate significant additional traffic to the area. Due to the location of the site and consideration of area roadways, an increase in trip generation at the site would not be expected to have a significant impact on the area roadways. The horizontal and vertical road curvature allows relatively good sight distance, although is somewhat reduced to the north on Bridge Lane. The creation of 2 additional residential lots would not be expected to have significant impacts with regard to traffic generation. Soils and Topography The majority of the agricultural portion of the site is relatively fiat throughout, with all existing slopes between approximately 0-10%. However, steep slopes exists within Lots 2 and 3, and particularly within the building envelope of Lot 3. Additionally, it should be noted that the site rises in elevation west of the existing dwelling to the north and within the proposed right of way. Steep slopes within the proposed site access and within the building envelope of the proposed residential lots would be expected to pose significant constraints on future development in these locations. The property does not contain any significant landforms or geological features. The Suffolk County soil survey (Warner, 1975) identifies four soil types on the subject site, which consist of the following: Riverhead sandy loam, 3 to 8% slopes (RdB), Haven loam, 0 to 2% slopes (HaA), and Plymouth loamy sand, 3 to 8% slopes (P1B). The Haven Loam series is described within the Suffolk County Soil Survey as land which is suitable for development, with good leaching potential. The hazard of erosion hazard is slight on HaA soils and slight to moderate on HaB soils. The Riverhead series consists of deep, well-drained moderately coarse Page 3 - ' nl~ugliese Subdivision ~ Cutchogue EAF Part I Review NP&V #01116 textures soils that formed a mantle of sandy loam or fine sandy loam over thick layers of coarse sand and gravcI (Warner, 1975). Thc soil survey lists thc erosion hazard for RdB as moderate to slight and thc main concerns of management involve controlling runoff and erosion and providing adequate moisture for landscaping/agriculture. Thc Plymouth series consists of deep, excessively drained, course-textured soils. P1B has a slight erosion hazard and thc soil tends to be draughty. Thc soils on site do not appear to present severe development constraints. Wetlands As previously stated, the site contains a portion of NYSDEC designated freshwater wetland SO- 52 in the southern portion of the site. This area is not proposed for additional development and the majority of the development rights within this lot have been pumhased by the Town. The NYSDEC and Town Trustees regulate those activities within 100 feet of a designated freshwater wetland. It is not expected that the proposed residential development within Lots 2 and 3 are located within the jurisdictional limits of the NYSDEC with regard to Article 24 or within Town Trustees jurisdiction. As regulated by Article 24, the following are listed as exempt agricultural uses and activities: grazing and watering livestock, making reasonable use of water resources for agricultural purposes, harvesting natural products, selective cutting of trees, harvesting agricultural products (with the exception of trees), operating motor vehicles for agricultural purposes, erecting structures required to enhance or maintain the agricultural products, using chemicals and fertilizers according to normally accepted agricultural practices, and otherwise engaging in the use of wetlands for growing agricultural products such as crops, vegetables, fruits or flower. Therefore, the continuance of agriculture within Lot 5 would not require a permit from the NYSDEC. The subject site is not located near any tidal wetlands. Water Resources Public water is supplied to the general area by the Suffolk County Water Authority, although the site itself is not specifically connected to public water. The closest water main to the site extends westward along the north side of Main Road (16 inch main), terminating just east of the site at the school located on the south side of Main Road. The Mill Lane Well Field & Pump Station is located on the northwest comer of the Middle Road (CR 48) and Mill Lane intersection, approximately 3,000 feet northeast of the site. It is estimated that the 2 additional proposed residential lots will utilize approximately 600 gallons of water per day and each lot will be connected to an on-site well. Additional water use is anticipated due to the continuation of agricultural use within the remaining lot, as well as for the existing dwelling and structure which will remain. Sanitary disposal within the proposed subdivision will be managed by on-site underground sewage leaching systems. In 1978, the Long Island Regional Planning Board published the Long Island Comprehensive Waste Treatment Management Plan (208 Study). The 208 Study identified eight (8) hydrogeologic zones in Nassau and Suffolk Counties. These zones were distinguished based upon differences in underlying groundwater flow patterns and water quality. Page 4 - ' "~ugliese Subdivision ~ Cutchogue EAF Part I Review NP&V #01116 The subject site is located within SCDHS Groundwater Management Zone IV, which according to Article VI of the Suffolk County Sanitary Code, has an allowable flow of 600 gallons per day (gpd) per acre in areas served by public water. Therefore, the allowable nitrogen bearing flow for the tax lot I2.6, which totals 4.859 acres is 2,915 gpd. The sanitary design flow is computed using the SCDHS manual Standards for Approval of Plans and Construction for Sewage Disposal Systems for Other Than Single Family Residences. The manual establishes the design flow as follows: Single family dwelling 300 gpd x 2 dwellings 600 gpd Therefore, the proposed applications would conform with Article VI of the Suffolk County Sanitary Code and would not be expected to adversely affect groundwater quality provided properly functioning systems are designed and installed. The elevation of groundwater beneath the subject site is slightly greater than 5 feet above mean sea level (msl) according to the 1997 SCDHS water table map. The topographic elevation on site ranges from approximately 10-35 feet above msl within Lots 2 and 3, based on the prepared minor subdivision map. Therefore, the minimum depth to groundwater is approximately 5-30 feet. The direction of groundwater flow is expected to be towards the east, northeast. The depth to groundwater on site is not expected to have significant constraints on the location of septic systems within the proposed residential lots, as the building envelope of these lots are located at and elevation of approximately 15-35 feet above msl. A standard, three pool septic system typically requires a minimum depth to groundwater of approximately 9-10 feet to allow adequate depth for leaching. SUMMARY In conclusion, the proposed applications would create 2 additional residential lots, which would generally conform to the character of the area. The site does not appear to contain significant environmental features that would limit residential development in the proposed development locations, with thc exception of steep slopes. It is recomxmended that the building cnvclopc be reduced within these lots to exclude slopes of over 15% and/or a grading site plan be required at the time of building permit review, with those areas to remain natural and undisturbed. It is further recommended that the topography and existing off-site structures to the north be indicated on the site plan so that impacts of the proposed access road may be assessed. The proposed project will increase waste water generation, solid waste generation and water use, in addition to increasing taxes which would be distributed to the various jurisdictions. The site is expected to increase the number of trips entering and exiting the site, although is not anticipated to cause a significant impact to the surrounding roadways. Location and Site Overview The overall project site is located on the north side of Main Road (Rte. 25), 927.99 feet west of Bridge Lane in Cutchogue, Town of Southold, County of Suffolk. The subject properties can be more particularly described as SCTM number 1000-97-01-12.6, 12.7 & 12.9. The parcel contains a total of 125.34 feet of road frontage along Main Road (Rte. 25) to the south and 379.90 feet of frontage along the Long Island Railroad (LIRR) to the north. The site does not contain significant geologic landforms, or known historical and/or archeological features, although the site is depicted on the NYS Office of Parks, Recreation and Historic Preservation (NYS OPRHP) Circles and Square Map as being located within an area with multiple site sensitivity. This review will discuss the proposed project and its potential impact on the land resources. Proposed Project The proposed project involves the subdivision of a 22.755 acre parcel into 3 lots. The proposed lots have the following lot sizes: Lot 1 - 17.896 acres, Lot 2 - 2.0 acres, and Lot 3 - 2.859 acres. Lots 2 and 3 are proposed for residential development and 14.813 acres of the development rights within Lot 1 have been purchased by the Town and no additional development is proposed within this lot. Lot 1 consists of SCTM #1000-97-01- 12.7 & 12.9 which requires a lot line change to incorporate these tax lots into one parcel. Lots 2 & 3 require the subdivision of SCTM #1000-97-01-12.6. Access to Lots 2 & 3 is provided via a proposed 25' right of way extending along the northern perimeter of Lot 2 eastward to Bridge Lane. It should be noted that the right of way will transect SCTM #1000-85-02-1.3, which is also owned by the applicant. The Planning Board has indicated that the development rights have been sold to the Town of Southold on 14.8 acres of the property and that conditional sketch plan approval is granted to the subdivision map dated January 22, 2001 subject to the lot-line change between proposed Lot 1 and the tax parcel to the north and east (SCTM #1000-97-01-12.4), which must be completed with the Planning Board. The Planning Board has previously asked that the correct acreage of the development right intact within Lot 1 be corrected and that the topographical lines and location of the nearby house and buildings be shown for the area of the proposed right of way. Additionally, the Planning Board has recognized that the site does not contain sufficient area to contain the required recreation area. Therefore, there is no recreational area or open space associated with this proposed subdivision~ Land Use and Zoning The project site is located in an area that contains a mix of residential, municipal, agricultural, commercial and undeveloped vacant land. The dominant land use in the general area is residential and agricultural, and the proposed application is consistent with surrounding uses. The site currently contains a winery/tasting room and a dwelling within the southern portion of Lot 1 and a newly constructed concrete block building within proposed Lot 2. The development rights on a total of 14.813 acres has been purchased by the Town. Agricultural and scattered residential land uses are located north, east and west of the site, with a municipal use located to the south on the south side of Main Road (Rte 25). Page 2 ,~ Pu~e Subdivision ~ Cutchague EAF Part I Review NP&V 001116 The subject site is located within SCDHS Groundwater Management Zone IV, which according to Article VI of the Suffolk County Sanitary Code, has an allowable flow of 600 gallons per day (gpd) per acre in areas served by public water. Therefore, the allowable nitrogen bearing flow for the tax lot 12.6, which totals 4.859 acres is 2,915 gpd. The sanitary design flow is computed using the SCDHS manual Standarcls for Approval of Plans and Construction for Sewage Disposal Systems for Other Than Single Family Residences. The manual establishes the design flow as follows: Single family dwelling 300 gpd x 2 dwellings 600 gpd Therefore, the proposed applications would conform with Article VI of the Suffolk County Sanitary Code and would not be expected to adversely affect groundwater quality provided properly functioning systems are designed and installed. The elevation of groundwater beneath the subject site is slightly greater than 5 feet above mean sea level (msl) according to the 1997 SCDHS water table map. The topographic elevation on site ranges from approximately 10-35 feet above msl within Lots 2 and 3, based on the prepared minor subdivision map. Therefore, the minimum depth to groundwater is approximately 5-30 feet. The direction of groundwater flow is expected to be towards the east, northeast. The depth to groundwater on site is not expected to have significant constraints on the location of septic systems within the proposed residential lots, as the building envelope of these lots are located at and elevation of approximately 15-35 feet above msl. A standard, three pool septic system typically requires a minimum depth to groundwater of approximately 9-10 feet to allow adequate depth for leaching. SUIVlblARY In conclusion, the proposed applications would create 2 additional residential lots, which would generally conform to the character of the area. The site does not appear to contain significant environmental features that would limit residential development in the proposed development locations, with the exception of steep slopes. It is recommended that the building envelope be reduced within these lots to exclude slopes of over 15% and/or a grading site plan be required at the time of building permit review, with those areas to remain natural and undisturbed. It is further recommended that the topography and existing off-site structures to the north be indicated on the site plan so that impacts of the proposed access road may be assessed. The proposed project will increase waste water generation, solid waste generation and water use, in addition to increasing taxes which would be distributed to the various jurisdictions. The site is expected to increase the number of trips entering and exiting the site, although is not anticipated to cause a significant impact to the surrounding roadways. The Board finds this layout acceptable. Them are three minor map changes that should be made: 1. The tax map lot number for the winery section of Lot #1 is 12.5. 2. The pond near the winery should be sketched in on the map (exact boundaries not needed for this particular subdivision action). ,~ 3. "Southold Town Development Rights on X acres" should be written on the northern section of Lot #1, and "Development Rights Intact on X acres" should be written on the southern (winery) portion of Lot #1. In addition, the sale of development rights on the parcels to the west (n/f Robinson, County) and east (nfl Pugliese Vineyards LLC, Town) should also be written in. It will enhance the map's appearance when it goes for approval fi.om other agencies. A minor subdivision application should also be prepared at this time, so that sketch plan approval can be granted when the revised maps are prepared. The application fee will be $2,500, plus an additional amount of approximately $500 at a later time for the environmental review. Since a number of agencies will be involved with the environmental review process and the property falls within Suffolk County Planning Commission jurisdiction, we request that 12 maps be submitted. The Planning Board will need proof that the right-of-way exists because it is located on a separate parcel. Please provide documentation of its existence, and that the subdivided parcel has a right-of-access. This can be created by the filing of new deeds if you do not have any other proof. There are two items that need to be handled in the Covenants and Restrictions for final subdivision approval. One is the concrete block building. Since it belongs to the vineyard, it should be covenanted so that you are liable for its maintenance and condition, and not the lot owner. You should also have to remove it at your expense if the lot owner so desires. The second item is the building location on Lot #3. The lot owner will be responsible for any erosion or other environmental damage cause by development on or near the slopes. Road and drainage plans will also have to be prepared by a licensed engineer for the subdivision. There is some issue here because the right-of-way could also be used to serve lots on the parcel on which it is located. For the two residential lots currently proposed, a 12' stone blend road in a 25' right-of-way would be required. We may be able to solve this in the Covenants - no future subdivision unless the road is upgraded. If there are any questions or problems, please let me know.
