Approximately 13+ acres (subject to survey) are proposed to be purchased at a price of $9000.00 per acre, having a cost of about $120,000.00. The unit price is supported by an appraisal the Town Board commissioned from A. Stype, SRA. The owner wishes to reserve from the easement an area at the southerly end of the entire parcel, which will conform to the Southold Town Code for use as a single-family residential plot. Will you please consider scheduling a public hearing before the Town Board relative to this recommendation in accordance with the provisions of Chapter 25 of the Southold Town Code. I would be pleased to appear in support of the proposed purchase. I enclose the necessary "Sort EAF," which briefly details the proposal and concludes a "negative declaration," pursuant to SEQRA. Mr. Leiblein: I didn' t say that yet, when I spoke to Mr. Lentini he said, I think we can be lenient in that area but the main thing we are looking for is to make sure the drainage is improved. Mr. McDonald: I would be looking for, if not curbing, something to restrict the flow of traffic out of that parking lot. I don' t know about curbing but something to show people (inaudible) . Mr. Leiblein: The logical place to have an entry to that parking lot is directly across the street from where we drive in now. When we go across the street with a fork lift to take a boat we go through there so my thought is if the Department of Transportation goes along with :it to make a curb cut with some shouldering that goes twenty or thirty feet either way and the rest of the area with some of those concrete columns or some CCA pilings and wee drive in and come in and set the boats down. As you may have noticed When we did have boats over there we turned them all around so the sterns were to the highway. Even that didn' t do any good we still had two engines stolen on the main highway after stealing one on the south side of the highway so that ' s $25 ,000 worth of engines down the drain. I put an alarm system in now and it is fine. It' s coming this way. You could leave anything anywhere in the old days quote, unquote. Mr. Latham: That was my question. Mr. Leiblein: At some time I may come in and say, we' re going to fence things in but I hate to do that. I feel like I 'm going into a prison. I don' t have anymore questions if you don' t. Mr. Orlowski: We don' t. Mr. Leiblein: Thank you very much and have a nice evening. Mr. Orlowski: Any other questions or comments? John Calibrese: I 'm a partner in the subdivision of Pugliese and Calibrese. I was wondering what the progress? Mr. Orlowski : Well, tonight we set a final hearing for the 22nd of October and we did a Negative Declaration. Mr. Calibrese: Excuse me what did you say? Mr. Orlowski: A final hearing was set for October 22nd and we gave it a Negative Declaration in regards to SEQRA. PLANNING BOARD 04 OCTOBER 2 0990 CMr. Calibrese: What does that mean? Mr. Orlowski: That means that you are well on your way to completion. Mr. Calibrese: Cause I told you I 'm running out of money this is three years, I mean I can' t believe that I have a minor subdivision for three years . In the meanwhile I got to keep paying money every month to pay for this thing. When I start out, I went to see Ms . Scopaz and she said oh, it will take about six months to a year. This is three years for my subdivision, you know this is ridiculous . Everytime we send something, something else comes up, then I get tied in with a winery and I last time I was here it was about six months ago, I don' t want to get tied in with the winery, I got nothing to do with the winery. It ' s my dollar, why should it take three years to do my subdivision. I mean, where is the money coming from, I mean I have to pal, for this thing, I mean, it' s not fair. Mr. McDonald: The point is that you are getting close to the end. Mr. Calibriese: 1. mean, where :is the money coming from? I mean this is a lot: of money we have to come up with every month. I mean you know we have to have some leniency on people. This isn' t fair, it' s not fair. What do you assume we have enough money to keep going with this? I mean, how do you assume that? I mean, somewhere along the line somebody has to make some decisions and say, well listen, you have to give us this otherwise forget about it but you just can' t keep stringing us along. Mr. Orlowski: I think we did that right from the very beginning but it was between you and your partner, there was a lot of discrepancy. Mr. Calibrese: No, everytime we kept getting stuff everything kept getting changed around. It got changed around to the winery, it changed around to something else, everytime it got changed around. You know when we came originally we were seeking to have a set off for two acre commercial. Then after we went through all the papers and everything then somebody told us you know, we have a new master plan. Why didn' t anybody tell us about this master plan. . After we got all the papers then twice you people met and made comments that because the master plan wasn' t approved yet that that was a good thing for the Main Road. So I talked to this ( inaudible) man and I said listen, we don' t know anything about it, nobody told us about this. We ' re going to be withdrawing the application for while you know you expedite my subdivision. Oh yeah, we ' ll take care of you that was like two and cne half years ago. It isn' t fair, I don' t know what else to say you know. Mr. Orlowski: Well, we' re getting closer. PLANNING BOARD 415 OCTOBER 2990 Mr. Calibrese: Does that mean on October 22nd that will be Cthe closing. Mr. Orlowski: Well, that will be pretty good. Mr. McDonald: Then we have the final hearing. Mr. Calibrese: Well, when is the final hearing? Mr. Orlowski: The 22nd. Mr. Calibrese: Do you see any problems with it? Mr. McDonald: Anybody who wants to can come to that meeting and complain, make any comments they want and we have to take into consideration their comments. if there are no difficulties, then that makes it. a lot easier,. Mr. Calibrese: It is not like asking to something like Taj-Mahalover there. You know I 'm just trying to build a house over there. Thank you. Mr. Orlowski: Very good. No further comments or questions from the audience? Any questions from the board? Board: No questions. Mr. Orlowski: No further questions , I ' ll entertain a motion. Mr. McDonald: I Rove we adjourn. Moore Moore & Moore Clause Commons Suite 3 P.O. Box 23 Mattituck, New York 11952 RE: Proposed Subdivision of Pugliese an Calabrese SCTM# 1000-97-1-12 . 1 Dear Mr. Moore: The Planning Board reviewed the revised maps dated June 22, 1990, for the above mentioned subdivision. The Board is not in favor of the removal of the previously requested covenant to merge the northerly property with the adjoining property owned by Mr. Pugliese. The 10 foot strip of land, from the parcel located on Main Road to the northwesterly portion of the lot., as shown on the revised map, would not allow for development of the northwesterly portion of the lot should this proposal be made in the future. If your client wishes to proceed with this as a two lot subdivision without a covenant merging the lot with the adjacent parcel also owned by Mr. Pugliese, a strip of land, fifty ( 50) feet in width, must be provided. In addition, this strip of land must be in a viable location, and must not necessitate the crossing of the pond by a road. Upon submission of either a revised Declaration of Covenants and Restrictions including a covenant merging the lots, or revised maps with an appropriate 50 foot strip of land, the Planning Board will continue with their review. In addition, "the draft Declaration of Covenants and Restrictions states that final subdivision approval was granted on April 10 , 1990 . This statement is not correct. The Planning Board has not granted final approval to this subdivision. Please contact this office if you have any questions regarding the above. The subdivision is now a two lot subdivision; Lot 1 consisting of 22 acres and Lot 2 consisting of 19.73 acres. The revision to this map eliminates the need to merge the northerly property with adjoining property owned by Mr. Pugliese. Accordingly, we ask that your requirements set forth in the letter dated April 10th be amended to eliminate the requirement of paragraph number 3. Enclosed for your review is the proposed set of Covenants and Restrictions. As the lots now exceed five (5) acres in size each, Health Department approval of the subdivision is not required. Accordingly, we await your approval of the Covenants and Restrictions and the map as proposed. If there is any additional information which we can provide, please do not hesitate to contact us. The final map shall. bear the following note: A Declaration of Covenants and Restrictions has been filed in the Suffolk County Clerk's o`fice which affects lots in this subdivision. The Commission also offers the following comments on the map for your use and consideration: 1 . It is suggested that before approval is granted to this subdivision that the subdivider be required to submit this proposal to the Suffolk County Department of Health Services for review to insure that the proposed ;;ubdivision will meet the requirements and standards of that agency. 2. It has been noted that the nature of the buildings on the tract are not indicated on the map. It would be helpful in our review if the proposed subdivision map would be complete in the information that it contains. Page -3- ------------------------------- 3. Conditional approval of this subdivision does not in any way imply approval of the layout of future subdivision of this tract presently under ccnsideration. 4. The layout of any subdivision for Lot 2 should be limited to a "cluster" plan so that prime agricultural soils can be saved and open space be created to help preserve the rural atmosphere of the town. 5. The map of this minor subdivision should be filed in the office of the County Clerk. This is to insure the validity of the subdivision map and that the subdivision map will be available to the general public in a central office of official records. Very truly yours, Arthur H. Such clearing and cutting shall be subject to review by the Town to insure proper maintenance and preservation of the natural buffer. 9. Conditions 1 , 2 and 4-8, inclusive, shall be filed as covenants and restrictions. in the office of the County Clerk on or prior to the granting of approval to this subdivision. These covenE.nts and restrictions can be modified only at the request of the then owner of the premises with the approval of a majority plus one of the Town Board or Planning Board of the Town of Southold after a public hearing. Adjoining property owners shall be entitled to notice of such public hearing but their consent to such modification shall not be required. 10. The final map shall bear the following note: A Declaration of Covenants and Restrictions has been filed in the Suffolk County Clerk's office which affects lots in this subdivision. The Commission also offers the following comments on the map for your use and consideration: 1. It is suggested that before approval is granted to this subdivision that the subdivider be required to submit this proposal to the Suffolk County Department of Health Services for review to insure that the proposed subdivision will meet the requirements and standards of that agency. 2. It has been noted that the nature of the buildings on the tract are not indicated on the map. It would be helpful in our review if the proposed subdivision map would be complete in the information that it contains. Page -3- -------------------------------------------------------------------------------- 3. Conditional approval of this subdivision does not in any way imply approval of the layout of future subdivision of this tract presently under consideration. 4. The layout cf any subdivision for Lot 2 should be limited to a "cluster" plan so that prime agricultural soils can be saved and open space be created to help preserve the rural atmosphere of the town. 5. The map of this minor subdivision should be filed in the office of the County Clerk.. This is to insure the validity of the subdivision map and that the subdivision map will be available to the general public in a central office of official records. Very truly yours, Arthur H.
