Dear Mr. Ward:
As per your request, I have reviewed the above referenced set-off for existing and
potential drainage problems. The existing North East side of Cox Lane already has a
drainage problem. Existing Town drainage structures are currently about 95% effective
with respect to runoff problems. Any additional run-off generated could render the existing
system inadequate.
Lot number "2" is a 4.2 acre parcel that is proposed to be set-off from the remaining
20 acres. This lot currently has a hollow or Iow point (+/- 1 acre in size) immediately
adjacent to the road. It is quite evident that this area collects a large volume of run-off
whenever it rains. Depending on the proposed development or re-grading of this parcel,
the potential for additional run-off is considerable.
If the topography of the front section of Lot number "2" is to remain unchanged
and/or undeveloped, no further drainage structures will be required. It is therefore
recommended that a covenant be established for lot number "2" requiring a drainage
review of any proposed development. This review should have the endorsement of the
Superintendent of Highways.

Dear Mr. & Mrs. Dank:
The following took place at a meeting of the Southold Town Planning Board
at a meeting held on Monday, September 30, 1996:
BE IT RESOLVED that the Southold Town Planning Board, acting under the
State Environmental Quality Review Act, do an uncoordinated review of this
unlisted action. The Planning Board establishes itself as Lead Agency, and as
Lead Agency makes a determination of non-significance and grants a
Negative Declaration.
BE IT RESOLVED that the Southold Town Planning Board grant sketch
approval on the map dated September 18, 1996, with the following
conditions:
A building envelope must be indicated on proposed Lot #2.
Such building envelope shall be subject to the Planning Board's
review and approval.
A Declaration of Covenants and Restrictions shall be recorded
for the subdivision stating that there shall be no further
subdivision of proposed Lot #2 in perpetuity.
Sketch plan approval is conditional upon submission of final maps within six

months of the date of sketch approval, unless an extension of time is
requested by the applicant, and granted by the Planning Board. The final
maps, six (6) paper prints and two (2) mylars must contain a current stamp
of Health Department approval and must be submitted before a final public
hearing will be set.
The sketch plan has been referred to the Engineering Inspector for review.
· You will be notified if any drainage requirement improvements are required
for the proposed set-off.
The sketch plan has been referred to the Suffolk County Planning
Commission for review. You will be notified if any changes or additional
covenants are required. Since additional covenants and restrictions may be
required, in addition to the ones mentioned above, it is not necessary to
submit the draft Declaration at this time.
The sketch plans have been referred to the Cutchogue Fire Department for
their recommendation as to whether a firewell is necessary for fire
protection. You will be notified if a firewell is required.
The Planning Board has reviewed the property and has decided that it is
inadequate in size for a reservation of land for park and playground use.
Therefore, a cash payment in lieu of land reservation will be required as per
Section A106-38 (e) of the Town Code. The amount to be deposited with the
Town Board shall be $2,000.00 (two thousand dollars per vacant lot in the
subdivision.) Payment is required prior to any final endorsement of the
subdivision,
A copy of the Negative Declaration is enclosed for your records.

Reasons Supporting This Determination:
An Environmental Assessment Form has been submitted and reviewed,
and it was determined that no significant adverse effects to the
environment were likely to occur should the project be implemented
as planned.
The applicant will have to comply with the requirements of the Suffolk
County Sanitary Code (SCSC) and all relevant standards of water supply
and sewage disposal systems. Design and flow specification, subsurface
soil conditions and site plan details will have to be approved by the Suffolk
County Department of Health Services (SCDHS). This impact is not
considered significant due to the anticipated project compliance with
established requirements of the SCSC and the SCDHS and the required
relevant permits.

We hereby request that the Southhold Planning Board grant
approval for a 4.25 acre parcel setoff located on one side of
our 24.43 acre farm, zoned Agricultural-Conservation.
The enclosed survey and aerial photograph xerox (both 1":100')
indicate the location and topography of the proposed setoff.
The parcel is situated at the narrowest end of the
property; it has a fairly uniform shape and follows the
natural contours, elevations and tree growth of the land; it
is completely visually screened from the main property by a
wide line of substantial trees and a drop off in elevation.
