RE: PROPOSED SET OFF FOR JOHN P. KRUPSKI & BROS., INC.
Dear Mr. Ward:
According to your letter dated January 10, 1995 addressed to Catherine Mesiano, Inc., I
understand that sketch plan approval in the above matter was granted with certain conditions.
Sketch plan approval was further conditioned upon submission of final maps within six months
of the date of sketch plan approval which would have been on July 10, 1995.
My office represents the First Baptist Church of Cutchogue who is the proposed
purchaser of the 3.7 aczes. One of the conditions in your January 10, 1995 letter was the
obtaining of approval from the Town of Southold to either purchase or obtain a right-of-way
over tax parcel 1000-96-2-8.
As you can see from recent artides published in both newspapers, the Church is
experiendng some difficulty in obtaining the Town's approval for both the set-off or the
purchase. A request for a donation of the property by the Town to the Church seems to be
unlikely.
In any event, an extension of time is hereby requested on behalf of the applicants for
the submission of final maps. I would think that we should have approval within six months.

CUTCHOGUE-- The First Bap-
tist Church in Cutchogue wants the
town to donate a piece of town prop-
erty. ko the organization to provide a
right of way for a new church they
intend to build on the South side of
Route 48 in Cutchogue.
The church currently sits on a
piece of land adjacent to the town
landfill and the growing congrega-
tion would like to build a ne~v, larger
facili~ on property across Route 48.
The only snag in their plan is that
the toxvn oxvns a strip of property
between the church and Route 48,
and the church needs that property
to gain access to the right of way.
Reverend Cornelius Fulford ad-
dressed the to,on board at its Tues-
day work session and again at the
evening meeting to ask for assistance
from tike town. Fulford compared
the donation of land to his church
and the donation of land to the
Young Men's Christian Association
(YMCA) in Laurel.
Fulford explained how his church
provides counseling for drug and al-
cohol addicts in the toxvn and would
like to add services such as day care
to the new facility.. "We, as a church,
give you something back," said
Fulford.

sible for the town to build anything
on the land and encouraged the board
to sell the land to the church at a rea-
sonable price or make an outright do-
nation.
Supervisor Thomas Wickham
sympathized xvith Fuiford's cause
and proposed the town grant an ease-
ment to the church. An easement
would allow the people use of it at a
small fraction of the appraised value
with the option to buy it at a future
date.
Wickham said he does not belie~ e
a comparison with the YMCA
project is accurate because in that
situation, he said, the granting of
town land would result in a benefit
to most of the people in the town and
the YMCA promises extensive pro-
grams for town residents where they
supply the major fund raising efforts.
The supervisor said that the town
might be able to help fund certain
activities for the church instead of
making the land donation.
Town Councilwoman Louisa
Evans said the chumh was a great
asset to the community, and the town
does xvant to help, but they need to
find a legal means to an end.

ation, but need counseling as well.
"The things the YMCA may be
lacking are the things the church can
provide for them," said Ford.
Councilman Joseph Lizewski told
the parishioners he wishes the town
could help them with their request .
for land because their organization
is more deserving of the land than
the YMCA.
The councilman lashed out at the
YMCA by saying it was "not run by
Mother Teresa" and if it were a for-
profit organization, it would rank in
the middle of the Fortune 500 com-
panies.
After the meeting Fulford told the
press, he did not favor an easement
because the town could still do what-
ever it wanted to with the land. The
land Fulford wishes to acquire is
approximately one quarter of an acre
on the Northern boundary on the
churches 3.7 acres.
Fulford expects construction of
the new $500,000 church to begin
in early 1997.

Reasons Supporting This Determination:
This proposal ;s to set off a 3.888 acre parcel from an existing 36.035 acre
parcel. Both lots meet the zoning requirements in this Agricultural-
Conservation (A-C) zone; thus the proposed action is consistent with
zoning.
An Environmental Assessment Form has been submitted and reviewed,
and it was determined that no significant adverse effects to the
environment were likely to occur should the project be implemented
as planned.
The applicant will have to comply with the requirements of the Suffolk
County Sanitary Code (SC$C) and all relevant standards of water supply
and sewage disposal systems. Design and flow specification, subsurface
soil conditions and site plan details will have to be approved by the Suffolk
County Department of Health Services (SCDHS). This impact is not
considered significant due to the anticipated project compliance with
established requirements of the SCSC and the SCDHS and the required
relevant permits.
