NOTICE OF AMENDMENT
TO TOWN CODE
AMENDMENT NO. 125
NOTICE IS HEREBY GIVEN that at a meeting of the Town Board of the
Town of Southold, Suffolk County, New York, held on the 15th day of
December, 1987, the Town Board enacted the following amendment to the Town
Code, entitled, "Code of the Town of Southold", together with the Building
Zone Map forming a part thereof, as follows, to wit:
Amendment No. 125 amends the Code of the Town of Southold by changing
from "A" Residential and Agricultural District to "C" Light I ndustrial District
the property of James L. Gray, Sr., situated at Cutchogue. in the Town of
Southold, County of Suffolk and State of New York, bounded and described
as follows:
BEGINNING at a point on the northwest line of Middle Road (C.R.Li8) 600
feet more or less southwesterly along said line from Cox's Lane, said point
being the southeast corner of the premises herein described and the southwest
corner of land of Pietrewicz; running thence along the northwesterly line of
Middle Road (C.R.Li8) South 25 degrees 52 minutes 33 seconds West 150 feet to
land now or formerly of H. P. Wickham; running thence North 56 degrees Li2
minutes 33 seconds West 263.16 feet to land of the Town of Southold; running
thence along said land and land of Pietrewicz North 23 degrees lLi minutes East
150.0 feet; running thence still along land of Pietrewicz South 56 degrees 55
minutes 50 seconds East 270.0 feet to the point or place of BEGINNING.
Containing within said bounds an area of 0.907 acre.

Part 3 Evaluation of the Importance of Impacts
5. Groundwater Quality
The proposed action will require a discharge permit which
will have to be approved by the Suffolk County Department
of Health Services (SCDHS). No significant impact on
groundwater is expected to occur due to the presence of
the landfill adjacent to the site and the relative
insignificance of the area of land sought for rezoning.
The proposed action will also require a well permit
from the SCDHS. Groundwater quality characteristics
will be determined by SCDHS as to whether treatment
would be required to insure potability by SCDHS.

Part 3 Evaluation of the Importance of Impacts
5. Groundwater Quality
The proposed action will require a discharge permit
which will have to be approved by the Suffolk County
Department of Health Services (SCDHS). No signigicant
impact on groundwater is expected to occur due to the
presence of the landfill adjacent to the site and the
relative insignificance of the area of land sought for
rezoning.
The proposed action will also require a well permit
from the SCDHS. Groundwater quality characteristics
will be determined by SCDHS as to whether treatment
would be required to insure potability.

Code, entitled, "Code of the Town of Southold", together with the Building
Zone Map forming a part thereof, as follows, to wit:
Amendment No. 124 amends the Code of the Town of Southold by changing

Purpose: The full EAF is designed to help applicants and agencies determine. in an orderly manner, whether a project
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-
ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine
significance may have little or no formal knowledge of the environment or may be technically. e.xpert in environmental
analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting
the question of significance.
The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination
process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a project or action.
Full EAF Components: The full EAF is comprised of three parts:
Part 1: Provides objective data and information about a given project and its site. By identifying basic project
data, it assists a reviewer in the analysis that takes place in Parts 2 ana 3:
Part 2: Focuses on identifying the range of possible impacts that may Occur from a project or action. It provides
guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially-
large impact. The form also identifies whether an impact can be mitigated or reduced.
Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the
impact is actually important.

WHEREAS, a public hearing was held and concluded on July 16, 1987
in the Matte.r of the Application of PUDGE CORP. under Appl. No. 3631,
and
WHEREAS, at sai d heari ng all those who desi red to be heard
were heard and their testimony recorded; and
WHEREAS, the Board has carefully considered all testimony
and documentation submitted concernjog this application; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning;
and the surrounding areas; and
WHEREAS, the Board made the following findings of fact:
1. The premises in question is a described parcel of land
containing a lot area of .895 of an acre, or 39,524 s'q. ft., with
frontage (lot width) of 150 ft. along the north side of C.R. 48,
Hamlet of Cutchogue, is vacant, and is more particularly shown
on the Suffolk County Tax Maps as District 1000, Section 96,
Block 1, Lot 20.
2. The subject premises is located in the "A" Residential
and Agricultural Zoning District and is immediately adjacent to
the Town of Southold Disposal Site at the north side. The
premises immediately adjoining this property along the west side
is also vacant and along the east side is a parcel of 6.29:t
acres with agricultural uses.
3. Town assessment records show the owner
parcel to be John S. Wickham, although it is our
that there has been a recent conveyance to Pudge
James L. Gray, Sr. (No proof of such conveyance

4. By this application, appellant requests a Variance
from the Zoning Ordinance to permit the construction of
100' wide by 75 ft. deep building for industrial use as
more partiuclarly shown on Drawing #SK-l premises by John A.
Grammas and Associates April 29, 1987.
5. No evidence has been introduced as required by
law that:
(a)

This Board is aware that the proposed new Master Plan
Maps depict this property for LIO, Light Industry, which would

sympathize with petitioner's plight; however, the Board finds
that the criteria set by the Courts has not been sufficiently
met and therefore lacks authority. to grant the relief as
requested.
Accordingly, on motion by Mr. Douglass, seconded by
Mr. Grigonis, it was
RESOLVED, that the Variance requested under Appeal

The Board Members were sympathetic and do agree that
this parcel should be re-zoned to permit contractor's office
uses. However, due to the limited jurisdiction of the Board
of Appeals under these circumstance~, we are without
authority to grant the variance applied.
A "denied without prejudice" clause has been added in
the event a future application is needed to be filed before
this Board for a Special Exception or other permit under
the newly proposed Master Plan Amendments.
