' 22355 Cox Lane, Unit #4 Cutchogue, NY 11935 Re: Proposed construction of Phase II of,site plan for Buccaneer Books, Depot Lane, Cutchogue SCTM# 1000-96-5-8 Dear Mr. Kelly: The following resolution was adopted by the Southold Town Planning Board at a meeting held on Monday, May 12, 1997: WHEREAS, final approval for Phase I of this project was granted on April 6, 1992, for final surveys dated November 6, 1991, and March 16, 1992; and WHEREAS, the approval granted on May 12, 1994 contained a condition that no building permit may be issued far any part of Phase 2 of this approved site plan until a survey with Health Department approval is received by the Planning Board and the site plan is re-endorsed by the Planning Board Chairman; and WHEREAS, the Planning Board has received a survey last dated May 16, 1991, prepared by Roderick VanTuyl, with a Health Department stamp approved for construction dated April 17, 1997; and WHEREAS, the proposed 60' by 100' storage building will be of the same construction and color as the existing building; and WHEREAS, the twenty foot wide buffer zone to the south of the property, shown Page 2 Proposed site plan for Buccaneer Books May 13, 1997 on the approved plan dated March 16, 1992, will be planted with an additional twenty (20) evergreens, six feet in height, staggered ten foot on center; and WHEREAS, any violation of the conditions of this resolution may be grounds for revoking this approval; be it therefore RESOLVED, that the Southold Town Planning Board authorize the Chairman to re-endorse the plans dated November 6, 1991, and March 16, 1992, subject to a one year review from date of building permit. Enclosed please find 2 copies of the re-endorsed site plan; one for your records and one to be given to the Building Department when you apply for your building permit. It was found that the parking had not been striped and the handicapped parking space had not been installed. In addition the parking area at the rear (east of the building) had not been installed. The parking area at the rear does not have to be installed at this time and can be considered land banked for future use, however the striping and handicapped space must be installed before this Board can recommend that a C. Hennessey, At a special meeting of the Board of Fire Commissioners on Harch 22, 1993 the following resolution was adopted and a copy sent to the Southold Town Planning Board. 1) Be it resolved to provide adequate fire protection to the building(s) on the subject property, the Board of Fire Commissioners is continuing to recommend that a fire well be installed as outlined in the letter of the Cutchogue Fire District's secretary, dated December 26, 1991, to the Chairman of the Southold Town Planning Board. 2) Be it resolved that it is further recommended that the construction of this fire well is primary for the benefit of the subject property, however due to the residual benefit to the existing structures and buildings in the surrounding neighborhood, that 75$ of the cost of this fire well be paid by the applicant and the balance by the f'~e district. 3) Be it resolved that it is further recommended that as a condition of any site plan approval and Certificate of Occupancy for the presently constructed building that the land owner agree to an annual inspection by the Chief of the Cutchogue Fire Department to determine the type of materials stored in the warehouse so that the fire district will have adequate notice on how to be prepared to handle an emergency at this location. 4) Be it resolved that it is further recommended that prior to the issuance of site plan approval or Certificate of Occupancy to the present building that a restrictive covenant be recorded in the Suffolk County Clerk's office to reflect the above resolution. Further, since your client expressed an interest in leaving the southern and eastern portions of the property in its existing natural state, the term "seeded" should be removed from the site plan. The phrase "To be left in its natural state" should be substituted in its place. Also, if your client wishes to 'landbank' some of the parking spaces required by Phase I or II, then these spaces should be marked on the plan. Also, the plan should indicate that when the evergreen buffer is planted, existing vegetation (e.g. deciduous trees) should be allowed to remain. Finally, in lieu of a landscaped berm in the front yard, the Board will accept a double, staggered row of street trees, placed 30' apart (on center). Bob Kassner of Planning staff was present at the meeting also. The purpose of the meeting was to discuss the changes that the Planning Board wanted to see in the proposed layout. I had prepared a sketch of the changes, which is so marked and is in the file. A brief synopsis of the Board's requests and their response follows. Request: Flip the layout so that the parking area and loading zone faced the north end of the property. The adjacent properties to the south and west are residential in character and zoning. This property is on the edge of the Limited Business district. The Board feels the business use should be screened from view of the residential properties. Response: They agreed to come in with another layout. However, they think they may want to put the building as close as 25 feet to the south property line, in order to maximize their ability to expand the proposed building to the north. The Code allows them to have a 25 foot side yard. It only requires 20 feet of landscaped screening within this 25 foot yard to protect the neighboring residential zone. Request: Eliminate the southernmost curb cut, which faces a residential district. Widen the northern curb cut to allow for two way traffic. Response: They agreed to eliminate the southernmost curb cut. They are not sure how they want to redesign the northern cut. Request: Relocate the parking spaces within the front yard to the north and west. Show 25 spaces, as required by the Code. Response: They agreed to eliminate the parking in the front yard. They indicated that they did not anticipate needing more than about 5 spaces, because of the nature of their business. They are willing to show the spaces on the site plan, but would like to land bank them until they are needed. Request: Set the building back 100 feet from the road. Response: They would like to put the building at the 60 foot setback line in order to maximize the expansion potential of the site. Questions: They wanted to know if they could let the rear portion of the property stay in its natural state instead of plowing it under, seeding it, etc. I reviewed the results of this meeting with the Planning Board members later that day. The Board decided that they would not like to see a building placed at the 25 foot side yard setback line on the south property line. They want more of a buffer between the building and the residence to the south. The Board had no problem with letting remain the existing vegetation in the rear and side yards. (However, the required buffer area between the business and residential zone will have to be supplemented by evergreen species of plants.) Finally, since the proposal is based on the future expansion of the building, the Board felt that the Hennesseys would do well to come in with the entire proposal now, with phased development shown on the site plan as such. The information in this last paragraph was communicated to Bill Relly over the telephone on 9/10/91.
