Dear Mr. Sherman:
Below is my summary of the discussion which took place at the Planning
Board's April 17, 2000, work session, at which you were in attendance.
As you know, the Planning Board has reviewed this subdivision (plan
dated March 28, 2000) for concept purposes only, in conjunction with the
applicant's application to the County for the purchase of development
rights. The Board's comments do not constitute an approval of any kind.
A technical review will be conducted upon receipt of a complete
subdivision application.
The Planning Board has received a Yield Plan dated Oct. 27, 1999.
The Yield Plan was prepared for concept purposes only. A yield plan
conforming to all requirements of the Subdivision Regulations, must
be included with the subdivision application.
The Planning Board is in favor of the flag lot design proposed for
Lots 1 and 2. However, a 16' wide common driveway will be required
for these lots. The common driveway shall not be located along the
property line with the land owned now or formally by Goerler. The
common driveway must be centered between the two 15' accessways,
or located entirely within the accessway for Lot #2, with access
granted to Lot #1.
Lot 5 is currently a separate tax parcel (97-5-2.2). However, this
parcel is shown as a lot within the subdivision because the property
lines have been slightly revised. That is, the existing lot is a 1
acre lot, and the proposed lot is a i acre lot, but with different
property //nos. Since this is an ex/sLing 1 acre lot, thfs lot does
not need to contribute to the density calculations for the overall
cluster concept.

Lot 6 is shown as "Commercial Area." All or part of this lot
lies within the LB Zoning District. The proper zoning designation
and boundary must be shown on the plan, in place of the
"Commercial Area" designation.
Since the LB District requires a minimum area of 80,000 square feet,
this lot must be included in the overall cluster calculations.
Lot 7 is shown on the March 28, 2000 plan as a 3.03 acre
"Greenhouse-Retail" area. However, it was noted at the work session
that this area was not planned as a separate lot and that it was to
remain under the same ownership as the area on which the County
will be purchasing the development rights. The Planning Board will
be requiring a covenant that there be no further subdivision of the
3.03 acre area in perpetuity.
Since Lot 7 is located within the A-C zoning district, this area
should not be labeled as "Greenhouse-Retail."
Lot 7 contains an area shown as a separate lot on the tax map
(97-5-1). Review as to whether or not the Town recognizes this lot
as a single and separate lot has not been conducted since the
subdivision proposal shows this area as merged with the adjacent
land. However, Town records show this area as under different
ownership from the adjacent lot (97-5-2.1). This must be addressed.
Building envelopes must be shown for all clustered lots.
In regard to the cluster calculations:
The cluster calculations shown on the March 28, 2000, plan are not
acceptable.
The cluster calculations for this subdivision should be calculated as
follows:
A. The total acreage of the "reserved" area for each lot included
in the cluster calculations should be determined. As noted
above, Lot #5 should not be included in the cluster
calculations. In addition, since the proposed 3.03 acre building
area for Lot #7 is greater than 80,000 sq. ft., this area should
not be included in the cluster calculations.
The total of the "reserved" areas should be subtracted from the
future Development Rights area of Lot #7 to determine the area
available for the sale of development rights.

Dear Mr. Orlowski and Planning Board Members,
We are writing to you per advice from Mr. Ed Forrester, Building
Department TOS. We would like to place a farm stand on our property to
comply with the current building code regulations and planning board
approval. Mr. Forrester has given us a copy of the Southold Town building
regulations for farm stands.
Enclosed is a survey of the site and surrounding area with the placement of
the proposed farm stand.
