RESOLVED, that whereas, a formal application for the approval of a subdivision plat, entitled Minor Subdivision of Rush M. Forquer, Jr., and Elizabeth F. DESCRIPTION OF ACTION The minor subdivision of Rush M. Forquer, Jr., and Elizabeth F. Forquer is a two-lot subdivision of property located at Mattituck in the Town of Southold. The project has been determined not to have a significant effect on the environment for the following reasons: An environmental assessment has been submitted which indicated that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. Because there has been no response in the'allotted time from the New York State Department of Environmental Conservation it is assumed that there is no objection nor comments by that agency. The Suffolk County Department of Health Services has indicated that a review indicates problems may be encountered with obtaining potable water due to high nitrate concentrations and pesticide contamination. Conditions should be suitable for the installation of individual sewage disposal systems. In regard to these comments there is an existing house and the remainder of the property will remain in farming. The project will meet all requirements of the Code of the Town of Southold Subdivision of Land Regulations. Forquer, Jr. and Elizabeth F. Forquer Dear Mr. Raynor: We have discussed on a number of occasions the lands per- taining to our clients above named. We find ourselves in an extreme hardship situation at this time due to the fact that my clients have contracted to sell a portion of their lands consisting of 14.5 acres to parties by the name of Anthony P. Cassone, Jr. and Dania G. Cassone, his wife. The parcel in question to be sold consists of 150 feet on Oregon Road to a depth of 581 feet, containing all of the buildings on the entire acreage, to wit: Residence, barn and accessory buildings. There is an existing Certificate of Occupancy for the en- tire 14.5 acres and all of the buildings thereon located. The purchasers are most desirous of closing this transaction before the end of this month due to the fact that they must move under the terms of their lease from their present residence. Under present regulations, it would appear according to the Building Inspector that my clients must proceed with a minor subdivision proposal to the Planning Board in order to set off this particular parcel containing buildings and residence which pre-existed our Zoning Ordinance. As you can see, the hardship by virtue of the current Rule and Regulation is extreme for all parties. In the light of the fact that we are concerned only with setting off the parcel of land consisting of 150 by 581 feet containing all the buildings with respect to my clients' lands, all of which pre-existed our Zoning Ordinance, we should think that there should be some way for this parcel to be set off and a CO secured. You can appreciate, I am sure, that as to the remainder of the acreage if any further subdivision would be re- quired in connection therewith, whether it be major or minor, Planning Board approval would have to be secured. In the light of the foregoing factors, we should respect- fully request that the Board act as soon as possible pursuant to Section Al06-50 of the Zoning Ordinance where the Planning Board is vested with the power to grant variations to the Ordi- nance in cases of extraordinary and unnecessary hardships where compliance with the Regulations may result in substantial in- justice. Surely, by permitting a set off of this one oversized parcel, one could not argue that it would nullify the intent and purpose of our Ordinance or our Master Plan. We are aware, of course, that casual sales in situations such as this have been permitted in both past and present. It would appear, therefore, that if it were necessary to do so in order to accom- plish an expedition set off of this property, that a conveyance thereof could be made to a family member, and thereafter, con- veyed to the prospective purchasers of our clients.
