Re: Proposed Minor Subdivision of Ernest Schneider
The parcel is located southwest of Alvah's Lane, 1347.30 feet north of Middle
Road (C.R. 48) in Cutchogue
SCTM#1000-95-3-10 & 101-1-14.3 Zone: A-C
Dear Ms. Wickham:
The following resolution was adopted at a meeting of the Southold Town Planning
Board on Tuesday, October 14, 2003:
WHEREAS, this proposal involves the subdividing of a 13.41 acre parcel (SCTM#1000-
101-1-14.3) into two lots, where Lot 1 equals 2.32 acres and Lot 2 equals 2.61 acres
and, through a lot line modification, enlarging Lot 1 (SCTM#1000-95-3-10) from 1.11
acres to 2.32 acres; and
WHEREAS, the Planning Board granted conditional sketch plan approval on April 16,
2001; and
WHEREAS, on April 16, 2001 the Planning Board ruled that the Negative Declaration
previously issued for the identical action was still valid; and
WHEREAS, the Cutchogue Fire District is not requiring a fire well for the proposed
action as stated in an August 1, 2001 letter; and
WHEREAS, the Planning Board has accepted the ruling with the following condition:
At the time a new residence is constructed upon Lot 3, a fire well will be required
and noted as such upon the final print & mylars and, further, a Covenant and
Restriction shall be filed noting this condition; and

WHEREAS, on September 28, 2001, a draft Covenant of Declarations was received by
the Planning Board; and
WHEREAS, on May 20, 2003, the Southold Town Board granted a waiver from the
provisions of Local Law#3 of 2002 and Local Law#3 of 2003; and
WHEREAS, all conditions of conditional final approval have been met; and
WHEREAS, all the requirements of the Subdivision Regulations of the Town of Southold
have been met; be it therefore
RESOLVED, that the Southold Town Planning Board grant final approval on the maps,
dated as revised September 3, 2003, and authorize the Chairman to endorse the final
surveys.
Enclosed please find a copy of the map that was endorsed by the Chairman. The mylar
maps, which were also endorsed by the Chairman, must be picked up at this office and
filed in the Office of the County Clerk. Any plat not so filed or recorded within sixty (60)
days of the date of final approval shall become null and void.

WHEREAS,the Declarant is the owner of certain real property situate at Alvah's Lane,
Cutchogue,Town of Southold, County of Suffolk and State of New York, more particularly bounded
and described as set forth in Schedule "A" annexed hereto, and

Dear Ms. Wickham:
The following resolution was adopted at a meeting of the Southold Town Planning Board on
Monday, August 11, 2003:
The final public hearing was closed.
WHEREAS, this proposal involves the subdividing of a 13.41 acre parcel (SCTM#1000-101-1-
14.3) into two lots, where Lot 1 equals 2.32 acres and Lot 2 equals 2.61 acres and through a lot
line modification, enlarging Lot 1 (SCTM#1000-95-3-10)from 1.11 acres to 2.32 acres; and
WHEREAS, the Planning Board granted conditional sketch plan approval on April 16, 2001; and
WHEREAS, on April 16, 2001 the Planning Board ruled that the Negative Declaration previously
issued for the identical action was still valid; and
WHEREAS, the Cutchogue Fire District is not requiring a fire well for the proposed action as
stated in an August 1, 2001 letter; and
WHEREAS, the Planning Board has accepted the ruling with the following condition:
At the time a new residence is constructed upon Lot 3, a fire well will be required and
noted as such upon the final print & mylars and, further, a Covenant and Restriction shall
be filed noting this condition; and
WHEREAS, on September 28, 2001 a draft Covenant of Declarations was received by the
Planning Board; and

WHEREAS, on May 20, 2003 the Southold Town Board granted a waiver from the provisions of
Local Law#3 of 2002 and Local Law#3 of 2003; therefore be it
RESOLVED, that the Southold Town Planning Board grant conditional final approval on the
maps, last revised March 27, 2002, subject to the following conditions. These conditions must
be met within six (6) months of the resolution:
1. The Planning Board reviewed the park and playground requirement. As per Section
106-38 of the Subdivision Regulations, the amount to be deposited with the Town for
park and playground services is now$5,000 per lot for each vacant lot in the
subdivision. A Park,and Playground Fee of$5,000 will be required prior to any
endorsement of the subdivision by the Planning Board.
2. The Suffolk County Department of Health Services approval expired on March 21,
2003. Please submit three (3) mylar maps and five (5) paper copies with an updated
Suffolk County Department of Health approval stamp.
3. The filing of the Declaration of Covenants and Restrictions with the County Clerk's
Office prior to any endorsement of the final plat. A notation is to be placed on the
final plat that a Declaration of Covenants and Restrictions has been filed in
accordance with the Planning Board's requirements. The notation is to include the
liber and page number of the recorded document.
4. The referenced Suffolk County Tax Map Numbers upon the plat are incorrect.
Please correct the plat to reference SCTM#1000-95-3-10 and 1000-101-1-14.3.

Whenever the Code calls for a public hearing, this section
shall apply. Upon determining that an application is complete,
the board or commission reviewing the same shall fix a time
and place for a public hearing thereon.The board or commission
reviewing an application shall provide for the giving of notice:
A. By causing a notice giving the time, date, place and
nature of the hearing to be published in the official
newspaper within the period prescribed by law.
B. By requiring the applicant to erect the sign provided by
the town, which shall be prominently displayed on the
premises facing each public or private street which the
property involved in the application abuts, giving notice
of the application, the nature of the approval sought
thereby and the time and place of the public hearing

The following resolution was adopted at a meeting of the Southold Town Planning Board on
Monday, June 9, 2003:
WHEREAS, On May 20, 2003, the Town of Southold Town Board granted the applicant a
waiver from the provisions of Local Law#3 2002 (and extended by Local Law#3 2003) entitled
"Temporary Moratorium on the Processing, Review of, and Making Decisions on Applications
for Major and Minor Subdivisions, Minor Subdivisions and Special Exemption Use Permits and
Site Plans containing Dwelling Units(s) in the Town of Southold"and, therefore, the Southold
Town Planning Board is processing the minor subdivision application; and
WHEREAS, the Southold Town Planning Board granted conditional sketch plan approval on
April 16, 2001 for six months; and
WHEREAS, this is the third extension request for the application; and
WHEREAS, the applicant is diligently pursuing his application; be it therefore
RESOLVED that the Southold Town Planning Board grant a retroactive nine-month extension of

Since the Town Board has granted a waiver of the moratorium, we request an extension of the
sketch plan approval which was stayed pending the moratorium. I enclose a copy of our letter
dated October 10,2002 on this subject.
Since October 10, 2002, the Health Department has issued its approval of the map. A copy of
their approval is enclosed. Although you will note that the approval date reads March 21, 2002,
it was actually approved on March 21, 2003. We will have that date error orrected, but I prefer
to wait until the Planning Board reviews this matter again in case there are other revisions
required.
The last matter before your Board on this file prior to the moratorium issue was the SEQRA
Negative Declaration.

We hereby request a,six month extension for sketch plan approval, which approval currently
expires on October 16, 2002. The Health Department approval is pending the filing of
Covenants and Restrictions in connection with their water quality standards. We received their
request for Covenants this week,and expect to have the C&Rs finalized within the next month.
Upon Health Department approval being Granted,and we can proceed to final sketch plan
approval.
We believe that a granting of an extension of an existing approval deadline is not precluded
by the moratorium. This extension would not constitute a review or continued review of an
application, and does not require a hearing or decision on the application itself. The lapse of a
sketch approval because of the moratorium is not contrary to the purpose of the moratorium,
which was to prevent the continued processing of an application. The extension, if granted,will
maintain the status quo,which was the purpose of the moratorium. U,at the expiration of the
moratorium,there are new zoning restrictions which impact the subdivision in question,then that
should be addressed at that time.
The provision in the Local Law on the moratoriums which suspends the time periods for
processing applications presumably applies to the time periods imposed on the Board,but the
language also appears to include processing by the applicant. if your reading of this provision is
that the sketch expiration deadline is suspended,please confirm that in the alternative,

WHEREAS an application has been made by Ernest Schneider for a waiver from the
provisions of Local Law#3 of 2002 (and extended by Local Law#3 of 2003) entitled
"Temporary Moratorium on the Processing, Review of, and making Decisions on applications
for Major Subdivisions, Minor Subdivisions and Special Exception Use Permits and Site Plans
containing Dwelling Unit(s) in the Town of Southold"pursuant to Section 6 "Appeal
Procedures"of Local Law #3-2002 to permit the Planning Board to consider an application for a
minor subdivision for the parcel of property known as SCTM# 1000-101-01-14.3; and
WHEREAS the application involves the subdivision of a 13.41 acre parcel into 2 lots; and
WHEREAS the Town Board has reviewed the file, conducted a public hearing, and considered
all pertinent documents; and
WHEREAS the criteria that the applicant must meet is set forth in section 6. (Appeal Procedure)
of Local Law#3-2002 and Local Law#3-2003 and the section states:
Section 6. APPEAL PROCEDURES a. The Town Board shall have the authority to
vary or waive the application of any provision of this Local Law, in its legislative
discretion, upon its determination, that such variance or waiver is required to alleviate an
extraordinary hardship affecting a parcel of property. To grant such request, the Town
Board must find that a variance or waiver will not adversely affect the purpose of this
local law, the health, safety or welfare of the Town of Southold or any comprehensive
planning being undertaken in the Town. The Town Board shall take into account the
existing land use in the immediate vicinity of the property and the impact of the variance
or waiver on the water supply, agricultural lands, open and recreational space, rural
character, natural resources, and transportation infrastructure of the Town. The
application must comply with all other applicable provisions of the Southold Town Code.
WHEREAS the Town has hired a "moratorium group" consisting of in-house and outside
planners and attorneys who are working on a"Comprehensive Implementation Strategy"of the
Comprehensive Plan of the Town of Southold and certain comprehensive planning currently
being undertaken includes, but is not limited to a 80%preservation of open space throughout the
Town and a 60% reduction in density and clear establishment of the Hamlet Centers and a
possible Transfer of Development Rights component(a full description of the "action" is set
forth in the SEQRA Resolution dated January 7, 2003 for the Southold Comprehensive
Implementation Strategy which is incorporated by reference into this decision); and
WHEREAS the Town Board finds that the application is not in contrast with the extensive
planning initiatives being undertaken by the "moratorium group", or the Comprehensive Plan of
the Town of Southold; and
WHEREAS the Town Board finds that this application will not adversely affect the purpose of
the Local Law# 3 of 2002 and Local Law#3 of 2003; and
WHEREAS the Town Board of the Town of Southold finds that the application will not
adversely affect the health, safety, or welfare of the Town of Southold; and
WHEREAS the Town Board of the Town of Southold finds that the minor subdivision
application is consistent with the existing land use in the surrounding area and has a minimal
impact on water supply, rural character, natural resources and transportation infrastructure of the
Town; and
WHEREAS the Town Board of the Town of Southold finds that the application has no effect on
agricultural lands and open and recreational space; and
WHEREAS based on the application, all relevant documentation, the comments set forth at the
public hearing on this matter, the comprehensive planning currently being undertaken by the
Town, the above referenced facts, and the criteria set forth in Local Law No. 3 of 2002 and

In this memo, the Planning Board will only address this request in the context of
land use planning; the consideration of and any comment upon any other
reasons as stated, are beyond the scope of this review.
The proposed action involves the subdividing of a 13.41 acre Parcel (SCTM#
1000-101-01-14.3) into two lots and through a lot line modification, enlarging Lot
1 (SCTM# 1000-95-3-10) from 1.11 acres to 2.32 acres. Lot 1 is currently a
single and separate lot and improved with a single-family residence; Proposed
Lot 2 is improved with a single family residence and equals 2.61 acres and
proposed Lot 3 is improved with greenhouses and equals 8.48 acres. The action
would create two new residential lots. The parcel is located southwest of Alvah's
Lane, 1347.30 feet north of Middle Road (C.R. 48) in Cutchogue (Exhibit 1). The
property is located in the A-C (Agricultural Conservation) zoning district. On April
4, 2001 the Planning Board granted conditional sketch plan approval on the map
dated March 18, 2001.
The Planning Board has reviewed the progression of the application and the
request for waiver for the proposed Minor Subdivision of Ernest Schneider and
makes a recommendation that the Town Board grant the request of waiver
for the application. This decision is based upon the following facts:
Land Use —The dominant land use in the vicinity is agriculture mixed with low
density residential. The area is wooded to the southwest of the subject parcel.
Lot 1 is occupied by a single-family residence and several out-buildings. Lot 2 is
occupied by a single-family residence and Lot 3 is occupied by a greenhouse
complex. The Long Island Lighting Co. holds a Easement that transverses the
northern section of the property. The parcel is in lawn with a few interspersed
trees.
The potential of the area to provide collective open space and/or open space
easements is low. Proposed Lots 1 and 2 are developed in single family
residences and therefore no opportunity exists. Lot 3 is a working agricultural
facility with hard structures in place.
During the application process, the visual impacts were evaluated during the
SEQR review and no "significant" adverse impacts were identified. Note,
however, that this region has been identified as providing significant scenic value
to the Town of Southold and all efforts to minimize the interruption of the view
shed should be taken.
The subject parcel is zoned A-C, which requires a minimum size of 80,000
square feet per lot. The A-C zoning district is also located to the north, south and
east of the parcel. Lots in the general vicinity range from 1 acre to 2.85 acres;
with numerous lots over 2 acres in size. Based upon such, the proposed action
would not significantly deviate from the general area land use and the parcel
sizes adjacent to Alvah's Lane.
Transportation Infrastructure — On February 24, 1992 the Planning Board
issued a Negative Declaration pursuant to the State Environmental Quality
Review Act Section Article 8, Part 617 indicating that no significant traffic impacts
are expected to occur if the project is implemented as planned.
Natural Resources — The parcels are in lawn with few interspersed trees. On
February 24, 1992 the Planning Board issued a Negative Declaration pursuant to

that no significant impacts are expected to occur if the project is implemented as
planned.
The action does not fall within the jurisdiction of the Suffolk County Planning
Commission, therefore, coordination with the commission is not necessary.
Water Supply—Water Supply to Lot 1, Lot 2 and Lot 3 are currently served by
wells. Sanitary disposal within the proposed subdivision is managed by on-site
underground sewage leaching systems
Rural Character— Lots 1 and 2 are improved with single family residences. The
proposed action could result in the residential development of Lot 3. The view
shed could be disrupted. As mentioned above, this area is scenic and
placement of a residence should be evaluated to minimize any adverse impacts
to the area.
Agricultural Lands — The parcel is currently located within the A-C zoning
district; a designation intended to promote the preservation of agriculture soils
and associated practices. Currently Lots 1 and 2 are improved and in lawn;
therefore, no loss of significant agricultural use will occur. Lot 3 contains
greenhouses and paved surfaces. Exclusive of the greenhouses, no land area is
in agriculture use. Soil types of the parcels include Haven Loam, 0 to 2 percent
slopes (HaA) - Capability Unit Ile-1 and Riverhead Sandy Loam, 3 to 8 percent
slopes (RdB) - Capability Unit Ile-2 (Soil Survey of Suffolk County 1972). The
soils are listed as Suffolk County Prime Farmland by the USDA Natural Resource
Conservation Service. The soil types are well suited for crops. If a single family
residence is constructed upon lot 3 or the greenhouse complex is expanded,
prime agricultural soils will be impacted or lost dependent upon the type of
structure.
Open Space and Recreation Space— Due to the size, location and current use
of the property, the potential to provide significant open space or recreational
uses are low.
Based upon the above, it is the Planning Boards' finding that although the
proposed project does not fully support the planning objectives of the Town of
Southold which include: The preservation of open space and recreational space;
the preservation of the rural, cultural and historical character of the Hamlets and
surrounding areas and the preservation of the natural environment; the size,
location and current residential use of the Lots 1 and 2 limits the ability of the
proposed action to fully support such objectives. Proposed Lot 3 is in active
agriculture, however, due to the size and type of current operations, little
opportunity exists to meet the above goals.

Gentlemen:
We represent Ernest Schneider and his daughter, who own two single and separate adjoining lots at the
above location. We request a waiver from the current moratorium on subdivisions so that Mr. Schneider may
proceed with his pending two lot minor subdivision and lot line change to
(a) divide a 12.3 acre parcel, containing his son's residence and a 61,000 square foot greenhouse, into a
2.6 acre lot for the residence (Lot 2) and a 8.5 acre lot for the greenhouse (Lot 3), and;
(b) to increase his daughter's single and separate adjoining 1.1 acre residence parcel to 2.3 acres (Lot 1).
The application fee of$250.00 is enclosed.
Mr. Schneider owns a 12.3 acre parcel containing both an existing residence built and occupied by his son
and a large greenhouse containing the family greenhouse business (tax lot 14.3). Mr. Schneider's daughter and
son-in-law, Darice and Robert Clark, own the adjoining 1.1 acre lot containing an existing residence. Mr.
Schneider applied to the Planning Board for a lot line change/minor subdivision to divide his 12.3 acre parcel in
a two lot subdivision containing the son's residence on one lot and the greenhouse on the second lot, and at the
request of the Planning Board, to increase the size of his daughter's 1.1 acre parcel to 2.3 acres. He obtained
sketch plan approval on April 16, 2001 and has Health Department approval.
The subdivision would result in 3 lots, each of which are already improved with separate principal structures.
If Mr. Schneider is not allowed to proceed with the subdivision because of the moratorium, he will encounter
the following hardships:
1. BUSINESS LOAN COLLATERAL: The greenhouse operation on Lot 3, Schneider Greenhouses,
employs 10 local people full time and requires seasonal financing to accommodate the high cash needs at the

beginning of each season pending the receipt of accounts at the end of the season. One reason for the
subdivision is so that the greenhouse parcel may be used as collateral for such loans without the necessity of
mortgaging his son's residence, now a part of the same parcel. Unless the subdivision, which is virtually
complete, is finalized, he will not be in a position to post the greenhouse property as proper loan collateral.
2. LIABILITY ISSUES: As a commercial greenhouse operation, and given the inherently risky nature of
agricultural enterprises, Mr. Schneider would like to transfer the greenhouse property into a limited liability
company or corporation to limit liability in the event of a lawsuit for personal injury or otherwise. This cannot
be accomplished without including his son's residence, which is unrelated to the business but would be subject
to attack by creditors if the subdivision is not allowed to proceed.
3. HOME OWNERSHIP AND FINANCING: His son has contributed significantly to the cost of the
construction of his residence on Lot 2,but Mr. Schneider cannot legally deed the property to him until the
subdivision is complete. This prevents his son and his wife from borrowing on their residence, which is a
financial hardship to them. They have also been unable to take advantage of the current low rates on
mortgages.
4. ESTATE PLANNING: Mr. Schneider needs to divest himself of some of his properties for estate
planning purposes and he cannot do so without the subdivision. He needs to eliminate the value of his son's
residence and the extra property to be added to his daughter's residence from his estate to avoid a high estate tax
bracket.
As an alternative argument, we believe, this subdivision proposal clearly falls under Exclusion 2 of Section 4
of the Moratorium Local Law 3/2002. It qualifies as a Set-Off which meets the definition of Section A106-13
of the Southold Town Code, and is an exempt lot line change as to Lot 1. However, the Planning Board issued
a policy on set-offs in which set-offs will only be considered as such if a residence is being set off from a vacant
parcel. This is not a part of the Zoning Code, but the Planning Board has held to their policy, requiring that we
seek a waiver from the Town Board from the moratorium.
The proposed lot division will not adversely affect the concerns for which the moratorium was instituted. The
property contains no farmland and is not large enough to support farming. It is located in an area where the
proposed lots will not disrupt vistas, and in fact visually the property will not change. It is not large enough to
be "conservation subdivision". Each proposed lot is already improved by a separate structure.
We ask for your prompt and careful consideration of this situation.

Dear Sir or Madam:
We hereby request a six month extension for sketch plan approval,which approval currently
expires on October 16, 2002. The Health Department approval is pending the filing of
Covenants and Restrictions in connection with their water quality standards. We received their
request for Covenants this week, and expect to have the C&Rs finalized within the next month.
Upon Health Department approval being granted, and we can proceed to final sketch plan
approval.
We believe that a granting of an extension of an existing approval deadline is not precluded
by the moratorium. This extension would not constitute a review or continued review of an
application, and does not require a hearing or decision on the application itself. The lapse of a
sketch approval because of the moratorium is not contrary to the purpose of the moratorium,
which was to prevent the continued processing of an application. The extension, if granted, will
maintain the status quo, which was the purpose of the moratorium. If, at the expiration of the
moratorium, there are new zoning restrictions which impact the subdivision in question,then that
should be addressed at that time.
The provision in the Local Law on the moratorium which suspends the time periods for
processing applications presumably applies to the time periods imposed on the Board, but the
language also appears to include processing by the applicant. If your reading of this provision is
that the sketch expiration deadline is suspended, please confirm that in the alternative.

The following resolution was adopted at a meeting of the Southold Town Planning
Board on Monday, December 10, 2001:
WHEREAS, this subdivision is for 2 lots on 12.3 acres and a 1.2 acre lot line change
with a third lot, with two of the lots containing existing houses and the other containing
greenhouses; and
WHEREAS, this subdivision was granted conditional sketch approval by the Southold
Town Planning Board on April 16, 2001; and
WHEREAS, the February 24, 1992 Negative Declaration on the previous, but same
application was determined to be still valid; and
WHEREAS, the applicant has agreed to file a Declaration of Covenants and
Restrictions requiring him to install a fire well prior to the issuance of a building permit
for construction of a single family residence on Lot 3 of the proposed subdivision; and
WHEREAS the applicant is waiting for Board of Health approvals;
BE IT THEREFORE RESOLVED that the Southold Town Planning Board grant a
retroactive extension of sketch plan approval on the maps, dated March 18, 2001, from
October 16, 2001 to April 16, 2002.

Sketch plan approval is conditional upon submission of final maps within six months of
the date of this extension of sketch plan approval. The final maps, six (6) paper prints
and two (2) mylars, must contain a current stamp of Health Department approval and
the Liber and Page number of the aforesaid Declaration of Covenants and Restrictions.
The maps must be submitted before a final public hearing will be set.
j The Planning Board has reviewed the property and has decided that it is inadequate for
j a reservation of land for park and playground use. Therefore, a cash payment in lieu of
land reservation will be required in the amount of $5,000 ($5,000 per vacant lot in the
1 subdivision). Payment is required prior to the final endorsement of the map.

DECLARATION OF COVENANTS AND RESTRICTIONS
DECLARATION, made the day of , 2001, by
ERNEST SCHNEIDER, residing at 915 Lakeside Drive, Southold,New York 11971,
referred to as the Declarant.
WHEREAS, the Declarant is the owner of certain real property situate at Alvah's
Lane, Cutchogue, Town of Southold, County of Suffolk and State of New York, more
particularly bounded and described as set forth in Schedule "A" annexed hereto, and
WHEREAS, the Declarant has made application to the Planning Board of the
Town of Southold for approval to subdivide the said real property into three (3) parcels in
a subdivision known as Map of Minor Subdivision Prepared for Ernest Schneider dated

Mr. Orlowski: Yes.
Abigail Wickham, Egg.: Thank you. I'm here on behalf of Mr. Schneider. We would like
to ask the Board to consider perhaps, to some extent, relieving him from the
recommendation of the Fire Department since he is not doing what you might consider
typical development. The one lot that currently exists, he is gratuitously making larger
as far as the set-off part of the lot line change. The remainder of the property, as you
know, already has a house on it. He would just like to give it to his son. He's not selling
it; he's not making a development or making a profit. And the remaining lot, as you
know, contains his greenhouse building. If your concern is with the greenhouse building,
that is heated by home heating fuel. There is a propane tank there that perhaps the Fire
Department was concerned about. That is strictly back-up for emergency. The main
source is heat for that whole operation — heating fuel oil. There are a few chemicals
stored at the property. Probably no more than you would have with a very active

homeowner and he keeps them in a building which is vented, according to regulations.
The fertilizer there, again, is a fairly restricted quantity. He has invited the Fire
Department to go down and take a look if they have any concerns or recommendations.
He doesn't intend to build a house at this point on that third lot. He would be willing to
take whatever he gets to utilize that in terms of not having to install a fire well at this
point at a fairly tremendous expense until such time that he did plan on building a house
on that third lot. As you know, the properties along the west side of Alvah's Lane that
were subdivided were not required to have a fire well installed. I believe there was one
down at the corner of Alvah's Lane and Route 48 some time ago which is near to some
of those lots but the northerly lots in that group are also quite aways away and this
would gratuitously benefit them at his expense and he would just like to ask you to
consider— it is a recommendation. It's not going to ...(inaudible)
Mr. Orlowski: Well, when it comes to fire protection and life and safety, the Board has
never over-ridden any Fire District in their recommendation. You said the Fire District
could come out and take a look and maybe they could come to some agreement if they
did get together and go over this.
Ms. Wickham: Well, I believe ...(inaudible) asked him to do that. Obviously, he and his
family work there. They are more concerned than anyone about fire protection and fire
safety. If there is anything they feel is not being done properly, certainly he would be
willing to correct that. He recently went through a credit review where C.O.s were
required and I believe that all the C.O.s required by the Town are in place on that
property. It's a glass and steel building. ...(inaudible) It's primarily not a flammable
building. That's why I mentioned the heat source that they may have been concerned
about. It was at one time propane. Right now, it's strictly back up.
Mr. Orlowski: Did he remove the propane tank?
Ms. Wickham: The propane tank is about the same size as you would find in a home
heating system that is heated where you have a pool and a home heated with propane.
It is not, according to Mr. Schneider, something that would be just in a very large
commercial greenhouse.
Mr. Schneider: I used to have four of them and I don't heat with propane any more and I
just have three burners that are used for standby and that's all. If that's a problem, I can
take the propane out.
Mr. Orlowski: I would suggest—we can hold this and talk to the Fire District if that is
their only problem and you're willing to take it out. Then maybe they won't ask for that
well.
Ms. Wickham: I'd like to ask you to give us time to do that. It seems like a really harsh
result that might may be able to get waived without sacrificing ...(inaudible) are
concerned.

Board Member Kenneth Edwards: Why doesn't the applicant try to set up a meeting with
the Fire Commissioners? They may have some other concerns that they haven't told us
about. They're the professionals in the field here and not us.
Ms. Wickham: Did you say they have other concerns?
Mr. Edwards: No. They may have. I think if you sat down and discussed it with them —
Ms. Wickham: Be glad to do that. This letter just came back.
Mr. Edwards: We normally go with the recommendations of the Fire Commissioners
within the districts of each hamlet when we have an application.
Chairman Orlowski: We'll hold it and let you talk to the Fire Commissioners. Is that all
right?

Town Planning Board on January 13, 1992; and
WHEREAS, the Planning Board has determined that the subdivision approval has

WHEREAS, the Planning Board has determined that the two applications are identical,
with minimal development impact, and the subdivision had previously undergone a
thorough environmental review; be it therefore
RESOLVED, that the February 24, 1992 Negative Declaration is still valid.

BE IT FURTHER RESOLVED that the Southold Town Planning Board grant sketch plan
approval on the maps dated March 18, 2001.
The sketch plan has been referred to the Cutchogue Fire Department for review. The
Planning Board may require additional covenants and restrictions upon review of the
report and the final map. You will be notified if any covenants and restriction are
required.
Sketch plan approval is conditional upon submission of final maps within six months of
the date of sketch plan approval, unless an extension of time is requested by the
applicant, and granted by the Planning Board. The final maps, six (6) paper prints and
two (2) mylars, must contain a current stamp of Health Department approval and must
be submitted before a final public hearing will be set.
The Planning Board has reviewed the property and has decided that it is inadequate for
a reservation of land for park and playground use. Therefore, a cash payment in lieu of
land reservation will be required. The amount to be deposited with the Town Board
shall be $5,000 ($5,000 per vacant lot in the subdivision). Payment is required prior to
the final endorsement of the map.
