Box 1424 Mattituck, NY 11952 Re: Proposed Minor Subdivision of Ernest Schneider The parcel is located southwest of Alvah's Lane, 1347.30 feet north of Middle Road (C.R. 48) in Cutchogue SCTM#1000-95-3-10 & 101-1-14.3 Zone: A-C Dear Ms. Wickham: The following resolution was adopted at a meeting of the Southold Town Planning Board on Tuesday, October 14, 2003: WHEREAS, this proposal involves the subdividing of a 13.41 acre parcel (SCTM#1000- 101-1-14.3) into two lots, where Lot 1 equals 2.32 acres and Lot 2 equals 2.61 acres and, through a lot line modification, enlarging Lot 1 (SCTM#1000-95-3-10) from 1.11 acres to 2.32 acres; and WHEREAS, the Planning Board granted conditional sketch plan approval on April 16, 2001; and WHEREAS, on April 16, 2001 the Planning Board ruled that the Negative Declaration previously issued for the identical action was still valid; and WHEREAS, the Cutchogue Fire District is not requiring a fire well for the proposed action as stated in an August 1, 2001 letter; and WHEREAS, the Planning Board has accepted the ruling with the following condition: At the time a new residence is constructed upon Lot 3, a fire well will be required and noted as such upon the final print & mylars and, further, a Covenant and Restriction shall be filed noting this condition; and Schneider Minor Subdivision — Page Two— 10/15/03 WHEREAS, on September 28, 2001, a draft Covenant of Declarations was received by the Planning Board; and WHEREAS, on May 20, 2003, the Southold Town Board granted a waiver from the provisions of Local Law#3 of 2002 and Local Law#3 of 2003; and WHEREAS, all conditions of conditional final approval have been met; and WHEREAS, all the requirements of the Subdivision Regulations of the Town of Southold have been met; be it therefore RESOLVED, that the Southold Town Planning Board grant final approval on the maps, dated as revised September 3, 2003, and authorize the Chairman to endorse the final surveys. WHEREAS, this proposal involves the subdividing of a 13.41 acre parcel (SCTM#1000-101-1- 14.3) into two lots, where Lot 1 equals 2.32 acres and Lot 2 equals 2.61 acres and through a lot line modification, enlarging Lot 1 (SCTM#1000-95-3-10)from 1.11 acres to 2.32 acres; and WHEREAS, the Planning Board granted conditional sketch plan approval on April 16, 2001; and WHEREAS, on April 16, 2001 the Planning Board ruled that the Negative Declaration previously issued for the identical action was still valid; and WHEREAS, the Cutchogue Fire District is not requiring a fire well for the proposed action as stated in an August 1, 2001 letter; and WHEREAS, the Planning Board has accepted the ruling with the following condition: At the time a new residence is constructed upon Lot 3, a fire well will be required and noted as such upon the final print & mylars and, further, a Covenant and Restriction shall be filed noting this condition; and WHEREAS, on September 28, 2001 a draft Covenant of Declarations was received by the Planning Board; and Schneider Minor Subdivision — Page Two— 8/12/03 WHEREAS, on May 20, 2003 the Southold Town Board granted a waiver from the provisions of Local Law#3 of 2002 and Local Law#3 of 2003; therefore be it RESOLVED, that the Southold Town Planning Board grant conditional final approval on the maps, last revised March 27, 2002, subject to the following conditions. These conditions must be met within six (6) months of the resolution: 1. The Planning Board reviewed the park and playground requirement. As per Section 106-38 of the Subdivision Regulations, the amount to be deposited with the Town for park and playground services is now$5,000 per lot for each vacant lot in the subdivision. A Park,and Playground Fee of$5,000 will be required prior to any endorsement of the subdivision by the Planning Board. 2. The Suffolk County Department of Health Services approval expired on March 21, 2003. Please submit three (3) mylar maps and five (5) paper copies with an updated Suffolk County Department of Health approval stamp. 3. The filing of the Declaration of Covenants and Restrictions with the County Clerk's Office prior to any endorsement of the final plat. A notation is to be placed on the final plat that a Declaration of Covenants and Restrictions has been filed in accordance with the Planning Board's requirements. The notation is to include the liber and page number of the recorded document. 4. The referenced Suffolk County Tax Map Numbers upon the plat are incorrect. The proposed action involves the subdividing of a 13.41 acre Parcel (SCTM# 1000-101-01-14.3) into two lots and through a lot line modification, enlarging Lot 1 (SCTM# 1000-95-3-10) from 1.11 acres to 2.32 acres. Lot 1 is currently a single and separate lot and improved with a single-family residence; Proposed Lot 2 is improved with a single family residence and equals 2.61 acres and proposed Lot 3 is improved with greenhouses and equals 8.48 acres. The action would create two new residential lots. The parcel is located southwest of Alvah's Lane, 1347.30 feet north of Middle Road (C.R. 48) in Cutchogue (Exhibit 1). The property is located in the A-C (Agricultural Conservation) zoning district. On April 4, 2001 the Planning Board granted conditional sketch plan approval on the map dated March 18, 2001. The Planning Board has reviewed the progression of the application and the request for waiver for the proposed Minor Subdivision of Ernest Schneider and makes a recommendation that the Town Board grant the request of waiver for the application. This decision is based upon the following facts: Land Use —The dominant land use in the vicinity is agriculture mixed with low density residential. The area is wooded to the southwest of the subject parcel. Lot 1 is occupied by a single-family residence and several out-buildings. Lot 2 is occupied by a single-family residence and Lot 3 is occupied by a greenhouse complex. The Long Island Lighting Co. holds a Easement that transverses the northern section of the property. The parcel is in lawn with a few interspersed trees. The potential of the area to provide collective open space and/or open space easements is low. Proposed Lots 1 and 2 are developed in single family residences and therefore no opportunity exists. Lot 3 is a working agricultural facility with hard structures in place. During the application process, the visual impacts were evaluated during the SEQR review and no "significant" adverse impacts were identified. Note, however, that this region has been identified as providing significant scenic value to the Town of Southold and all efforts to minimize the interruption of the view shed should be taken. The subject parcel is zoned A-C, which requires a minimum size of 80,000 square feet per lot. The A-C zoning district is also located to the north, south and east of the parcel. Lots in the general vicinity range from 1 acre to 2.85 acres; with numerous lots over 2 acres in size. Based upon such, the proposed action would not significantly deviate from the general area land use and the parcel sizes adjacent to Alvah's Lane. Transportation Infrastructure — On February 24, 1992 the Planning Board issued a Negative Declaration pursuant to the State Environmental Quality Review Act Section Article 8, Part 617 indicating that no significant traffic impacts are expected to occur if the project is implemented as planned. Natural Resources — The parcels are in lawn with few interspersed trees. The action does not fall within the jurisdiction of the Suffolk County Planning Commission, therefore, coordination with the commission is not necessary. Water Supply—Water Supply to Lot 1, Lot 2 and Lot 3 are currently served by wells. Sanitary disposal within the proposed subdivision is managed by on-site underground sewage leaching systems Rural Character— Lots 1 and 2 are improved with single family residences. The proposed action could result in the residential development of Lot 3. The view shed could be disrupted. As mentioned above, this area is scenic and placement of a residence should be evaluated to minimize any adverse impacts to the area. Agricultural Lands — The parcel is currently located within the A-C zoning district; a designation intended to promote the preservation of agriculture soils and associated practices. Currently Lots 1 and 2 are improved and in lawn; therefore, no loss of significant agricultural use will occur. Lot 3 contains greenhouses and paved surfaces. Exclusive of the greenhouses, no land area is in agriculture use. Soil types of the parcels include Haven Loam, 0 to 2 percent slopes (HaA) - Capability Unit Ile-1 and Riverhead Sandy Loam, 3 to 8 percent slopes (RdB) - Capability Unit Ile-2 (Soil Survey of Suffolk County 1972). The soils are listed as Suffolk County Prime Farmland by the USDA Natural Resource Conservation Service. The soil types are well suited for crops. If a single family residence is constructed upon lot 3 or the greenhouse complex is expanded, prime agricultural soils will be impacted or lost dependent upon the type of structure. Open Space and Recreation Space— Due to the size, location and current use of the property, the potential to provide significant open space or recreational uses are low. Based upon the above, it is the Planning Boards' finding that although the proposed project does not fully support the planning objectives of the Town of Southold which include: The preservation of open space and recreational space; the preservation of the rural, cultural and historical character of the Hamlets and surrounding areas and the preservation of the natural environment; the size, location and current residential use of the Lots 1 and 2 limits the ability of the proposed action to fully support such objectives. Proposed Lot 3 is in active agriculture, however, due to the size and type of current operations, little opportunity exists to meet the above goals. We request a waiver from the current moratorium on subdivisions so that Mr. Schneider may proceed with his pending two lot minor subdivision and lot line change to (a) divide a 12.3 acre parcel, containing his son's residence and a 61,000 square foot greenhouse, into a 2.6 acre lot for the residence (Lot 2) and a 8.5 acre lot for the greenhouse (Lot 3), and; (b) to increase his daughter's single and separate adjoining 1.1 acre residence parcel to 2.3 acres (Lot 1). The application fee of$250.00 is enclosed. Mr. Schneider owns a 12.3 acre parcel containing both an existing residence built and occupied by his son and a large greenhouse containing the family greenhouse business (tax lot 14.3). Mr. Schneider's daughter and son-in-law, Darice and Robert Clark, own the adjoining 1.1 acre lot containing an existing residence. Mr. Schneider applied to the Planning Board for a lot line change/minor subdivision to divide his 12.3 acre parcel in a two lot subdivision containing the son's residence on one lot and the greenhouse on the second lot, and at the request of the Planning Board, to increase the size of his daughter's 1.1 acre parcel to 2.3 acres. He obtained sketch plan approval on April 16, 2001 and has Health Department approval. The subdivision would result in 3 lots, each of which are already improved with separate principal structures. If Mr. Schneider is not allowed to proceed with the subdivision because of the moratorium, he will encounter the following hardships: 1. BUSINESS LOAN COLLATERAL: The greenhouse operation on Lot 3, Schneider Greenhouses, employs 10 local people full time and requires seasonal financing to accommodate the high cash needs at the i beginning of each season pending the receipt of accounts at the end of the season. One reason for the subdivision is so that the greenhouse parcel may be used as collateral for such loans without the necessity of mortgaging his son's residence, now a part of the same parcel. Unless the subdivision, which is virtually complete, is finalized, he will not be in a position to post the greenhouse property as proper loan collateral. 2. LIABILITY ISSUES: As a commercial greenhouse operation, and given the inherently risky nature of agricultural enterprises, Mr. Schneider would like to transfer the greenhouse property into a limited liability company or corporation to limit liability in the event of a lawsuit for personal injury or otherwise. This cannot be accomplished without including his son's residence, which is unrelated to the business but would be subject to attack by creditors if the subdivision is not allowed to proceed. 3. HOME OWNERSHIP AND FINANCING: His son has contributed significantly to the cost of the construction of his residence on Lot 2,but Mr. Schneider cannot legally deed the property to him until the subdivision is complete. This prevents his son and his wife from borrowing on their residence, which is a financial hardship to them. They have also been unable to take advantage of the current low rates on mortgages. 4. ESTATE PLANNING: Mr. Schneider needs to divest himself of some of his properties for estate planning purposes and he cannot do so without the subdivision. He needs to eliminate the value of his son's residence and the extra property to be added to his daughter's residence from his estate to avoid a high estate tax bracket. We request a waiver from the current moratorium on subdivisions so that Mr. Schneider may proceed with his pending two lot minor subdivision and lot line change to (a) divide a 12.3 acre parcel, containing his son's residence and a 61,000 square foot greenhouse, into a 2.6 acre lot for the residence (Lot 2)and a 8.5 acre lot for the greenhouse(Lot 3), and; (b)to increase his daughter's single and separate adjoining 1.1 acre residence parcel to 2.3 acres (Lot 1). The application fee of$250.00 is enclosed. Mr. Schneider owns a 12.3 acre parcel containing both an existing residence built and occupied by his son and a large greenhouse containing the family greenhouse business (tax lot 14.3). Mr. Schneider's daughter and son-in-law, Darice and Robert Clark, own the adjoining 1.1 acre lot containing an existing residence. Mr. Schneider applied to the Planning Board for a lot line change/minor subdivision to divide his 12.3 acre parcel in a two lot subdivision containing the son's residence on one lot and the greenhouse on the second lot, and at the request of the Planning Board, to increase the size of his daughter's 1.1 acre parcel to 2.3 acres. He obtained sketch plan approval on April 16, 2001 and has Health Department approval. The subdivision would result in 3 lots, each of which are already improved with separate principal structures. If Mr. Schneider is not allowed to proceed with the subdivision because of the moratorium, he will encounter the following hardships: 1. BUSINESS LOAN COLLATERAL: The greenhouse operation on Lot 3, Schneider Greenhouses, employs 10 local people full time and requires seasonal financing to accommodate the high cash needs at the beginning of each season pending the receipt of accounts at the end of the season. One reason for the subdivision is so that the greenhouse parcel may be used as collateral for such loans without the necessity of mortgaging his son's residence, now a part of the same parcel. Unless the subdivision, which is virtually complete, is finalized, he will not be in a position to post the greenhouse property as proper loan collateral. 2. LIABILITY ISSUES: As a commercial greenhouse operation, and given the inherently risky nature of agricultural enterprises, Mr. Schneider would like to transfer the greenhouse property into a limited liability company or corporation to limit liability in the event of a lawsuit for personal injury or otherwise. This cannot be accomplished without including his son's residence, which is unrelated to the business but would be subject to attack by creditors if the subdivision is not allowed to proceed. 3. HOME OWNERSHIP AND FINANCING: His son has contributed significantly to the cost of the construction of his residence on Lot 2, but Mr. Schneider cannot legally deed the property to him until the subdivision is complete. This prevents his son and his wife from borrowing on their residence, which is a financial hardship to them. They have also been unable to take advantage of the current low rates on mortgages. 4. ESTATE PLANNING: Mr. Schneider needs to divest himself of some of his properties for estate planning purposes and he cannot do so without the subdivision. He needs to eliminate the value of his son's residence and the extra property to be added to his daughter's residence from his estate to avoid a high estate tax bracket. I'm here on behalf of Mr. Schneider. We would like to ask the Board to consider perhaps, to some extent, relieving him from the recommendation of the Fire Department since he is not doing what you might consider typical development. The one lot that currently exists, he is gratuitously making larger as far as the set-off part of the lot line change. The remainder of the property, as you know, already has a house on it. He would just like to give it to his son. He's not selling it; he's not making a development or making a profit. And the remaining lot, as you know, contains his greenhouse building. If your concern is with the greenhouse building, that is heated by home heating fuel. There is a propane tank there that perhaps the Fire Department was concerned about. That is strictly back-up for emergency. The main source is heat for that whole operation — heating fuel oil. There are a few chemicals stored at the property. Probably no more than you would have with a very active Southold Town Planning Board Pape Seventeen June 11, 2001 homeowner and he keeps them in a building which is vented, according to regulations. The fertilizer there, again, is a fairly restricted quantity. He has invited the Fire Department to go down and take a look if they have any concerns or recommendations. He doesn't intend to build a house at this point on that third lot. He would be willing to take whatever he gets to utilize that in terms of not having to install a fire well at this point at a fairly tremendous expense until such time that he did plan on building a house on that third lot. As you know, the properties along the west side of Alvah's Lane that were subdivided were not required to have a fire well installed. I believe there was one down at the corner of Alvah's Lane and Route 48 some time ago which is near to some of those lots but the northerly lots in that group are also quite aways away and this would gratuitously benefit them at his expense and he would just like to ask you to consider— it is a recommendation. It's not going to ...(inaudible) Mr. Orlowski: Well, when it comes to fire protection and life and safety, the Board has never over-ridden any Fire District in their recommendation. You said the Fire District could come out and take a look and maybe they could come to some agreement if they did get together and go over this. Ms. Wickham: Well, I believe ...(inaudible) asked him to do that. Obviously, he and his family work there. They are more concerned than anyone about fire protection and fire safety. If there is anything they feel is not being done properly, certainly he would be willing to correct that. He recently went through a credit review where C.O.s were required and I believe that all the C.O.s required by the Town are in place on that property. It's a glass and steel building. ...(inaudible) It's primarily not a flammable building. That's why I mentioned the heat source that they may have been concerned about. It was at one time propane. Right now, it's strictly back up. Mr. Orlowski: Did he remove the propane tank? Ms. Wickham: The propane tank is about the same size as you would find in a home heating system that is heated where you have a pool and a home heated with propane. It is not, according to Mr. Schneider, something that would be just in a very large commercial greenhouse. Mr. Schneider: I used to have four of them and I don't heat with propane any more and I just have three burners that are used for standby and that's all. If that's a problem, I can take the propane out. Mr. Orlowski: I would suggest—we can hold this and talk to the Fire District if that is their only problem and you're willing to take it out. Then maybe they won't ask for that well. Ms. Wickham: I'd like to ask you to give us time to do that. It seems like a really harsh result that might may be able to get waived without sacrificing ...(inaudible) are concerned.
