The fOllowing action was taken by the SoutholdTown Planning
Board at a regular meeting held January 9, 1979..
RESOLVEP that the Southald Town Planrilng Board override
condition #1 of the Suffolk County Planning Commission for the
map of the minor sUbdivision of Margery Burns. The condi t.1on of
the Suffolk County Planning Commission states that "No sanitary
d;Laposal :tacHi ty shall be constructed wi thin 100 feet of the
mean high water 11ne". The override is based on the following
finding of the County of Suffolk Department of Health Services.
"Based on the information submitted that i:he applications be
approved provided (a) that the two wells be located approxilllll:tely
10 feet from the common lot line and two feet from the lot lines
fronting on Cedar Beach Road; (b) that the aeWageayatem'locations
be designated by the General Engineering Unit, maintaining at
least 75 feet from surface waters. The override is also based on
the request of the Southold Town Planning Board that the number of
lots be reduced from. five to two.

Dear Muriel:
Relative to our letter of November 15, 1978, addressed
to Charles G. Lind, a copy thereof to the Planning Board, and
Mr. Lind's reply thereto to John Wickham, Chairman, dated
December 14, 1978, a copy thereof to the undersigned, we sub-
mit herewith photocopy of determination dated November 14, 1978,
made by the Suffolk County Department of Health Board of Review
relative to installation of sanitary and water facilities at the
two lot minor subdivision.
In the light of the ruling of the Board of Review of the
Health Department, we would respectfully request that the
Southold Town Planning Board override the condition numbered 1
set forth by the Suffolk County Department of Planning in their
letter to the Planning Board dated October 5, 1978. This will
eliminate the conflict that will then exist between the two
Departments and enable us to comply solely with the determina-
tion made by the Suffolk County Department of Health.

Dear Mr. Wickham:
In regard to the letter of Richard J. Cron, Attorney, dated November 15,
1978, please be advised that the staff can not waive any requirement imposed by
the Commission on a proposed subdivision.
Once the Commission has rendered its report on a proposed subdivision it
will not re-review that proposed subdivision in light of new data unless there
has been a significant change in the design of the layout, a change in the laws
pertaining to land subdivision or a change in governmental policy. If the local
planning board is of the opinion that the report of the Commission, in its entirety
or in part, is objectionable, it can override the report of the Commission by a
majority plus one. In any override it must state its reasons for doing so.

of November 13, 1978, relative to securing a modification of con-

As we indicated, the Suffolk County Department of Health and
its Board of Review have determined that it would be in the best
interest of all concerned if the proposed wells in the above minor
subdivision, consisting of two lots, were placed near the road and
the proposed cesspools within 7S-BO feet of Dryad's Basin a8 to
u;t #1 and within 75-80 feet of Canoe Inlet as to Lot #2.
The problem that has arisen is with respect to your letter
o,f October 5th where you provide as to Condition #lthefol1owing
"No sanitary disposal facility sha],l be constructed within 100 feet
of the mean high water line. It In order that the records of your
Department as well as that of the Southold Town Planning Department
conform to the Suffolk County Health Department, we would respect-
fully request: that you send a letter to the Southold Town Planning
Board with 8 copy to the undersigned indicating that you do hereby
waive the condition of #1 of your letter of October 5, 1978, so as
to comply with those imposed by the Suffolk County Health Department

Dear Mr. Wickham:
The Suffolk County Planning Commission at its regular meeting on October 4,
1978, reviewed the proposed subdivision plat entitled, "Minor Subdivision-Margery
D. Burns", referred to it pursuant to Section 1333 of the Suffolk County Charter.
After due study and deliberation it resolved to approve said map subject to the
following conditions deemed necessary to help preserve the natural and aesthetic
attributes of Canoe Inlet and Dryad's Basin:
1. No sanitary disposal facility shall be constructed within 100 feet of the
mean high water line.
2. No stormwater runoff resulting from the development and improvement of the
lots shall be permitted to discharge directly into the adjoining bodies of
water.
3. Erosion control measures shall be required during and immediately after
construction to insure that soils and other deleterious materials will not
be carried into the adjoining bodies of water.
4. No building shall be erected on either lot that will be closer than 50
feet to the mean high water line.
5. All necessary permits under the Tidal Wetlands Act, if applicable, shall
be acquired before start of any clearing or construction on either lot.
