We are in receipt of Suffolk County Department of Planning letter, dated
January 11, 1985, setting forth their disapproval of the above division
of property. My review of same finds an apparent lack of understanding
of the project on their part.
Approval of this project has been granted by New York State D.E.C.,
Suffolk Co. Health Dept., Southold Town Zoning Board of Appeals and the
Southold Town Planning Board, after careful review and consideration of
the fact that the lots created would be of insufficient area.
On the basis if the above, we respectfully request that the Southold
Town Planning Board override the decision of the Suffolk County Depart-
ment of Planning and uphold its decision of December 3, 1984, to approve
this set-off.

Dear Mr. Orlowski:
The Suffolk County Planning Commission at its regular meeting on January 9,
1985, reviewed the proposed subdivision plat entitled, "Minor Subdivision - Winds
Way Building Corp.", referred to it pursuant to Section 1333 of the Suffolk
County Charter. After due study and deliberation it resolved to disapprove said
map for the following reason.
Creation of a subdivision with substandard lots, that is, lots whose areas
are considered less than the minimum required by the zoning classification of
the property, constitutes an overintensification of land use in a groundwater
sensitive area in what is meant to be a low density area. Such action could
establish a precedence for future subdivision of this kind which would essentially
be a circumvention of the Town Board's areas. The Commission feels that the Town
Planning Board should have the prerogative to review this type of application
rather than it being left to the sole discretion of the ZoninR Board of Appeals.

NEGATIVE DECLARATION
Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review Act and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice is
hereby given that Southold Town Planning Board as lead agency for
the action described below has determined that the project will not
have a significant effect on the environment.
DESCRIPTION OF ACTION
The mi~or subdivision of Winds Way Building Corp, Map of Svante
Johnson, located at Southold is two lots on 3 acres~1000-90-3-18,
1000-92-1-1,2
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
Beacuse there has been no correspondence from the Department of
Environmental Conservation in the alotted time, it is~ssumed
that the agency has no objections or comments.
The Department 'of Health SeLvices has no objection to our designation
of lead agency. There is no record of an application to this
Department. Application on Lot No. 1, HD #t4So245. It appears
that the project can be served by Subsurface sewage disposal system
depending on subdoil conditions being adaquate. The project can
be served by an individual water supply system, however, test~ll
will bel. required d~e to marginal water supply.
The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations.

The Health Department's primary environmental concern pertaining
to development is ~hat the applicant comply with the requirements of the
Suffolk County Sanitary Code especially Article ¥ and VI, and relevant
construction standards for water supply and sanitary sewage disposal..
These considerations are to b! nreVtewed completely at the time of
application. Full constderat~o in placement of water supply wells
and disposal systems is given to state and town wetland requirements.
The Health Department maintains jurisdiction over final location of
disposal and well systems and the applicant should not undertake to
construct any water supply or disposal system without Health Department
approval.
Other portions of the Suffolk County Sanitary Code also apply to
commercial development such as Article XII. The Lead Agency is requested
to forward a copy of this form to the applicant with its findings.

Upon application for WINDSWAY BUILDING CORP., c/o Rudolph H. Bruer,
Esq., Main Road, Southold, NY for a Variance to the Zoning Ordinance,
Article III, Section lO0-31, Bulk Schedule, for approval of insufficient
area (and width) of two parcels in this proposed division of land located
along Cedar Point Drive East, Southold; Cedar Beach Park Filed Map
No. 90, Lots 82, 83, 94; County Tax Map Parcel No. 1000-90-03-18.
The board made the following findings and determination:
This]is an appeal from Article III, Section 100-31, Bulk Schedule,
of the zoning ordinance for approval of insufficient area of two parcels
in this proposed~division of land,.~Pabdel 1 of.l.7± acres and Parcel 2
of 1.3± acres. The premises in question is located at the north side
of Cedar Point Drive East, and access into Parcel 2 is shown by a
private right-of-way 20' in width, 56' feet in length from Cedar Point
Drive East. The premises in question are part of a previous subdivision
filed with the Suffolk County Clerk December 1927 as Map No. 90, and
Parcel 1 would consist of the lots referred to as "82, 83, and 84.
iParcel 2 would consist of the lots referred to as "85, 86, and 87."
-i ~ - The board members have viewed the premises in question and are
familiar with the neighborhood. It is the opinion of.the board that
the relief requested is not substantial since Parcel 1 would containi
approximatel 74,052 sq. ft., or 92.5% of the current ~equirements, and
Parcel 2 would contain approximately 56,628 sq. ft., or 70% of the
current requirements. In viewing the area, the board finds a majority
of the parcels to be of similar size and character, or smaller, than
that proposed by this application. The board agrees with the
reasoning of the applicant.
In considering this appeal, it is the opinion of the board that:
(1) by allowing the variance, no substantial detriment would be
created affecting adjoining properties; (2) that no adverse effects
will be produced on available governmental facilities of any
increased population; (3) the variance will be in harmony with
and promote the general purposes of zoning; (4) the circumstances
are unique; (5) no adverse effects will be produced on available
