Dear Mr. and Mrs. Norkus:
The following action was taken by the Southold Town Planning Board,
Monday, September 16, 1985.
RESOLVED that whereas a formal application for the approval of a
subdivision plat entitled "Robert and Aldona Norkus" located at
Southold was submitted to the Planning Board on February 22, 1983 and,
filing fee of $100 was paid on April 11, 1984, and
WHEREAS, a public hearing was held on said subdivision application
and plat at the Town Hall, Southold, New York, on August 26, 1985
at 7:45 p.m., and
WHEREAS, the requirements of the Subdivision Regulations of the
Town of Southold have been met by said subdivision plat and application,
NOW, therefore, be it RESOLVED that the application of "Robert and
Aldona Norkus" for approval of said subdivision plat prepared by
Rod Van Tuyl dated as last amended April 24, 1984 be approved
and the Chairman be authorized to endorse approval on said subdivision
plat, subject to the following conditions:
1. No lot shall be subdivided or its lot lines changed in
any manner at any future date unless authorized by the Southold
Town Planning Board.
2. No residential structure or sanitary disposal facility
shall be installed or constructed within 100 feet of the upland
edge of the tidal wetlands along the shoreline of Cedar Beach Harbor.

3. No stormwater runoff resulting from the development of
the subdivision or any of the lots shall be discharged directly
into the adjacent body of water nor the tidal wetlands bordering
that body of water.
4. A conservation or scenic easement having a minimum width
of 50' shall be established along the upland side of the tidal wetlands
along Cedar Beach Harbor to insure that nodevelopment adverse to
the aesthetic quality of the shoreline will take place along the
shoreline. A conservation or scenic easement doe not prevent future
lot owners from constructing catwalks and/or docks providing all
the necessary Town, State, and Federal approvals are obtained for
the construction.
5. Adequate road and drainage improvements shall be made in
the existing roads (paper streets, Orchard Lane, and Clearview Road)
to insure that there is adequate access to the Lots not only for
the lot owners but also for emergency and service vehicles.
6. Conditions 1-5 inclusive, shall.be filed as covenants
and restrictions in the office of the County Clerk on or prior to
the granting of approval to this subdivision.
7. Receipt of a park and playground fee, the amount of
said fee to be determined by the Town Board.
When we are in receipt of notice that the above conditions have
been met, the Chairman will endorse approval on the subdivision
map.

WHEREAS, the Declarant is the owner of certain real property
situate at Southold, Town of Southold, Suffolk County, New York,
more particularly bounded and described as set forth in Schedule

WHEREAS, the Declarant has made application to the Planning
Board of the Town of Southold for approval to subdivide the said
real property into four parcels, and
WHEREAS, for and in consideration of the granting of said
approval, the Planning Board of the Town of Southold has deemed it
to be for the best interests of the Town of Southold and the owners
and prospective owners of said parcels that the within covenants
and restrictions be imposed on said parcels, and as a condition of

Re: Access for R. & A. Norkus - Minor Subdivision at Bayview
Property now owned by others.
Comments:
I made a final inspection of the above access as follows:
The wheeled length of the road is 340 L.F.
Width will average 15 ft.
I had made checks on the bankrun base prior to today's inspection
and found it to be 6" or more. The top course of stone blend from
probings will average 2".
From observation there should not be any drainage problems.
The T turn which was made into Lot D is too short to accommmodate
a school bus but will allow the average length automobile to turn
around. The turn leg length is 28 ft. only in length.
The typical road itself is satisfactory and I recommend approval
of same.

Re: Access Road for R. & A. Norkus minor subdivision at Bayview.
Property now owned by others.
Comments:
Advised by R. Nine that he had started work on the access for the
new owners and would like an inspection before construction was
continued further. Work to date - clearing and stripping topsoil.
Topsoil about one foot in depth.
Note: This access as shown on the Van Tuyl map is in a 25 ft.
R.O.W. which is within the subdivision. Adjacent to it is another
25 ft. of R.O.W. owned by others. According to one of the new
owners, M. McDonald, who was on the site, they have legal permission
to use part of the adjacent R.O.W. for roadway purposes. The 14 ft.
road to be centered in 50 ft. of R.O.W..
The length of the access road ends 30 ft.! into frontage of Lot D
where a T turn will be constructed to permit turning of vehicles.
There may be a drainage problem at the only change in the road
alignment. From observation today there appears to be a low area
in that location. Van Tuyl should have submitted a profile as called
for in the recommendations. If any drainage installations are
found to be necessary, according to M. McDonald, they will be installed.

'!here is no existing road within the 25 ft. width R.O.W. as shown on the map.
'!he R.O.W. is wooded in part. When this access road is constructed some consideration
should be given to the intersect it makes with Orchard Lane. If the present road in
Orchard Lane is centered in its 50 ft. R.O. W., it will make a difficult turn into
the 25 ft. R.O.W.
Recollllllendations for access to lots B, C & D:
1. Clear the R.O.'N. where necessary. Remove stumps, tcpsoil and leaf mould. If
topsoil is more than 2 ft. in depth, remove for 1 ft. only.
2. Road Width to be 14 ft.
3. Replace excavation for topsoil, stump removal, etc. with a goed grade of compacted
clean fill.
4. Place a compacted 6" course of bankrun sand and gravel or equal on fue replacement
ma. terial.
5. Place a compacted 2" top course cJ: 3/8" store blend or equal.
6. Contours and field inspection indicate fairly level existing ground,am I 00 not fore-
see any drainage problems.

The following conditions apply to all permits:
A. If any of the permit conditions are unclear, the permittee shall contact
the DiviRion of Regulatory Affairs at the address and telephone noted below.
B. A copy of this permit or approval and approved project plans and supple~ent-
ary conditions shall be available at the project site whenever authorized
work is in progress.
C. The permit sign enclosed with the permit or a copy of approval letter shall
be protecteu from the weather and posted in a consptcious location at the
work site until completion of authorized work.
D. At least 48 hours prior to commencement of the project, the permittee shall
complete and return the top portion of the enclosed receipt form certifyine
that he is fully aware of and understands all provisions and conditions of
this permit. ,lithin one week of completion of the permitted ~~rk the
bottom portion of that form shall also be completed and returne~.
E. For projects involving activities to be accomplished over a period or more
than one year, the permittee shall notify the Regional Permit Administrator
in writing at least 48 hours to the commencement of resumption of work each
year.
F. If project design modifications take place after permit issuance, the
permittee shall submit the appropriate plan changes for approval by the
Regional Permit Administrator prior to undertaking any such modifications.
The permittee is advised that substantial modification may require submiss-
ion of a ne'" application for permit.
G. All necessary precautions shall be taken to preclude contamination of any
wetlands or waterway by suspended solids, sediment, fuels, solvents,
lubricants, epoxy coating, paints, concrete, leachate or any other
environmentally deleterious materials associated with the project work.
n. Any failure to comply precisely with all of the terms and conditions of this
permit, unless authorized in writing, shall be treated as a violation of
the Environmental Conservation Law.
I. The permittee is advised to obtain any permits or approvals that may be
required from the U.S. Department of A~1Y Corps of Engineers, New York
District, 26 Federal Plaza, He" York tIT 10007, (Attention Regulatory
Functions Branch), prior to commencing work authorized herein.
J. The granting of this permit does not relieve the permittee of the responsib-
ility of obtaining a grant, easement, or other necessary approval from the
Division of Land Utilization, Office of General Services, Tower Building,
Empire State Plaza, Albany, llY 12242, which may be required for any
encroachment upon State-owned lands under water.

In accordance with the provisions of Article 2, Section 220, of the Suffolk
County Sanitary Code, the determination of the Board of Review is as
follows:
Based on the information submitted, the Board will approve the request for
a waiver to allow the installation of wells less than forty (40) feet into
water. Data obtained at the hearing indicates that there is a lens of
fresh water approximately thirty (30) feet thick. Therefore, the Board
will require the wells for these four (4) lots to be twenty-five (25) feet
into water.

The Suffolk County Planning Commission at its regular meeting On June 6,
1984, reviewed the proposed subdivision plat entitled, "Minor Subdivision -
Robert and A1dona Norkus", referred to it pursuant to Section 1333 of the
Suffolk County Charter. After due study and deliberation it resolved to
approve said map subject to the following six conditions deemed necessary to
help pres~rve the natural and aesthetic attributes of the shoreline of Cedar
Beach Harbor.
1. No lot shall be subdivided or its lot lines changed in any manner at
any future date unless authorized by the Southold Town Planning Board.
2. No residential structure or sanitary disposal facility shall be in-
stalled or constructed within 100 feet of the upland edge of the
tidal wetlands along the shoreline of Cedar Beach Harbor.
3. No stormwater runoff resulting from the development of the subdivision
or any of the lots shall be discharged directly into the adjacent body
of water nor the tidal wetlands bordering that body of water.
4. A conservation or scenic easement having a minimum width of 50 feet
shall be established along the upland side of the tidal wetlands along
Cedar Beach Harbor to insure that no development adverse to the aes-
thetic quality of the shoreline will take place along the shoreline.
5. Adequate road and drainage improvements shall be made in the existing
roads (paper streets, Orchard Lane and C1earview Road) to insure that
there is adequate access to the lots not only for the lot owners but
also for emergency and service vehicles,

6. Conditions 1-5, inclusive, shall be filed as covenants and restric-
tions in the office of the County Clerk on or prior to the granting
of approval to this subdivision.
These covenants and restrictions can be modified only at the request
of the then owner of the premises with the approval of a majority
plus one of the Town Board of the Town of Southold after a public
hearing. Adjoining property owners shall be entitled to notice of
such public hearing but their consent to such modification shall not
be required.

Board to the Town Board to include this proposal for exemption from
the two-acre zoning requirements effective May 20, 1983 by Local Law
#7-1983.
5. On March 13, 1984, the Town Board granted relief from the
bulk requirements as provided in Local Law #11-1983, as to lot area,
as in effect prior to May 20, 1983.
6. On April 2, 1984, the Southold Town Planning Board reviewed
and approved the sketch map of the applicants;
7. On September 7, 1984, the Building Department issued a
Notice of Disapproval for the subject division of land since action
is required by this board under Article III, Section 100-31;
8. Article III, Section 100-31, Bulk Schedule of the Zoning
Code in effect prior to May 20, 1983 required a minimum lot width
of 150 feet.
9. The applicants are requesting a lot width of 100 feet for
each of the four proposed parcels: Parcel "A" which is shown with
an area of 48,000 sq. ft., Parcel "B" an area of 44,000 sq. ft.,
Parcel "CD an area of 45,000 sq. ft., and Parcel "D" of 54,000 sq.
ft.
In considering this appeal, the board determines: (a) that
the relief requested is not substantial, being one-third of the
requirements (in effect May 20, 1983), (b) there will be no effect
on population density thereby not effecting available governmental
facilities, (c) there will be no substantial change in the char-
acter of the neighborhood or a substantial detriment to adjoining
properties since there are lots of similar character in the
immediate vicinity, (d) that the circumstances of this appeal
are unique, (e) that there is no other method feasible to
rearrange to lot lines to try and meet the lot width requirements
other than a variance, (e) that in view of the manner in which
the difficulty arose, justice will be served by allowing the
variance applied, as noted below.
NOW, THEREFORE, on motion by Mr. Sawicki, seconded by Mr.
Grigonis, it was
RESOLVED, that the relief as requested under Appeal No. 3305
for 100-foot lot width for each of the four proposed parcels as
shown on survey amended August 8, 1984 for ROBERT G. AND ALDONA
NORKUS, BE AND HEREBY IS APPROVED SUBJECT TO THE FDLLOWING CONDITIONS:
1. There be no further lot area reductions for any parcel
(or lot line changes, redivisions);
2. All new construction must comply with all requirements
of the zoning code applicable to 40,000 sq. ft. parcels (A-40);
3. All new construction must comply with Chapter 46, "Flood
Management Law" (the minimum lowest floor elevations above mean sea

The official notice will be read by Councilman Townsend.
COUNCILMAN TOWNSEND: "Notice is hereby given that public hearings will
be held by the Town Board of the Town of Southold at the Southold Town Hall,
Main Road, Southold, New York, on the 14th day of February, 1984, on the
following petition for relief from the Bulk Requirements of the Zoning Code of
the Town of Southold, pursuant to Section 100-31A thereof: 7:50 P.M. -
petition of Robert G. Norkus and Aldona Norkus, on certain property situate
off Orchard Lane, approximately 450 feet easterly from Cedar Bezch Road, a
Bayview, Southold, New York. All persons interested in said matters shall
appear at the time and place above specified and will be given an opportunity
to be heard. Dated: January 17, 1984. Judith T. Terry, Southald Town Clerk."
We have proof of publication from The Suffolk Times and from The Long
Island Traveler-Watchman, and an affidavit from Judith Terry that the public
notice was placed on the Town Clerk's Bulletin Board. We have a notice from
the Suffolk County Department of Planning that it is a matter of local determination.
And a letter from Henry Raynor of the Southold Town Planning Board saying that
it was the concensus of the Southold Town Planning Board to grant relief under
Local Law 11.
Frank, since this is the first time we've had one, do you want to explain
the situation, what necessitates this hearing and the basic criteria.
SUPERVISOR MURPHY: What this is is people asking relief on the zoning
requirements and we will take any comments tonight and then the Board will
study this and then make a decision that if, yes, that this application does--
we want to grant relief to the people or we don't. We will study the findings
of the Planning Board and how they acted on it and see if the Town or the
Planning Board was negligent in not proceeding with this subdivision properly,

and if we feel there is any part on the Town, the Town Board will probably
grant it or deny it.
COUNCILMAN TOWNSEND: I don't think negligence. I think that there were
just so many applications at the time, the reason we did this was because we
were beseiged by applications and a lot of these had been in the hopper, so
to speak, for many months and it was the opinion of the Town Board to grant
this relief procedure so that someone who had had their application in in time
but for administrative reasons were not able to get it processed, would still
have a fair chance, and that's what we're here to determine.
SUPERV ISOR MURPHY: Now, is there anybody who would like to speak in
favor of this application?
RICHARD J. CRON, Attorney, Cutchogue: I am the attorney for Mr. and
Mrs. Norkus on this particular application. I was going to, by way of back-
ground, explain why the nature of the application, why the relief is being
granted, but since as a result of Mr. Townsend having done so, I guess it
is not really necessary to do so. Basically what we're seeking, of course,
is relief from the existing zoning ordinance, and particular the bulk require-
ments of that ordinance through the enactment of Local Law 11 which grants
relief in situations where, through no fault of the applicant, or the one who
has submitted property for subdivision, certain results failed to take place
prior to May 20th of 1983, and such is the case with the Norkus application.
By way of some background, I think I ought to indicate that what we're talking
about is a parcel of land about four and a half acres. It's situated off Bayview,
at Southold, and at the present time, as it was when the subdivision, minor
subdivision map was submitted to the Planning Board, it presently has five
so-called buildable lots for which certificates of occupancy had been issued and
are still in force and effect. Mr. Norkus started the subdivision and its approval
way back in October of 1982. Unfortunately, in order to convert the five lots
to a four lot minor subdivision he ran into some difficulty with respect to a
road which had to be abandoned. The Town Attorney's advice was solicited
by the Planning Board and, of course, his advice was accurate, that the road
had been legally abandonded before you could commence with the four lot
minor subdivision. Well. finally after the legal steps had been taken and the
road legally abandoned. the application was again resubmitted to the Planning
Board. And if my memory serves me correctly, and as stated in my factual
portion of the petition, that was on February 22, 1983. The Planning Board,
basically, between that date and May 20, 1984. the so-called "cut-off date" for
having maps approved that do not conform to the bulk law requirement two-acre
zoning, that had not unfortunately been accomplished. But the reason for it
was not the fault of the applicants. The applicant had submitted everything
and the Planning Board, basically, for whatever reason, whether it didn't get
to it, or had too many other applications. never got around to acting on that
particular application. The maps were complete, the moneys had been paid
on the application fee, and an application had been filed. It wasn't until, I
believe, June 1 of 1983 that the Planning Board then wrote to the Town Board
indicating that this was something that should basically be approved because
it would have been in the best interest of the Town and is so today, to convert
five lots into a four lot minor subdivision, all of the lots being of greater size
than they would be with a five lot minor subdivision. So. I think the record
clearly indicates that what occurred, did not occur through any fault of the

applicant, and that it truly is a type of situation that Local Law 11 is designed
to accomodate the applicant. So I would therefore respectfully request of this
Board that the relief be granted as also recommended by the Planning Board.

MRS. RUTH OLIVA, North Fork Environmental Council: I don't think there's
any question that the applicant did have his proposal in just as Mr. Cron had
said, ahead of time, and the Planning Board was just not able to get to it.
But we do want to make the Board aware that the applicant says he has 4.4
acres and if you look at the map very carefully on Lots A and B, the five foot
contour line practically bisects the first two lots in the middle, which would
cut the amount of area down considerably and there's also some wetland areas
in Lots C and D, so I just wonder if he has the 4.4 buildable lots.
SUPERVISOR MURPHY: Thank you. Anyone else like to comment at all?
MR. CRON: Just let me offer one comment in response to that remark. What
Mrs. Oliva says is true, but irrespective of the fact that the five foot contours
almost cuts off half of the lot--cuts off part of the lot, I would indicate that
you're still talking about an area between the five and ten foot contours of
somewhere around 100 by 250 feet, which is sufficient area to construct a
residence, I would think. You're not going to I)ave a full acre of buildable
land, perhaps, but you'll !lave a sufficient area in any event to build.
SUPERVISOR MURPHY: Thank you. Anyone else? Frank Bear?
MR. FRANK BEAR, Southold: I think that Mr. Cron has just made a very
important point. They do not have a full acre for all of these four lots
that are proposed. The former zoning did require one acre each. It seems
to me that's sufficient reason to deny this request.

to the proposed Norkus subdivision. The water table and the water supply is
very fragile in that area. Frequently at times we have had salt water in our
water supply and our point is over 400 feet from the nearest body of water,
which is Dryad's Basin and this is why we object to this. Thank you.

. Relief Petition
MRS. BETTY SCHLOSS, Southold: I'm also a resident in the Cedar Beach
area. I would like to refresh the Town Board's memory. It was just February
of 1980 that this property was up for another variance of a different kind that
was turned down because of the inadequate water supply. It seems to me that
it's very important that the Town Board take note of the fact that the five foot
contour line goes behind lots 35, 36, 37, and 38, and that the area is very
heavily flooded. Perhaps if you go out there tomorrow you might see the
results of two days of rain. The only buildable lots on this property are
actually from the old Cedar Beach Map, No. 47 and 48, and the property
included, well, which was one time called the General Wayne property, has
at the present time a year-around restaurant drawing on water supply needs
and sewage disposal systems and it also has an apartment upstairs, so I would
like to have the Board take that into consideration. And in effect, the Town
Board could be assisting the owner in doubling the amount of housing that
could be put on their parcels, from two, which could be placed on the back
lots, to four, which the current request is of the petition. Thank you.

The Health Department's primary environmental concern
pertaining to development is that the applicant comply with
the requirements of the Suffolk County Sanitary Code especially
Article V and VI, and relevant construction standards for
water supply and sanitary sewage disposal. These considerations
are to be reviewed completely at the time of application. Full
consideration in placement of water supply wells and disposal
systems is given to state and town wetland requirements. The
Health Department maintains jurisdiction over final location
of disposal and well systems and the applicant should not
undertake to construct any water supply or disposal system
without Health Department approval.

That on October ~~ 1983, THE TOWN BOARD OF THE
TOWN OF SOUTHOLD enacted Local Law No. 11 to provide relief in
certain ascertainable hardship situations for owners of land
who filed subdivision maps which met zoning requirements prior
to May 20, 1983, but due to circumstances beyond their control
failed to secure Planning Board approval prior to May 20, 1983.
5. That in support of the petitioners' request for
relief herein, the following facts are set forth, and where in-
dicated, documents hereto annexed and made a part hereof:
(a) petitioners are the present owners of five
(5) lots as set forth on enclosed photocopy of survey heretofore
annexed as Exhibit "A".
(b) That petitioners hold Certificates of Occupancy
for said five (5) lots, to wit: Lot 35, No. Zl0963; Lot 36,
No. Zl0962; Lots 37 and 38, No. Zl0961; Lot 47, No. Zl0965, and
Lot 48, No. Zl0964.
(c) That on October 19, 1982, petitioner wrote
to the Planning Board regarding the need to abandon a 30 foot
right of way designated as Orchard Lane which bisected the land

1. Petitioners are the fee owners of certain real
property situate off Orchard Lane, approximately 450 feet east-
erly from Cedar Beach Road, at Bayview, Town of Southold,
described on the Suffolk County Tax Map as 1000-089-3-4, 6, 8, 9,
10 and 11.
2. That on May 16, 1983, THE TOWN BOARD OF THE TOWN
OF SOUTHOLD enacted Local Law No. 7 which increased the minimum
requirements of the Bulk and Parking requirements of the Southold
Town Zoning Ordinance, effective May 20, 1983.
3. That on August 9, 1983, THE TOWN BOARD OF THE TOWN

(j) That on June 30, 1983, the Planning Board wrote
to petitioner and advised that his proposed four (4) lot minor sub-
division did not meet the 80,000 square foot requirements of the
Southold Town Zoning Ordinance, and that since sketch plan approval
had not been secured prior to May 20, 1983, the application,
attached documents and check were being returned.
6. That the facts herein stated show that the petitioners
had at all times proceeded without delay and in good faith to meet
the requirements of the Southold Town Planning Board.
7. That all requirements and necessary documents for
approval by the Planning Board of the petitioners' four (4) lot
minor subdivision had been submitted prior to March 20, 1983, and
petitioners could do nothing further except await the action of the
Planning Board on sketch plan approval.
8. That the period between February 22, 1983, and May 20,
1983, afforded the Planning Board a reasonable time and opportunity
to have acted on petitioners' application for a sketch plan approval.
9. That petitioners at all times diligently and in good
faith prosecuted their application for sketch plan approval of the
proposed four (4) lot minor subdivision, and that failure to secure
same prior to May 20, 1983, were due to circumstances beyond the
control of the petitioners.

(e) That on November 1, 1982, Town Attorney Robert
W. Tasker responded to the effect that legal proceedings for road
abandonment be commenced, after conclusion of which, the proposed
four (4) lot minor subdivision be submitted to the Planning Board.
(f) That on November 18, 1982, the Planning Board
wrote to the petitioner enclosing a copy of Mr. Tasker's letter
of November 1, 1982.
(g) That on January 28, 1983, a Certificate of
Abandonment of the 30 foot right of way described in paragraph 5
(c) of this petition was filed in the Suffolk County Clerk's
Office under Certificate No. 2364, Abstract No. 9249.
(h) That on February 22, 1983, petitioners filed
with the Planning Board an application for a minor subdivision,
with all required documents thereto annexed, and together with a
check for the filing fee in the sum of $100.00.
(i) That a review of the file of the Planning Board,
as well as the minutes of the Planning Board, indicate that no
action was taken on the petitioners' application until June 1,
1983, at which time at a meeting of the Planning Board, the
following was entered into its minutes:
"Robert Norkus - It was the consensus of the
Board that the proposed subdivision of Robert
Norkus be considered for the exemption list
regarding two acre zoning. The Board, after

Dear Henry:
You have sent me certain documents sent to you by Robert Norkus relative
to Lots 35, 36, 37, 38, 47 and 48, as shown on subdivision map of Cedar
Beach Park (Map No. 90) now owned by Norkus. Mr. Norkus has indicated
that he wishes to abandon Orchard Lane which runs between these lots and
then to divide the five lots into four lots, each to contain approximately
40,000 sq. ft. You have asked me to advise the Planning Board as to the
manner of proceeding with this request.
Section 335 of the Real Property Law provides for the filing and also the
abandonment of subdivision maps in Suffolk County. Subdivision 3 of this
section provides, in part, as follows:
". . . Whenever at least 20 years have elapsed since the filing
of said map, the owner of the property to be abandoned may,
without consent, abandon any streets or portions thereof shown
on said map and which are in the bounds of property to be aban-
doned if such streets or portions thereof are neither opened, nor
public highways, nor used by the public, nor necessary for the
use of the owners, occupants or any other persons having an
interest in any part of the subdivision;"
The letter from the American Title Company indicates that the owners of
lots to the south gain access to their lots by means of the 50 ft. right-of-
way shown on the map sent to you by Mr. Norkus. Accordingly, these
lot owners do not require the use of Orchard Lane.

In view of the foregoing, it is my opinion that Mr. Norkus can abandon Orchard
Lane pursuant to Section 335(3) of the Real Property Law.
As to procedure, I believe that Mr. Norkus should first abandon Orchard Lane
and then should submit an application to the Planning Board for the approval
of the four lots as a minor subdivision.
Access to the resulting four lots would be gained over Clear view Avenue;
thence south to the 50 ft. right-of-way; thence west to Cedar Point Drive;
thence north to South Bayview and Cedar Beach Roads, both of which are
Town highways. Access over the private roads will require approval under
Section 280(a) of the Town Law, which, as you know, requires that such
private roads be suitably improved to the satisfaction of the Planning Board
before building permits may be issued.,
It would seem that simultaneously with the filing of the application for the
minor subdivision, Mr. Norkus should also apply for approval of access to
the lots in question.
If any of the four lots do not conform to the area requirements of the Zoning
Code, then variances must be applied for and obtained by Mr. Norkus from
the Southold Town Board of Appeals. If this should be the case, then the
Planning Board approval of the minor subdivision should be subject to the
obtaining of the required variances from the Zoning Board of Appeals.

Dear Mr. Gillies:
I have reviewed the survey of Roderick Vay Tuy1, dated August
20, 1979 and we have caused an examination of title to said
premises.
As shown on said survey are two roads known as C1earview Road
and Orchard Lane. I have also noted that more than twenty
years has elapsed without said streets being used for the pur-
pose of public thoroughfares nor are said streets necessary
for means of ingress and egress for other parcels to the near-
est open public highway.
It appears to me therefore, that pursuant to section 35 sub-
division 3 of the Real Property Law, these streets can be
abandoned.
Furthermore, in Liber 5088 cp 432 and Liber 4859 cp 563 there
is a 50 foot easement of right-of-way which immediately south
of the subject premises and provides access to those lots to
the south of the premises in question.
In view of the foregoing, it is the position of this Company
that C1earview Road and Orchard Lane, to the extent that said
paper roads run through our premises, can be abandoned pursu-
ant to Section 35 Subdivision 3 of the Real Property Law. Our
Company would affirmatively insure title to that land based
upon the completion of a proper abandonment proceeding.
