When the Cranberry Acres subdivision was originally reviewed by the Planning Board, it was determined that a majority of the site was wetland area located below the 5 foot contour line. The upland area for each proposed lot was calculated and it was determined that Lot #3 contained 136,000 square feet of upland area. The property is located in the Agricultural-Conservation (A-C) Zoning District. The A-C district requires a minimum of 80,000 square feet per lot. However, wetland areas are not included in the minimum lot size. Therefore, although the area of Lot #3 is greater than that which is required by the A-C District, the lot does not contain enough upland for two lots with 80,000 square feet of upland area each. In addition, the Cranberry Acres subdivision was not designed with the intent to further subdivide any of the lots. When the subdivision received conditional approval on December 16, 1985, one of the conditions of approval was that there was to be no further subdivision of any lot in perpetuity. You will recall that this three-lot subdivision was approved at a time which the Planning Board did not require the filing of minor subdivision maps in the County Clerk's office. The subdivider, Mr. Edward R. Deutsch, has been unable to file the maps now due to the fact that the owner of the partially completed building on lot no. 3 is in serious arrears in the payment of property taxes and the map will not be accepted by the County Clerk for filing until all the taxes are paid to date. In light of the Planning Board's policy which was in existence at the time the subdivision was approved, it would appear to me that the Town must issue the building permit assuming the subject lot has received the necessary Health Department approvals. The Board went on to note that any plat not so filed or recorded within the stipulated time "shall become null and void". As you may have heard from my conversations with various Town officials, I am unable to file the surveys because the current owner of one of the lots (the fourteen acre parcel ) has not paid his real estate taxes for two years and now owes approximately $11,000. The Suffolk County Clerk won't allow me to file the surveys with back taxes owed. Neither can I purchase the tax lien. This leaves me in the "catch 22" situation of not being able to file, build upon or sell the remaining two lots I own even though my taxes are paid and up to date. My alternatives appear to be to pay my neighbor's $11,000 tax bill with no lien or certainty that I will be repaid or to simply sit and wait until his property is foreclosed or he pays his taxes. Another alternative might be to ask the Planning Board to approve the same survey already approved but with the fourteen acre lot deleted, since that parcel has already been sold and built upon. My concern is that I need some time. If the subdivision and surveys become "null and void" on August 12, 1993 (sixty days from Planning Board approval ) , do I have to start over? May I ask that you inquire of the Board as to a course of action that would be acceptable. If the Board will lift the filing deadline, it would give me some time to try and work this out. This contour appears to be a reasonable approximation of the wetland edge. The upland areas shown on Lots 3 and 4 do not equal 2 acres nor are they contiguous. It may be possible to design 3 lots with standard area and frontage, but other dimensional variances would be needed on at least two of the lots . I have met with Dr. Fink with regard to this application and we would like to propose the following to the Board. Without being redundant, the board is well aware that we have voluntarily reduced this major subdivision from seven lots to four. We, in turn, are also aware that there exists approximately twelve acres of wetlands adjacent to the existing building plots. In review of this application and in consideration of the environmental aspects -out forward at the public hearing, we would ask the board' s approval again for the four lots with additional restrictions being nlaced on the proposed subdivision; these being: 1) A common water source be created in the westerly portion of the property (please note that this is the area we pumped 3,000 gallons per hour without any change in nitrates. ) 2) From this common source we will supply, by easement or any other method amenable to the Board, the entire potable water supply for the four lots. We strongly_ feel that these additional voluntary restrictions over come all aspects of objections as aired at the public hearing and trust that the Board will feel the same. On behalf of several neighbors, particularly Mr. Robert Gazza, and Mr. & Mrs. Schloss, I would like to reiterate the concerns raised therein. I would particularly point out the problems presented by Lot Nos. 2 and 3 (shown on the latest subdivision map of which I am aware) which are created by the high ground water conditions and non- potable drinking water supply. Almost the entire area of these lots are designated as undevelopable wetlands by the DEC. Secondly, we would reiterate the Department of Health' s concern that the test hole data presented is inaccurate. To the extent that the current subdivision map is considered a sketch plan, we would object to its current delineation of lots as being incompatible with the preservation of the formerly connected tidal wetland. Southold, N.Y. 11971 December 12, 1983 Southold Town Planning Board Town Hall Southold, N.Y. 11971 Attn:Henry Raynor, Chairman Subject:Cranberry Acres at Cedar Beach, Southold Dear Mr. Raynor: We are somewhat dismayed at the fact that the Town Planning Board would give preliminary approval to a one-acre development in an area that is so environmentally fragile, laced with wetlands and probably has the most severe potable water problem in the Town of Southold. We also do not understand why this was done even though the Suffolk County Department of Health has already denied permits to Cranberry Acres on the grounds of insufficient potable water. My wife and I own two lots directly across Cedar Beach Rd. fran proposed Cranberry Acres lot numbers two, three and four. Our hone is on our easterly lot. our wells are at the top of the rise right up against the road where our two lots meet the road. (ref: attached map) These are the only usable wells we have of fair and in order to use this water it must be treated five times. The water is passed through four resin tanks to remove manganese, iron, hydrogen sulfide and tannins(brown organic matter). The fifth treat- ment is through a reverse osmosis unit to remove excess salt for drinking or cooking purposes. We have outlined the problem on the attached map. As you can see, the area in question is surrounded by salt water, tidal salt marsh and salty groundwater. It appears that the only usable fresh water(after treatment) is a small pool of water at the top of the rise which would probably be very rapidly depleted if too many hones were allowed to draw frau it. If this happened, the salt water would intrude , rendering the wells unusable. We now use this water judiciously allowing for rainfall replenishment. Cranberry Acres is proposing that the well for their lot number two be directly across the street from our wells, not very far away. They are also proposing that the well for their lot number three be close to the well for lot number two and that lot number four should share the well used for lot number three. In essence, they are proposing to put wells for three houses within a radius of about ninty feet all drawing water from this small pool of fresh water that is surrounded by salt water. This would put wells for five lots all into this single pool of water. If this source of treatable water is consumed too rapidly, where will we get our water frau? Will the town supply us with usable water? We wanted all concerned to be aware of the seriousness of the problem. In addition to the above problems, we would like to formally object to the approval of this development for the following reasons: 1- we feel that sane of the lots as shown on the proposed survey extend into the marsh. 2- Due to the fact that the wells must be near the road, we feel that the cesspools would be too close to the marsh,(which is a tidal salt marsh and not a fresh water marsh) which may cause pollution in Cedar Beach Creek. T � -`- 3- We also feel that the cluster zoning regulations are being abused in order to obtain one-acre zoning as it appears that the majority of acres to be left un- developed are unbuildable wetlands anyway. In addition, we object to the proposal to put more than one dock and catwalk across the single lot that fronts Dryads Basin. We believe the Town should maintain a policy of one dock per lot in a residential area and not allow the semblance of a marina to be built. If this policy is not maintained, creekfront property owners could sell right-of-ways to upland lot owners and blanket our creekfronts with docks. We would prefer not to see any additional docks in Dryads Basin at all as it has a very small entrance and poor water exchange. My wife and myself would also like to request to be listed as interested parties and be notified of all hearings, etc., concerning this development. We do hope we have outlined the problem clearly and would be happy to meet at the site with any parties who would care to discuss any of the above or related matters. Thank You. We see too many examples of what happens when poor zoning laws allow rampant development of homes on land which cannot support them. A recent article in the New York Times, December 18th, describes the tragedy taking place in Mastic in Suffolk County . I do not wish to see the town of Southold written-up in like manner because there were too few people who stopped to think about the dire consequences of such a development in our own town. We also do not understand why this was done even though the Suffolk County Department of Health has already denied permits to Cranberry Acres on the grounds of insufficient potable water. My wife and I own two lots directly across Cedar Beach Rd. frau proposed Cranberry Acres lot numbers two, three and four. Our home is on our easterly lot. our wells are at the top of the rise right up against the road where our two lots meet the road. (ref: attached map) These are the only usable wells we have of four and in order to use this water it must be treated five times. The water is passed through four resin tanks to remove manganese, iron, hydrogen sulfide and tannins(brown organic matter) . The fifth treat- ment is through a reverse osmosis unit to remove excess salt for drinking or cooking purposes. We have outlined the problem on the attached map. As you can see, the area in question is surrounded by salt water, tidal salt marsh and salty groundwater. It appears that the only usable fresh water(after treatment) is a small pool of water at the top of the rise which would probably be very rapidly depleted if too many hones were allowed to draw fran it. If this happened, the salt water would intrude , rendering the wells unusable. We now use this water judiciously allowing for rainfall replenishment. Cranberry Acres is proposing that the well for their lot number two be directly across the street frau our wells, not very far away. They are also proposing that the well for their lot number three be close to the well for lot number two and that lot number four should share the well used for lot number three. In essence, they are proposing to put wells for three houses within a radius of about ninty feet all drawing water frau this small pool of fresh water that is surrounded by salt water. This would put wells for five lots all into this single pool of water. If this source of treatable water is consumed too rapidly, where will we get our water from? Will the town supply us with usable water? We wanted all concerned to be aware of the seriousness of the problem. In addition to the above problems, we would like to formally object to the approval of this development for the following reasons: 1- We feel that sane of the lots as shown on the proposed survey extend into the marsh. 2- ]hue to the fact that the wells must be neer the road, we feel that the cesspools would be too close to the marsh,(which is a tidal salt marsh and not a fresh water marsh) which may cause pollution in Cedar Beach Creek. -a- 3- We also feel that the cluster zoning regulations are being abused in order to obtain one-acre zoning as it appears that the majority of acres to be left un- developed are unbuildable wetlands anyway. In addition, we object to the proposal to put more than one dock and catwalk across the single lot that fronts Dryads Basin. We believe the Town should maintain a policy of one dock per lot in a residential area and not allow the semblance of a marina to be built. If this policy is not maintained, creekfront property owners could sell right-of-ways to upland lot owners and blanket our creekfronts with docks. We would prefer not to see any additional docks in Dryads Basin at all as it has a very small entrance and poor water exchange. My wife and myself would also like to request to be listed as interested parties and be notified of all hearings, etc., concerning this development. We do hope we have outlined the problem clearly and would be happy to meet at the site with any parties who would care to discuss any of the above or related matters. Thank You. Mr. Raynor advised Mr. Schilke to address his concerns to the Southold Town Board as they are beyond Planning Board jurisdiction. It was also noted that the Planning Board will make a physical field inspection of this area prior to taking any action. Cranberry Acres - The Board reviewed the revised maps which reflect deletion of lots #8 and #9 .
