was discussed at our regular meeting of July 11, 1983 . The
following resolution was passed by our Board:
RESOLVED that the Southold Town Planning Board approve
the site plan "General Wayne Inn, Inc. for the construction_
of a greenhouse addition and alteration subject to a one
year review and an on site inspection by the Planning Board
prior to the issuance of a Certificate of Occupancy.

therefore , no variance is required to continue present use of the

The proposed 44 parking spaces are more than adequate to
accomodate seating capacity of 188 persons as required by Art . XI ,

This certification of proposed restaurant expansion is sub-

RE: General Wayne Inn Site Plan
The writer visited the premises to inspect the new
parking area involving 27 cars to be constructed on the northerly
side of current premises . The staked out area running east to
west is 140 ' long on one side, accomodating 14 vehicles and on
the other side 130' long to accomodate 13 cars. The width of the
parking area is 64 ' and thus sufficient to handle the total inven-
tory of 27 vehicles .
I was accompanied by Mr. Vincent O'Connor and Mr. Duane
Seaman, one of the principals .
In my opinion this area is proper to handle the 27 ad-
ditional vehicles .

The purpose of this memorandum is to present to the Planning Board the respectful but urgent request
of the applicants for such action at the June 20, 1983 meeting of the Planning Board as will permit,
subject to Building Inspector approval, the immediate commencement of construction of a greenhouse-
type addition to the General Wayne. Inn, the restaurant premises on Cedar Beach Road, at the end of
May View Road, Southold.
Premises History
The General Wayne Inn is known to the Planning Board. It used.to be called "Cedar Beach Inn"
and, as such, had been successfully operated as part of a large the owners of the Cedar
Beach Inn divided and sold off their property. The premises became known as the General Wayne
Inn. Over the past ten years, the Inn has been operated by a succession of owner- or lessee-managers.
All such operations failed. Today the "Inn" is really, and may be renamed, the General Wayne Res-
taurant. It is not today operated as a hotel or inn.
The New Owners_
In July, 1982, the two present owners purchased the property. One of the new .owners is Victor
Farinha, Jr. He has been, and still is, an employee and official of Peerless Photo Products, in
Shoreham. He works during the day at his position with that company. On the evenings of each
day and on the weekends he manages the Inn. The other owner is Duane A. Seaman, a resident
of Shoreham -- Mr. FaHnha resides in Flanders, Riverhead. Mr. Seaman is the owner-operator
of Seaman Bus Service which provides school bus transportation to the Shoreham School District.
Mr. Seaman succeeded his mother as owner-operator of the business, which had originally been
founded and operated by his late father. Both of these family men enjoy good reputations in their
Long Island communities. They originally met as members of Rocky Point Rotary, became friends
and more recently business partners in acquiring the Inn. The Innis operated under the corporate
name General Wayne Inn, Inc., the stock of which is owned 50 % - 50 % by Messrs. Farinho and
Seaman.
I began to represent them in August 1982 when they came to me, after their purchase, to assist them
in applying for their State Liquor Authority restaurant liquor license. The license was issued in No-
vember of last year. The owners hired an experienced French chef. Over winter weekends they
were encouraged bya modest but admiring and growing patronage.

Need for "New Image"—
Realizing that they were following a series of failed operations, the owners determined early that
they must make over the image of the establishment.
Earlier Plan for Improvement -
Delay in Obtaining Financing
--------------------
Early this year, using the services of an East Hampton architect, the owners planned the development
of a major addition to the Inn which would not only handle increased dining customers but also
the catering of functions. This improvement was in the form of a large room addition to the rear of
the Inn building. In site area, the new room would have taken the place of the former outdoor
patio which had been covered by a plastic-type roof attached to a frame. That patio cover had
been removed by the new ownersatthe outset of their management because of its badly deteriorated
condition.
When the plans for the new room had been finalized, the owners presented themselves to the bank
which had supplied the financing, over above the owners' cash investment, for their purchase of
the property. The bank assured them that the financing presented no problem. However, week after
week, and then overallsome two months went by before financing was approved, including bringing
in the Samall Business Administration at the request of the bank. Finally, approval was announced.
However, by that time, it was apparent that the substantial.structure planned could never have then
been built in time for the summer season and, indeed, would have been under construction through-
out most of the summer.
Another factor must unfortunately be mentioned at this point. As mentioned, the winter business
had indicated that the spring would bring an encouraging increase. The spring was marred by some
of the rainiest weekend weather continuously visited upon Eastern Long Island. Some 17 out of the
first 23 weekends of this year were rainy. This put a damper on the restaurant business.
Revised Plan for Greenhouse-Type Addition
In spite of the delay by the bank and in the face of the bad weather, the owners continued in their
determination to "change the image" of the General Wayne Inn. Together with their architect and
me, the owners discussed what must be done. As a result of long discussion, it was determined that
an enlargement of the premises must be accomplished, but on a more modest scale and in a form
that could be quickly built. That resulted in a plan to remove the rear walls of the dining room and
the tap room and to erect, next to the rearof the Inn, a greenhouse-type addition. The greenhouse
would be prefabricated. A concrete block wall would be built for its foundation. It could be quickly
erected on the site.
It was found necessary to pre-order the greenhouse in order that the manufacturer of it would create
it in time in its specially designed form and size to span the back of the building. It was ordered
and is to be delivered late this week.

Adding this glass walled addition and removing the present rear walls of the dining and tap rooms
would not only provide additional dining space but also would open up the scenic view down to the
water from the rear of the Inn. With such development, it can really be anticipated that the "image"
of the Inn would be changed.
Need for Immediate Commencement
of Construction to be Ready for July
-----------------------
To get the benef it of this somewhat courageous investment -- considering the unsuccessful history
of the previous operators of the Inn over the past ten or more years -- it is essential that the addition
be erected and in operation by the July 4th weekend. That objective can be accomplished from a
physical construction standpoint. Yet there must be a concurrence of regulatory approvals to obtain
the objective.
The Suffolk County ABC Board, after the above facts were presented to it, gave an expedited ap-
proval to the request for approval of the alteration of the licensed premises. The alteration involves
moving the bar from its present location within the existing tap room to a location at the rear of
the section of the greenhouse -type addition to the rear of the tap room. The application for the
alteration is now before the State Liquor Authority. The owners are advised that such approval
will be promptly issued.
The architect and I have had several contacts and carferences with the Southold Town Building In-
spector. Advised of the time urgency, he promptly gave his reactions and comments on the proposed
plans for the new construction. Every detail which he suggested has been incorporated into the
plans by the architect, The Bus Iding Inspector has assured that he will issue prompt approval. We
have agreed with him on inital construction operations and the checking by a member of the Build-
ing Department of the depth of block wall excavations.
Vital Nature of Prompt Approval
---------------------
To date, over and above their initial investment, the General Wayne Inn has meant only the putting
into the business of more and more money without yet any profits. The money has been needed to
keep the operation going pending improvements and hoped for increase in business.
The owners' business projection is that this proposed addition must be built and in operation for the
full July and August months if this restaurant is to escape the fate which marked previous operations.
This projection is objective in view of the limited capacity of the dining room and tap room, their
separation from each other, a condition which planned removals of partitions will cure, and the fact
that the badly in need of repair patio roof structure had to be removed. Not enough dining space,
without the proposed addition, is afforded for use in the active summer months to carry this restau-
rant business year round.
The Application is Meritorious
--------------------
There is no problem here of conformance to the Building Code. The plans have accorded to the Code
and meet the requirements of the Building Inspector.
In my opinion, which I respectfully submit, the appliimtion to the Planning Board meets the require-

ments of the Southold Town Code and Zoning Ordinance. The application may properly be ap-
proved by the Planning Board.
Request of the Board
The owners and I realize that this application is on at the June 20, 1983 meeting for pre-presen-
tation. However, in view of all that we have brought to the attention of the board in this memo-
randum and in view of the propriedy of the proposed construction and its plans under the Zoning
Ordinance, we respectfully ask that the Planning Board act to approve this application at its
June 20, 1983 meeting in order that the improvements can now be commenced and this business
given the opportunity to change failure into success.

Pursuant to our conversation on Wednesday, June 15th, regarding the
list of your comments mailed to my office (dated June 7th) , please be
advised of the following action:
Item #1: Estimated cost of new construction will be less than 50%

This memorandum supplements my letter and memorandum to the Planning Board dated May 26, 1983.

I reside at Wickapogue Road (P.O.Box 657), Southampton, New York. I am the attorney for Gen-
eral Wayne Inn, Inc. and for the owners of the Inn premises, Messrs. Victor Forinha, Jr. and Duane
A. Seaman.
This affidavit is made in regard to the application presented by General Wayne Inn. Inc. and the
owners to the Town of Southold Planning Board and to the Town Building Inspector for approval of
proposed construction of a greenhouse-type addition to the restaurant now being operated at the
premises. Plans for such structural alterations and reconstruction have been filed with the Board
and the Building Inspector.
Based on estimates developed in discussions with the architect on this improvement, Gabriel S. Aval-
lone, 2 Newtown Lane, East Hampton, New York 11937, and with suppliers and contractors, the
aggregate cost of the work and improvements proposed will be approximately $ 80,000.
In connection with the financing of improvements at the General Wayne Inn, the owners have been
in communication with Union Savings Bank, 625 Ocean Avenue, Patchogue, New York 11772,
and have received from the bank an appraisal made by one of its officers-appraisers, Edward J. Krug,
of the existing premises. The bank's appraisal of the building of the General Wayne Inn is $375,000,
the land $ 100,000, and the total value $ 475,000.

Honorable and dear Sirs:
My client is General Wayne, Inc., lessee and operator of the restaurant premises under the some
name on Cedar Beach Road, Southold, New York. I also represent the owners of the property,
Victor Farinha, Jr., residing at 67 Huntington Lane, Flanders, Riverhead, New York 11901, and
Duane A. Seaman, residing at 82 Route 25 A, Box 726, Shoreham, New York 11786. Messrs. Far-
inho and Seaman are the stockholders in the above restaurant corporation. The corporation and the
owners all join in the application being made by this letter and the accompanying papers.
The development proposed is to add a greenhouse type structural addition to the existing premises,
at the rear of the premrisses, together with a deck at the rear of the addition, and also to sq uare
off, by additions, the wwei`�` nd of the tap room within the premises. The accompanying memo-
randum and plans present compliance with the requirements of Southold Town Code Section 100-134
and other applicable Code provisions. Site plan approval is asked.

time. The applicants desire to move forward on the improvements in order to have the benefit of the
