The parcel, also known as the site of the former General Wayne Inn in Southold, is currently zoned half Hamlet Business (HB), due to its historic use as an inn, and half Agricultural Conservation(AC), the zoning district adjacent to the south and west. The property is no longer used as an inn, and the condition of the inn building has been allowed to deteriorate. The parcel's current zoning district, Hamlet Business, was apparently applied to this property to allow the historic use of restaurant and inn. With the historic use discontinued, the future use of the property must be considered. The Hamlet Business zone is intended for higher-intensity commercial use in the hamlet business center. This property is deeply embedded in a residential community located far from the hamlet center and any other commercial zoning. Many of the allowable uses in the Hamlet Business zone are incompatible with single family low-density residential neighborhoods. Over the years the trend has been to restrict the zoning on this property. On the original zoning map in 1957, the entire 3.4 acres was zoned `B" Business. By 1972, the zoning map shows the parcel zoned as "M-1" General Multiple Residence over only half the property, while the rest became "A" Residence (I-acre residential). This was reaffirmed in the town-wide zoning map update of 1989, when the property was zoned "HB" Hamlet Business over the portion that was formerly M-1, and A-C (Agricultural, 2-acre residential) over the remainder formerly A- Residence. Page Two — Zoning Recommendation The Town has consistently resisted further down-zoning on this property. The property was before the Town Board for a change of zone application in May 6, 1980 (see attached minutes from the public hearing) to change the "A-Residence District' on half the property to the "M-1 General Multiple Residence District', with the proposal to build a townhouse condominium project. The Town Board did not grant that zone change (the proposal included another three acres to the east). On March 9, 2006, the Zoning Board of Appeals denied area variances requested for proposed lots in a subdivision of the property, the effect of which would have been to increase the yield on the property by one lot, from three to four, and decrease the minimum lot size on in the AC district (see attached ZBA decision). The Planning Board recommends changing the zone of the entire parcel to R-80 Residential, based on the following findings: 1. The subject property is entirely surrounded by residential development and residential zoning districts. 2. The rezoning of the subject property is consistent with the zoning designation of the parcels surrounding on three sides; R-80 to the north, (80,000 s.f minimum lot size), Agricultural Conservation to the south and west (also 80,000 s.f. minimum lot size). 3. The R-80 zoning designation will result in less intense and more compatible land uses than permitted in the current Hamlet Business zoning district. The public and the community will benefit from this change of zone by eliminating the possibility of an incompatible use being introduced into the neighborhood. There will also be public benefit in the form of environmental protection. An intense use on this property could potentially have an impact on the groundwater quality, and in turn, eventually affect the nearby surface waters. Further, potential commercial uses allowed in the HB zone often involve activities viewed as nuisances in residential neighborhoods such as noise, traffic, bright lighting, and truck traffic. If the Town Board decided to rezone the property, it should have reasonable justification, as the current use conflicts with the surrounding residential uses. The Hamlet Business zone may also be the wrong zone for the property. It allows uses such as banks, movie theaters, and laundromats, which are not good uses for the property. The Resort Residential zone may more accurately represent the historical use of the property. This zone would allow bed-and-breakfast use by right, and allow restaurants by special exception. The Residential Office zone may also allow the owner to maintain the property for low-impact business use. Any residential zones would also be in character with the neighborhood. A decrease in allowable intensity may be beneficial to the Town. While reviewing subdivisions in the Bayview area, the Planning Board has received a lot of complaints about speeding on Main and North Bayview Roads. These roads are long and fairly straight, which result in the high speeds, but they also have a number of bends and slopes that have the potential to cause accidents. We would like to thank the Planning Board for requiring a fifteen foot wide evergreen buffer that will RESTORE the natural and noise barrier that Mr. Rossi had removed. In regards to this buffer we strongly urge that the Planning Board include a provision that these evergreens must have a 90% survival rate after 5 years. This will protect the neighbors from Mr. Roqsi planting the evergreens and then forgetting about maintaining them. We do not want to see brown/dead evergreens because of lack Of proper care. Our ptgve cottorna mill center around the use of the residential property Mr. Rossi has stated to a potential customer that he could accommodate 450 people in the tent, restaurant and bar. He stated that he could erect a 60 x 100 ft. tent with windowed side flaps so that you could see the grounds, a wooden floor and indoor lighting that might incluFle a chandelier. These comments by Mr. Rossi leads to the following questions and concerns: I . TENT A. Can a tent, to be used for business purposes,be put on the residential tract? We strongly feel that a business (in this case the General Wayne Inn)should not be allowed to put up a tent in a residential tract to accommodate a business. Continued use in this manner would eventually lead to a change in zoning from Residential to Business. II. PARKING A. Can an overflow of cars from a business (G.W.I J be permitted to park in a residential tract? B. Since Mr, Rossi has parking space approvals for 44 cars,where can or will he park the overflow of cars to accommodate 450 people? Ill. HEALTH ISSUES A. They are no longer issued or in effect, and those outstanding have been rescinded. This ruling was applied recently to a property I possessed and to others. As such, it should terminate the unrestricted parking of 44 cars on residential property in support of the General Wayne Inn's business activities. 1 do understand that permits for individual instances may be issued to deviate from Zoning Laws. These permissions neither change nor negate their specific provisions. These permits may apply to parking spots, tents, excessive outdoor lighting and other uses which are normally non-existent on residential properties. By issuing permits the Building Department remains in control of events, and, at its discretion, may grant or not approve an application which is submitted. This control ensures that fees are paid with each application and that there is limited use which forestalls this method of circumventing the provisions of the Zoning Laws - can you picture staging garage sales at every home in our town every weekend? Don't know if I understand the ramifications of the Board of Health's approval to allow 188 people at the General Wayne Inn's facilities. Does it override the Fire Department's limit of 156 people that may occupy the building at one time? Does it merely note that the subsurface sewage disposal system is capable of accommodating 188 people? If so, during what period of time? I have lived in my home for 15 years. During this period there was only one instance where cars were parked in the residential portion of Mr. Rossi's properties to any large degree. This occurrence took place about 13 years ago. I remember it well, because there was extensive damage inflicted to the road surface of Orchard Lane caused by school buses, trucks and car traffic. In this instance and others caused by Southold Planning Board March 24, 1999 Page Two weather and time breaking down the road, I along with others using this road have had to regrade it without any financial contributions from the General Wayne Inn's owner(s). An examination of the road which has recently been resurfaced and carefully seeded for the restoration of grass by the Suffolk County Water Authority will show extensive damage inflicted by payloaders, tractors, and trucks which were engaged in the removal of trees, shrubs and evergreens in the residential portion of Mr. Rossi's properties. I fear that on- going traffic in finding parking spots and for the activities involved in the erection of partying equipment will have a recurring detrimental effect on the road, as well. The advent of boom boxes and bass speakers has made it difficult in recent years to have an undisturbed nights sleep without being awakened by a bass speaker reverberating through the walls of the house. Even closing windows and turning on the air conditioner on summer nights does not block out the invasive frequencies of the bass speaker . We already have an increasing " noise problem in our town at the present time . Bringing an outdoor Planet Hollywood " disco atmosphere from the city to our quiet residential areas is certainly not beneficial to our residents . Operating as an inn and restaurant with soft indoor music would be more in line with prior usage . Outdoor " Dance Bands " would radically affect this area negatively, disturb the sleep of residents and possibly even affect the health of some of those who live here . The resulting noise pollution would intrude upon our property and into the privacy of our homes . One of the many blessings of living here is to be able to enjoy the peace and quiet of our rural surroundings . We are sure that many of our neighbors currently vacationing in Florida and points south will echo our feelings on this matter upon their return . Also , it was a shame to see all those large trees and the hedges removed . The chain saws were roaring for over two weeks straight and then the wood chippers for another two . Now we have to face the threat of outdoor " music " to keep us awake . We respectfully and fervently request that you would please try to do everything within your power to prevent outdoor music and the resulting noise problem that it would cause in this area .
