Dear Mr. Goehringer:
On or about February, 1987, I had occasion to advise Carmine Aliperti
that no applications would be required for the filling of a certain
parcel of the above-captioned property, which had prior to the
acquisition been used as a dumping area. Specifically, I told him that
a wetland permit would not be required in that the property had an
elevation of greater than ten (10) feet and an area of less than 15,000
square feet.
No doubt, Mr. Aliperti relied upon the truth and accuracy of the
statement made. I apologize for any inaccuracies in my instruction to
Mr. Aliperti I extend those apologies to yourself and The Town of
Southold.
To mitigate against any condition that may have been caused, the area
disturbed will be re-vegitated with appropriate planting.

Motion was made by Member Douglass , seconded by Member
Sawicki , to forward the following _response to Mr. Aliperti ,
requesting a plan showing all proposed changes (which may
or may not be .in violation and. must be further investigated
by the Building Department, etc. ) :
" . . It is our recommendation that a plan be submitted
to the Building Department showing all proposed changes or
grading plan (existing verses proposed) , together with the
areas of plantings . In this way ,_ it can be determined by
the Building Inspector whether or not any distance of land
is being proposed and advise you to proceed further ,through
our office and through the N. Y . S. D. E. C. as may be deemed
necessary.
Please furnish us with copies of your application to
the Building. Department together with the proposed grading
plan in- order that we may be kept up-to-date . . . . "

Of the Zoning Code requires a minimum lot width of 175 feet. The
percentage of relief requested in relation to this requirement
is 15% for proposed Lots 1 and 2 , and seven percent for proposed
Lot #3.
In considering this appeal , the board also finds and determines :
(a ) the character of the land .and circumstances are unique; (b)
the variance will not in turn cause a substantial effect of
increased population density or be adverse to the safety , health ,
welfare , comfort , convenience and order of the town ; (c ) the
practical difficulties are sufficient; (d) there will be
no substantial detriment to adjoining properties ;
difficulty cannot be obviated by some method feasibleeforhappel-
lant to pursue other than a variance; ( the

is not substantial ;
