When I wrote to Mr. Jacoby to confirm that both the set-off and the minor subdivision application had been dismissed without prejudice he responded that he wished only that the set-off be discontinued and that the minor continue to be processed. Therefore, please accept this request that the minor subdivision be restored as an active application. I understand that the watershed protection study for Laurel Lake is still underway and therefore, it would appear that neither the Town nor the Planning Board have been prejudiced by this error. SOUTHOlD TOWN Main Road PlANNING BOARD Southold, New York 11971 Re: Application of Daniel Jacoby Dear Chairman Orlowski: This letter is written to you in response to advice by your Department that all subdivisions in the vicinity of Laurel Lake will receive positive declarations. Initially, please note our objection to this determination as it relates to Mr. Jacoby's minor four-lot subdivision. The application, as presented, complies in all respects with your subdivision ordinance and it is therefore difficult to understand why it is not an action without significant impact under the state Environmental Quality Review Law. However, recogniz ing that your decision will not be based solely on Mr. Jacoby's application but also upon other concerns of your board, please accept this request that you consider Mr. Jacoby's request for a set-off as shown on the attached set-off map prepared by Peconic Land Surveyors dated October 27, 1988. It is respectfully requested that your Board approve the set-off while the environmental subdivision proceeds through the SEQRA process.
