POSITIVE DECLARATION
PURSUANT to Part 617 of Article 8 of the Environmental Conser-
vation Law, the Southold Town Planning Board assumes lead
agency, and, as lead agency, has determined that the proposed
actions described below may have a significant effect on the
environment and that a Draft Environmental Impact Statement
shall be prepared.

SEQRA STATUS:
Each of the individual actions around the Lake is, in
effect, an unlisted action, but t-he cumulative eifect is akin to
a Type I action.

REASONS SUPPORTING THIS DETERMINATION: �
There are three major and two minor subdivision proposals which
together encompass approximately 219 acres and 85 lots in the
vicinity of Laurel Lake; and _
There should be consideration of the potential cumulative effect
of the proposed development on the ecology of the area with
regard to the overall impacts on groundwater quality, surface
water quality, wildlife habitat, and public lands; and
The Laurel Lake area has been under study as a special
groundwater protection area by the Long Island Regional
Planzing Board' s Special Groundwater Protection Area Advisory
Council; and
The stretch of Sound Avenue between Bergen Avenue to the west
and Cox Neck Road to the east is the sole point of ingress and
egress, and none of these subdivisions has additional access to
other public roads. This stretch of road is a heavily travelled
east-west corridor and also a curving road on hilly terrain.
Its capacity to handle safely the additional volume of traffic
from the projected development should be examined.

board to dismiss Mr. Jacoby's minor subdivision application. W�en
I wrote to Mr. Jacoby to confirm that both the set-off and the
minor subdivision application had been dismissed without
prejudice he responded that he wished only that the set-off be
discontinued and that the minor continue to be processed.
Therefore, please accept this request that the minor
subdivision be restored as an active application.
I understand that the watershed protection study for Laurel
Lake is still underway and therefore, it would appear that
neither the Town nor the Planning Board have been prejudiced by
this error.

Dear Mr. Fitzgerald,
In response to your letter of December 18, 1989, the
Planning Board' s decision to require one generic environmental
impact statement was based on two factors. One was the
conclusion that the cumulative impact of several applications
necessitated the preparation of one generic impact statement as
opposed to several individual impact statements.
The second was more practical. The Board could have had
the generic impact statement prepared by an outside consultant.
It would have had to charge each applicant a proportionate share
of the cost of its preparation. Instead, the Board is allowing
the applicants, together, to prepare the document inasmuch as
some of the work has already been done by an environmental
consultant in the employ of one of the applicants.
In response to your request for the precise words in the
law that provide the basis for the Board' s decision, I regret to
inform you that it is not within the Planning Board' s function
to interpret the statutory authority for its environmental
review and all the associated case law on your behalf. It is
suggested that you direct your legal questions to an attorney
who is knowledgeable in matters involving environmental law.

In reply to your inquiry on the status of the Laurel Lake
area, I am happy to report that approximately three weeks ago we
issued purchase orders to two appraisers and the appraiser's
efforts are now under way. Unfortunately, we were delayed due to
the problem of locating appraisers who didn' �-iiava u ..•ested
interest in the vicinity. I have directed our personnel who work
with the appraisers to determine their progress and I should have
an estimated time of completion later this week.
I am also happy to report that our activities to determine
water quality and quantity at the Mill Lane site is moving
forward. Our driller started boring activities on October 30,
and within two weeks we should have a drilling log that would
indicate formation characteristics . At that time, we will select
various well depths for test pumping to determine quality and
quantity.
Representatives from our Watershed Oversight Protection area
and I are meeting some of your technical people on Wednesday,
November 8 , 1989. At that time, I wiil provide an update on
Laurel Lake area.

State Regulations offer the applicant the option of preparing

REASONS SUPPORTING TH25 DETERMINATION:
There are three major and two minor subdivision proposals which
together encompass approximately 219 acres and 85 lots in the
vicinity of Laurel Lake; and _
There should be consideration of the potential cumulative effect
of the proposed development on the ecology of the area with
regard to the overall impacts on groundwater quality, surface
water quality, wildlife habitat, and public lands; and
The Laurel Lake area has been under study as a special
groundwater protection area by the Long Island Regional
Planning Board' s Special Groundwater Protection Area Advisory
Council; and
The stretch of Sound Avenue between Bergen Avenue to the west
and Cox Neck Road to the east is the sole point of ingress and
egress, and none of these subdivisions has add.itional access to
other public roads. This stretch of road is a heavily travelled
east-west corridor and also a curving road on hilly terrain.
' Its capacity to handle safely the additional volume of traffic
from the projected development should be examined.

Dear Mr . Orlowski :
Mr . Jacoby is the owner of 10 . 5-acres of land with 200 ' front-
age on Laurel Lake. A small and very basic home, a remnant of
the children' s camp which formerly occupied the site, is the
only dwelling on the property. Mr. & Mrs. Jacoby are very anx-
ious to build a new home for their personal use on the prop-
erty.
The appropriate applications have been submitted, discussed a
number of times with the Planning Board, changed, resubmit-
ted, and so on. It was finally decided to set off the property
upon which the existing structure is located, leaving approxi-
mately 8 . 5 acres for the construction of the new home.
Several discussions recently with Melissa have yielded the
information that the coincidental application for major sub-
divisions by other property owners in the area has or may
result in significant delays in the consideration by the
Planning Board of the Jacoby application.
We understand, of course, the need of the Board to view the
overall picture and the impact upon both the community and the
environment of all of the proposed development , but on the
other hand we feel that it may be years before all the details
of several major subdivisions can be worked out . The construc-
tion of single residence by the Jacobys will probably have
very little incremental impact on either the community or the
environment .
We ask, therefore, that the Planning Board proceed with the
consideration of the Jacoby application on its own merits and
a subsidiary ot

The Suffolk County Department of Health Service (SCDHS) has reviewed the
above-referenced proposals. We have no objection to Town's designation as lead
agency.
Based on our preliminary review, we strongly believe that the potential for project-
spec'rfic and cumulative negative environmental impacts is significant.
Specifically, we believe that independently, the proposed actions pose potential
significant impacts on groundwater, surtace water, freshwater wetlands, wildlife habitat,
and public lands resources within a similar geographical area.
In addition, the close proximity of these proposals and their collective location
within a designated Special Groundwater Protection Area (SGPA), supports a

comprehensive assessment of short- and long-term cumulative impacts on the Laurel
Lake area.
As a result, we recommend that the above-mentioned proposals (and others which
may be proposed in their vicinity) be reviewed collectively through a Generic
Environmental Impact Statement (GEIS).
We believe the need for a Laurel Lake GEIS is well supported by the implementing
rules and regulatfons for the State Environmental Quality Review Act (SEGIRA) which
state in pertinent part that:
"A Generic EIS may be used to assess the environmental effects of :
(1) a number of separate actions in a given geographic area which, ff considered
singly may have only minor effects, but if considered together may have �
sign'rficant effects; or ....
(3) separate actions having generic or common impacts..." [NYCRR: Part 617.15
(a)]
The GEIS can provide govemmerrt agencies and the general public with an
accurate impact assessment of the overall development of this area, and iderrtify
mitigation measures necessary to minimize potential impacts to the eMire affected area
(not simply individual sRe specific measures).
Also, we are confident that a GEIS for the entire 211-acre (approximate)
development area will reduce duplication of efforts by the applicants and involved
agencies, which may well occur in the event of independent, segmented reviews of
each application.
Finally, we believe the most valuable function of a GEIS for the Laurel Lake area
would be its identHicatfon and discussion of design altematives. Responaibly
undertaken, this part of the document would provide a detailed assessment of
altematives and proJect designs and comprehensive planning strategies [i.e., transfer of

development rights (TDR), clustering, partiaUtotal acquisition, etc.] intended to minfmize
potential negative impacts on the overall study area.

FOR

LAUREL LAKE GEIS
I. DescMtion of the Pr000sed Actions:
A. Location
The document should contain detailed design drawings and include Suffolk
County Tax Map numbers for the overall project sites.
B. Sanitary Code Compliance
1. The SCDHS maintains jurisdiction over the final location ot water supply and
sanitary sewage disposal systems. We recommend, therefore, that the
document provide a detailed discussion of the regulations and compliance
requiremeMs of our agency as they apply to the proposed development and the
potential altematives to the proposed actions.
In addition, the document should outline the Article VI application status of the
proposed projects, and explain proposed methods of compliance wkh the
appropriate requirements of the Suffolk County Sanitary Code (SCSC). General
statements regarding the applicants' intentions to comply with all appropriate
SCDHS standards should not be considered sufficierrt detail for this portion of
the document.
2. If the applicants have not yet submitted applications for realty subdivision
approval to our agency, applications should be submitted at the earliest possible
date so our staff may provide technical comments.

C. Water Supply
The document should discuss in detail sufficient for technical assessment, the
water supply requirements for the proposed actions and should demonstrate
water supply availability.
D. Wetlands Delineation
Wetlands and water bodies must be represented accurately on property surveys
and site plans submitted to our agency for review. Proposals wRh inaccurate
information regarding wetlands and surface waters cannot be evaluated for yield,
equivalent density, or proper locations of sewage disposal systems or water
supply facilRies.
II. Environmental Settina
A. Groundwater Gluality
1. We are concerned about potential groundwater quality impacts associated with
the overall development of the study area, especially with respect to poteMial
impacts on wetlands and surface waters. We recommend that the GEIS
evaluate potential groundwater impacts in the study area wRh specific atteMion �
to the potential impacts on Laurel Lake and its associated freshwater wetlands.
2. The entire GEIS study area is located within one of the Special Groundwater
Protection Areas (SGPA) designated by the Long Island Regional Planning
Board (LIRPB).
The LIRPB has made substantive general recommendations regarding zoning
and land use, aimed at protecting these area's groundwater resources.
We encourage the Town to require discussion of the LIRPB's recommendations
for these designated areas relative to the proposed actions and alternatives
being evaluated in the GEIS.
B. Wildlife Habitat Identification and Protection
1. The document should provide a detailed assessment of the study area's
terrestrial and aquatic ecosystems. This section of the study should provide a

detailed cover map of the study area and include the resuRs of an on-site
species inventory. (The document should not contain merely a predetermined
list of probable species found in habitats similar to the subject study area.)
In addition, the dates of all field studies and qualifications of the individual(s)
conducting the investigations should be included in the document for review.
2. The document should identify potential short- and long-term impacts to wildlife
species and habitat as a result of the proposed actions. Information pertaining
to rare and endangered species, habitat fragmentation, area-sensitive species,
and loss of indigenous natural communities is important to this discussion.
3. The document should evaluate (in detail sufficient for comparative assessment)
project design alternatives which maximize protection of corrtiguous natural
areas and provide for the highest diversiry of natural habitat types. We are
especially concerned about the full protection of any areas providing habitat for
rare and endangered species.
4. Sources of information pertaining to rare, threatened and endangered species
should be stated in the GEIS.
We recommend the discussion be supplemented with information obtained from
the regional office of NYSDEC and the New York State Natural Heritage Program.

C. New York State Requlations and Requirements
1. Development of parcels within the study area will be subject to regulation and
review by the New York State Department of Environmental Conservation
(NYSDEC), pursuant to Article 24 Freshwater Wetlands Act of the New York
State Environmental Conservation Law.

The GEIS should outline the regulatory requiremeMs of the State pursuant to the
above legislation and discuss how the proposed projects affected by this
regulation will satisfy State permitting standards and policies.
2. The document should provide a detailed base map of the study area which
includes NYSDEC-approved wetland delineations, and regulatory limits.
D. Imnacts on Public Lands and Historic Resources
1. The GEIS study area should include discussion of public lands of the NYDSEC
and Camp Malloy. We are especially concerned about potential development
impacts to the NYSDEC preserve property, and fishing opportunities on Laurel
Lake.
2. Also, we are concerned about any potential impacts on historic resources as a
result of proposed development projects. We recommend, therefore, that the
GEIS include historic resources data for this area and a historical and
archeological impact analysis for any of the proposed projects which may be
neceasary.
E. Akematives
The GEIS should provide appropriate design altematives with site plans which
are suitable for comparative assessment.
We recommend that altemative designs seek to maximize protection of the study
area's natural habitats, freshwater wetlands, and water resources
comprehensively, and be presented in an objective manner. Altematives which
unquestionably have greater impacts than the desired actions are inappropriate.

WHEREAS, the stretch of Sound Avenue between Bergen Avenue to
the west and Cox Neck Road to the east is the sole point of
access and exit for four major and one minor subdivision
proposal which in total encompass 210. 96 acres and 84 Lots; and
WHEREAS, none of these subdivisions have ready access to other
public roads for additional access; and
WHEREAS, this stretch of road is a winding, and curving road on
hilly terrain, its capacity to handle safely the additional
volume of traffic from the projected development is in question;
and
WHEREAS, this stretch of road is a heavily travelled east-west
corridor; and
WHEREAS, these particular applications are in the vicinity of
Laurel Lake, there should be consideration of the potential
cumulative impact of the proposed development on the area with
regard to potential stormwater runoff, septic system leaching,
qroundwater quality and loss of habitat; and
WAEREAS, the applications lie adjacent. to or within, whether
nwholly or in part, the Core Watershed Protection Area which has
been designated by the Town Board (January 19, 1988) as a study
area; and
WHEREAS, the Southold Town Water Advisory Committee has been
reviewing land use management practices in this area, and the
Core Watershed Protection Area has also been included as a
special groundwater protection area by the LIRPB'S Special
Groundwater Protection Area Advisory Council; and
wHEREAS, these individual actions around the Lake are in
effect, unlisted actions, the cumulative effect is akin to a
Type I action, and
THEREFORE, BE IT RESOLVED that The Southold Planning Board
hereby assumes lead agency status in the review of the following

' The Planning Board conducted a field inspection of the
above mentioned subdivision to inspect the entrance to the
property. The Planning Board is in agreement with the entrance
as it has been staked.
The Planning Board would also like to see revised maps
showing a road terminating with a cul-de-sac to allow access to
the four ( 4) lots. This road should terminate near the middle of
the parcel, it is not necessary for it to extend to the southern
boundary of the property. The radius of the cul-de-sac should be
at least fifty ( 50) feet (with a diameter of 100' ) .

At the time that I responded to Mr. Jacoby' s intial request
of February 1988, it appeared that his property might lie
entirely within the proposed Core Watershed Area. (See enclosed

It is possible that just the upper portion of the property
may be within the Core Watershed Area. However, it is premature
to make any assumptions because a definitive map has not been
prepared or adopted and a program has yet to be developed and
presented to the Town Board by the Water Advisory Committee. Any

Mr. Orlowski: Does the Board have any comment at this point in
time?
Mr. Mullen: I concur with your statement, I would like to see
the sewer and water situation.
Mr. Orlowski: Mr. Raynor is also asking, if they do provide the
sewer and water, will this alternative be suitable to this Board
at this point.
Mr. Mullen: I would have to give it consideration at that time.
Mr. Ward: I see where the applicant is headed. I think that we
should get back to you on that.
Mr. Raynor: Alright, because if it is not a viable alternative,
quite honestly it is a very . . .hardship to proceed and not to
follow as the zoning exist on this piece of property.
Mr. Orlowski: It' s a good question.

note states, and I quote "Must be presented on or before no

Mr. Ehlers: Good Evening, my name is Richard Ehlers, law offices
at the corner of Lincoln and Griffing Avenue in Riverhead. May I C '
hand out the exhibit for the Board' s consideration? Calculation
of the tax map and the surrounding parcels. Mr. Jacoby is the
owner of a 10 plus or minus acre parcel, which appears on your
map as lot number five off Laurel Lake. That is at the end of -
the Horton Subdivision. What causes Mr. Jacoby to be before your
Board, is that in 1986 Mr. Jacoby and Mr. Horton came before
your Board for a minor subdivision on his greenhouse property.
Mr. Jacoby had a right-of-way over the Horton property which was
not in a location that this Board felt that the permanent
right-of-way should be to Mr. Jacoby' s property. After lengthy
discussions between myself and Gail Wickham on behalf of the
Horton's, it was agreed that the right-of-way that Jacoby had be
moved and certain parcels of land would be transferred to
straighten out a boundary line dispute between the two parties.
The Jacoby house is part of the old Camp Maloy structures that
were there many years ago. The house is basically small, cramped
and not very comfortable. Mr. Jacoby is an older man, retired
and his wife frankly has said if you don't get me a better
house to live in I am not going to come out here any more. As a
result of the negotiations with the Hortons the question came up
what can we do if anything to put a better residence on this
site? Originally we were going to come in for a set off, but it
was my advice to them since they were concurring the fees of the
survey and the appearances to the Board that they go for a minor
subdivision because the are elderly people and that will assist �
them with their estate plan. Your Board has made a field
inspection and as a result recommended that the right-of-way be
continued through the property to the southerly side of the
Jacoby property. And it is that question that i put before your
Board. In the Horton agreement which I believe that was reviewed
by the Town Attorney and approved by your Board, although I
don' t have any proof of that;•it specifically states that we may
not give access to the lots to the south of us over the
right-of-way that we have previously enjoyed. So the amended
right-of-way as approved by your Board limited our ability to
give any access to the Hortons to the south. Secondly, I drove
down there this evening and the Hortons yet to develop the
right-of-way in any way. It is still a dirt road. I have a pick
up truck. It was a fairly bumpy road to the Jacoby house.
Evidently the Hortons have been able to build houses down there,
without benefit of improving the driveway. The Jacoby' s are not
desirous in having this become a north-south thoroughfare. I
don' t think your Board wants to turn the meandering lane near •
the lake into a north south road at that location. It is hilly
and bumpy and it curves a lot. So we would like you to rescind
your earlier recommendation that requests the right-of-way .
through the property and the building of the cul-de-sac at the
southerly end of the property. That is basically my purpose of
being here to try and have some dialogue with the Board on the
advisability on that cul-de-sac. Then to hopefully to submit �
such further map as you direct us to submit.
Mr. orlowski: Well, our concern is with the property to the
south and what is going to happen with it some day.

� Mr. Ehlers: Respectfully, the property to the south has quite
large access on State Road 25. It would seem to not be the most
logical position to bring the traffic way down from Sound Avenue
and possible impact the lake front with passerbys and
unnecessary traffic. When the parcel to the south appears to
have seven hundred odd feet of road frontage on State Route 25 -
and fully capable of supporting its own road access.
Mr. Orlowski: Well, this will also act as a second ingress and
egress to that parcel. What is the Board' s comment on this?
Mr. Ward: That was our main concern was that there was no other
way in and out of that. As if and when the Horton parcel is
developed with more houses we really have pretty much a long
dead end roadway.
Mr. Ehlers: Maybe my client misunderstood the Horton
application. He understood that that was the end of the Horton
development. Is there a different subdivision pending before
this Board with Horton?
Mr. Orlowski: We don' t know which one is pending with Horton
right now. What we are concerned with now is just your
application and when we are going to put the right-of-way and
where we are going to let it extend to.
� Mr. Ehlers: The Horton right-of-way moved the right-of-way to
the west. The Jacoby property has a dell, I guess you would call
it, in that area. It doesn't seem to be the best place to build
an extensive road just on the whim that something may happen in
the future. so that is another argument we have against it. We
would really hate to see a major north south road. You have old
Aldrich' s lane just to the west there which the Town can choose
to approve as it desires.
Mr. Orlowski:Any chance of getting that proposed2 Ingress
staked, so the Board can take a look at exactly where it comes
from.
Mr. Ehlers: That will be something we can do.
Mr. Orlowski: What do you think?
Mr. Ward: We could take another look at it.
Mr. Ehlers: Would like us to stake were Horton' s properties
easement has relocated to the Right-of-Way entrance to the
Jacoby parcel.
Mr. orlowski: Yes, and on your survey. I think we have a
discrepancy just looking at it from the field. We can' t really
� tell. It will give us a better idea to see how it lines up. ,
Mr. Ehlers: How should I arrange that?
Mr. Orlowski: As soon as it is staked give us a call and we will
take a look at it.

Dear Board Members :
Please accept this letter in response to your Board ' s
request that a 50 foot wide right-of-way be extended to the
southerly boundary line with a temporary cul-de-sac .
The Jacoby minor subdivision is at the southerly end of
the Horton subdivision which is pending before your board at
this time . Mr . Horton negotiated an amendment to Jacoby ' s
existing right-of-way through the Horton subdivision in order
to meet the concerns of your board . This agreement was , I
believe, revieaed by the board and approved .
Pursuant to paragraph 10 of the Horton/Jacoby agreement ,
"Jacoby agrees , for himself, his heirs ,
successors and assigns, not to permit access
from his premises described on Schedule B
to Route 25 , so as to suffer , permit or
allow through traffic from Sound Avenue
to Route 25 . "
Therefore, it is respectfully requested that the Board
reconsider its prior recommendation for access across Jacoby' s
property to the south . In addition to the impediment found
in the previously approved Horton right-of-way, it is submitted
that a north/south road between Route 25 and Sound Avenue through
the Jacoby and Horton subdivision does nbt make good sense .
In order that this matter may be resolved as expeditiously
as possible , it is requested that the Jacoby subdivision be

conveys to Jacoby, his heirs, successors and assigns, a 16 foot right of way
situated within the 50-foot wide strip of land described in Schedule D,

of way within the parcel described in Schedule D shall be detex�ninad by
peconi,c, and may be changed within said 50 foot strip upon relocation of the
roadway in the condition required by this agrearent.
3. The right of way as described in Schedule D shall be for
ingress and egress and for telephone and electric services to lands of Jacoby
described in Schedule B.
4. Peconic agrees to be fully responsible for relocating the right
of way and i�roving the ro�clway witl�in such right of way to specifications
of the Southold Taan Planning Board in connection with their approval of a
minor sulxiivision of the Peconic parcel, and to cut a driveway with 6-inch

I understand that a question has arisen concerning the
northerly boundary of Mr. Jacoby's property. Please accept
this letter as an explanation.
The property to the north of Mr. Jacoby is owned by Mr.
Horton who has had a subdivision pending for some time with your
board. I understand that one of the issues to be addressed
by Mr. Horton is the relocation of the right-of-way serving Mr.
Jacoby 's property. An agreement was reached some time aqo and
I believe a copy has already been filed with your board. Part
of the agreement settling the relocation of the right-of-way
settled the boundary line dispute. The deeds to accomplish
this transfer have been executed and should be with the County
Clerk for recording. Once the County notes the recording, the
Real Property Tax Service will amend the tax map.
Please accept this request that your board review Mr.
