The following resolution was adopted by the Southold Town Planning Board at a
meeting held on Monday, June 14, 1999:
WHEREAS, on April 5, 1999, the Planning Board granted conditional final
approval to the Akscin/Hohl Lot Line Change, final surveys dated April 7, 1998,
and last amended on March 24, 1999, subject to the filing of new deeds
reflecting the lot line change for each parcel; and
WHEREAS, the deeds were submitted on June 1, 1999 and each deed
contained a notation that the area involved in the lot line change would be added
to and merged with the adjoining applicable parcel; and
WHEREAS, on June 11, 1999, the Planning Board received a memo from Scott
Russell, Chairman of the Board of Assessors, noting that the two pieces of
property outlined in the deeds (each 2,194 square feet in area) would be
merged with the applicable adjacent parcel as required by the Planning Board's
condition of approval; and
WHEREAS; the deeds, together with the memorandum from Scott Russell, fulfill
the condition of approval; be it therefore
RESOLVED that Southold Town Planning Board authorize the Chairman to
endorse the final surveys last dated March 24, 1999.

Dear Mr. Lark:
The following resolutions took place at a meeting of the Southold Town Planning
Board on Monday, April 5, 1999:
BE IT RESOLVED that the Southold Town Planning Board, acting under the
State Environmental Quality Review Act, do an uncoordinated review of this
unlisted action. The Planning Board establishes itself as lead agency, and as
lead agency makes a determination of non-significance, and grants a Negative
Declaration.
The final public hearing, which was held at 7:55 p.m. was closed.
The following resolution was adopted:
WHEREAS, Kenneth and Carol Hohl are the owners of the property known and
designated as SCTM# 1000-88-2-16 and Raymond J. Akscin is the owner of the
property known and designated as SCTM# 1000-88-2-17, located on the
north side of Main Bayview in Southold; and
WHEREAS, this proposed lot line change is to subtract 2,200 square feet from
the Akscin parcel and add it to the Hohl parcel; and to subtract 2,200 square
feet from the Hohl parcel and add it to the Akscin parcel; and

WHEREAS, the Southold Town Planning Board, pursuant to the State
Environmental Quality Review Act, (Article 8), Part 61?, declared itself lead
agency and issued a Negative Declaration on April 5, 1999; and
WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice
of Public Hearing, has received affidavits that the applicant has complied with
the notification provisions; and
WHEREAS, a final public hearing was closed on said subdivision application at
the Town Hall, Southold, New York on April 5, 1999; and
WHEREAS, all the requirements of the Subdivision Regulations of the Town of
Southold have been met; be it therefore
RESOLVED, that the Southold Town Planning Board grant conditional final
approval on the surveys dated April?, 1998, and last amended on March 24,
1999 and authorize the Chairman to endorse the final surveys subject to
fulfillment of the following condition. The condition must be met within six (6)
months of the date of this resolution:
1. New deeds reflecting the lot line change must be filed for each parcel.
Copies of the recorded deed must be submitted to this office.

Gentlemen:
We are the owners of property at Main Bayview Road,
Southold, New York (SCTM#1000-88-2-16). We have owned this
property since January 29, 1985. We request the Planning Board
approve the lot line change as applied for by Raymond Jay Akscin
for the reason that we will be able to have a driveway on our own
premises. At present, we have to use Mr. Akscin's driveway from
Main Bayview Road. By the Planning Board granting the lot line
change the driveway will then be on our own premises and Mr.
Akscin will locate a driveway further to the west on his
property.
In addition, the lot line change allows Mr. Akscin to have a
larger yard area between his building and my house in which area
the buffer plants can be maintained on his property.
Upon approval by the Southold Town Planning Board of this
lot line change, we will merge this 2200 sq. ft. Parcel with our
existing property so it will consist of one parcel of land.

Gentlemen:
I am the owner of property at Main Bayview Road, Southold,
New York (SCTM#1000-88-2-17). I have been personally in title
since May 2, 1996. Prior to that my family has owned the property
since 1961.
Along the mutual property line were several very large, old,
diseased and dead trees which required removal. These trees were
on the boundary line because originally the parcel owned by
Kenneth L. Hohl and Carol M. Hohl was owned by my father and
mother. After removal of the diseased and dead trees, it became
necessary to plant a landscape buffer which was accomplished.
Mr. and Mrs. Hohl wanted me to deed the 2200 sq. ft. parcel
on his west border between the existing hedge line and his
property line so that the driveway he used would be on his
property. In exchange, he agreed to deed me a 2200 sq. ft.
parcel in the area where the trees were removed. I agreed to all
of the above and explained it would be necessary to acquire a lot
line change, which I agreed to pursue.
Upon approval by the Southold Town Planning Board of this
lot line change, I will merge this 2200 sq. ft. parcel with my
existing property so it will consist of one parcel of land.

Dear Ms. Spiro:
In response to your letter of February 1, 1999 in connection
with the above captioned matter, I am providing you the following
information to correspond with the numbers in your letter.
)
1. It is my understanding Mr. Akscin has appeared before
the Planning Board and has resolved the concerns of the Board
regarding the shape of the lots.
2. Enclosed is the amended survey of John C. Ehlers
correcting the solid versus the dotted lines.
3. The deeds which you refer to in paragraph 3 of your
letter are the ones under which Mr. Akscin and Mr. and Mrs. Hohl
own their respective properties. You were quite correct in
indicating that the Akscin deeds (Liber 11772 pg. 574 and Liber
11772 pg. 576) include land to the east which is not shown on the
lot line proposal. It is not shown in this application for two
reasons:
First, this "other land" has nothing to do with the
application. The deed into Kenneth L. Hohl and Carol M. Hohl
(Liber 9728 Pg. 285) is correct and shows their easterly boundary
line of South 30 degrees 36 minutes 10 seconds West 167.49 feet.
Second, the survey of John C. Ehlers which shows the easterly
line of Mr. Akscin's property as South 30 degrees 36 minutes 10
seconds West 395.13 feet and the southerly line in this area
North 69 degrees 26 minutes 50 seconds West 470.88 feet is also
shown on Suffolk County Tax Map 1000-088-2-17. This portion of
Mr. Akscin's property he has clear title.

Unfortunately, the property to the east and south of these
lines he does not have clear title. That property is also shown
on Suffolk County Tax Map 1000-089-1-1 and is assessed to Rudolph
and Florence DeHaan courtesy of Mr. Jack Sherwood, a former
employee of the Town of Southold. The title to this particular
area of Mr. Akscin's parcel which contains 4.212 acres is in
dispute with Florence DeHaan. This property is also shown
on the Map of Cedar Beach Park, Map No. 90 as "Park & Play-
ground". This portion of Mr. Akscin's property has been subject
to past litigation in the Supreme Court of Suffolk County in the
matter of Raymond J. Akscin and Geraldine Akscin v. Rudolph J.
Dehaan and Florence DeHaan, Index No. 90-01759. Unfortunately,
this matter as to the title to the property has not been resolved
as of this date. Therefore it would have been disingenuous on
Mr. Akscin's part to include this property in the application,
even though the deed from his parents reflects otherwise.
I am hoping this satisfies your inquiries, however if you
have any other questions, you can verify the above by either
contacting Mr. Sherwood or Florence DeHaan.

Dear Mr. Lark:
The Planning Board reviewed the above mentioned proposal at a work
session. Please find the Board's comments below:
1. The Planning Board is in favor of the concept of the lot line
proposal. However, the Board is not in favor of the irregular shape
of the proposed new lot lines, and would like the new lot to remain
rectangular in shape.
2. The survey submitted for the proposed lot line change shows the
proposed property line as a dotted line and the existing property
line as a solid line. The Lot Line requirements call for the proposed
property line to be shown as a solid line and the existing property
line to be shown as a dotted line.
3. Three deeds (Liber 11772 Page 574, Liber 11772 Page 576, Liber 9728
Page 285) where submitted with the application materials. It appears
that the deeds include the land to the east (shown as now or
formerly Raymond Akscin & Rudolph Dehaan) which is not shown as
part of the Lot Line proposal.
The above mentioned items must be addressed before the Planning Board
can proceed with the Lot Line proposal.
