Gentlemen:
Your letter of September 24, 1971, in regard to the above
captioned matter, was received by the Planning Board at their
regular meeting held on October 5, 1971, please be advised of
the followings
In view of the fact that the Trustees and the Town Board
required Mr. Victoria to bring back the shoreline to an agreed
upon position, this would remove any restrictions we mi~]t have
on this particular piece of property. However, that parcel of
the Victoria property on the easterly side and northerly end,
shown as the boat basin, has not been corrected. Therefore, in
our opinion, it still merits prohibition of development of any
kind until the condition of our letter of May 12, 1966 is
corrected.

Dear Mr. Wick-ham:
I have been informed by Mr. Terry that you expected us to attend
a meeting of the Planning Board two weeks ago. Unfortunately, Mr. Terry
indicated that our site plan would be reconsidered at that meeting, but
did not make it clear to me that our attendance would be required. I,
therefore, apologize for any inconvenience that our absence may have caused
the Board and trust that we can take up the matter again at your earliest
convenience.
Last night I attended the public Hearing relating to our
application for a rezoning of 46,000 square feet of our property adja-
cent to Bayview Road. At that Hearing a letter was read fr~m you
indicating the Board's recommendation that the rezoning be disallowed.
We desire the rezoning for two reasons:
#1. It eliminates the complication of returning to the Appeals Board
to get a variance to allow us to cross the 200 feet strip with
driveways; and,
#2. It will enable us to renovate the existing motel building into a
more reasonable number of units.
Let me point out that a failure to obtain thSs rezoning will have no effect
whatsoever on the number of new buildings we intend to construct (i.e. five
buildings of 6 - 2 bedroom dwelling units). In addStion, it will have no
effect on the total number of residents that might inhabit the property,
since we would then construct larger size units in the ex~stlng motel build-
ing which would accommodate a comparable number of total occupants.
Given the present area of our M1 Zoned property (7.5 acres by
survey), it would seem that we saould be allowed to build a total of 37
units whether or notwe receive the zoning change. Ii' you recall: we
already have agreed to permanently (as a deed restriction or other

covenant) refrain from constructing dwelling units or other structures
within 900 feet of Bayview Rosd even if we are s~ccessful in the rezoning
attempt.
In sny case, let me re-emphasize our desire to cooperate w:]th the
planning Board in any way possible short of forfeiting our perogative to
develop the property in conformance with the dictates of the ex.ist:Tng
zoning ordinances.
If you desire further clarification of our pos~]t~ion~ please
feel free to contact us d~rectly. I trust that we will be able to resolve
any remaining differences st an August meeting of your Board.

Dear Sirs:
Please be advised that the Southold Town Planning Board
reviewed your proposed plot plan for modular apartments at
their meeting held on March 7, 1972.
Please be advised of the following:
1. There is about 304,926 sq. ft. of area in the "M-l"
district which will permit 33.8 dwelling units without both
public water and public sewer, or 46.8 dwelling units with
both water and sewer.
2. There is about 48,000 sq. ft. of area in the "A"
district (200 ft. from Bayview Road to the "M-l" district
lin~) which cannot be counted for area in the multiple resi-
dence project and through which no access should be approved
without a variance from the Board of Appeals.
3. There is not enough seperation between some of the
buildings. Article V, Section 502 - No building shall exceed
125 feet in length. The minimum distance between principal
buildings shall be equal to two times the height of the high-
est building, and the minimum distance between a principal
and an accessory building shall be twenty (20) feet. Any
inner court shall have a minimum dimension of sixty (60)
feet and any outer court shall have a minimum dimension of
twenty (20) feet and its depth shall not exceed its width.
4. The plot plan must show both 5 ft. elevations or
contours, and all wetlands area subject to tidal floodings.
5. The plot plan must also show water and sewer lines,
and all interior paths and sidewalks.
6. There is a review fee due of $25.
