Gentlemen: Your letter of September 24, 1971, in regard to the above captioned matter, was received by the Planning Board at their regular meeting held on October 5, 1971, please be advised of the followings In view of the fact that the Trustees and the Town Board required Mr. Victoria to bring back the shoreline to an agreed upon position, this would remove any restrictions we mi~]t have on this particular piece of property. However, that parcel of the Victoria property on the easterly side and northerly end, shown as the boat basin, has not been corrected. Therefore, in our opinion, it still merits prohibition of development of any kind until the condition of our letter of May 12, 1966 is corrected. Unfortunately, Mr. Terry indicated that our site plan would be reconsidered at that meeting, but did not make it clear to me that our attendance would be required. I, therefore, apologize for any inconvenience that our absence may have caused the Board and trust that we can take up the matter again at your earliest convenience. Last night I attended the public Hearing relating to our application for a rezoning of 46,000 square feet of our property adja- cent to Bayview Road. At that Hearing a letter was read fr~m you indicating the Board's recommendation that the rezoning be disallowed. We desire the rezoning for two reasons: #1. It eliminates the complication of returning to the Appeals Board to get a variance to allow us to cross the 200 feet strip with driveways; and, #2. It will enable us to renovate the existing motel building into a more reasonable number of units. Let me point out that a failure to obtain thSs rezoning will have no effect whatsoever on the number of new buildings we intend to construct (i.e. five buildings of 6 - 2 bedroom dwelling units). In addStion, it will have no effect on the total number of residents that might inhabit the property, since we would then construct larger size units in the ex~stlng motel build- ing which would accommodate a comparable number of total occupants. Given the present area of our M1 Zoned property (7.5 acres by survey), it would seem that we saould be allowed to build a total of 37 units whether or notwe receive the zoning change. Ii' you recall: we already have agreed to permanently (as a deed restriction or other Mr. Joan Wickham~ Chairman Southold Town planning Board July 12~ 1972 Page Two covenant) refrain from constructing dwelling units or other structures within 900 feet of Bayview Rosd even if we are s~ccessful in the rezoning attempt. In sny case, let me re-emphasize our desire to cooperate w:]th the planning Board in any way possible short of forfeiting our perogative to develop the property in conformance with the dictates of the ex.ist:Tng zoning ordinances.
