John Simicich minor subdivision - Mr. Charl~s Cuddy appeared on
behalf of his client. He asked that the board consider the proposed
subdivision submitted in 1975, as withdrawn by the applicant. The
present proposal has a third lot included, which was part of the
property that had been in one name. This lo~ (#3) had been set off
by the Building Inspector and acquired approval from the ZBA for a
280-A. Although Mr. Simicich has no intentions of further subdividing
or using lot #2, Mr. Cuddy informed the board that he would not advise
his client to sign a covenant stating such. Because Mr. Simicich has
previously offered to dedicate 12~ feet to widen or exceed Camp Mineola
Road, the board suggested that this beaffixed to the map. A committee
was appointed to do a field inspection on this property and report
their findings to the board at the November 9, 1981 meeting.
The Cove - Mr. Turner and Lynn Edwards met with the board to discuss
the Building Inspector's report dated September 17, 198!. The commit-
tee gave a report on the field inspection made on October 17, 198!. It
was noted that the existing dwellings do not conform.with the footage,
as they require an ~dditional 178 feet. They are used for seasonal
occupancy, each having their own electrical meter. Mr. Turner added
that he would like to add decks to the existing structures for extra
footage. The board informed Mr. Turner that a roof would have to be
added to such a deck in order to meet the addi~ional foQtage. The
board suggested that Mr. Turner have a conference with the BUilding In- (
spector with regard to what he would permit and consider as a livable
area in the buildings. The Planning Board and the Building Inspector
will confer to determine parking needs. The board will review the file
of Crescent Beach, in East Marion, which is a similar proposal handled

Pharr/Nicholas Aliano minor subdivision- Mr. Richard Lark appeared
on behalf of his client, Pauline Pharr. It is their intention to ac-
quire the parcel of liB" zone for a toy business. Mr. Lark stated that
an effort to acquire the entire "B" portion was made with the owner,
Nicholas Aliano, to no avail.

On motion made by Mr. Orlowski, seconded by Mr. Latham, it was
RESOLVED that the application of Pharr/Nicholas Aliano be processed
as a "set-off", section 106-13 .
Vote of the Board: Ayes: Raynor, Latham, Mullen, Orlowski
Honeysuckle Hills/Walter Gatz - Mr. Richard Lark submitted a letter
requesting consideration of amending number three of the Suffolk County
Planning Commission.
It was the concensus of the board to remain in agreement with the SUffOl~

Dear Henry,
It was nice seeing you again, and we would like to thank
you for the time and courtesy that you extended to us in your
office last week.
We are enclosing a site plan to which we have added more
of the information that is required, such as the lot and block
number, etcetera. We are submitting this site plan in lieu of
the Pre-submission Conference, and hope that we may have the
advice of the Planning Board as soon as possible. You will
recall that this is being submitted with the thought of the
conversion of ownership.

Gentlemen:
The Cove proposal was submitted to me July 20 as a
sketch plan by Robert Bayley Architect (dated July i 9, 198i) .
The proposal of additional new multiple units and possible
some or all the units becoming condominium owned.
In this M-1 Zone District, Art. V100-50B, Multiple
dwellings are a permitted Use by Special Exception by the
Zoning Board of Appeal and subject to site plan approval by
the Planning Board in accordance to Art. XIII.
ART. XIII 100-133 Site Plan approval procedure A. A
pre submission conference prior to the submission of a site plan.
B the site plan then is submitted to the BUilding Inspector.
Only the sketch plan has been submitted so far.
The site plan should show the required off street parking
according to Art. XI 100-112. The number of parking spaces
required for multiple dwellings shall be determined by the
Planning Board.
The existing cottages are non conforming dwelling units
with insufficient building area.
The premises has enough area for the total proposed units
shown on the submitted sketch Plan. The motel has efficiency
units. (Kitchen facility) Multiple dwelling buildings shall
not exceed 125 feet in length etc. 100-52.
The Zoning Board of Appeals granted Bayview Development
Corp. on September 13, 1971 (Appeal 411466) extension of the
Marina use with conditions.

The Zoning Board of Appeals also granted Bayview Development
Corp. on April 6, 1972 (Appeal #1505) to construct multiple
apartment for permanent occupancy (not over 33) with conditions.
A copy of this action is attached.
The applicant should have a pre submission conference with
you, apply to the Zoning Board of Appeal for Special Exception
100-50B (2 ) (3 ) (4 ) and submit the required site plan.

On motion by ~~. Gillispie, seconded by Mr. Hulse, it was
RESOLVED that the Southold Town Board of Appeals rescind
action (at the request of the Bayview Development Corporation)
on Appeal No. 1466 dated November II, 1971 wherein the Bayview
Development Corporation d/b/a Victoria Motel & Cottages Was
granted permission to expand an existing marina.

Decision ot Southold Town Board of Appeals on Appeal No. 1505;
Public Hearing held on March 16, 1972 _ 9:30 P.M. (E.S.T.), upon
application of Bayview Development Corporation, Bayview Road,
Southold, New York, for a special exception in accordance with
the Zoning Ordinance, Article V, Section 500, Subsection B-3,
tor permission to construct multiple residence apartments
(permanent occupancy). Location of property: south side of
Bayview Road, Southold, New York, bounded north by Bayview
(' Road, east by James Bitses, south by Corey Creek, west by A. &
F. Koke.
After investigation and inspection the Board finds that
applicant requests permission to construct multiple residence.
apartments (permanent occupancy) on the south side of Bayview
Road, Southold, New York. The findings of the Board are that
applicant intends to convert existing motel for temporary
Occupancy to permanent apartment-type living units. Applicant
feels that a clustering of 6 units per building instead of 4
units gives a more efficient land usage and layout.
The Board finds that the public convenience and welfare
and justice will be served and the legally established or
permitted use of neighborhood property and adjoining use dis-
tricts will not be permanently or substantially injured and
the spirit of the Ordinance will be observed.
On motion by }w. Gillispie, seconded by Mr. Hulse, it was
RESOLVED Bayview Development Corporation, Bayview Road,
Southold, New York, be GRANTED permission to construct building
units of six units each, as applied for, on property located on
the south side of Bayview Road, Southold, New York, subject to
the following conditions:
f 1. The total number of dwelling units in use at anyone
time on the M-l zoned portion of this property may
never exceed 33 units.
2. At no time shall certificate of oocupancy be granted
to new dwelling units unless the old dwelling units
which the new constructidr is intended to replace are
demolished and removed from the property.
, No new construction shall be placed closer than 20 feet
3. to the northerly line marking the separation between
M-l zone and Residential zone.
4. The distance between any buildings shall be the minimum
provided by the Ordinance.
