Dear Mr. Harvey:
I have reviewed your letter of objection received August 1, 1984.
The applicant has withdrawn the swimming pgol, deck and request for a
variance for these structures. Test borings are not required from this agency
but they should be available at the local planning board.
The New York State Tidal Wetlands Act only protects those tidal
wetlands that existed when the official tidal wetland maps were compiled
(1974). The traffic situation is one you should discuss with the local
planning board.
You will not be considered a party-in-interest to this project as
you have not given substantative objection on the basis of the tidal
wetland impacts that would occur should a permit be issued.

zoning code, regarding "M" zoning of four ,nd two units
per acre. In conjunction with this subject, We ~re parti-

merit on Corey Creek. Con~.idering the receut concerns end
efforts to correct the H~sha~Gom~ck Pond problem, it seeme
absurd to allow high density development on yet enother
creek.

Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review Act and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice is
hereby given that Southold Town Planning Board as lead agency for
the action described below has determined that the project will not
have a significant effect on the environment.
DESCRIPTION OF ACTION
The ~~5~J~x~ site plan of Cove Beach located
at Southold, which is a proposal for 33 living units.
The project has been determined n~t to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
The Department of Environmental Conservation has no objection
to our agency being lead agency for this action. It has
an unlisted classification, and a Tidal Wetlands Permit
may be necessary. They comment that the density should not
exceed 1 unit per 10,000 square feet.
Because there has been no response in the alloted time
from the Suffolk County Department of Heal, Services, it
is assumed that there is no objection nor comments by
that agency.
The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations.

Gentlemen:
When my husband and I were looking for a country home we chose the B~view area
because of its beautiful rural nature. We are restoring an eld house(1850's) as our
contribution towards maintaining the character cf this lovely area. Our pleasure
b~%s been somewhat dampened by the possibility that condeminiums may be built across
the street from our home. We appreciate that you may be bound to not consider the
esthetics of this t~pe of building as part of your decision to approve er not approve
this proposal, but we would like to call attention to the inapprol~riate~es~fof
condominiums in Bayviewo Proliferation of condominiums, if not checked, will soon
make the North Fork look the same as the many ether crowded communities West of the
North Fork.
My husband and I are both professional people and are not opposed to constructive
progress; however, this type of development can only erode %he special character of
Bayview. How much better it would be to build seven homes on the seven acres in terms
of reducing several problems: excessive traffic, limited water supply, the pollution
threat to Corey Creek. While Bayview Road has a posted speed limit of 35 MPH, the
average traffic speed is much closer to 55 MPH. The blind entrance to The Cove
is within 300 yards of another blind entrance at Cedar Drive which is preceded by
the blind rise of Brush's Hill. This section of Bayview Road is so dangerous that
we drive our young children to the homes of their friends rather than letting
them run the risk of walking on Bayview Road. The ?8 automobiles mentioned in The
Cove plans will further aggrevate traffic conditions.
Persons living in Bayview a~e very aware of the limited water supply and to the
threat of salt water intrusion to this supply. The large amount of water required
to supply 33 housing units will offer another substantial use of this resource.
One of the bonuses of our location that we were not l%/lly aware of when we
bought our home is Corey Creek. The thought of sewerage eventually flowing into it
is not a pretty one.
Our understanding of the new Master Plan proposal seems to recognize the need
to protect these resources and establishes criteria for their protection, a seperate
water supply system and a sewerage treatment system. The project which you are
being asked to approve appears fo flaunt n~t only the recommendations for water
and sewerage systems, but for population density as well.

Dear oirs.
I want to state my opposition to the 33 unit condominium proposal
to be built at the "Cove" site, directly across from my home on Bayview
Road. The traffic is eo heavy now that it is dangerous for me to cross to
my mailbox. It is hard to imagine what will happen with an additional
75-80 drivers in that small area.
I can't believe that the ~own Board would approve of so many more people
when it is common knowledge that the water is in short supply in Bayview
and the sewerage is sUre to pollute Corey Creek.
There are so many new single dwellings now being built in Bayview
that 33 condominiums seem an intolerable addition.
Please confirm my confidence in the Town Board by turning down
this proposal as Lt now stands.

Gentlemen:
We would like to voice our objections to the proposed multiple dwelling
complex at the site of The Cove Beach Resoz~t.
Our property and house is contiguous with me Cove, located to the
~est of ~ae Cove"s entra~lce.
We question the Environmental Assessment Statement, Part B.~.g. that
predicts an averse of ten vehicular trips per ho~tr. ~hile this might hold
true over a~ twenty-four hour period, it is certainly not representative
of the amount of traffic that will be generated during the peak traffic hours
of the day. Near collisions from this dangerous entrance onto Bayview Road
are an every day occurrence with the present use of this property; the increase
in traffic, will greatly hei~ten this risk to say nothing of the resultant
congestio~f traffic at this soot.
Our dther concerns are th~ water supply and sewerage disposal. We fear
that the new use of this property,residential instead of motel, will bu~xlen the
already fragile water supply. We also believe that the increased sewerage
will eventually wind up in Corey Creek, a place that we have enjoyed for
crabbing and clamming for many years.
If mutiple dw?llings must be aporoved for this location, we ~ that
you seriously consider limit~e number to an amount that is approp~ate to the
land and resources available~perhaps a reduction of one-thiz~i to on~-half
of the number now proposed.

Gentlemen:
~e have reviewed the E~vironmental Assessment of the proposal for The CoYe
at Southold and are distressed that there are apparently no objections to this
proposal.
If we understand the Maste~ Plan Proposal it seems doubtful that a project
such as The Cove would be approved. One paragraph in this document suggests
that a public water supply and sewerage treatment system would be required.
Another par~raph from this document states that the plan is based on an
average household size of 2.5 persons.~The Cove, with 33 units on approximately
7 acres, would have 82.5 persons. The updated plan recognizes the limited water
supplyin~Bayview and has accordingly adjusted building lot size up to 2 acres
to preserve this resource. ~ith this in mind, it is entirely unreasonable to
pe~it 82.5 persons to live in an area that can justifiably support only 17.5 persons.
We recognize that this property is zoned M-l, and that exceptions must be made;
however, the magnitude of the exception is questionable in our estimation. The
location of The Cove is highly desirable and should command high prices no matter
what is built there. We submit that the investors could build one-half as many
units as is proposed, double the price thus ensuring their return and come
closer to conforming with the the Master Plan and resources available at
this location.

Dear Sirs~
I have seen the proposal for thirty-three condominium units to be built
to replace the existing dwellings at The Cove. I do not believe that condominiums
belong on the North Fork and hope that you will not approve this proposal.
My home is within 200 yards of the entrance to The Cove and the traffic
from the motel, with its difficult entrance to Bayview Road, causes traffic tie-
ups with the present amount of cars from the motel. People in the neighborhood
grit their teeth amd wait for the tourist season to be over so that their
~ives can return to normal. If condominiums are built this ~raffic will be
with us on a year round basis.
Furthermore, where will the water come from to supply the needs of
washing machines, lawn and garden watering, car washing,etc. We keep hearing
about how Bayview is at the end of the water table, and faced with salt water in
the drinking water supply, yet it seems a new house is started every day in the
Bayview area. Building this number of housing units will not do anything
to help solve this problem.
One more thing, the sewerage will end up in Corey Creek. It does seem a
shame to ¥11ute.this beautiful body of water when with careful use of the
land surrounding ~t, it can be kept unpolluted.
As a person who was in the Real Estate business for many years, I am
not against all development, I just don't want it to be done unwisely so
that what we have now is spoiled.

After the Planning Board letter of June 7, 1984, we met
with Dave Emilita and Jim Brier on June 18th at 11:00 a.m., in order
to review our plan. At that time, we submitted five (5) copies
of the revised plan, which we believe can be certified by the
Building Department.
It was our understanding from that meeting that the next
step would be for the Planning Board to look at the revised map ~nd
to see if anything further is required.
Possibily you can refresh Mr. Brier's recollection of
the meeting.
In any event, if there is anything ~u~ther which you

Dear Sir:
The enclosed Newsday story about how Newport, RI is being despoiled
by spreading condominium construction contains a graphic preview of
what is shaping up right here in Southold in projects such as
Seacroft in Cutchogue, and the Cove in Bayview, Southold.
There seems to be a clear consensus among the population here
against such big developments. Why can't they be scaled down drast-
ically to preserve what we have here ??

Waves of Condos in Newport
The Hartford Courant
Newport, R.I. -- "The Brenton Cove area is
filled chockablock with flimsy condominiums,"
said John J. Slecum as he sat in his big, turn-of-
the-century home on world-famous Bellevue
Avenue ahd lamented the sad state of the "City
by the Sea."
"And Bonniecrest," he continued. "It was a
fine Victorian mansion. Now it has a slum sur-
rounding it.
....... rhey are spoiling the appearance of New-
port," Slceum said. "If they continue, it will be
spoiled to a degree that tourists won't want to
come here anymo~-~, which w~ou ~]~ all right
with me except, by then, I would no longer wish
to live here."
The condominums Slocum calls "slums" sell
for anywhere from $250,000 to $1 million each,
but a lot of people, and the U.S. government,
think Slooum has a point about what is happen-
ing to the citfs appearance.
Because of the recent burst of condominium
, the National Park Ser-
vice recently removed five properties,
including Brenton Cove and Bonnie-
crest, from the citfs Ocean Drive Na-
tional Historic Landmark District. It
was only the second time in history
that the agency found a historic land-
mark se altered that it no longer mer-
ited the designation.
The federal action has intensified a
long-simmering concern over what
the boom in condominiums, time-
sharing hotels and retail construction
may cost a city long famous for Colo-
nial neighborhoods, Gilded Age man-
sions and wild seascapes.
Since the condominium craze began
in Newport about three years ago, 850
units have been built, Bruce Bartlett,
the city planner, said.
Meanwhile, development of the
city's waterfront, which began in the
1970s, has replaced 20 acres of 18th-
and 19th-Century buildings with new
hotels, condominiums, time-sharing
hotels and stores. Tens of millions of
dollars in proposed projects on or near
the waterfront, including a 300-room
Holiday Inn, a parking garage and
several time-sharing hotels, may
match what has already been built,
Bartlett said.
Edgehill mansion on a crowded Brenton Cove hillside
buildings at Bonnicerest, Brentan Cove and the
neighboring area~ of Edgehill, Beachbeund and
Penn Craig, developers bulldozed landscaping
that had been preserved since the turn of the
century. That, too, upset preservationists.
At Bonniecrest, developer Abraham D. Gos-
man of New~on, Mass., has converted the old
mansion into 13 condominiums. On the grounds,
he has built 43 units and hopes to get approval to
build 13 more. The buildings, "quality construc-
tion all the way," are an asset to Newport, he
said. The owners of the condominiums live in
Newport an average of only 60 days a year but,
he added, pay taxes to support city services.
Yse, said Cherol, but what is the cost of such
development? "If we wall offthe waterfront and
destroy Ocean Drive, what is left for people to
come to Newport for?" he asked.
Bartlett said the city has begun to try to con-
trol development by tightening the zoning law.
For example, the height restriction on water-
tryst buildings has been reduced to 46 feet
above sea level.
City officials, he said, are certain to increase
their effort to control further development and
preserve the best of the old city.
Everyone interviewed emphasized that New-
port is still worth seeing, that development has
aot destroyed its appeal. "Newport is still a
great place," Seliozy said. "We haven't lost it,
but we have seriously wounded ourselves."/il

Early warnings that all was not well can e
from preservationists. They protested when t~
city tore down the waterfront buildings in Bloc
Alley, an area filled with honky-tonk bars
tronized by sailors.
The bars might have been sleazy, Antoinet~
Downing, chairman oftha Rhode Island Histor -
cai Preservation Commission, said, but the:
were housed in wonderful old 18th- and 19t~-
Century buildings.
The buildings that replaced them are too bil,
"utterly out of scale," Downing said.

Newport's building boom grew out of panic
and was at first widely viewed az a godsend.
In 1973, the Nixon administration moved the
Navy fleet out of Newport. With the fleet went
about 15,000 Navy men and women, civilian
support workers and their families. In all, near-
ly a third of the population of Aquidneck Island,
on which Newport is situated, was suddenly
gone, city councilman Charles S. Soliozy said.
'There was an air of desperation," Soliozy
said. Newport, he said, suddenly was willing te
do anything to attract tourists, businesses and
developers: "Whenever anybody wanted ~o do
anything, it was approved."
The zoning ordinance was rewritten to make
it easier for developers to build, Bartlett said.
For example, height restrictions were changed
to allow hotels to rise to 100 feet.
A modest recovery a]rcady had begun when
two events focused national attention on New-
port. First came the Bicentennial, and Newport
became the favored place to see the Tall Ships.
Then came the America's Cup summer of 1977.
ARer that, Bert]ett said, tourism, property
and the building boom "took off." The number of
annual visitors to this city of 30~000 people in-
creased from about I million a year in the early
1970s to about 4 million last year, ac-

Gentlemen:
The subject property is zoned A Residential and M-1 General
Multiple Residential. The proposed multiple dwelling use is a
permitted use in the M-1 portion of site. (Art. V, Sec. 100-50
A (1) with reference to Art. IV, Sec. 100-40 A (2))
The lot area of the M-1 district, without an accurate survey,
can not be determined. However, for the proposed 33 living units
an area of 297,000 sq. ft. would be required. This is based on
a criteria of 9,000 square feet of land per living unit where
city water and sewage is not provided. (Art. XI, Sec. 100-116
Dwelling unit density)
Building side yard set backs shall total 45'-0", (Art. VI,
Sec. 100-51 Bulk & Parking Schedule). The proposed side yards
total 40'-0", a variance would be required for an insufficient
side yard set back.
The middle living units of the proposed buildings are two
stories, 24'-0" high. Building minimum separation are required
to be (2) times the height of the highest building. The building
separation as proposed are 32'-0" and 36'-0" between most of the
buildings. This should be increased to a 48'-0" minimum sep-
aration to comply with Art. V, Sec. 100-52 B.
This site plan review can not be certified as meeting all
the provisions of the Zoning Ordinance, Chapter 100 - Code of
the Town of Southold, N.Y.

Dear Mr. Orlowski:
The Suffolk County Planning Co~ission at its regular meeting on April 3,
1985, reviewed the proposed subdivision plat entitled, "The Cove at Southold
(Condominium)", referred to it pursuant to Section 1333 of the Suffolk County
Charter. After due study and deliberation it resolved to approve said map subject
to the following four conditions deemed necessary to help preserve the natural and
aesthetic attributes of the shoreline of Corey Creek.
1. No new sanitary disposal facility shall be constructed or otherwise
located within 100 feet of the shoreline of Corey Creek.
No stormwater runoff resulting from the development and improvement
of the subdivision or any of its lots shall be discharged into the
adjoining body of water.
Erosion and sediment control measures shall be required during and
immediately after construction on each lot to insure that storm-
water runoff will not carry eroded and other deleterious materials
into Corey Creek.
Conditions 1-3, inclusive, shall be filed as covenants and restric-
tions in the office of the Count~ Clerk on or prior to the granting
of approval to this subdivision.
These covenants and restrictions can be modified only at the request
of the then owner of the premises with the approval of a majority plus
one of the Tow~ Board of the Town of Southold after a public hearing.

The following conditions apply to all permits:
If any of the permit conditions are unclear, the permittee shall contact
the Division of Regulatory Affairs at the address and telephone noted below.
A copy of this permit or approval and approved project plans and supplement-
ary conditions shall be available at the project site whenever authorized
work is in progress.
The permit sign enclosed with the permit or a copy of approval letter shall
be protected from the weather and posted in a conspicious location at the
work site until completion of authorized work.
At least 4~ hours prior to cor~nencement of the project, the permittee shall
complete and return the top portion of the enclosed receipt form certifying
that he is fully aware of and understands all provisions and conditions of
this permit. Within one week of completion of the permitted work the
bottom portion of that form shall also be completed and returned.
For projects involving activities to be accomplished over a period or more
than one year, the permittee shall notify the Regional Permit Administrator
in writing at least 48 hours to the commencement of resumption of work each
year.
If project design modifications take place after permit issuance, the
permittee shall submit the appropriate plan changes for approval by the
Regional Permit Administrator prior to undertaking any such modifications.
The permittee is advised that substantial modification may require submiss-
ion of a new application for permit.
Ail necessary precautions shall be taken to preclude cont~m~nation of any
wetlands or waterway by suspended solids, sediment, fuels, solvents,
lubricants, epoxy coating, paints, concrete, leachate or any other
environmentally deleterious materials associated with the project work.
Any failure to comply precisely with all of the terms and conditions of this

The Tidal Wetlands boundary line should be shown. (The
limits for the upland filling of land and construction of
building is depenaent upon the location of this line as
per the NYSDEC Tidal Wetlands Permit)
The correlation of the test hole data and the drainage
pool detail indicates that the bottoms of several
leaching pools may possibly extend into ground water,
thus reducing storage capacity. The designer should
indicate the inverts through the leaching pool system and
provide drainage calculations.
We recommend approval of this site plan contingent upon comletion of
the above comments.

above referenced project. The two {2) comments which we addressed in
our letter to you dated July 28, 1987 have been satisfied are as

responsibility of the developer to notify the
N.Y.S.D.E.C. of his intention to commence work, as he is
subject to inspections by representatives of that
department. The developer should adhere to the minimum
distances for placement of clean fill and the

Wetlands Permit, as issued by the N.Y.S.D.E.C.
Additional information regarding the drainage system has
been shown. Also, drainage calculations have been
provided. The overall drainage system appears to be

All wire fabric shall meet the requirements of the current
A.S.T.M.. designation A-392. It is to be hot dipped
galvanized after weaving (A.S.T.M., A-392, Class II).
2. All posts and columns shall be hot dipped galvanized in
accordance with A.S.T.M. designation A-123.
3. All rods snd fittings shall be hot dipped galvanized in
accordance with A.S.T.M. designation A-153.
4. All fittings shall be malleable iron, cast iron or pressed
steel~

Ail concrete footings shall have a compressive strength of
2500 lbs per square inch after 28 days. Posts shall sit in
footings a minimum of 7 days before any fabric is attached.
When the air temperature is below 50~ F during pouring of
the concrete, it is to sit a minimum of 14 days before the
fabric is attached.
~11 gates shall be 1 5/8" D.D. Frames with the same fabric
as the fence. All gates shall be complete with hinges,
latches and stops.
All weights are lbs. per ft + 5%.
Black vinyl-protected steel chain link fence shall be
installed in locations as shown on the plans.
