Dear Mr. Cron:
The fOllowing action was taken by the Southold Town
Planning Board, Monday, February 7, 1983.
RESOLVED that the Southold Town Planning Board rescind
condition #1 on the resolution of approval, dated May 24,
1982, for the minor subdivision of James W. Dawson and accep-
tance of the access road as indicated in Inspector Davis'
report #275, excluding the 40' turnaround provision on lot
#4, and said access to be maintained at or above its present
state.
This action was taken after discussion with Mr. Victor
Lessard, Building Administrator, in which a determination was
stated that improvements to a right-of-way should go to the
edge of the property line and that area to be designated as
front yard rather than previous requirements of the right-of-
way going 25 I into the property for establishing the front
yard.

W. DAWSON, residing at 9 Stone Ledge Road, Upper Saddle River,
New Jersey 07458, hereinafter called the "Owner";
WHEREAS, the Owner has title to certain lands situate,
lying and being at Main Bayview Road, Southold, Town of Southold,
County of Suffolk and State of New York, said lands hereinafter
being more particularly described; and
WHEREAS, it is the Owner's intention that the aforesaid

the subdivision or any of the lots shall be discharged
directly into any of the adjacent bodies of water.
3. No sanitary disposal facility shall be installed or
constructed within 100 feet of the upland edge of the
shoreline of the boat basin or Corey Creek.
4. The conditions hereinabove set forth shall be filed as
covenants and restrictions in the Office of the Clerk
of Suffolk County.

A t the July 9, 1996, Town Board work session, I was asked to provide
additional information in regard to the above mentioned parcel.
On July 9th, I contacted Agnes Miles at the Suffolk County (853-5949) in
regard to the price of the property. Ms. Miles did not know the price,
but said that the comps had been ordered and that she would contact me
as soon as they were submitted. I called her again today, she still did

Dear Mr. Raynor:
In accord with our meeting at the offices of the Planning Board
on Tuesday, January 25, 1983, and as per your request, I submit
herewith this letter.
I would respectfully request that the Planning Board submit to
me a letter for the purposes of securing a vacant land certificate
of occupancy with respect to Lot #4 designated on the minor subdivi-
sion map heretofore approved by the Planning Board.
I should appreciate if the letter would indicate that the
installation of the right of way to and into Lot #4 is deemed to be
satisfactory to the Planning Board and that said right of way in-
stallation would not give rise to any objection in the issuance of
a building permit by the Southold Town Building Department.
I would also request that the letter further indicate that the
test well pipe installed in the right of way near the traveled high-
way need not be removed but may be properly capped below the surface
of the traveled right of way.
Finally, with respect to the "turning" area required by the
report of John W. Davis, #260, that the installation thereof be de-
layed and determined by the future property owner of Lot #4, and

that said turnaround be installed in either of the following manners:
(1) Through widening the present 16 foot graveled
portion of the right of way to a total width of
32 feet at the most easterly end of said right
of way for a distance westerly therefrom of
25 feet; or
(2) That the owner of Lot #4 provide .turnaround
access into said 25 foot right of way by a
circular driveway proceeding from the area of
the construction of any residential dwelling.
I would greatly appreciate receiving the foregoing letter at
the earliest possible date.

Dear Mr. Davis:
At a regular meeting of the Planning Board, December 13,
1982, our Board passed a resolution to accept the report
captioned above, noting that no turnaround area was provided
and the test well pipe in the middle of the road should be
removed.
Please advise our board if you have any objections to
burying the pipe, instead of removal, as it has been indicated
by the attorney for the applicant that this pipe will be used
in the future. We would also ask if you have any objections
,to our board approving the right-of-way with a condition that
no bUilding permit is to be issued for lot #4 until such time
as a turnaround area of 32 feet is provided for emergency
vehicles.

The fOllowing action was taken by the Southold Town Planning Board,

RESOLVED that whereas, a formal application for the approval of a
subdivision plat entitled "James W. Dawson" located at
Bayview was submitted to the Planning Board on October 6, 1981
and, a filing fee in the amount of $100 was paid December 7, 1981 and,
WHEREAS, a public hearing was held on said subdivision application
and plat at the Town Hall, SouthOld, New York, on April 26, 1982 at
8 : 00 p. m., and
WHEREAS, the requirements of the Subdivision Regulations of the Town
of Southold have been met by said subdivision plat and application,
NOW, therefore, be it RESOLVED that the application of James W.
Dawson for approval of said subdivision plat prepared by
Roderick Van Tuyl, P.C. dated April 27, 1982 , be approved and the
chairman be authorized to endorse approval on said subdivision plat
subject to the following conditions:
1. No approval shall be given to this subdivision until
the question of adequate access for Lot 4 is satisfactor-
ily resolved. A twenty foot wide panhandle could be
added to the parcel so that Lot 4 will have frontage on
and access to Main Bayview Road. The creation of the
panhandle will resolve the access question.

Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review Act and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice is
hereby given that Southold Town Planning Board as lead agency for
the action described below has determined that the project will not
have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of James W. Dawson is a four-lot subdiv-
ision located at Bayview Southold.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project
be implemented as planned.
Because there has been no response in the allotted time
from the New York State Department of Environmental
Conservation, it is assumed that there is no objection
nor comments by that agency. Applicant should be aware
that a permit may be required because of the proximity
to the wetlands.
The Suffolk County Department of Health Services has
indicated its agreement with the lead agency designation.
Prior to commenting on the sewage disposal and water supply
facilities, it would be necessary to have a test hole and test
well information. Clearance from the New York State Department
of Environmental Conservation should be obtained by the applicant.
The project will meet all the requirements of the Code
of the Town of Southold Subdivision of Land Regulations.

Dear Mr. Raynor:
The Suffolk County Planning Commission at its regular meeting on April 14,
1982, reviewed the proposed subdivision plat entitled, "Minor Subdivision -
James W. Dawson", referred to it pursuant to Section 1333 of the Suffolk County
Charter. After due study and deliberation it resolved to approve said map sub-
ject to the following five conditions deemed necessary to help preserve the
natural and aesthetic attributes of the shoreline of Corey Creek:
1. No approval shall be given to this subdivision until the question of
adequate access for Lot 4 is satisfactorily resolved. A twenty foot
wide panhandle could be added to the parcel so that Lot 4 will have
frontage on and access to Main Bayview Road. The creation of the
panhandle will resolve the access question.
2. No lot shall be subdivided or its lot lines changed in any manner at
any future date unless authorized by the Southold Town Planning Board.
3. No stormwater runoff resulting from the development of the subdivision
or any of the lots shall be discharged directly into any of the ad-
jacent bodies of water.
4. No sanitary disposal facility shall be installed or constructed with-
in 100 feet of the upland edge of the shoreline of the boat basin or
Corey Creek.
5. Conditions 2, 3 and 4 shall be filed as covenants and restrictions in
the office of the County Clerk on or prior to the granting of ap-
proval to this subdivision.

At a regular meeting of the Southold Town Planning Board, Monday
December 7, 1981 a field inspection report was given on the sub-
division map entitled James W. Dawson.
It was reported that the wooded area, designated on lot #4 appeared
to be located on the adjacent property. It was the concensus of the
board to refer this proposal to the Council Advisory Committee for
their comments and recommendations on the proposed layout. We will

Gentlemen:
The following statements are offered for your consideration
in the review of the aqove-mentioned minor subdivision and its
referral to the Suffolk County Planning Commission:
(1) No grading, other than foundation excavation for a
residential building is proposed.
(2) No new roads are proposed and no changes will be made in
the grades of the existing roads, except as may be required
by the Southold Town Planning Board.
(3) No new drainage structures or alteration of existing
structures are proposed.

Dear Mr. Cron:
The following actions were taken at a regular meeting of the Southold
Town Planning Board, Monday, February 8, 1982:
RESOLVED that the Southold Town Planning Board approve the sketch map
of the minor subdivision entitled James W. Dawson, dated October 22,
1981 and amended January 25, 1982 located at Southold.
RESOLVED that the Southold Town Planning Board declare itself lead
agency in regard to the State Environmental Quality Review Act for
the subdivision of James W. Dawson located at Southold. An initial
determination of non-significance has been made.
It was the concensus of the board that you submit a map designating
the location sites for the proposed dwellings.
Upon receipt of six (6) copies of the final maps, we will refer them
to state and county agencies. I have enclosed a copy of the require-
ments nescessary for an acceptable map.
