Y. 11971 Re: Proposed sub-division "Old Town Park" Gen tlemen: On Monday August 12, 1985, I appeared before your Board and submitted a plat of the above sub-division. Said plat, made by Van Tuyl of Greenport, indicated water frontage which was delineated by a line known as the mean high water mark, and as such the outer boundary of the property involved in the plat. I was requested by members of the Board to supply additional information concerning wetlands lying beyond this mean high water mark. At the present time I am in the process of arranging for a proper survey and will submit same in the near future. However, I must call the attention of the Planning Board to the fact that wetlands in the Town of Southold are the property of the Town and fall within the jurisdiction of the Trustees of Southold. As such, you are in effect asking me to submit a survey of property out- side of the boundaries owned by applicant which are the subject of the plat. I do not believe the statute contemplates the accurate survey of someone elses property when one is seeking to file a plat. All that the statute requires is the approximate location of the neighboring property, the owners thereof and any pertinent features such as roads, waterways, etc. The boundary between Corey Creek and the property subject to this plat falls at the mean high water mark and does not include the marshes adjacent thereto belonging to the Town Trustees. I raise this point not to obstruct but to protect my rights in the future should I become subject to restrictions, prohibitions or a town wide plan and zoning map which I anticipate will be adopted in the near future. I am filing this notice with you to protect my rights which may be adversely affected by what I consider an unnecessary delay and an irrelevant addition to the application of my plat plan. In the event that I am penalized because of the delay in the acceptance of this plat, I reserve all rights that existed in my favor on Monday, August 12, 1985 at the time I submitted /the plat to the Planning Board -l- and at the time that the additional information was requested of me concerning the property of another, to wit; the Town Trustees, I appreciate Ahe efforts of the Planning Board and realize that there must be some coherance and order to the continued expansion of the Town, I am in favor of your efforts and in fact thank you therefor as a resident-beneficiary of the reasonable ordinances that have been passed. I will do all in my power to get you the information you seek, and I am sure that you will not penalize me for the delay in securing a survey of the marshes beyond my mean high water mark. I will do my best to comply with your order and I am sure you will do your best not to penalize me for the delay. Y.' 11971 Re: Propo sed sub-division Old Town Park_ Att:i Mr. Bennett Orlowski, Jr. Chairman Dear Mr. Orlowski: I am in receipt of your letter of June 8th, 1984 in which you state that you will hold the above application in abeyance untilcthe matter is resolved. Please be advised that there is no need to hold the matter in abeyance since the lots as submitted to your office are oversized and even with a 501 right of way on the easterly portion of the property would still exceed the requirements of the master plan. Consequently you-are holding this application in abeyance. This is an unnecessary delay. I respectfully request you reconsider your position in light of the fact that there is more than enough room on each lot as designed to accommodate the 50' right of way, if it should later transpire that one does exist. The right of way alleged failed many years ago for non-user and in fact has been an illusory right of way because it has always been impassable. It has not been used in thirty five years and cannot be used since it passes through the bottom of a pond which is 151 deep. The probabilities are that this right of way (if any ever existed) will be set to rest and nullified by the courts. Under these circumstances it is an arbitrary and capricious act on the part of the Planning Board to impose an injunction on my application. Again I urge you to process this matter with all deliberate speed since the claim of a right of way is specious . As you can see, the land was transferred to Mr . Bitses subject to the "Right of Way" which Mr . Bitses has apparently chosen to ignore in his submission of the proposed subdivision . As indicated, this right of way was passed from deed to deed relative to the original land transfers of the properties in question. In this regard, I also enclose copies of the deed from Toedter to Nidds, dated August 51 1955 wherein the 25 or so families can trace their original right of way to Corey Creek. Moreover , I enclose a copy of a deed from Toedter to Bangert and Hering dated December 13, 1954 wherein the land upon which the right of way exists was so transferred with such property right designated in the subject deed. Thus, there can be no question that the original property rights, through the relevant chains of title, evidence the subject easement as originally transferred as well as demonstrating that same currently exists in favor of many community members. As such, Mr . DANIELE April 25, 1984 SOUTHOLD TOWN PLANNING BOARD Main Road Southold, New York 11971 RE: Proposed Subdivision Submitted by: James Bitses Gentlemen: I write on behalf of a number of community members of the Hamlet of Southold regarding their deeded water rights and fifty foot right of way from Main Bayview Road southerly to Corey Creek. It is our information that on or about April 18, 19841 Mr. James Bitses filed with your offices a so-called Sketch Plan for minor subdivision to be known as Old Town Park at Southold. Please permit this letter to serve as formal opposition to the proposed subdivision as so submitted. Upon review of the submitted Plan, the community members were surprised to see that Mr. Bitses has completely ignored the deeded right of way running in favor of approximately thirty families. A further review of the property in question reveals that Mr. Bitses purchased his property subject to the aforesaid right of way. Moreover, the entire area of land known as the Hamlet of Southold was transferred subject to this self-same easement. The attempt by Mr. Bitses to unilaterally vitiate this valuable property right is most inappropriate. For this reason alone, the proposed subdivision should be rejected in its entirety. Y. 11971 he: Old Town Park James Bitses D ; ir: Enclosed please find four Department of Environ- mental Conservation maps, consisting of aerial photographs of the northern shore of Corey Creek. You will note that the above premises has been outlined in red . You will further note that the Department of Environmental Con- servation has marked the subject premises with the symbol "ds", which indicates dredged spoil. Easterly of the subject premises you will notice that the land of the Anchorage I4otel is not marked with any symbol even though it also consists of dredged spoil. The only difference between the dredged spoil on the adjoining property and the dredged spoil on my property is a one half inch layer of topsoil and grass. There are many areas in Southold Town consisting of dredged spoil upon which dwellings have been erected . I cite, in particular, the area to the south of Goose Creek bridge upon which there are presently four dwellings built upon dredged spoil identical to that found in Old Town Park. As I stated at the previous hearing the dredged spoil at Old Town Park was laid down by the County dredge in 1962 and has had twenty two years in order to settle. This type of soil requires two years for settling prior to construction. As I further stated during our previous hearing, there is a six inch layer of clay over the southerly portion of the subject premises and this in turn prevents rain water from seeping into the ground . The inch or two of water found on a clay bed is technically designated as 11perched water" and consists of rain water. Th Spring, in order to alleviate the clay condition, the area affected "comprising one acre" will be deep plowed in order to break up the clay bed . As I stated before, the clay bed is six inches thick and since the deep plow penetrates two feet below grade, the clay will be broken and mixed with the underlying sand . This will remove the "perched water" condition. 0 -2� -2- May I point out that the information you sought concerning the Department of Environmental Conservation classification of the subject premises was ;.n your own files. I resent being sent on an errand to secure informa- tion which you already have. The only result has been a delay of approximately two months to present you with that information which you already had and should have knovm that you had . As for buildable lots, as stated before, dredged spoil can be built upon after two vears of settling. The mere fact that there is a clay condition does not diminish the buildable quality of property but instead enhances it as cla7 is a much firmer base than sand . As further stated during the previous hearing, the present grounO level represents a future sub-soil level two to four feet below finished grade. When buildings are erected on the above premises the area will be backfilled with sand and gravel and topped with a four inch layer of top soil. It is anticipated that the sills upon which the houses will rewb will be eight feet three inches above mean high water level in order to qualify as non-flood plain structures. This is more than can be said about ninoty percent of the houses in the Village of Orient which are all below the flood plain level. 1 respectfully request that the minor sub-division, as submitted , be approved considering the fact that I withdrew a one acre plat and substituted a two acre plat for the specific purpose of speeding up the approval. 14ill you kindly place this matter on the next agenda.
