Dear Mr. Lark:
The fOllowing action was taken by the ~lanning Board at the
regularreeting, Monday, January 7, 1985.
RESOLVED that the Southold Town Planning Board approve the
set-off (106-13) for Mark and Ellie Gordon located at Southold,
plan dated as last amended November 16, 1984. This set-off of
11,478 to be merged to property owned by Ralph Lavinia. This
approval is subject to : 1) Review by the Suffolk County Planning
Commission and 2) Filing of the covenants and restrictions with
the County Clerk.
Please forward six (6) copies of the survey (see the enclosed
list for requirements) in order that we may refer them to the Suffolk
County Planningicommission. Enclosed are the original covenants
to be filed.

Dear Mr. Raynor:
will you kindly review the enclosed copy of survey showing
premises presently owned by Ralph and Anna Lavinia. Our
clients, Mr. and Mrs. Marc Gordon. have contracted to
purchase these premises less that portion of the property
marked "Set Off" on the survey. Mr. Lavinia would like to
retain this portion to the benefit of an adjoining piece
to which he is in title. It has been agreed between the
parties that at such time as this portion of the property
should be for sale, Mr. and Mrs. Gordon would have the
right of first refusal to purchase same.
Based on the survey and my above remarks. we ask that you
offer us your opinion as to Mr. Lavinia's chances of ob-
taining Planning Board approval of such a set off.

Pursuant to your letter of June 30, 1983, please be advised
the above-captioned matter is not an application for a minor
subdivision.
The application is for a set-off for property containing
11,478 square feet: part of which is presently used as a right-
of-way for access to property owned by Lavinia, Gomez, Wittmer
and DeMaria to be transferred from Mark and Ellie Gordon to
Ralph Lavinia.
Would you please review your records concerning this appli-
cation and advise me when it could be scheduled on the Planning
Board's agenda for a conference. I am enclosing the original
application I filed with the Planning Board on May 31, 1983.
This was returned in your letter of June 30, 1983, although you
retained the Short Environmental Assessment Form and six (6)

Ralph Lavinia. On the Lavinia property there is a small
cottage which was built prior to zoning, The property
to be set off from your applicants' other land is not
used by your applicants, and in fact the garage located
thereon is presently utilized by Mr. Lavinia in connec-
tion with his parcel.
The property will not be developed as it primarily serves
as a right-of-way to provide access for the Lavinia, Gomez,
Wittmer and DeMaria properties.
The parcel to be set off is irregular in shape due to the
development this neighborhood has taken with the building
of homes on small parcels of land fronting on the Southold
Park District.
The Proposed set-off will not adversely affect or prevent
the the present or future use of the neighboring lands.

Ralph Lavinia. On the Lavinia property there is a small
cottage which was built prior to zoning. The property
to be set off from your applicants' other land is not
used by your applicants, and in fact the garage located
thereon is presently utilized by Mr. Lavinia in connec-
tion with his parcel.
The property will not be developed as it primarily serves
as a right-of-way to provide access for the Lavinia, Gomez,
Wittmer and DeMaria properties.
The parcel to be set off is irregular in shape due to the
development this neighborhood has taken with the building
of homes on small parcels of land fronting on the Southold
Park District.
The Proposed set-off will not adversely affect or prevent
the the present or future use of the neighboring lands.
In fact, Mr. Lavinia's parcel will be enhanced and contain
an area of 18,983 square feet and include the garage which
properly belongs with this parcel.
