RESOLVED that whereas, a formal application for the approval of a subdivision plat, entitled Minor Subdivision of Samuel B. Prellwitz located at Peconic was submitted to the Planning Board on June 17, 1980, and an application fee of $100 was paid on July 18, 1980, and WHEREAS, a public hearing was held on the said subdivision application and plat at the Town Hall, Southold, New York, on July 28, 1980 at 8:30 p.m. , and WHEREAS the requirements of the Subdivision Regulations of the Town of Southold have been met by said subdivision plat and application, Now, therefore, be it RESOLVED that the application of Samuel B. Prellwitz for approval of said subdivision plat prepared by Roderick Van Tuyl, P. C. , be approved and the chairman be authorized to endorse his approval on the map subject to the following: 1. Consideration of the conditions of the Suffolk County Planning Commission. 2. It is through a wooded area from Indian Neck Road to a tight turnaround driveway at the last southeasterly building in Lot No. I. Material in roadway appears to have some bankrun and is well consolidated (A few test, probes show 3"—+ ) . Widening for a two way road would involve some tree clearing. 7here are a few potholes throughout, the length. 'hie profile is approximately level. The first 200 ft, is somewhat, below the existing O.S. (10" , ), the remaining length about. even tait;h the O.S. Emergency vehicles such as fire eq iipment,, ambulances, etc. could negotiate i.his road. Tirning around at present, can be done where the road branches off into the Fischer property. Could see no apparent drainage problems althought, this road might present trouble with frost coming out in the spring season. In my opinion a one way en',rance road would be accen'sable even for the 730ft.. length due to the limited amount of traffic that will use it.. I am the person most affected by the proposed major subdivision of Mr. Prellwitz as I adjoin - touch - to the South Lot 2. I presume that I am entitled to notice in all matters relating to the development of the subdivision and I am requesting that I be so informed. On your files at the moment my property is listed as owned by Foster Adams of New York City so if you wish to send out dual notice that also would be fine. I would like to be notified everytime there is to be discussion of this proprty at your meetings. The issues unresolved during the Rosenberg application wee$ the question of allowing beach privileges when the property being subdivided is waterfront property. You did not requirethis with Rosenfeld and should have. Another problem (relatd ) is the fact that you have massively sub- divided. Indian Neck without at the same time providing parking and water access to the people who will be building here. I as the only year round resident living adjacent to the 50 foot public area have been foeeedX to put up with intolerable conditions. Those con- ditions have included noise, day and night of people and cars, tresspassing, sights, obscenities, gunshots, drinking, teen age Parties and unending sex acts both during theddytime and at night with ongoing sound effects and car engines. This problem is one the town will sometime have to address. One. Sufficent beach frontage has to be purchased to accomadate those using it, or restrictions have to placed on the existing beach. Two. The Town has to pass a law requiring subdivisions with beach front utilize their own for those buy$ng from them. Whether tlits can be forced on Rosenberg retroactively remains to b seen. Three. Recently I have requested Mr. Dean tocnnsider methods to lessen my burden and to make others share in it. I have asked for a gloodlight from an existing light pole to illuminate the end of the road and the Moving of all branches whichwould .01bintefere with the purpose of illuminating the whole end of the lane. Also, very possibly the installation of a send pole at the end of the reed. Four. I hse asked that there be no parking from the end of the road to the corner at any time and that the town purchase Ind for a parking area from which peple cold walk to the begch. 2. I have spoken toMr. Prellwitz about some of these things and I hope to work with him and his prospetive buyers to make this area habitable and legal for everyone includtg most especially myself. It seems to me a prking lot could be almost tdtally incnspicuous if properly landscaped and perhaps the lovers could go there at night. I have several location suggestions. The most obvius would be Mr. Prellwitzes lot 4 which would be within easy walking distance of the beach. Next would be the lot belonging to Joan an d Dorothy Reddent across from the old Redden property. People cold still drive down to unload things but could not park at anytime. To outline the problems already existing: On really hot days the beach is already overloaded (there is not enough room, literally and legally. In terms of cars and parking they have on occasion been parked on both sides of the road almost from the and of Indian Neck back to the entrance for the public on Richmond Creek. Tyirning at the end of Indian Neck is often difficult andwould probably be impossible if the Day family every regained the pro- perty they have let the town use. The noise from doors aimming, cars stepping and stopping, hot- rodding, playing radios etcetera is excessive. The sexual activity is illegal and totally unnerving and more than anything in the world I would like to have it stopped outside my window. I thank you in advance for your cooperation in trying to resolve these matters. In general in regard to Mr. Prellwitzes plans and having had only twenty four hours to think abut them and considerting I don't want anyone living near me ever, they seem quite fiar. I am sure that you will take great care with enfironmental impact statements, cess pools etcetera and I hope that thepotential buyers will be instructed. on the many products they should not use.
