TOWN OF SOUTHOLD LANDFILL CLOSURE INVESTIGATION SPECIFICATION FOR LABORA TORY ANALYTICAL SERVICES General It is the intent of this specification to describe and procure laboratory analytical services in support of a New York State Department of Environmental Conservation (NYSDEC) 10/93 6NYCRR Part 360 LandfIll Closure Investigation to be undertaken by the Town of Southold (Town). Ail work will be undertaken in compliance with analytical protocols established by the . New York State Department of Environmental Conservation and in conformance with the 10/93 6NYCRR Part 360 requirements. The requested analytical services involve the analysis of groundwater samples, and are presented in summary in Attachment I. laws. The contract laboratory (Laboratory) shall comply with all applicable Federal and State Laboratorv The Laboratory shall be approved in all categories of water, and solid and hazardous waste analytical services by the New York State Department of Health (NYSDOH) under its Environmental Laboratory Approval Program (ELAP), and shall be a laboratory with Contract Laboratory Program (CLP) certification under the NYSDOH ELAP for organic and inorganic analyses to meet the requirements of the 199 I NYSDEC Analytical Services Protocol (ASP). Prior to contract execution, the Town may wish to conduct an audit of the Laboratory. Upon contract execution, the Laboratory shall, at the request of the Town, transmit a copy of its quality assurance protocols and/or its Standard Operating Procedures (SOPs) to Town for review. In addition, shortly after this contract is executed, the Town may wish to convene a meeting among representatives of the Laboratory and the Town to discuss procedures that will ensure appropriate and timely communication among all parties to mitigate or eliminate anticipated problem areas.> Analytical Standards The Laboratory shall use the current NYSDEC analytical methods and procedures as set forth in the 199 I Analytical Services Protocol or, where analytical procedures are not available in the 1991 NYSDEC ASP, shall use procedures in accordance with New York State Department of Health approved methods, the latest edition of Standard Methods for the Examination of Water and Wastewater, the United States Environmental Protection Agency Test Methods for Evaluating Solid Waste (SW-846) or 40CFR Part 136. Attachment 2 contains a table listing monitoring parameters, container type, preservation methods and holding times. Note that for this contract, all analyses must comply with the holding times listed in Attachment 2. .1314\T0308501(ROl) -1- . . . Samole Oriein The following samples will be collected for analysis: · Groundwater Samole Containers and Collection The Laboratory shall provide all the necessary sample containers (IKEM 300 or equivalent) and preservatives depending on the analyses to be performed. The Laboratory shall provide sample coolers, custody seals, chain-of-custody forms, and "blue ice" or other coolants, as necessary. Extra sample containers shall be provided with each shipment in case of breakage. The Laboratory shall ' establish procedures with the Town or agent thereof concerning reporting and transportation procedures, as needed. Town or agent thereof will collect samples in the containers provided by the Laboratory and will deliver/ship the samples back to the Laboratory utilizing the Laboratory's federal express account or the Laboratory's courier service. Analytical Reoort Two copies of the Laboratory analytical results shall be sent to the Town or designated representative by the Laboratory in a Category B format as required by the 1991 NYSDEC ASP and other appropriate non-CLP procedures. Results shall be reported to the Town or designated representative within 30 days of delivery of the last sample of a Sample Delivery Group (SDG) to the Laboratory by the Town. In addition, a copy of the Laboratory analytical results shall be sent to the Town or agent thereof by the Laboratory on diskette in a spreadsheet format. Data packages which are not complete or do not contain all analyses of the SDG will be considered late 31 days after Validated Time of Sample Receipt (VTSR). Costs for late reporting shall be modified to reflect the following price reductions per sample: Days After VTSR Reduction Days After VTSR Reduction 32-35 36-45 5% 10% 46-55 56-65 20% 30% Term The term of the contract shall be for 18 months with an option for an additional 12 months, and all prices shall be held firm for that period initiating at the point when the contract is fully executed between the Town and the Laboratory. . \314\T0308501(ROl) -2- , . . Conditions · Allor part of the 10/93 6NYCRR Part 360 Routine and Baseline compound list (organics and inorganics) analyses and deliverables, as specified in the attached Analytical Services Agreement, must fulfill all of the 1991 NYSDEC ASP Quality Control (Qc) Requirements. In the event that the Laboratory fails to meet the ASP requirements, the Laboratory shall bear the cost associated with resampling by the Town and reanalysis of the samples and data, including data validation. · All appropriate quality assurance/quality control requirements and deliverables associated with non-ASP methods (e.g., SW-846 and 4OCFR136) to analyze appropriate samples shall be provided with the data packages. Representatives of the Town and the ' Laboratory will discuss non-ASP reporting requirements at the "kick-off" meeting previously discussed in this document. . All appropriate quality assurance/quality control requirements and deliverables associated with Routine and Baseline analyses shall be in strict compliance with the 12191 NYSDEC ASP and other laboratory procedures as appropriate (i.e., Leachate Parameters). The deliverables shall include completed NYSDEC "Sample Identification and Analytical Requirements Summary" and "Sample Preparation and Analysis Summary" forms (for organic and inorganic analysis) for each data package. The sample tracking forms must indicate the year of the SW846 and/or NYSDEC ASP used. In the event that the Laboratory fails to meet 1991 NYSDEC ASP QC requirements, the Laboratory shall bear the cost associated with resampling by Town and reanalysis of the samples and data. · In the event that the NYSDOH revokes the Laboratory's certification to undertake laboratory analysis for Routine and/or Baseline parameters and other analyses required under this contract, the Laboratory shall notify the Town or agent thereof within 24 hours. In the event that appropriate certification is lost, and the Town is required to obtain the services of an alternate laboratory to undertake analytical services for this project, the resampling by the Town, reanalysis, revalidation and other expenses incurred to obtain results acceptable to the NYSDEC shall be borne by the Laboratory. · The Laboratory shall extract a sufficient amount of sample to ensure that if a sample must be reanalyzed, the extraction holding time will not be exceeded. Refer to Attachment 2 for a summary of the required holding times. . Should the Town or an agent thereof, have questions relative to data or any attendant material submitted by the Laboratory, the Town will submit the question{s) in writing to the Laboratory representative. The Laboratory, in turn, shall prepare and transmit an adequate response to the Town or agent within five working days. .1314\T0308501(ROl) -3- . . Aooroximate Ouantities The Laboratory shall be aware that the sample quantity is an expected amount. the Town reserves the right to increase or decrease the number of analyses for each constituent group/matrix based upon field conditions. The Laboratory shall be paid according to the quantity of work actually completed and demonstrated as valid by acceptable data validation procedures undertaken by the Town at the respective unit prices detailed in the Laboratory unit prices attached to this contract. Any changes in the work to be done shall not constitute a claim for damages or for loss of anticipated profits. Measurement and Pavrnent Payment shall be on the basis of the unit prices contained in this contract and actual work performed as determined by the Town. The Laboratory is responsible for providing the reporting of all analytical data in compliance with the 1991 NYSDEC ASP and deliverable requirements. The Town will conduct an independent evaluation of the validity of the data in accordance with generally accepted data validation procedures prior to approving payment to the Laboratory.
