Jehovah's Witness Church - The Board reviewed tis site plan
for an addition on an existing church located at Indian Neck
Lane, Peconic. The Board of Appeals had granted a special
exception with the condition that the parking for the use
remain on the premises at all time. Mr. Leo Russell was present.
Mr. Russell stated that he had received approval from the
Highway Department to cut the shoulder on Indian Neck Lane
and Spring Lane to allow additional parking for five cars.
Mr. Russell stated that they have an attendent to park cars
and have not had any problem with this arrangement. Ms. Swatstanowicz,
from the audience, stated that she had seen cars parked acrossed
the street.
On a motion made by Mr. Latham, seconded by Mr. Mullen, it was
RESOVLED that the Southold Town Planning Board approve the
site plan for the "Greenport New York Congregation of Jehova's
Witnesses" lcoated at Indian Neck Lane, Peconic for construction
of an addition on an. existing church, survey dated as last
amendedJuly 16, 1986, subject to:
1. A one-year review.
2. Ail parking for this use should be kept on the premises
(on-site) at all times.
Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward
On a motion made by mr. Mullen, seconded by Mr. Latham, it
was
RESOLVED that the Southold Town Planning Board accept Inspector
John W. Davis' report No. 525 regarding the final inspection
on the access road within the minor subdivision formerly owneed
by Robert and Aldona Norkus located at Southold.
Vote of the Board: Ayes: Orlowski, Mullen, Latham, Ward
On a motion made by Mr. Latham, seconded by Mr. Ward, it was
RESOLVED that the Southold Town Planning Board accept Inspector
John W. Davis' report No. 526 regarding'the final inspection
on the roads within the major subdivision of Land's End located
at Orient.

In relation to verbal advice or comment from Mr. Freeman .
it is regrettable that he seems to be limiting writtep responses
which themselves are not necessarily pertinant or accurate.
As you know, there are disagreements on everything in and out
Of court which makes every conflict problematic and perhaps
at times almost meaningless.
In writing Mr. Freeman offers 'advisory opinions' based on
the information and/or facts presented (usually in writing).
Considering all that these written opinions often are honored
due to laziness but are not necessarily final or accurate/legal.
Verbally our new supervisor has declared his interest in
'opening the prooess' yet the processes, perhaps because of his
wishes, are increasingly being closed - often for no seemingly good
reason.
At the moment most information you claimto need to redact is
easily available elseWhere. I am highly unclear and uncertain
about the proposed redactions on ethics financial forms. For the
public to be informed asmuch information as possible must be
available to themor their conlusions will often err. This is
particularily true when reViewing, for instance, your offices
responses to foil requests, employees statements on financial
statements, and a variety of other typesof applications where
the information you want to redact is r.levant to forming con-
clusions about the truthfulness and fitness of an applicant.
Note that for the moment I am seeking only FOIL requests, not
yet your respmnses. I consider it probably rare that such requests
should be secret. TO identify which Joe Jones is seeking information
I suggest an address or similar identification is necessary. TO
withhold theseforms (and eventually at least some responses) you
are h1.aing what might be misconduct or misfeasance in yOUJ' office.

communications with Mr. Freeman I consider unfounded ana that you are
being led into lawlessness and misconduct.

Gentlemen:
Enclosed is the new site plan with additional parking for the
Kingdom Hall of Jehovah's Witnesses on Iridian Neck Lane in Peconic.
We have also received permission from the Southold Town Highway
Department to enlarge the roads adjoining the present property to
allow additional parking for 5 (five) cars on Indian Neck Lane
as well as 6 (six) more on Spring Lane. These extensions of the road
will allow the parking and keep the present width so there will be no
restricting of the flow of traffic on either of these roads.
With all these parking areas we will be able to accomodate
40 (forty) cars. This will be more than enough to handle the parking
necessary for the attendance the building could seat.
We have also assigned parking attendants to park the cars and
since this arrangement went into affect we have had no problem
with congestion on any of the roads even without the additional
parking we have included in the new site plan.
We hope this will meet with your approval.

The subject premises is an existing use in the 'A'
Residential-Agricultural Zoned District. The proposed
addition will require a Special Exception by the Zoning
Board of Appeals under Art III Sec. 100-30 B (2)
Site plan does not include a schedule indicating
whether existing parking is adequate or whether proposed
use of addition will increase parking needs.
The parking area adjacent to Spring Lane is located
across the street from land Zone 'A' Residential and
shall be screened in accordance to Art XI Sec. 100-112
K (2)
Based on the foregoing this site plan can not be

for Jehovah's Witnesses Church
Dear Mr. Russell:
The following recommendations were made at the April
13, 1987 meeting of the Planning Board with regard to the
above mentioned site 'plan.
The Planning Board conducted a field inspection for the
property and noted that the lights must be shielded from the
adjoining properties. It was also requested that larger screening
be planted. And, it appears that the stormwater runoff is
going down into the creek, therefore, it is requested that
drainage basins be installed in the parking area at the low
spot. The enclosed copy of the survey indicates the area
where the drains should be placed.
We ask that the above noted improvements be finalized
prior to the issuance of a certificate of occupancy.
If you have any questions, please don't hesitate to contact
our office.

The Jehovah's Witness Church, located on Indian Neck
Lane in Peconic, has applied for an 810 ft. addition to
their existing building. Presently there is a parking
promblem during services. Cars are parked allover the side
of the road in Indian Neck Lane and double parked on Spring
Lane. This represents a dangerous traffic situation and
should be corrected. An 810 foot addition will only
aggravate the problem, if not immediately, in the furture.
Please address this issue as you consider~the addition.

WHEREAS, a public hearing was held and concluded on May 22, 1986
in the Matter of the Application of GREENPORT N.Y. CONGREGATION OF
JEHOVAH WITNESSES under Application No. 3498; and
WHEREAS, the board members have personally viewed and are
familiar with _the p,.-emises in question, its present zoning, and
the surrounding areas; and
WHEREAS, at said hearing all those who desired to be heard
were heard, and their testimony was recorded; and
WHEREAS, the board has carefully considered all testimony
and documentation submitted concerning this application; and
WHEREAS, the board made the following findings of fact:
1. By this application, appellant requests a Special Excep-
tion to the Zoning Ordinance, Article III, Section 100-30{B)[2] for
permission to construct a 27' by 30' addition along the easterly
side of the existing building for use as a library in conjunction
with the Greenport New York Concgregation of Jehovah's Witnesses
use as a religious establishment. The addition will be set back
not closer than 24 feet from the southerly property line and 70
feet from the easterly property line, all as shown on survey
amended March 7, 1986, prepared by Roderick VanTuyl & Son.
2. The premises in question is located in the "A" Resi-
dential and Agricultural Zoning District, containing a lot area
of 20,625~ sq. ft. with 165' frontage along the south side of
Spring Lane and 125' frontage along the east side of Indian Neck
Lane. The surrounding properties are also located in the "A"
Zoning District.

3. The subject premises is presently improved with an
one-story frame building of approximately 1,680 sq. ft. which
is set back 40 feet from its front property line along Spring
Lane and 38 feet from its front property line along Indian Neck
Lane, and 24 feet from the southerly property line.
4. It is noted that this project will require site-plan
and parking approval from the Southo1d Town Planning Board,
which is pending this board's determination at this time.
In considering this application, the board finds and
determines that: (a) the use requested will not prevent the
orderly and reasonable use ot adjacent properties or of properties
in adjacent use districts; (b) the use will not adversely affect
the safety, welfare, comfort, convenience or order of the town;
(c) the use is in harmony with and will promote the general
purposes and intent ot zoning. The board has also considered
subsections [a] through L1] of Article XII, Section 100-121(C)L2]
of the Zoning Code.
Accordingly, on motion by Mr. Goehringer, seconded by
Mr. Douglass, it was
RESOLVED, that a Special Exception for permission to
construct an addition of a maximum size 27' by 30' as shown
on survey amended March 7, 1986, prepared by Roderick VanTuyl,
P.C. for religious/library use, as applied under Application
No. 3498 in the Matter of GREENPORT NEW YORK CONGREGATION OF
JEHOVAH WITNESSES, BE AND HEREBY IS APPROVED, SUBJECT TO THE
FOLLOWING CONDITION:
That parking tor this use should be kept on the premises

Dear Mr. Goehringer and Members of the ZBA:
Referring to Appeal # 3498 of the COngregation of
Jehovah Witnesses at 1345 Indian Neck Lane, Peconic - we wish to
point out that when services are held at the above premises there appears
to be insufficient parking presently in their parking area inasmuch as a
number of their vehicles are parked both on Spring Lane, Indian Neck Lane,
and on the private property on the North side of Spring Lane.
To reduce the parking area by putting an addition on the
building will only force more vehicles to park off the premises. By adding
to the building one would expect that you would insist on additional on site
parking spaces, due to the increased square footage of the addition.
We also wish to point out that they do have a number of
spotlights on the outside of the building and we feel it is incumbent upon the
Board to see to it that the lights are properly shielded so that the lighting
will be contained on the property and not cause an inconvenience to their
neighbors.
We hope you will take these comments into account when
making your determination of this appeal.

Referring to appeal No. 3498 for Jehovah Witnesses Congregation
I wish to go on record in opposition to there special exception to
construct an addition of 202 sq. feet. After attenting the
Southold Town Board of Appeals regular meeting Thursday, May 22,
1986 there representative stated that there are now 108 people in
the Congregation and they expect to double. Presently they park
on the private lot on the north side of Spring Lane which will one
day be developed forcing them to park on Indian Neck Lane and on
Spring Lane. If they expect to double there will be an addition
to the parking promblem. They have only 24 parking spots now
and to reduce this through building the addition will be unwise
and encourage traffic congestion. Please adress this issue
as you consider the addition. Thank you.

Separately I have read that the Town has instituted a study of run-off
into the Creeics and other bodies of Hater to try and control and understand

In addition to being ugly and Wh~ecessary and inconsistent Hith a
largely rural very pretty and undeveloped street, if indications hold,

rubber and so on, will head towards and eventually reach Richmond Creek at
the end of Spring Lane. This project has been overseen on a daily basis
by the Building Department, an unHelcome sight on the Lane.

questionable development off :Iells Avenue again involving Jichmond Creek
is having Hhat I am told is to be its sales office renovated by none other

project? Are laws Hritten Htih relatives and cronies businesses in mind?
Discuss and expose this issue please. Ne do not need a concrete
jungle and such Hill further adversely affect the air and Hater 1<hatever it
does to your brother-in-laws pocketbook. It is no coincidence (and not

I wish to go on record as being opposed to the granting
of special exception for permission to construct an
addition. The Congregation already has a parking promblem.
And to take away from the small parking lot will only cause
promblems for the furture.
People park on Spring Lane and on privtae property
on the North side of Spring Lane, and on Indian Neck.
There is a promblem with all the congestion now. To add
an addition will only make a dangerous situtation worse.

Enclosed is a copy of correspondence from the Building
Inspector regarding his review of the above mentioned site
plan pursuant to certification.
As you can see, the plan can not be certified for the
reasons indicated.
We advise that you contact the Building Department to
obtain the procedure for applying to the Board of Appeals,
as noted in the first paragraph of the correspondence.
Also, we would request that you have the site plan revised
to show buffering as indicated in the third paragraph of the
correspondence.
Once the plan meets certification, we will schedule the proposal
on the next available agenda for Planning Board action.

Dear Mr. Russell:
The Planning Board made an inspection of the above
referenced property on March 28, 1990.
The Planning Board will not recommend the issuance of a
Certificate of Occupancy until the following items are addressed:
1. The lights must be shielded from the adjoining
properties.
2. Two drainage basins must be installed in the parking
area at the low spots in order to prevent stormwater
from running into Richmond Creek. The Board did
notice that one drain had been installed as per the
Board's request of April 15, 1987.
The enclosed map shows the recommended location of the
second drain which was requested in the April 15, 1987 letter.
Please notify this office when you have completed the above
items. Another field inspection will be scheduled at that time.
