Terry Southold Town Clerk Enclosure ... ~ ,.~ ~. .1 i esPECIFICATIONS FOR THE PU.HASE OF GASOLINE BY THE TOWN OF SOUTHOLD FOR CALENDAR YEAR 1995 Under these specifications, the Town of Southold seeks bids for the purchase of all its gasoline requirements for the 1995 calendar year for all Town Departments. The Police Department maintains Police Headquarters at Peconic, New gallons of unleaded gasoline annually. The Highway Department maintains a 1,000 gallon tank for unleaded gasoline, and a 1,000 gallon tank for unleaded plus gasoline. All tanks are located at the Highway Department premises at Peconic Lane, Peconic, New York. The Highway Department uses approximately 12,000 gallons of unleaded gasoline annually, and approximately 24,000 gallons of unleaded plus gasoline annually. In submitting bids, the bidder must either submit a fixed price per gallon to be charged throughout the term of the contract, or a price which is based on a rack price at the bidder's source of supply. If a rack price is used, the lowest rack price within five (5) days of each delivery to the Town must be used. T ,",wn CI~"" Dear Judy: It is my understanding that All American has bid on the gasoline for the Town of Southold, I also understand that the bid was altered and then submitted. I can only believe that it would make the bid null and void as other bidders submitted bids based on the require- ments stated in the specifications. I want to go on record and state that All American's service to the Police Department was unsatisfactory. The Police Department functions 24 hours a day, 365 days a year. This certainly includes holidays and week- ends. On four occasions, in the year 1994, our department ran out of gasoline for the police vehicles and had to find a supply through other sources. On two occasions, the pumps had to be repaired as the dry source caused the pumps to seize. For our department, 24 hour delivery is not acceptable. Automatic delivery would give my department a constant supply of gasoline. The Town employs police officers to do nolice work and not to climb tanks to determine the amount ~f gasoline that remains. Automatic delivery eliminates the need for us to do All American's work. All American has altered not acceptable for our needs. rejected, this portion of the bid. BIDS FOR FUEL DATE: NOVEMBER 3, 199~ You have asked whether the Town may reject a bid for failure to comply with the specifications. All American was the low bidder for gasoline, but the bid changed the specifications to eliminate the obligation to check the fuel tanks for content except by telephone, and changed the notice requirements for deliveries from four hours to twenty-four hours. I believe the vendor note re pump repair is a clarification, rather than a change, of the specs. On All American's bid for diesel fuel, it changed the specs to delete the obligation to check the fuel tanks for content except by telephone. I believe the other notes are for clarification and are not a change in the specs. The law provides that a bid should be awarded to the lowest responsible bidder who complies with the specifications as advertised. Whether a bid complies with specifications involves a factual determination by the awarding board and the courts will generally not upset that determination except where fraud or bad faith are present. A town may decline bids which fail to comply with the literal bid specifications or it may waive a technical non-compliance if it is in the town's best interest. I believe the Town could reject the All American bid. I suggest that Ray Jacobs give the Town Board additional information showing why the changes in All American's bid are significantly different from the Highway Department's needs. SPECIFICATIONS FOR THE PURCHASE OF GASOLINE BY THE TOWN OF SOUTHOLD FOR CALENDAR YEAR 1995 Under these specifications, the Town of Southold seeks bids for the purchase of all its gasoline requirements for the 1995 calendar year for all Town Departments. The Police Department maintains Police Headquarters at Peconic, New gallons of unleaded gasoline annually. The Highway Department maintains a 1,000 gallon tank for unleaded gasoline, and a 1,000 gallon tank for unleaded plus gasoline. All tanks are located at the Highway Department premises at Peconic Lane, Peconic, New York. The Highway Department uses approximately 12,000 gallons of unleaded gasoline annually, and approximately 211,000 gallons of unleaded plus gasoline annually. In submitting bids, the bidder must either submit a fixed price per gallon to be charged throughout the term of the contract, or a price which is based on a rack price at the bidder's source of supply. If a rack price is used, the lowest rack price within five (5) days of each delivery to the Town must be used. Verification of the rack price used by the bidder must be supplied by the bidder to the Town upon request. Vendor receiving the award must check tanks twice weekly and fill a 2,500 gallon capacity tank York, and uses approximately at the 70,000 as necessary.
