The following action was taken by the Southold Town
Planning Board, Monday, June 9, 1986.
RESOLVED that the Southold Town Planning Board approve
the set-off of C. Bruce and Anne Staiqer to set off 23,518
square feet from 46,293 square feet as shown on the Van Tuyl
survey dated August 21, 1985. Property is located at Wells
Road, peconic, tax map numbers 1000-86-2-4 & 5.
It was also noted for the record that a variance
was received from the Board of Appeals.
When the survey has been endorsed, we will forward
a copy to you for your records.

Comments: The Health Department's primary environmental concern
pertaining to development is that the applicant comply with the
requirements of the Suffolk County Sanitary Code especially
Articles V and VI, and relevant construction standards for water
supply and sanitary sewage disposal. These considerations are to
be reviewed completely at the time of application. Full considera-
tion in placement of water supply wells and disposal systems is
given to State and Town wetland requirements. The Health Depart-'
ment maintains jurisdiction over final location of disposal and
well systems and the applicant should not undertake to construct
any water supply or disposal system without Health Department
approval.
Other portions of the Suffolk County Sanitary Code also apply to
commercial development such as Articles VII and XII. The Lead

Dear Mr. Staiger:
I am in receipt of your application for approval of the above
referenced realty development.
This is to confirm that approval to this Department for a realty
development is not required at the present time.
This Department is using the 1980 tax maps as a guide in determin-
ing whether or not the filing of a realty development map is required under
Article 6 of the Suffolk County Sanitary Code. Since it appears that the
number of tax parcels have not increased since 1980, this Department is not
requiring the filing of a realty development map.
It should be noted that, the policy of this Department's use of
the tax maps as a guideline is under review by the County Attorney's office
and therefore subject to change in the future.

WHEREAS, a public hearing was held and concluded on May 1,
1986, in the Matter of the Application of C. BRUCE AND ANNE STAIGER
under Appeal No. 3399; and
WHEREAS, the board members have personally viewed and are
familiar with the premises in question, its present zoning, and the
surrounding areas; and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded and transcribed; and
WHEREAS, the board has carefully considered all testimony and
documentation submitted concerning this application; and
WHEREAS, the board made the following findings of fact:
1. The premises in question is located along the southeast
sid~'of Wells Road, in the HJmlet of Peconic, and is identified on
the Suffolk County Tax Maps as District 1000, Section 86, Block 2,

2. The subject premises consists of a total area of 46,293
square feet (combined total), an average depth of 219:t feet, and
lot width (frontage) of 210 feet. Existing on the westerly portion
of the subject premises is a single-family, It-story frame house
with an accessory garage, both as shown by survey prepared by
Roderick VanTuyl, P.C. August 21, 1985.

3. By this application, appe11dnts request approval of the
insufficient lot area, depth and width of two parcels: (a)
on the westerly portion, Lot #1, of 22,775 sq. ft., 227.10 depth,
and 100 feet in width; (b) on the easterly portion, Lot #2, of
23,518 sq. ft. to a tie line, 227.10 depth, and 110' lot width.
The existing dwelling is shown on Lot #1 with a setback from the
proposed easterly si~e line (proposed division line) at not less
than 10 feet and with a setback fror" the rear property 1 ine (at
a tie line) at its closest point at 70I feet. Lot #2 is vacant.

Kathryn N. Wells and others, to the applicants conveying
proposed Lot #2; (c) N.Y.S. Department cf Environmental
Conservation Article 25 Tidal Wetlands Permit issued Octo-
ber 31, 1985 for the re-division as proposed; (d) Suffolk
County Health Department letter dated August 27, 1985 waiving
Article VI for a realty development since the number of parcels
has not increased since 1980 as per the County Tax Map records;
(e) letter dated October 9, 1985 from the Southolc Town
Planning Bcard indicating that the set-off applicaticn be
denied becalse it does not conform with the Clrrent zonins
requirement of 80,000 each and needs a variance.
5. In viewing the immediate area, the board finds
that parcels located generally north and south of the
subject premises consist of an area similar or smaller than
that proposed hereir. Also, it is noted that Lot #1 was
purchased prior to the enactment of zoning (1957); and lot
#2 was purchased at the time of the 12,500 sq. ft. area zoning
requirement.
In considering this appeal, the board finds and
determines: (a) that the circumstances are unique; (b)
that the variance will not in turn cause a substantial effect
of increased population density or be adverse to the safety,
health, welfare, comfort, convenience and crder of the town;
(c) the practical difficulties shown ere sufficiert to warrant
the granting of the variance; (d) there will be no substantial
change in the character of the neighborhood or a substantial
detriment to adjoining properties; (e) the difficulty cannot
be obviated by some method feasible for appellants to pursue
other than a variance; (f) that in view of the manner in which
the difficulty arose and in consideration of all the above fac-
tors, the interests of justice will best be served by allowing
the variance applied for.
Accordingly, on motion by Mr. Goehringer, seconded by
Mr. Sawicki, it was
RESOLVED, that the relief requested under Appeal No. 3399
in the Matter of the Application of C. BRUCE AND ANNE R. STAIGER
for approval of the insufficient lot area, depth and width of
parcels #1 and #2 of 22,775 sq. ft. and 23,518I sq. ft., of
227.10 lot depth, and 100 ft. and 110 ft. width, respectively,

The Health Department's primary environmental concern pertaining
to development is that the applicant comply with the requirements of the
Suffolk County Sanitary Code especially Article V and VI, and relevant
construction standards for water supply and sanitary sewage disposal.
These considerations are to be reviewed completely at the time of
application. Full consideration in placement of water supply wells
and disposal systems is given to state and town wetland requirements.
The Health Department maintains jurisdiction over final location of
disposal and well systems and the applicant should not undertake to
construct any water supply or disposal system without Health Department
approval.
Other portions of the Suffolk County Sanitary Code also apply to
commercial development such as Article XII. The lead Agency is requested
to forward a copy of this form to the applicant with its findings.

I am now in the process of tryin, to undo the town's action
which has createa hardship and problems for us by punishin, us for
the "crime" of having both of our lots listed with the same ownership
on the deeas. We are not tryin, to divide a one acre lot; merely
trying to reestablish the fact that we bou~ht two lots at different
times in ,ood faith lon, before the one acre zonin, requirement was
established. Circumstances have aevelooed that make it verv likelv
that in the not too distant future we shsll need to be able to
imolement our orieinal olans for lot e'-2-..
I should like to submit in support of our plea for approval of
the set-off we are requestin" the followin, facts:
1. The town's action in joinin, these two lots has createa
both difficulties ana hardship in relation to our plans
for lot e2-2-..
Mrs. Stai,er has suffered three serious heart failures
in the past year and a half, and the time is near when
we must think of movin, to a smaller house that will be
less demandin, upon the two of ue.
2. The two lots in question are surrounded (north and South)
by a number of lots of rou,hly similar size. In fact,
checkin, either the tax map, or the map prepared from
the ori,inal survey map from our deed (copies submitted)
will reveal that of the ten lots involved, our two lots
are somewhat lar,er than any of the others. This is
confirmed by the required new survey maps that show
both of our lots to be over 1/2 acre each; while .ost
of the other lots are considerably less than 1/2 acre.
3. I also enclose a letter from the Suffolk County Dept.
of Health Services which reco,nizes the e.istance of
two lots and atates that "epproval of thie Department
for a realty development is not required".
.. I have submitted all the necessary documents (application
#10-15-0"5) to the DEC and the two pro,ram mana,ere with
whom, I talked seem to forsee no difficulties in securin,
approval from the DEC.
May I request that you expedite your decision in this case since
as a result of Mrs. Stailer's problems, I hope to take her to a warmer
climate durin, the winter months as suwwested by her doctor.

davelooment is not required at the present ti~.
This Department is using the 1980 tax maps as a guide in determin-
ing whether or not the filing of a realty development map is required under
Article 6 of the Suffolk County Sanitary Code. Since it appears that the
number of tax parcels have not increased since 1980. this Department is not
requiring the filing of a realty development map.
It should be noted that, the policy of this Department's use of
the tax maps as a guideline is under review by the County Attorney's office
and therefore subject to change in the future.
