The lot to be set off is suitable for residential purposes without danger of flood or other perils. The house on Parcel 2 has existed on the lot since 1958. 2. Adequate provision has been made for drainage and sewer disposal. A Health Department application for the water SUpply is pending. 3. The lot to be set off conforms to the sizes of the lots in the surrounding R-40 zone. 4. REASON FOR APPEAL .ontinUed . 1 STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because the zoning ordinance would permit only one odd-shaped lot. The house, built in 1958, is on the westerly side of the lot, while the easterly side was obtained in 1968. This leaves the easterly side virtually unbuildable, resulting in a drastic re- duction in value. 2 The hardship created is UNIQUE and is nbt shored by all properties alike in the immediate vicinity of this property and in this use district because other lots in the vicini ty, except the parcel to the north, are all zoned R-40, and have lot sizes of approximately one acre or less. 3 The Variance would observe the spint of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because the proposed lot sizes are in conformity with the neighborhood scheme. When the area was rezoned under the Master Plan in January, 1989, every single parcel in the area was zoned R-40 except for this parcel, which was arbitrarily excluded.
