Dear Mr. Samuels:
The following resolution was adopted by the Southold Town Planning Board at a
meeting held on Monday, December 10, 2001.
The final public hearing was closed.
The following resolution was adopted:
WHEREAS, Rita J. Pellegrini is the owner of the property known and designated as
Pellegrini Vineyards, located at Route 25 in Peconic; and
WHEREAS, this site plan for Pellegrini Vineyards is to restore an existing barn for wine
storage; and
WHEREAS, this site plan was certified by the Building Department on December 10,
2001; and
WHEREAS, the Town Engineer has reviewed the drainage calculations and the
Planning Board has accepted his recommendation for approval; and
WHEREAS, the Southold Town Planning Board has determined that this action is a
Type II Action and not subject to review under the State Environmental Quality Review
Act, (Article 8), Part.617; and

WHEREAS, a final public hearing was closed on said application at Town Hall,
Southold, New York on December 10, 2001; and
WHEREAS, all the requirements of the Site Plan Regulations of the Town of Southold
have been met; be it therefore
RESOLVED, that the Southold Town Planning Board grant final approval on the
surveys, dated October 18, 2001, and authorize the Chairman to endorse the final
surveys subject to a one year review from date of building permit.
Enclosed please find two copies of the approved site plan; one for your records and one
to be submitted to the Building Department when you apply for your building permit.

as Pellegrini Vineyards, located at Route 25, Peconic; and
WHEREAS, on December 11, 2001, the Southold Town Planning Board granted approval on
the site plan prepared by Thomas C. Samuels dated October 18, 2001; and
WHEREAS, in a letter dated February 24, 2012, the owner requested a final site inspection;
however, Site Plan Approval expired unbeknownst to the owner in December of 2004. The site
plan approval must be extended prior to final inspection; therefore, be it
RESOLVED, that the Southold Town Planning Board grants an Extension of Site Plan
Approval from December 11, 2004 to June 11, 2012 on the site plan entitled "Renovations to

Dear Ms. Pellegrini:
I am writing as a follow-up to the Planning Board Work Session held on March 12, 2012
where the application referenced above was discussed. This application was approved
in December, 2001, and the approval expired three years later, December 2004 (all Site
Plan Approvals expire in three years). The Site Plan Approval must be extended by the
Planning Board prior to a final inspection and subsequent Certificate of Occupancy
being issued by the Building Department.
Because it has been over seven years since the site plan expired, the Planning Board
must first conduct a site visit prior to granting an Extension of the Site Plan Approval.
Following the site visit, the Board will review the application and consider granting an
extension at their next available public meeting (likely April 9th, 2012).
To expedite the process, the Board will need an affidavit from a licensed engineer or
other qualified professional stating that the drainage was installed according to the
Approved Site Plan. In addition, because the Town Code has been up-dated since this
approval expired, please send a letter stating what, if any, exterior lighting is proposed
or has been installed on the building.
The final step for the Planning Board will be to find that the site plan has been
completed in accordance with the Approved Site Plan. They will do so in writing, at
which time you may then apply to the Building Department for the Certificate of
Occupancy.

Dear Ms. Pellegrini:
I am writing as a follow-up to the Planning Board Work Session held on Mamh 12, 2012
where the application referenced above was discussed. This application was approved
in December, 2001, and the approval expired three years later, December 2004 (all Site
Plan Approvals expire in three years). The Site Plan Approval must be extended by the
Planning Board prior to a final inspection and subsequent Certificate of Occupancy
being issued by the Building Department.
Because it has been over seven years since the site plan expired, the Planning Board
must first conduct a site visit prior to granting an Extension of the Site Plan Approval.
Following the site visit, the Board will review the application and consider granting an
extension at their next available public meeting (likely April 9th, 2012).
To expedite the process, the Board will need an affidavit from a licensed engineer or
other qualified professional stating that the drainage was installed according to the
Approved Site Plan. In addition, because the Town Code has been up-dated since this
approval expired, please send a letter stating what, if any, exterior lighting is proposed
or has been installed on the building.
The final step for the Planning Board will be to find that the site plan has been
completed in accordance with the Approved Site Plan. They will do so in writing, at
which time you may then apply to the Building Department for the Certificate of
Occupancy.

As a follow up to the letter sent to you dated June 6, 2007, the Planning Board is in receipt of the as-built
site plan prepared by Samuels & Steelman dated October 18, 2001 and last revised June 8, 2007. The
Planning Board reviewed the as-built site plan submitted at their work session on June 11, 2007.
As you explained at the work session, the proposed drainage/dry wells and leaders have not been installed.
After discussions with the Planning Board and the Town Engineer the drainage must be installed to the
satisfaction of the Town Engineer prior to the issuance of a final site plan sign off.
In addition, please ensure the installation of all handicap parking complies with New York State Code and
ADA requirements. AS discussed, the five (5) landbankad parking spaces should be either shifted or
adjusted so they are not directly abutting the. existing 24.2' x 20.5' structure.
Once the above referenced items have been completed, please contact this office, in writing so that a final
site inspection maytake phce. In addition, please submit three (3) copies of the as-built site plan for review

At your written request for a final satisfaction letter, dated May 1, 2007, Planning Department staff
performed a site visit at the above referenced location. On December 11, 2001, the Planning Board issued
an approval to "restore an existing barn for wine storage". In reference to the above, the Planning Board
held a work session to review the approved site plan prepared by Thomas C Samuels dated October 18,
2001, the adopted resolution dated December 10, 2001 and site visit staff comments.
In comparing the approved site plan with the existing conditions, it appears the on ske conditions do not
match the approved site plan. Some of these changes include:
· The proposed drainage/dry wells and leaders do not appear to have been installed. As per the
Town Engineer, this must be completed.
· The existing driveway does not appear to match the approved gravel driveway for the site.
· There is a shed near the southwest comer of the approved building which is not shown on the
approved site plan. A determination from the Building Department should be made to determine if
an amended site plan is required. Please contact this Department directly.
· The proposed concrete slab and loading dock on the approved plan do not appear to be installed.
Please provide details regarding the size of the existing concrete slab.
· The approved 5 space parking area does not appear to be ins/ailed. In addition, the approved plan
indicates two (2) handicap parking spaces that have not been installed.
· There is a dumpster at the northeast comer of the approved building which is not shown on the
approved site plan.

Please submit, in writing, anychanges to the site plan including an explanation of those changes. Prior to
final site plan approval all requirements of the adopted resolution and approved site plan must be met. Any

NOTICE OF PUBLIC HEARING
§ 58-1. Providing notice of public hearings.
[HISTORY: Adopted by the Town Board of the Town of
Southold 12-27-1995 as L.L. No. 25-1995, Amendments
noted where applicable.]
§ 58-1. previding notice of public hearings.
Whenever the C~de calls for a public hearing, this section
shall apply. Upon determining that an application is complete,
the board or commission reviewing the same shall fix a time
and place for a public hearing thereon. The board or commission
reviewing an application shall provide for the giving of notice:
A. By causing a notice giving the time, date, place and ·
nature of the hearing to bo published in the official
newspaper within the period prescribed by law.
B. By requiring the applicant to erect the sign provided by
the town, which shall be prominently displayed on the
premlse~ facing each public or private street which the
property involved in the application abuts, giving notice
of the application, the nature of the approval sought
thereby and the time and place of the public hearing
thereon. The sign shall be set back not more than ton
(10) feet from the preporty ]/ne. The sign shall be
display, ed for a poried of not le~s than seven (7) days
immediately precedin~ the dato of the public hear/ng.
The applicant or his/her agent shAl! fie an affidavit that
s/he has complied with this provision.
C. By requiring the applicant to send notice to the owners
of record of every property which abuts and every
property which is across from any public or p~/vato street

existing barn located at the above referenced facility. The renovation plans were prepared
by Samuels & Steelman's Office and dated 10/18/01.
The drainage calculations provided on the site plan meet the minimum requirements
of the Town Code.

Dear Bob,
Enclosed you will find a SITE PLAN APPLICATION and drawings for the Richmond
Creek Farm site on the Main Road in Peconic. There is currently a house, a barn,
and a garage on the site. The barn has a building permit and construction is under way
to restore the existing structure and provide new exterior finishes. This application
seeks approval for case storage use in part of the existing barn.
There is no plumbing component to the project at this time, so no application has been
made to the Suffolk County Health Department.
Enclosed also please find a check to the application fee. I have calculated the amount
as follows:
