Dear Ms. Tiska:
The following took place at a meeting of the Southold Town Planning Board on
Monday, April 6, 1998:
The final public hearing, which was held on March 16, 1998 and continued on
April 6, 1998, was closed.
The following resolution was adopted:
WHEREAS, the Peconic Land Trust is the owner of the property known and
designated as SCTM~ 1000-86-1-9 (a.k.a. SCTM~ 1000- 86-1-9.1, 9.2 and 9.3),
located on the south side of Main Road and the north side of Wells Road in
Peconic; and
WHEREAS, the proposed minor subdivision is for Section 1 of a proposed
subdivision with a total of four (4) lots; and
WHEREAS, Section 1 contains two (2) lots: Lot Number 1 is 41.2849 acres in
area, of which the Town has purchased the development rights on 37.2849
acres. Lot Number 2 is 7.9242 acres which will be further subdivided as Section
2, into a total of three 2 acre lots; and
WHEREAS, the Southold Town Planning Board, pursuant to the State

Environmental Quality Review Act, (Article 8), Part 617, declared itself lead
agency and issued a Negative Declaration on the four (4) lot subdivision (both
Sections 1 and 2) on January 26, 1998; and
WHEREAS, as shown on the final map, there is a deed discrepancy in regard to
the southerly most section of the parcel involving an area of 0.3403 acres; and
WHEREAS, this discrepancy will be resolved by Peconic Land Trust giving the
right to this property to Chester H. Skwara and Joyce M. Skwara; and
WHEREAS, should the Peconic Land Trust, or future owner of Lot Number 2,
choose not to proceed with any further subdivision of Lot Number 2, any
development occurring on Lot Number 2 shall be set back at least 75 feet from
the landward limit of the wetland. Grading within the 75' area shall be prohibited,
and clearing and cutting shall be limited to that necessary for proper
maintenance and removal of diseased, decayed or dead material and obnoxious
plant species; and
WHEREAS, the Southold Town Planning Board, pursuant to Chapter 58, Notice
of Public Hearing, has received affidavits that the applicant has complied with
the notification provisions; and
WHEREAS, a final public hearing was closed on said subdivision application at
the Town Hall, Southold, New York on April 6, 1998; and
WHEREAS, all the requirements of the Subdivision Regulations of the Town of
Southold have been met; be it therefore
RESOLVED, that the Southold Town Planning Board approve and authorize the
Chairman to endorse the final surveys dated February 26, 1998.
Enclosed please find a copy of the map which was endorsed by the Chairman.

State Environmental Quality Review
FULL ENVIRONMENTAL ASSESSMENT FORM

Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-
[y, there are aspects of a proiect that are subjective or unmeasureable. It is also understood that those who determine
significance may have little or no formal knowledge of the environment or may be technically expert in environmental
analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting
the question of significance.
The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination
process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a project or action.
Full EAF Components: The full EAF is comprised of three parts:
Part 1: Provides objective data and information about a given project and its site. By identifying basic project
data, it assists a reviewer in the analysis that takes place in Parts 2 and 3.
Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides
guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially-
large impact. The form also identifies whether an impact can be mitigated or reduced.
Part 3: If any impact in Part2 is identified as potentially-large, then Part3 is used to evaluate whether or not the
impact is actually important.

Dear Ms. Lapides:
On April 15, 1999, you submitted one (1) mylar map of the Richmond
Creek Farms, Section 1 subdivision with a request for the Planning Board
Chairman to re-endorse the subdivision.
The original subdivision, Richmond Creek Farms Section 1, map dated
February 26, 1998, was approved by the Planning Board on April 6,
1998, and was endorsed by the Planning Board Chairman on the same
date. Richmond Creek Farms, Section 1, was not flied in the Suffolk
County Clerk's Office since it was understood that upon the Planning
Board's approval of Richmond Creek Farms, Section 2, both Sections 1
and 2 would be simultaneously filed in the County Clerk's Office. As you
know, Richmond Creek Farms, Section 2, was approved by the Planning
Board, and endorsed by the Chairman on April 5, 1999.
At the Planning Board's April 19, 1999, work session, the Planning Board
re-endorsed the mylar for Richmond Creek Farms, Section 1, in order for
the mylar to be filed in the County Clerk's Office. The map, dated
February 26, 1998, is the same map as was originally endorsed by the
Planning Board Chairman on April 6, 1998, and contains an updated
approval (March 25, 1999) from the Suffolk County Department of Health
Services.
The mylar must be picked up at the Planning Office. Please submit two
(2) paper copies of the endorsed map for the Planning Board's
records.

This land, together with the remaining land to the north of it, extending to the terminal
end of Richmond Creek, can best be described as the most ecologically significant, fragile
and sensitive tidal wetland of Richmond Creek and perhal~ of the entire North Fork.
Owing to its rugged configuration, narrow, shallow in spots, and densely wooded and
undeveloped, it is virtually free of power boating, thereby making it a quiet and serene
wildlife and bird sanctuary. To those who may not be aware of it, I can personally verify the
existence of many rare and endangered species which thrive there.
To namc a few:
A largc resident colony of Belted Kingfisher which may be seen frequently
anywhere in thc creek, but do their nesting and reproduction deep in that sanctuary at thc
north end.
Other species observed there are: several species of plover, Snipe and Woodcock,
Black Skimmers, Black and Yellow Crowned Night herons, Green Backed Herons, Great Blue
Herons, Snowy Egrets, Great American Egrets, and many species of medium to small wading
shore birds, yellow legs, Dowitchers, etc.
In addition, there are a significant number of predatory hawks and falcons, such as the
Kestrel, the Merlin, the Peregrine and the No,hem Harrier, Hawks, such as the Red-tailed,
Coopers, and Broad-Winged. There are also occasional Ring-Necked Pheasants, coveys of
quail, Mallard ducks, Buffehead, Geese, Loons and many other species of waterfowl.
Muskrat, Red Fox, white-tailed deer and many species of song birds nest and reproduce in
that sanctuary, some common, some rare or unusual, some migratory and some resident.
As for the effect that more housing will have on the quality of marine shellfish, finfish
and plant life, there is no reasonable argument that may be made in its defense. Down,
through the years, residents of creek front homes have seen water quality deteriorate to thc
point where shellfishing has been banned. In my view, the cause has been overdevelopment,
plain and simple.
Some degradation of wildlife has affcady occurred. In my opinion, this was caused by
the construction of large homes at the foot of Spring Lane. This building process was
unusually loud, disruptive and prolonged. What was once a solid wall of beautiful, tall
evergreens on that peninsula is now a skimpy scattering of trees dominated by obtrusively
large and awkwardly sited housing there, ff an agreement to preserve the pines was made, it,
apparently has failed. A commensurate loss of habitat and wildlife is the result. In my
opinion, the outcome of the proposed development of Lot g2 will be far more serious,
because it is in the very hcart of the sanctuary I have described.
While most conservative minded residents reco~c, niT~: thc importance of the wildlife
sanctuary here, the value of the productive nature of the marine environment cannot bc
overstated. It is a natural spawning nursery for a wide range of finfish, from bottom feeding
food fish, such as: flounder, fluke, eel, porgy, etc., to species such as Striped Bass, Weakfish,
Bluefish and others. In view of worldwide recognition of thc depletion of fisheries thc world
over, thc value of this natural spawning estuary takes on special significance, and we should
be willing to do whatever it takes to protect it.
The best solution imaginable, of course, would be for thc state, which has been so
generous with thc costly and troublesome mandates it has imposed on us, to do something
beneficial for the East End, by funding a total acquisition of thc entire creekfront properties
on the northern end to preserve forever this precious habitat.
Failing that, I propose that a full environmental impact study be made on this proposal.
Were that to happen, I think a negative result would be likely. At the very least, thc buffer
zone should be increased from a meaningless 75 feet to 200 feet or something more
reasonable,for thc survival of thc sanctuary and thc marine environment.

Reasons Supporting This Determination:
An Environmental Assessment Form has been submitted and reviewed,
and it was determined that no significant adverse effects to the
environment were likely to occur should the project be implemented
as planned.
The Planning Board has received correspondence from the Town Trustees
stating that the Trustees have no objection to the proposed subdivision. The
Trustees noted that Trustee jurisdiction extends 75' landward of the Tidal
wetlands. Building envelopes for the proposed subdivision are shown as being
75' landward of the tidal wetland.
The proposed project is consistent with land use in the surrounding area and lot
sizes are equal to or greater than lots in the surrounding neighborhood. Subsoils
are conducive to sanitary and drainage leaching facilities as evidenced by the
on site test holes. There is no significant erosion potential expected as a result
of development.
The Planning Board has received correspondence from the New York State
Department of Environmental Conservation. That agency had no objection to the
PIanning Board assuming lead agency as the anticipated impacts are primarily
of local significance.
The applicant will have to comply with the requirements of the Suffolk
County Sanitary Code (SCSC) and all relevant standards of water supply
and sewage disposal systems. Design and flow specification, subsurface
soil conditions and site plan details will have to be approved by the Suffolk
County Department of Health Services (SCDHS). This impact is not
considered significant due to the anticipated project compliance with
established requirements of the SCSC and the SCDHS and the required
relevant permits.

stating that there is to be a seventy-five (75) foot wide wetland buffer area
adjacent to the wetland area. Grading within this area shall be prohibited

Lots 2 and 3 shall be accessed by a common driveway, as indicated on the
proposed subdivision plan. The Declaration of Covenants and Restrictions
shall provide for an access agreement and maintenance agreement for the
two lots.
Sketch plan approval is conditional upon submission of final maps within six
months of the date of sketch approval, unless an extension of time is requested
by the applicant, and granted by the Planning Board. The final maps, six (6)
paper prints and two (2) mylars must contain a current stamp of Health
Department approval and must be submitted before a final public hearing will be
set.
The sketch plan has been referred to the Suffolk County Planning Commission
and the Town Trustees for review. You will be notified when the Planning Board
receives reports from these agencies.
The sketch plans have been referred to the Southold Fire Department for their
recommendation as to whether a firewell is necessary for fire protection. You will
be notified if a firewell is required.
The Planning Board has reviewed the property and has decided that it is
inadequate in size for a reservation of land for park and playground use.
Therefore, a cash payment in lieu of land reservation will be required as per
Section A106-38 (e) of the Town Code. The amount to be deposited with the
Town Board shall be $6000.00 (two thousand dollars per vacant lot in the
subdivision.) Payment is required prior to any final endorsement of the
subdivision.

Pursuant to the requirements of Section A14-24, Article XIV of the Suffolk County
Administrative Code, the above captioned proposed final plat which has been referred to the Suffolk
County Planning Commission is considered to be a matter for local determination. A decision of
local determination should not be construed as either an approval or disapproval.
Comments:
This local determination is rendered with the understanding that prior to the granting of final
approval the map shall be revised pursuant to the following:
1. The title block to be revised pursuant to chapter 5 (Requirements of Notice 2.b.[1]).
The name of the proposed minor subdivision (i.e.: Peconic Land Trust, Inc.) is similar
enough to map titles previously submitted by Southold Town to warrant the name to be
changed. Commission staff recommends something to the effect "Minor Subdivision of
Richmond Creek Farms."
Panhandle lots (flag lots) should not be created where the length of the panhandle is greater
than 300. Excessive driveway length may cause difficulty for emergency equipment
attempting to reach the main portion of the parcel. The configuration of lot 3 should be
reconsidered.
The "Landward limit of tidal wetlands" as indicated on the submitted map should be
verified by Town conservation or State conservation biologists and indicated on the map
as to the verifying agency and date.

5. No new residential structure or sanitary disposal facility should be constructed or otherwise
located within 100 feet of the wetlands bordering the parcel.
6. No stormwater runoff resulting fi.om the development and improvement of the subdivision
or any of its lots should be discharged into wetlands bordering the parcel.
Appropriate steps should be taken to ensure the agricultural reserve area shown on this map
remains undeveloped except for those agricultural related structures which are permitted
by Town Law.
Deed restrictions and covenants should be placed on the agricultural reserve so as to limit
any residential structures and also to advise future residents that the agricultural reserve
exists and that those lots may be subject to the noise and fugitive dust normally associated
with agricultural activities.
All prospective owners of lots within this subdivision should be advised that their lots are
located adjacent to an agricultural reserve and those lots may be subject to the noise and
fugitive dust normally associated with agricultural activities.
The final map should bear the following note: A Declaration of Covenants and
Restrictions has been filed in the Suffolk County Clerk's Office which affects lots in this
subdivision.
8. The deed description discrepancy for the southeast comer of the subject parcel should be
resolved prior to final approval.
The map of this minor subdivision should be filed in the office of the County Clerk. This
is to insure the validity of the subdivision map and that the subdivision map will be
available to the general public in a central office of official records.

The Commission also notes the timing of the referral (Dated Dec. 30, 1997, received Dec.
31, 1997) and the intent of the Southold Planning Board to render a decision at the January
5, 1998 meeting. Please be advised that actions subject to Suffolk County Planning
Commission review which are taken without referral to and action by the Suffolk County
Planning Commission are procedurally defective. A procedural defect may render a
development project null and void and could invalidate the use and occupancy of the site
and adversely affect the owners interest therein.

Dear Melissa:
As per our discussion, I have reviewed the Full EAF and the subdivision sketch plan
completed by the project applicant. At this time I have completed the following work with
regard to this project.
1. Review of Full EAF
The Full EAF submitted by the project applicant has been reviewed against two
field inspections and the proposed project plan. I find this document to be accurate and
complete.
2. Field Inspection and Project Review
I inspected the subject site on December 16 & 17, 1997. The subject site is a
large agricultural tract, 49.55 acres in size, located southeast of Main Road in Peconic,
west of Wells Road and fronting the western tributary of Richmond Creek to the
southwest. The site includes several existing structures including a house, two barns and
a garage clustered in the north. This parcel is bordered by a sod field and residential
housing to the northeast and south and residential housing and Richmond Creek to the
southwest. A narrow wetland fringe extends along the entire frontage on Richmond
Creek.
The existing house and structures are clustered at the north end of the site. This
area is proposed to be part of the future 4.00 acre development area fronting Main Road.
Southeast of this area is the proposed 37.6252 acre non-development area extending to
Wells Road at the south end. The southern comer of the site fronting Richmond Creek is
an area of 7.9242 acres proposed to be subdivided into three lots. Proposed lots would
be (#3) 2.4087 acres, (#2) 2.6229 acres and (#1) 2.8926 acres from north to south. The
northernmost lot would have 322.4 feet of frontage followed by 393 feet and 232.5 feet
for the second and first lots, respectively. Each lot would range from 247 to 434 feet
deep. Lots are proposed to be serviced by individual wells and onsite sanitary systems.
Access to the lots would be from Wells Road near its terminus at Richmond Creek.

Inspection of the parcel finds several vegetation cover types. The most
extensive vegetation type is agricultural. This type encompasses all of the future
development area fronting Main Road, the majority of the proposed non-development
area and part of the minor subdivision. The second most predominant cover type
includes disturbed upland/shrub including most of the area immediately landward of the
wetland fringe up to the edge of the existing farm field. This area is littered with brush
from the cutting of black locust trees which are the dominant tree between the wetland
and farm field. A narrow band of mature oaks and cedars occupies much of the area
landward of the wetland boundary within lot 1 and a small portion of lot 2. Estuarine
tidal marsh fringes the entire frontage of the proposed subdivision area. Width of the
marsh varies from 50 to 100 feet. In the noah, the wetland is dominated by an almost
pure stand of common reed. Beginning in the subdivision area the species diversity
increases including most typical marsh species. A crescent-shaped area of high quality
high marsh exists at the common boundary between lots 1 and 2. An extensive area of
salt shrub habitat occupies the upper wetland elevations along this frontage.
The proposed project is consistent with land use in the surrounding area and lot
sizes are equal to or greater than lots in the surrounding neighborhood. Subsoils are
conducive to sanitary and drainage leaching facilities as evidenced by the on site test
holes. There is no significant erosion potential expected as a result of development.
Though wetlands fringe the entire Richmond Creek waterfront, the depth of the lots
provides for adequate wetland setbacks. Proposed activities within the building
envelopes would be subject to NYSDEC jurisdiction. Town of Southold Trustees
jurisdiction extends 75 feet landward of the designated wetlands. It is recommended that
that the area fronting each parcel 75 feet or greater from the designated wetlands remain
natural and/or is enhanced through planting of native species. Establishment of this
buffer area will ensure that land use does not significantly impact the wetlands.
lfthe Planning Board is in agreement with the assessment provided above, I believe that
the proposed project will not cause a significant adverse impact upon natural or human
environmental resources. Accordingly, the Board may wish to consider the adoption of a
Negative Declaration in connection with this project.

The Town has purchased the development rights on 37. 2849 acres of
49.5 acre parcel. As shown on the map, the density on the total parcel
has been reduced to 3 proposed lots. Lot 4 contains an existing
single-family residence.
The Planning Board requests your review of the wetland delineation. If
all is in order, the Planning Board plans to proceed with the SEQRA

The above referenced property is located in an R-80 zone and therefore had a potential
density of approximately 24 lots. The Peconic Land Trust was able to purchase the property and
subsequently sold the development rights on 37.63 acres of farmland to the Town of Southold.
The density has been reduced to a total of four home sites, one of which is a Pre-existing residence
with barns on proposed lot 4. Thus, where there could have been a total of 25 homes there will
now only be 4 at the most.
We are aware that a deed discrepancy exists regarding a portion of the property located in
the southeast comer of the parcel. We currently in the process of addressing this problem. As
well, we also note that an adjacent owner's fence encroaches on our property. We have contacted
the neighbor and are working towards resolving this matter.
