I For Relief Pursuant to Chapter 100, Section 100-31.1 of the Code of the Town of Southold. ------------------------------------------x TO THE TOWN BOARD OF THE TOWN OF SOUTHOLD: That upon the petition of ANNA FIORE, the petitioners respectfully submit to the Town of Southold the following: 1. petitioners are the owners of a parcel of real property consisting 49.9 acres located on the South side of Main Road in peconic, Town of Southold, Suffolk County, New York. Annexed is a copy of the description of the property. 2. That prior to May 20, 1983, and January 1, 1983, the petitioners applied to the Planning Board of the Town of Southold for permission to subdivide said property and submitted an application for a major subdivision with respect to same known as "SUBDIVISION OF RICHMOND CREEK FARMS" . 3. On June 15, 1982, the Planning Board approved the petitioners' preliminary map entitled "RICHMOND CREEK FARMS" . 4. Said preliminary subdivsion map, as approved, provided for the clustering of 42 building parcels each of which would contain an area of approximately 20,000 to 30,000 , . ( . ( . square feet, with approximately 15.3 acres remaining as open space. 5. Since the lots on the preliminary map were less than 40,000 square feet, the petitioners were required to obtain a variance from the Suffolk County Health Department. 6. The petitioners made an application to the Suffolk County Health Department and a hearing on the application was held. 7. At the conclusion of the hearing, the Petitioners requested additional time to submit additional information to the Suffolk County Health Department. 8. The petitioners are still attempting to obtain said additional information to submit to the Suffolk County Health Department to obtain approval. 9. The application before the Suffolk County Health Department is still pending. 10. The Petitioners have expended substantial sums to date in attempting to obtain approval of their subdivision. WHEREFORE, the Petitioners respectfully request that they be granted a waiver of the bulk and parking requirements of Chapter 1000 of the Code of the Town of Southold as amended by the Southold Town Board of May 16, 1983, and that they be permitted to proceed with obtaining approval for a subdivision based upon the bulk and parking schedule in effect prior to May 20, 1983. Dear Mr. Raynor: In accordance with your request the staff has examined the proposed sub- division layout for a 49.6 acre tract reputedly owned by A. Flore, }I. Longo, L. Stein, C. Christake, J. Evangalista, and S. Evangelista and offer the follow- ing comments on the map for your use. The overall layout of the proposed subdivision appears to be satisfactory. There are several aspects of the layout that you may wish to consider, if you have not done so already. 1. We suggest the use of a curve at Lots 22-23 to facilitate turns. 2. The Commission usually requires a 100 foot setback from wetlands for residential structures and sanitary disposal facilities. The proposed setback of 75 feet shown within Lot 25 will, therefore, be unsatisfactory. 3. The appendages of Lot 42 do not serve any useful purpose. It is suggested that they be incorporated into the Grattan parcel. In exchange Grattan could give the developer part of his parcel so that a short radius corner curve can be created. The end result is that the Grattan parcel would be enhanced and the design of the subdivision improved. 4. The staff does not understand the necessity of a 60 foot wide street right-of-way. A 50 foot right-of-way would be sufficient. 5. They also noted that the application of the subdivision had expired therefore, the Board will start the process of a subdivision over. A committee was appointed to doa field inspection on this property November 19, 1981 and report their findings to the Board at the November 23, 1981 meeting. Correspondence from the Suffolk County Department of Health stating that the proposed subdivision has been reviewed by this office and is not being processed for approval since it appears that it does not meet the standards of the Department, which are that a realty development to be served by private wells and individual sewarage systems, have minimum lot areas of 40,000 square feet. The letter further explains the applicant can appeal this and apply for a varience. Letter. to Mr. Haefeli from the Planning Board informing him that since the recommendations of the Superintendent of Highways and Town Engineer have not been received as stated in the Planning Board's resolution of March 8, 1982, the public hearing scheduled for April 12, 1982 will have to be adjourned. An on-site investigatIon of the property was made on September 16, 1980. The Southold Town Planning Board was particularly interested in the suit- ability of the aite for sand awale drainage. As shown on the Nay 14, 1980, design by Van Tuyl Surveyors, the proposed swales would not meet SCS speci- fications. Swale grades would be adequate (less than 3 percent), swales would be properly excavated to coarse material (at estimated depths of 2 to 3 feet) and backfilled with sand, but grass filter strips are not planned between the road and the swales. Without these grass strips oils and sed- i,~nts will quickly seal bhe swale surface and destroy its effectiveness. Swales such as these would be nearly impossible to properly _intain. The site characteristics lend themselves fairly well to sand swale drain- age. Unfortunately, the planned six-foot wide area is not large enough to properly install the swales and their grass filter strips. Perhaps the Town could persuade the developer to (1) install the swales partway into the lots and (2) write into each lot sale that the swales must not be disturbed and that the Town will maintain them. Unless more room is provided for the swales they will do little to help drain the development. Haven loam (0-21 slopes) and Riverhead sandy loam (3-81 slopes) are the predominant upland.soils on the site. Neither has major limitations for development. Both soils are rapidly permeable, however, and could possi- bly cause pollution problems in the groundwater or Richmond Creek after cessPQOls are installed. Tidal marsh soils are located along the creek. If properly stabilized with vegetative cover (especially during construc- tion) the open space area should adequately protect these tidal areas from stormwater runoff. Due to the proximity of the development to wetland areas the NYSDEC should be notified of the project. Stormwater runoff and sedimentation problems during construction could af- fect Wells Road and Richmond Creek unless the developer installs temporary conservation practices. A temporary diversion ditch or straw bale filters between the development and Wells Road would keep sediment from moving off- site. New leaching basins would also be protected. I enclose a copy of his computation which as you can see shows that the lot yield equals 42 acres. The difference between the lot yield as shown on the sketch map and the 38.6 acres indicated by the Board as being the yield, is based upon the fact that the total acreage of 49.6 acres as shown on the sketch map represents true acres of 43,560 square feet per and not builder's acres of 40,000 square feet per. The total square footage included in the plan is 2,160,576 square feet and if this is divided by a builder's acre of 40,000 square feet, the lot yield is 54. If you deduct from the 54 acres, the 1.2 acres which is subject to flooding and drainage easement, the balance of the acreage is 52.8 which when further reduced by the 20% open space requirement of 10.56 acres, leaves a balance of 42.24 acres which can be developed and therefore the number of permitted lots is 42. 516 727-8200 , . . The corrections contained in your letter of July 30, 1979 have been taken care of. Specifically, the following: 1. The jib pieces surrounding the Grattan property have been included as part of Lot 42; 2. The meadow line has been shown on the plot; 3. The turn-around has been moved east so that it does not extend unnecessari- ly into the open space. 4. The area subject to flooding has not been computed in the open space formula, as you can see, only 1.2 acres are sub- ject to flooding or subject to the drainage easement. As you can see, the revised plot eliminates any area for park or playland and the entire 15.3 acres is designated as open space. My understanding is that when a subdivision is filed pursuant to a cluster development the 20 percent open space area takes the place of the park and playland area needed with respect to a standard subdivision. . The Simons have not decided whether to proceed with a subdivision at this time, but are concerned abcut the subdivision of the neighboring property to the West. Young and Young have prepared the enclosed sketch on which the southerly fifty foot road matches up with the road proposed by the Richmond Creek subdivision. However, Young has shown a suggested revision to the Richmond Creek map which would match the northerly fifty foot road which the Simons would eventually like to put in. As you can see, this plan indicates the metes and bounds of the entire parcel of property. Also, it indicates the area subject to flooding and which area was deleted in the computa- tion of the number of lots permissible pursuant to Section 100-136 of this ordinance. This particular plan does indicate an area of 2.6 acres of park and playground which designation will, on the final plan, be deleted, and that the 2.6 acre area will be shown as part of the total open space area. It is my understanding that properly developed in a cluster fashion, the park and playground requirements of Section Al06-38 of the Code doe not have to be met since the open space which results from a cluster takes the place of park and playground area.
