Dear Mr. Olsen:
The following action was taken by the S0uthold Town Planning
Board at a regular meeting held March 10, 1980.
WHEREAS, a formal application for the approval of a subdivision
plat, entitled Minor Subdivision of Briarcliff Sod, Inc.~ was
submitted to the Planning Board on November 29, 1979 and an
application fee of $20 was paid on November 29, 1979, and
WHEREAS, a public hearing was held on the said subdivision
application and Plat at the Town Hall in Southold, New York, on
March 10, 1980 at 1:45 p.m., and
WHEREAS, the requirements of the Subdivision Regulations of
the Town of Southold have been met by said subdivision Plat and
application,
Now, therefore, be it RESOLVED, that the application of
Briarcliff Sod, Inc. for approval of said subdivision plat prepared
by Young and Young and dated August 23, 1979 and amended October 10,
1979, be approved and the chairman be authorized to endorse approval
on said subdivision plat.

Dear Mr. Olsen:
The Planning Board took action on February 11, 1980 to rescind
its previous actions regarding the subdivision of Briarcliff Sod,
Inc. at Peconic. One action rescinded the waiver of the public
hearing and the other the approval of the subdivision. These actions
were taken as a result of a conference with the Town Attorney in
which he informed the Board that it has no power to waive any part
of the regulations; it may only waive improvements.
In order not to cause any problem with this subdivision in the
future, the Board has decided to proceed in this fashion. The
following action was also taken.
.RESOLVED to set 1:45 p.m., Monday, March 11, 1980, at the Town
Hall, Main Road, Southold, New York, as the time and place for a
public hearing on the question of the approval of the minor
subdivision of Briarcliff Sod, Inc. located at Peconic.

Dear Mr. Olsen:
The following actions were taken by the Southold Town Planning
Board at a regular meeting~.held January 7, 1980.
WHEREAS, the minor subdivision of property of Briarcliff Sod,
Inc. has had a public hearing by the Southold Town Zoning Board of
Appeals on December 6, 1979 and has been granted a variance by that
Board, and
WHEREAS, this waiver of the Subdivision Regulations is deemed
to be in the public interest as a second public hearing is a
duplication of effort in this matter,
Now, therefore, be it RESOLVED that pursuant to Article V
Section A106-50 of Subdivision of Land of the Code of the Town of
Southold that the application of Briarcliff Sod, Inc. for a minor
subdivision of property at Peconic be granted a waiver of Article
II Section A106-22Eof Subdivision of Land of the Code of the Town
of Southold.
WHEREAS, a waiver of public hearing was granted on January 7,
1980, and
WHEREAS, the requirements of the Subdivision Regulations of the
Town of Southold have been met by said subdivision Plat and
application,
Now, therefore, be it RESOLVED, that the application of
Briarcliff Sod, Inc. for approval of said subdivision plat prepared
by Young and Young and dated October lC, 1979 be approved subject
to the following modifications, and that the Chairman of the Planning

Board be authorized to endorse approval on said subdivision Plat
upon compliance by the applicant with such modifications as noted
below.
Modification of said Plat to show the following conditions of
the Suffolk County Planning Commission:
Adequate drainage structures shall be constructed on the
site to retain on the site all stormwater runoff created
by the development and improvement of either lot.

All driveways shall contain a turnaround provision, such
as a "T" shaped shunt, so that vehicles leaving either lot
will not have to back out into the traffic stream on Main
Road.
I am enclosing the negative declaration also necessary in
this matter. Upon receipt of maps with the above notation, I will
have the chairman sign the maps.

Gentlemen:
I am still awaiting the decision with regard to your March
meeting in reference to the above captioned subdivision.
Subsequent to this meeting, I have briefly discussed with
Mr. James Monsell of the Village a proposal as follows:
1) The applicant for the%proposed subdivision ~f Briarcliff
Acres would donate the necessary area for the Village of Greenport
well site providing there is adequate quantities necessary to
meet the Village standards. As it would be necessary for the
Village to install mains from this well field to its existing
water main at the juncture of South Harbor Road and Main Road,
we request the following consideration:
2) The lots within Briarcliff Acres would have a waiver of
installation and hookup fees as an offset to the donation of the area
necessary for the well.
We hereby request confirmation'as to whether the Village of
Greenport presently has the ability to service the proposed
Briarcliff Acres subdivision.
We would appreciate a response with regard to this matter as
presently we have waited more than 90 days to obtain an answer
so that we may proceed before the Southold Town Planning Board,
Suffolk County Planning Commission, Suffolk County Department of
Health Services, etc.

Pursuant to Article 8 of the Environmental Conservation Law
State Environmental Quality Review Act and 6NYCRR Part 617, Section
617.10 and Chapter 44 of the Code of the Town of Southold, notice
is hereby given that Southold Town Planning Board as lead agency
for the action described below has determined that the project will
not have a significant effect on the environment.
DESCRIPTION OF ACTION
The minor subdivision of Briarcliff Sod, Inc. is a twO-lot
residential subdivision of 25.629 acres located at Peconic.
The project has been determined not to have a significant
effect on the environment for the following reasons:
An environmental assessment has been submitted which
indicated that no significant adverse effects to the
environment were likely to occur should the project be
implemented as planned.
Because it is more than 300 feet from tidal wetlands,
it is not under the jurisdiction of the New York State
Department of Environmental Conservation.
The Suffolk County Department of Health Services has
indicated that a precursory review indicates that
conditions are adequate for sewage disposal facilities
although problems may be encountered with obtaining
potable water due to high nitrate concentrations in the
area. The house on lot I is existing and the remainder
of the area will be in sod farming.
The project will meet all requirements of the Code of
the Town of Southold Subdivision of Land Regulations.

map subject to the following conditions that are deemed necessary to help preserve

resent Briarcliff Sod Inc., which is in the process of purchasing approximately
24, 820 acres from Philip and Elizabeth Wenzel. The Purchaser has a Variance
Proceeding pending before the Zoning Board of Appeals to separate from the farm
land the house and frame garage, which parcel would be retained by the Sellers and
would have an area of 35,247 square feet,
I have been advised by my client that there is no immediate intention to subdivide
the acreage, and the land at this poinl would be used for agr~tural purposes. I
