RESOLVED that whereas, a formal application for the approval of a subdivision plat entitled " Estate of Charles Simon" located at Peconic was submitted to the Planning Board on March 22 , 1984 and, filing fee of $100 was paid on March 22 , 1984 , and WHEREAS, a public hearing was held on said subdivision application and plat at the Town Hall, Southold, New York, on March 18, 1985 at 7 :30p.m. , and WHEREAS, the requirements of the Subdivision Regulations of the Town of Southold have been met by said subdivision plat and application, NOW, therefore, be it RESOLVED that the application of "Estate of Charles Simon" for approval of said subdivision plat prepared by H. Young and last dated Jan. 23 , 1985 , be approved and the chairman be authorized to endorse approval on said subdivision plat subject to the following conditions: 1 . Lots numbered 1, 2 and 3 as shown and designated on the Minor subdivision map approved by and filed with the Southold Town Planning Board shall no be further subdivided in perpuity. 2 -Any further subdivision of Lot number 4 , will constitute a major subdivision subject to the prevailing terms and conditions of the subddvision law of Southold Town, with a map of the subdivision filed in th e office of the County Clerk. Due to the minimum lot area requirement of the zoning classification of this property being considerably less than the area of Lot 1 the lot shall be made subject to a restriction that will prohibit future subdivision to avoid any attempt by a future owner to subdivide the parcel and thereby create lots whose areas will be substandard. 0 4 .: Any dirveways on Main Road shall make an angle of at least 70 and preferably 90 with the state road. 5 . Any drive way on Main Road for Lot 4 shall have a turnaround provision, such as a T-shaped shunt, so that a vehicle leaving a lot will not have to back out into the traffic stream on the road. 6 . A short radius curve, preferably with a radius no greater than 20 feet shall be provided at the intersection of Main Road with Wells Road to facilitate turns at the corner and to enhance the streetscape . 7 No driveway or entrance road on Main Road and on Wells Road shall,,be located within fifty (50) feet of the ends of the short radius curve connecting the southerly side of the right-of-way of Main Road with westerly side of the right-of-way of Wells Road. 8 . The alignment of Wells Road shall be improved by the use of large radius curves in place of the angular bends. This improvement will bring the alignment of the road up to modern standards and will enhance the streetscape . 9 . All stormwater runoff resulting from the development and improvement of this subdivision or any of its lots shall be retained on the site by adequate drainage structures so that it will not flow out onto the right-of-way of Main Road. 10. Any change in the runoff pattern of Lot 4 due to improvement of the lot or change in its current use shall be subject to analysis and the construction of adequate drainage structures because current stormwater runoff is carried by a pipe culvert under Wells Road to a discharge point at the edge of the tidal wetlands bordering Richmond Creek. 11 . Conditions 1,2 ,3 ,4 ,5 ,7 ,9, and 10 shall be filed as covenants and restrictions in the office of the County Clerk on or prior to the granting of approval to this subdivision. DESCRIPTION OF ACTION The minor-subdivision of Charles Simon Estate is a 4 lot subdivision on 39 .4 acres located at Wells Road, Peconic . The project has been determined not to have a significant effect on the environment for the following reasons : An environmental assessment has been submitted which indicated that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. Because there has been no response in the allotted time from the NY State Department of Environmental Conservation it is assumed that there is no objection nor comments from that agency. The Suffolk County Department of Health Services has indicated no objection to our lead agency. ; the application is incomplete they need a DEC permit or letter of no jurisdiction and it appears the project can be served by subsurface sewage disposal system and individual water supply system. Test well shows elevated NaCl . Prior to construction of water supply or disposal system, Health Department approval must be obtained. Conditions 1, 2, 3, 4, 5 , 7, 9 and 10 shall be filed as covenants and restrictions in the office of the County Clerk on or prior to the granting of approval to this subdivision. These covenants and restrictions can be modified only at the re- quest of the then owner of the premises with the approval of a majority plus one of the Town Board of the Town of Southold after a public hearing. Adjoining property owners shall be entitled to notice of such public hearing but their consent to such modifica- tion shall not be required. Mead's application to the Planning Board. Mrs . Mead called the Planning Board office the week of January 4 , 1984 to request an application and an appointment on the next agenda. The Planning Board secretary told her she could not be on the agenda for January 9, 1984 as the agenda was full. Mrs . Mead called the Planning Board office the beginning of February to be on the February 13 , 1984 agenda. The secretary told her the agenda was full, however, she could be scheduled for the next meeting, March 12, 1984 , with plans to be submitted. It was also suggested that if the plans were submitted, her application could be placed on the agenda for the Board to review without an appointment. Mrs . Mead stated that she wanted an appointment, and one was tentatively scheduled for March 12 , 1984 with a notation that plans were to be submitted, pursuant to Section 106-21A. Mrs . Mead called approximately 1' weeks prior to the March 12 meeting regarding her appointment. The Planning Board secretary explained that the Board had scheduled public hearings for this date, therefore, she could not be scheduled. She was also told that the Board requires plans to be submitted two weeks prior to the meeting, and since her plans were not in, she could not be on the agenda. Mrs . Mead called the Planning Board office on March 14 , 1984 asking for an appointment on the next agenda which was April 9, 1984 . She stated that she would have her plans in two weeks prior to the meeting. She was tentatively scheduled for that meeting, again with a notation that plans were to be submitted. Southold Town Board (2) April 5 , 1984 ---------------------------------------------------- On March 15 , 1984 Planning Board secretary spoke to the Chairman regarding the agenda. He noted that in review of the previous file, Mrs . Mead was represented by Counsel and that her attorney should schedule all Planning Board appointments . On March 19 , 1984 Planning Board secretary sent a letter to Mrs . Mead explaining this . On March 20, 1984 Mrs . Mead called the Planning Board office stating that she was not represented by Counsel on this application. She questioned whether she still had her appointment in light of this fact. It was noted that she still did not have her application nor her maps in the office . She stated that she would have everything in by March 22 , 1984 . On March 22 , 1984 Mr. and Mrs. Mead presented the application and maps to the Planning Board secretary Mrs. Mead again questioned if she was still on the agenda The Planning Board secretary told her she was , but the Hoard was to-review the- agenda and if there were any problems, she would be contacted. Beginning in January, 1984, and weekly since , I have called the Planning Board office to schedule an appointment re , application for minor subdivision of the Charles Simon Estate , Peconic. 2. I could not get an appointment for the January meeting, but was told by the secretary to call the following week for a February appointment. I did so and was told I could not get a February appointment, but to call back for a March appoint- ment. The week following the February meeting,. I called the secretary of the Planning Board again, and a March 22nd appointment was confirmed. When I called just prior to March 22, 1984 for the time of my scheduled appointment, I was told I could not have that appointment. I was told to call again for an April appointment.
