Dear Mr. Jarvis:
The following resolutions were adopted by the Southold Town
Planning Board at a meeting held on Monday, April 27, 1992.
BE IT RESOLVED that the Southold Town Planning Board,
acting under the State Environmental Quality Review Act, do an
coordinated review of this unlisted action. The Planning Board
establishes itself as lead agency, and as lead agency makes a
determination of non-significance, and grants a Negative
Declaration.
WHEREAS, Herodatus Damianos is the owner of the property
known and designated as Pindar Vineyard SCTM#1000-85-2-15,
located at Main Road in Peconic; and
WHEREAS, a formal application for the approval of this site
plan was submitted on February 28, 1992; and
WHEREAs, the Southold Town Planning Board, pursuant to the
State Environmental Quality Review Act, (Article 8), Part 617,
declared itself Lead Agency and issued a Negative Declaration on
April 27, 1992; and
WHEREAS, this site plan was certified by Victor Lessard,
Principal Building Inspector on March 26, 1992; and
WHEREAS, all the requirements of the Site Plan Regulations
of the Town of Southold have been met; and

be it therefore,
RESOLVED, that the Southold Town Planning Board approve and
authorize the Chairman to endorse the final surveys dated
February 14, 25, & 26, 1992, subject to a one year review from
the date of the Certificate of Occupancy.

Re: Use of Proposed 86 ft. by 35 ft. Building at Pindar
Dear Dr. Damianos:
Thank you for conferring with the Board of Appeals at our
Regular Meeting held on Thursday, May 7, 1992 concerning the
proposed use of the 86 ft. by 35 ft. building.
As you know, the conference was the result of reviews
concerning a site plan which was pending under the zoning code
and the environmental procedures, and there were concerns that
our department and other departments or agencies will also have
jurisdiction concerning use of the structure for public
assemblies such as wine festivals, concerts, sales of wine,
etc. You were kind enough to provide us in writing with the
proposed uses, now as a gazebo and in the future for certain
public events.
As explained to you on Thursday evening, public assembly
uses are not permitted as a matter of right under the current
zoning code and do not fall under the accessory provisions of
the code. They are uses found to be independent and not
customarily necessary or incidental to the production of wine.
We advised you that an application to the Town Clerk under
Chapter 27 of the Code of the Town of Southold to determine the
need for permits was necessary for such public assembly uses, as
well as any proposed extension of retail sales of wine, in the
form of an amended Special Exception to be filed with the Board
of Appeals. The Town Board and the Zoning Board each have
original jurisdiction for these permits, and an amended site
plan application with the Planning Board.
In our understanding, after our discussion, that the use of
the building at this time is only for private "gazebo-type"
sittings of individuals or groups who will be entering or

leaving the winery building and not at this time for large
public assembly events, such as festivals, concerts, and/or
not-for-profit charitable fund-raising events. In any event,
when and if you decide to plan for such public events, you have

We are furnishing copies of this letter to the Planning
Board Chairman, Members and Staff, and the Building Department
for their permanent recordkeeping and Update.

Dear ~. Goehringer:
I am drafting this letter to your office regarding plans for a proposed
gazebo/pavillion on the property directly behind our existing Winery.
In this letter we will try to address any questions your office might
have with regards to the present and future uses of the proposed
structure.
The gazebo ~11 only be used on a seasonal basis for picnicing of our
customers and as a staging area for tours. ~ woo_Id use it for wine
tastings, sittings, wine education groups and small wine industry
lectures. Other future uses of this gazebo will include such things
as poetry readings, harvest festivals and not-for-profit charitable
fund-raisers.
As to the physical characteristics of the building, it is an 86 foot
long by 35 feet wide traditional rustic-looking, open-air building.
Lighting and electrical power are not planned at this time. Hours of
use for this building will parallel those of the winery, 8 a.m. to
6 p.m., and sales will not take place in this gazebo.

Dear Mr. Kassner:
The Suffolk County Department of Health Services (SCDHS) has received your letter
dated March 17, 1992, concerning the above-referenced application, and has no objection to the
Town's designation as lead agency.
This correspondence is intended primarily to expedite the procedural requirements of
SEQRA pertaining to the establishment of lead agency. The comments provided below are,
therefore, general in nature. The department wishes, however, to reserve its right to provide more
detailed information within the comment period established for this action.
I. Suffolk County Sanitary Code (SCSC)
The SCDHS maintains jurisdiction over the fmal location of sewage disposal and water
supply systems, pursuant to the authority and requirements of Articles 4, 5, 6 and 7 of the
SCSC. Thus, applicants should not undertake the construction of, or connection to, either
system without Health Department approval.

Applications must comply with all relevant density and construction standards for water
supply and sewage disposal. Where applicable, the depa~hnent regulates the storage,
handling and discharge of restricted toxic and hazardous materials pursuant to the
requirements of Axticles 7 & 12 of the SCSC. ~

If an application has not yet been submitted to the SCDHS, one should be filed at the earliest
date to allow for the technical review oftbe proposed action. Project designs submitted to the
department should be fully consistent with any action currently under review through the
SEQRA process. The applicant should contact the SCDHS to determine the regulatory
reqnirements for the proposed structure.
Design and flow specifications, information regarding subsurface soil conditions, water supply
information, and complete design details are essential to the review of this project, and are
evaluated fully at the time of application review. Should the town require additional
environmental information (such as a DEIS, or EAF Part III) discussion of the compliance
requirements of the SCDHS should be required.
Of particular concern to the department are those areas which because of elevated groundwater
conditions, or soils which are not conducive to the proper functioning of conventional
subsurface sanitary sewage disposal systems. Your agency should be aware that such
conditions frequently require the use of fill or the excavation of subsurface soils to
accommodate subsurface sanitary disposal systems constructed in conformance with the
requirements of the SCSC.
The department is also significantly concerned with areas where access to potable water may be
constrained by unacceptable groundwater quality and the lack of an available public water
supply. All private water supply systems must be constructed in conformance with
requirements of the SCSC.
H. NATURAL RESOURCES:
The SCDHS fully supports all efforts to maximize protection of natural resources which may be
impacted upon by construction and development activities. It is the position of the depatlment
that the SEQRA review process provides the greatest opportunity for comprehensive
consideration of these resources, and that all practicable planning measures should be
employed to help ensure their protection.
Of particular concern to department is the adequate protection of wetlands, surface waters,
natural communities, contiguous natural habitats, and rare, threatened and endangered species.
In addition, efforts to protect sensitive physical resources such groundwaters, dunes, bluffs,
shorelines, natural drainage channels, groundwater recharge areas, and steep slopes are fully
supported and encouraged by the SCDHS.
In general, the depamnent encourages the following land use measmes be considered (where
appropriate) to actions being reviewed pursuant to SEQRA.

1. Maximum practicable setbacks from all wetlands, surface waters, dunes, and bluffs
2. Non-disturbance buffers between wetland limits and required structural setbacks
3. Clustering of subdivision lots to provide for maximum preservation of large contiguous
areas of dedicated open space
4. Stringent clearing limitations which can reduce potential impacts to wildlife habitats,
vegetative communities, and unconsolidated soils

The project involves a proposed 3,010 square foot gazebo
for picnicking and scenic viewing, on an existing 38 acre
vineyard and winery. The site and area are zoned for
winery and vineyard use by the Town of Southold, thus the
proposed action is consistent with zoning.
The proposed site plan was reviewed by the Principal
Building Inspector and found to meet all zoning
requirements.
An environmental Assessment Form has been submitted and
reviewed, and it was determined that no significant adverse
effects to the environment were likely to occur should the
project be implemented as planned.

confirm fo~ the record that although we have no objection to
your assuming lead agency status, our department will be an
involved agency.
Please note that the proposed accessory [pavillion or gazebo)
building is shown to be at a height from ground level to the top
of the roof at above 18 feet (total height scales to be 30 feet,
and when calculating an average for a pitched roof, the height
is a total of 21+ feet. Accessory buildings are limited to a
height of 18 feet (vertical distance measured from ground to the
mean height between ridge and eave).
It is our position that a variance (height) application should
be filed under the accessory provisions of the code befor~ the
Planning Board considers final approval of its location on this
site since the building is at least three feet above the
limitation. The alternative, of course, would be to su~bmit a
amended construction plan showing compliance with the height
requirements for permanent recordkeeping.
We are providing a copy of this memorandum to the Building
Inspector's Office for their records.
