Work is continuing on the maps for final approval. However, we are being held up receiving Suffolk County Health Department ap- proval. CHARLES ACRES After reviewing correspondence from soil and water and making another field inspection of the proposed subdivision, a few questions regarding drainage on the site need to be addressed. The first area of concern is the pond and drainage facilities leading to it. Soil and water indicates that the ground-water would be closer to an elevation between 3-5. A field investigation during a relatively dry time of year has revealed an elevation of 3 .51 . Since the surveyor/engineer has not submitted water tables proving his contention of elevation 1 , we would have to assume given the information we have on surrounding sites and field evidence gathered that the water table is closer to 4 than 1 . Assuming a groundwater elevation of 4 there would be excessive back-up into the piping, leaching pools and catch basins given the invert elevations shown on the plan (see attached plan) since a detailed plan is not given for the leaching basins ( i.e. soil type, invert elevation, depth of basins) it is difficult to determine how the basins will work to reduce flow into the pond by leaching into the ground. The attached plan is the best assumption of inverts and depths of the leaching basins given the information available. Given a 2" rainfall with the above situation there will more than likely be a backing up of water and eventual overflow out the basins and onto Wells Road and this proposed subdivision road. Another question is how the leaching basins will be maintained. Siltation and clogging will undoubtedly occur and the basins will have to be cleaned periodically. There does not seem to be any consideration for this since the basins are covered by ± 2 ' of ground. Another question regarding the pond is the total depth. Will a depth of -7 introduce salt water to the area and in turn affect any wells in the subdivision? There is a lack of substantiated proof to make a conclusion. If it is found that this depth may have a potential to cause future problems the bottom elevation will have to be raised and the area of the pond increased to handle the required volume of runoff. It was noted during a field inspection on a rainy day that some ponding and quite a bit of overland runoff occurs in this area of the proposed lots 1-4. It is recommended that a grass swale be installed along the westerly side of Wells Road and direct the runoff towards the South. The water at this time will travel overland from the area of proposed Lot 4 towards Lot 1 . Since Wells Road is slightly higher than the property, the water will then run south along wells Road until it comes to a low point on the road (approximately 270 ' from the first curve) and then crosses the road and heads easterly towards a branch of Richmond Creek. Ponding can and does occur at this point on the road. Leaching pools should be installed at this low point at the end of a proposed grassy swale and then directed into the pond. Computations will have to be made to determine how much runoff will be added and then determine how much larger the pond will have to become. In conclusion, it is apparent that changes will have to be made to the pond. Raising the bottom of the pond (if required) will necessitate enlarging the pond to handle the anticipated runoff. Unless the surveyor/engineer can demonstrate that the water table of 1 .00 is correct, the drainage facilities as described earlier, will also have to be revised. It is also recommended that all piping proposed have a minimum of a 1% slope. Several pipes are much less than this. A short radius curve , preferably with a radius no greater than 20 feet, shall be provided at the intersection of Main Road with Wells Road to facilitate turns at the corner and to enhance the streetscaoe. 7. No driveway or entrance road on Main Road and on Wells Road shall be located within fifty (50) feet of the ends of the short radius curve connecting the southerly side of the right-of-way of Main Road with the westerly side of the right-of-way of Wells Road. Covenants and Restrictions 1 . No structure shall be erected, altered, placed or permitted upon any building plot forming a portion of the premises hereinabove described other than a single-family detached residential dwelling not to exceed two (2) stories in height with a private garage for not more than three (3) auto- mobiles. 2. The minimum ground floor area, exclusive of open porches and garages, shall be as follows: (A) For a one (1) story house, 1500 square feet. (B) For a one and one-half (1 1/2) story house, 1000 square feet on the first floor with an additional 500 square feet, floored and framed, on the second floor. All second floor ceiling heights shall be a minimum of seven (7) feet six (6) inches, with a minimum kneewall -2- height of four (4 ) feet. (C) For a two (2) story house, 1000 square feet on each floor, together with a minimum ground floor attached extension of at least 12 feet by 20 feet which may be used either as a garage, an in- terior living area, or as a covered porch. 3. No residence shall be permitted to be erected on any portion of the premises hereinabove described without obtain- ing prior written approval of the plans and specifications by the "Owners" . One signed and approved copy of said plans and specifications shall remain in the possession of the "Owners" and another signed and approved copy shall remain in the possession of the building plot owner. No changes to the exterior of the dwelling shall be made without the prior written approval of the "Owners" . 4 . No residence shall be erected without obtaining prior written approval by the "Owners" of the plot plan showing the proposed location of the residence upon the building plot. No residence may be erected having a front yard setback from the street of less than fifty (50) feet. 5. No garages or outbuildings shall be erected without the prior written approval of the "Owners" . 6 . No residence or garage erected on any portion of the subject premises shall have asbestos siding. 7 . No fence, wall, partition or other barrier of any kind, more than four (4) feet in height, shall be erected or maintained without the prior written approval of the "Owners" . A fence is intended to include any hedge, vegetation barrier, "tree hedge" or earthen berm. -3- i i 8. Any swimming pool erected must be an inground pool and must comply with all regulations of the municipalities having jurisdiction. 9. The grounds of each residence must at all times be kept neat, orderly and well-maintained. 10. The exterior of all residences shall be 1008 com- pleted within ten (10) months of the date of the issuance of a building permit by the Town of Southold. 11 . All debris shall be removed from the premises prior to occupancy of the residence. 12. No trailer, camper, basement, tent, garage or other temporary structure shall at any time be used as a residence either temporarily or permanently. 13. No signs other than one displaying the owner's name and his/her profession or occupation if said resident has an office as a doctor, dentist, lawyer or accountant shall be erected. Such permitted signs shall not exceed six (6) inches in height or twenty-four (24 ) inches in width. 14. No animals, other than the usual household pets, shall be kept on the premises and such pets must be confined to their owner' s premises except, however, when being trans- ported to and from the said premises. No coop, cage or other structure for housing animals shall be erected without the prior written approval of the 'Owners" . 15. No portion of the subject premises shall be used or maintained as a dumping ground for rubbish, trash, garbage or other waste. All such material shall be stored in a hidden, sanitary container and shall be removed promptly from the premises. 16. No clothes poles, clothes lines, playground equip- -4- ment or vegetable gardens shall be placed, erected or main- tained except in such a location as to insure that they shall not be readily visible from the street. 17. No residence shall be boarded up, nor shall any win- dows or entrances be sealed, for any extended period of time. 18 . No owner of a residence shall rent any portion or portions of the premises to boarders or transients. 19 . No trucks, cars, boats, mobile homes, campers or trailers shall be stored out-of-doors on the subject premises with the exception that no more than two (2) regularly used cars or pickup trucks may be parked in the driveway of each residence and with the further exception that no more than one ( 1 ) boat, not to exceed twenty (20) feet in length, may be temporarily stored in the rear of a residence. 20. No regularly used vehicles may be parked on the street. Parking for all regularly used vehicles must be pro- vided on the residence premises. 21. No snowmobiles, dirtbikes, quadratracks or like vehicles may, be operated within the subdivision. 22. Anything herein contained to the contrary notwith- standing, it: is expressly declared and agreed that the Cove- nants and Restrictions herein shall not apply to or prohibit the erection and maintenance of a temporary sales office in any residence on said premises by the "Owners" , or by any builder of a. residence on the premises. 23 . Anything herein contained to the contrary notwith- standing, the "Owners" shall be permitted to erect signs on premises owned by them to aid in the development and sale of building plots and residences on the subject premises. 24. Parcel marked "Open Space" as shown on map entitled -5- i "Subdivision Map of Charles Acres at Peconic" , to be filed in the Office of the Clerk of the County of Suffolk, shall for- ever and in perpetuity constitute a "Common Area" for the benefit of persons owning lots within the proposed subdivi- sion. Said "Open Space" shall not be open or available to the public for general or park use, but shall remain at all times in the exclusive possession and for the exclusive use and enjoyment of owners of Lots 1 through 14 within said proposed subdivision. In order to insure the "Owners" intent and pur- pose to preserve the "Open Space" as an open and scenic Common Area for the benefit of persons owning building plots on the said proposed subdivision map, the following protective cove- nants and restrictions shall run with the land and be binding upon all purchasers, owners, mortgagees, lienors and other persons acquiring an interest in Lots 1 through 14 on said proposed map, or any portion thereof: (A) The "Owners" shall at their own cost and ex- pense establish a Not-For-Profit corporation, to be known as "Charles Acres Homeowners' Association, for the benefit of owners of Lots 1 through 14 on said proposed subdivision map. (B) Each said lot owner, or succeeding owner, shall automatically become a member of said Homeowners' Associa- tion. (C) Each of said lots shall bear one-fourteenth of the expenses of the Homeowners' Association activities, after its formation by the "Owners' . These expenses shall include maintenance charges and any and all real property taxes levied after the date hereof on the "Open Space' . (D) Title to the "Open Space" shall be conveyed to the Homeowners' Association promptly after the creation of -6- said Association. (E) Each of said lot owners shall have an equal vote in the affairs of the Homeowners' Association and shall have an equal right to the use and enjoyment of the Common Area. (F) Once the Homeowners' Association has been for- mally established, all responsibility for the operation and the maintenance of the Common Area and facilities thereon shall lie with the Homeowners' Association. (G) Conveyances from the "Owners" to owners of Lots 1 through 14 on said proposed subdivision map shall include a grant of an easement of enjoyment over the premises shown on said map as "Open Space" , such easement to continue until such time as said Homeowners' Association is created. (H) The Homeowners' Association shall have the right to borrow money for improvements to the "Open Space" and may encumber the "Open Space" as security for said improve- ments to said Common Area. ( I ) The Homeowners' Association shall have the right to suspend membership rights of any lot owner for non- payment of assessments, or for the infraction of any published rules of said Association. (J;I No structures may be erected on the Common Area except with the permission of the Planning Board of the Town of Southold. (K) Each deed of conveyance to Lots 1 through 14 shall include by reference these covenants and restrictions. (L) The Homeowners' Association shall be perpetual, shall have the right to purchase insurance, shall pay taxes, shall provide in its Charter and/or By-Laws for an annual -7- j homeowners' fee and shall further provide that all such fees and assessments shall become liens until paid upon said Lots 1 through 14 . The Homeowners' Association shall have the right to proceed with necessary legal action to foreclose and/or enforce said liens, and it shall further have the right to commence action against any lot owner of Lots 1 through 14 for the collection of any unpaid assessment in any court of compe- tent jurisdiction. (M) The By-Laws of to Homeowners' Association shall be approved by the Town Board of the Town of Southold before adoption by the Homeowners' Association. (N) The "Owners" shall assume responsibility for all taxes and improvements to the 'Open Space" until such time as any six (16) of Lots 1 through 14 have been conveyed to per- sons other than the 'Owners" . (0) Anything herein contained to the contrary not- withstanding, the provisions of this Article shall continue in perpetuity for the benefit of the owners of Lots 1 through 14 on said proposed subdivision map. 25. If the "Owners" or their successors or assigns shall fail to enforce these Covenants and Restrictions, it shall be lawful for any person or persons owning any portion of the hereinabove described premises to prosecute at law or in equi- ty the persons violating or attempting to violate any such Covenant and Restriction either to prevent them from so doing or to recover damages for such violation. 26. It is expressly understood and agreed that the fore- going Covenants and Restrictions are intended to cover the above-described real property only and are not to be extended to any other property of the 'Owners" , or their successors and -8- i i I assigns, so as to restrict in any manner any other real property which they may now own or which they may hereafter acquire. 27 . Anything herein contained to the contrary notwith- standing, it is expressly declared and agreed that the Cove- nants and Restrictions herein shall not apply to or prohibit the erection and maintenance of a temporary sales office in any residence on said premises by the "Owners" , or by any builder of a residence on the premises. 23. Anything herein contained to the contrary notwith- standing, the "Owners" shall be permitted to erect signs on premises owned by them to aid in the development and sale of building plots and residences on the subject premises. 24. Parcel marked "Open Space" as shown on map entitled -5- i i { "Subdivision Map of Charles Acres at Peconic" , to be filed in the Office of the Clerk of the County of Suffolk, shall for- ever and in perpetuity constitute a "Common Area" for the benefit of persons owning lots within the proposed subdivi- sion. Said "Open Space" shall not be open or available to the public for general or park use, but shall remain at all times in the exclusive possession and for the exclusive use and enjoyment of owners of Lots 1 through 14 within said proposed subdivision. In order to insure the "Owners" intent and pur- pose to preserve the "Open Space" as an open and scenic Common Area for the benefit of persons owning building plots on the said proposed subdivision map, the following protective cove- nants and restrictions shall run with the land and be binding upon all purchasers, owners, mortgagees, lienors and other persons acquiring an interest in Lots 1 through 14 on said proposed map, or any portion thereof: (A) The "Owners" shall at their own cost and ex- pense establish a Not-For-Profit corporation, to be known as "Charles Acres Homeowners' Association, for the benefit of owners of Lots 1 through 14 on said proposed subdivision map. (B) Each said lot owner, or succeeding owner, shall automatically become a member of said Homeowners' Associa- tion. (C) Each of said lots shall bear one-fourteenth of the expenses of the Homeowners' Association activities, after its formation by the "Owners" . These expenses shall include maintenance charges and any and all real property taxes levied after the date hereof on the "Open Space" . (D) Title to the "Open Space" shall be conveyed to the Homeowners' Association promptly after the creation of -6- i 1 i said Association. (E) Each of said lot owners shall have an equal vote in the affairs of the Homeowners' Association and shall have an equal right to the use and enjoyment of the Common Area. (F) Once the Homeowners' Association has been for- mally established, all responsibility for the operation and the maintenance of the Common Area and facilities thereon shall lie with the Homeowners' Association. (G) Conveyances from the "Owners" to owners of Lots 1 through 14 on said proposed subdivision map shall include a grant of an easement of enjoyment over the premises shown on said map as "Open Space" , such easement to continue until such time as said Homeowners' Association is created. (H) The Homeowners' Association shall have the right to borrow money for improvements to the "Open Space" and may encumber the "Open Space" as security for said improve- ments to said Common Area. ( I ) The Homeowners' Association shall have the right to suspend membership rights of any lot owner for non- payment of assessments, or for the infraction of any published rules of said Association. (J) No structures may be erected on the Common Area except with the permission of the Planning Board of the Town of Southold. (R) Each deed of conveyance to Lots 1 through 14 shall include by reference these covenants and restrictions. (L) The Homeowners' Association shall be perpetual, shall have the right to purchase insurance, shall pay taxes, shall provide in its Charter and/or By-Laws for an annual -7- homeowners' fee and shall further provide that all such fees and assessments shall become liens until paid upon said Lots 1 through 14. The Homeowners' Association shall have the right to proceed with necessary legal action to foreclose and/or enforce said liens, and it shall further have the right to commence action against any lot owner of Lots 1 through 14 for the collection of any unpaid assessment in any court of compe- tent jurisdiction. (M) The By-Laws of to Homeowners' Association shall be approved by the Town Board of the Town of Southold before adoption by the Homeowners' Association. (N) The "Owners" shall assume responsibility for all taxes and improvements to the "Open Space" until such time as any six (6) of Lots 1 through 14 have been conveyed to per- sons other than the "Owners" . (0) Anything herein contained to the contrary not- withstanding, the provisions of this Article shall continue in perpetuity for the benefit of the owners of Lots 1 through 14 on said proposed subdivision map. 25. If the "Owners" or their successors or assigns shall fail to enforce these Covenants and Restrictions, it shall be lawful for any person or persons owning any portion of the hereinabove described premises to prosecute at law or in equi- ty the persons violating or attempting to violate any such Covenant and Restriction either to prevent them from so doing or to recover damages for such violation. 26. It is expressly understood and agreed that the fore- going Covenants and Restrictions are intended to cover the above-described real property only and are not to be extended to any other property of the "Owners" , or their successors and -8- assigns, so as to restrict in any manner any other real property which they may now own or which they may hereafter acquire. 27 . Invalidation of any one of these Covenants and Re- strictions in whole or in part, by judgment, by court order, or otherwise shall in no wise effect any of the other provisi- ons which shall remain in full force and effect. 28. Anything in Article 25 hereof to the contrary not- withstanding, the "Owners" may amend, waive or terminate any of these Covenants and Restrictions so long as they are the owners in title of one (1 ) or more lots contained within the subject premises.
