Dear Mr. Jarvis;
The following resolution was adopted by the Southold Town
Planning Board at a meeting held on Monday, May 24, 1993.
WHEREAS, Herodatus Damianos is the owner of the property known
and designated as Pindar Vineyards, SCTM# 1000-85-2-15, located
at Main Road in Peconic; and
WHEREAS, a formal application for the approval of this site plan
was submitted on March 5, 1993; and
WHEREAS, the Southold Town Planning Board, pursuant to the State
Environmental Quality Review Act, (Article 8), Part 617,
declared itself Lead Agency and issued a Negative Declaration on
May 3, 1993; and
WHEREAS, all the requirements of the Site Plan Regulations of
the Town of Southold have been met; and be it, therefore
RESOLVED, that the Southold Town Planning Board grant
conditional final approval on the surveys dated May 10, 1993,
and authorize the Chairman to endorse the final surveys subject

regulations pertaining to Article 8 (State Environmental Quality
Review Act) of the Environmental Law.
The Southold Town Planning Board, as lead agency, has determined

Reason Supporting This Determination:
The project involves a proposed structure 21'4" by 16'2" to
house toilet facilities~on an existing 38 acre vineyard
and winery. The site and area are zoned for winery and
vineyard use by the Town of Southold, thus the proposed
action is consistent with zoning.
The applicant will have to comply with the requirements of
the Suffolk County Sanitary Code (SCSC) and all relevant
standards of water supply and sewage disposal systems.
Design and flow specifications, subsurface soil conditions,
and site details will have to be approved by the Suffolk
County Department of Health Services (SCDHS). This impact
is not considered significant due to the anticipated
project compliance with established requirements of the
Suffolk County Sanitary Code (SCSC) and the Suffolk County
Department of Health Services (SCDHS) and the required
obtainment of the relevant permits.
An Environmental Assessment Form has been submitted and
reviewed, and it was determined that no significant adverse
effects to the environment were likely to occur should the
project be implemented as planned.

SUBJECT: Pindar Vineyards Toilet Facilities
Dear Mn Arno~
This is a follow up of our telephone conversation the other day regarding procedures
and actions by members of the Planning Board. Am of the opinion that the Planning
Board staff can do a better job in servicing the residents of the Town, if perhaps they
receive some clarification and input from you. The following items are ones that I feel
were not handled as judiciously and expeditiously as was warranted:
People should not be told that there is a "State Law", that the Town must wait
thirty (30) days after sending out notification of intent to become Lead Agency.
In this particular case there was only one (1) other agency, which was the
Suffolk County Department of Health Services. The time delay was
compounded by the applicant going to the Planning Board on February 26th,
one (1) day late after the deadline that they normally receive requests, which
postponed the decision an additional month.
Additional care can be made in the correct addressing of notification to other
agencies. In the case of the Suffolk County Department of Health Services, an
incorrect address was used (according to the Health Department), and the intent
notification was not received until Friday, April 9th. The Health Department
technological staff member handling it prepared the appropriate statement that
they had no objections to the Planning Board being Lead Agency and there were
no environmental impact concerns, and so forth, and even went to the extent of
finding another department head to authorize that it be faxed to the Planning
Board on the 12th ~ in spite of the reputed history of the Health Department
taking a long time, they certainly responded very expeditiously in this case,
especially in comparison with the Town.

A recognition by the Planning Board staff of which needs to come first. The
Health Department will not process a permit until they receive notification that
the S.E.Q.R.A. process is complete. It seems that the Planning Board members
seem to think that they had to get the Health Department approval before they
completed the S.E.Q.R.A. I think that it is understood (at least I hope it is) that
they do need Health Department approval before they give final Site Plan
approval.
There seems to be a conception by the Planning Board staff that the technical
details requested by another agency on a project must be completely resolved
before the S.E.Q.R.A. process can be completed. This might be true if there
was a major project involving an Environmental Impact Statement, but certainly
in this case there is none perceived by anyone. The Health Department, for
example, is still reviewing the latest submittal and taking into consideration such
details as the leaching pool diameters, the arrangement of the septic tanks,
existing well data, future expansion area, and so forth. None of these technical
items, in my opinion, should delay the S.E.Q.R.A. process, including a
determination of significance.
If you agree with any, or perhaps all of the above, your guidance to the Planning Board
perhaps will add to their responsiveness and effectiveness in their dealings with the
businesses and residents of Southold Town.

Mr. Javis: Good evening, I am trying to make up a little bit
of time that I lost which is a little bit of my own fault and
just the bureaucracy in general. What it pertains to is building
a new set of bathrooms next to our pavilion (Pindar Winery)
that we built last year. I was hoping if there was any way
possible because the people that we had working with us kind of
dropped the ball a little bit and I have to put it back together
again.
Mr. McDonald: We kind of know what is going on. I notice that
we got a letter from the Health Department and they are saying
that your application is not even complete down there yet and
that they need submission of additional information including
wells, septic systems within a hundred feet of the site area,
expansion for the sewage system profile etc..
Mr. Ward: Would you like a copy of that letter?
Mr. Javis: Yes, this is news to me right now.
Mr. McDonald: It just came. In light of that though, I think
we are only talking about a couple of more weeks until the next
meeting to grant you the SEQRA Determination. By the time you

get this stuff together we will be back up and ready to grant
you what you need.
Mr. Javis: From my understanding, I discussed it with Merle
Wiggins today, all this has been taken care of.
Mr. Ward: You have got an incomplete application with the
Health Department, they may be minor items but they are
incomplete and when you or your agent makes a submission they
should know these things.
Mr. McDonald: Get you stuff together and at the next meeting we
will pop you through.
Mr. Javis: Mr. Wiggins swore up and down to me today that
everything is ready to go and he will send the fax out today.
Mr. Ward: Get cleaned up at the Health Department and we will
try to get you on for May 3rd.
Mr. Orlowski: When do you have to have this done?
Mr. Javis: As soon as we can possibly build it. I have guys
on line that are ready to go.
Mr. Orlowski: How long will it take to build it?
Mr. Javis: Well probably a month and a half at least and if
you really want to know, I have my wedding reception there on
June 19th at one o'clock and I would like my grandparent's to
be able to use the bathroom. So, now the pressure is on from my
own family.
Mr. McDonald: We have a meeting the first thing in May right?
Mr. Ward: You have to get cleaned up with them first.
Mr. Javis: O.K., I will follow through with this. Other than
that, there are no other problems right?
Mr. McDonald: Right from the beginning it was pretty much
straight ahead.
