Pursuant to your inquiry of the construction of a home
on lot #1 , please be advised of the following:
Any development on parcel #1 should be done in a
fashion that the area be sloped to the west,
away from Main Road and on lot #1 . Any deviation
from this would result in the applicant constructing
enough recharge to retain 6 inch rainfall .
Parcel #1 should have one driveway only. (no loop)

N/wly/s of Rte. 25, opposite Skunk Lane, Cutchogue, N.Y.
Reference is made to following conditions for approval as per letter of January 5, 1979
from the Suffolk County Department of Planning.
Condition 1. Adequate drainage structures shall be required on each lot to contain any
stormwater runoff resulting from the development and improvement of each lot
so that it will not flow into Main Road;
Comment: There are no drainage installations on any of the lots and from my inspection,
they are not necessary.
Condition 2. All driveways shall have a t °rnaround provision so that vehicles leaving
each lot will not have to back o,.t into the traffic stream:
Comment: Lot No. 1, owned by Stojan is vacant, has no improvements, no driveway and
no drag-nage problem.
Lot. No. 2, owned by St:rcken, has a useable time worn blzestone driveway
with t,rning area in front of a garage.
Lot, Nos. 3 and 4, owned by Stojan, have a circular macadam driveway.
Condition 3. No more than one driveway access shall be created on Main Road for each
lot and where feasible, a common driveway shall be sed for each two lots:
Comment: Lots No. 3 and No. 4 have a common driveway.
Condition 4. Ap7)roval contingent on Sl,ffolk County owning the development rights to
adjacent land repat,edly owned by Martha Stojan ;
Cc m-ent: No comment on this condition.
A 4" gravel farm road 12 ft, wide has been placed by Zaveski in the 3J Ft. R.O.W. from
Rte. 25 to the barn behind Lot No. 2. Also placed is a rectangular gravel area in front
of the barn that is used for turning around. '[here is a small area at the north side of
the turning area that ponds daring rainfall. This can be corrected with minor grading.
Also, in disozssing the farm road, etc. with Mr. Stojan, he mentioned that the Zaveski
farm road called for a black top surface. Attached are copies of the Stojan/Zaveski
agreement the+ covers the black top surface. Would the Si;ffolk County Department of
Planning be involved in the type of farm road constriction that meets a main highway
snch as Rote 25?

Dear Mr. Wickham:
As you know, the above matter was before you during
1977 and during 1978, and involves the sale of development
rights on a farm prop rty to the County of Suffolk with the
sale of the agricultu al lands to a local farmer, and a minor
subdivision on the ba ance of the property along Main Road,
Peconic, New York.
I was astounded and absolutely shocked to hear this
morning that you have not yet set a public hearing for the
minor subdivision. The excuse this time was that your Board
did not have the deed to the County of Suffolk for the
Development rights. The excuse last month was that the owners '
names and the phrase "Minor Subdivision" should be transposed
on the map. Neither of those reasons have any basis in law
or the Southold Town Code for refusing to schedule a hearing.
It appears that your Board' s supercilious attention
to detail, often not based in law or the Southold Town Code, is
an established pattern to delay developments within the Town of
Southold, Be that as it may, in this case you are not delaying
development, but obfuscating a perfectly straightforward trans-
action, which should result in a large number of acres being
preserved in perpetuity for agriculture. I implore you to
place this matter on your hearing calendar as soon as possible
so that the owner and the farmer are not prejudiced by your
delay.
