Gray Change of Zone Petitions, Scoping Meeting Dear Judith: Please be advised that a Scoping Meeting was held as scheduled for the purpose of establishing the scope, format and content of the Draft EIS's for the above referenced projects. A list of those present is attached. The scope of the document will conform to the Scoping Documents provided to your office under separate cover. In addition, Valarie Scopaz expressed two (2) specific areas of concern to the Planning Board, as follows: 1) the site lies within a Special Groundwater Protection Area -- the significance of this designation and impacts of the project related to this issue should be included; and, 2) the use is not in conformance with zoning or Master Planning efforts, in addition, there is an abundance of vacant industrial land in the Town -- this issue should be addressed in terms of need for the project, zoning compatibility, precedent setting nature of the action, and alternative SItes, and conformance to land use plans. Please also be advised that the applicants have prepared a site plan which depicts a coordinated industrial use on both sites. Both Valerie and I requested that the apphcants' provide your office with a copy of this plan for the Board. Based upon my understanding as a result of the meeting, it appears as though the applicants' intends to coordinate the processing of these two apphcations. With this in mind, I would appreciate the input of the Town Board with regard to processing of the Draft EIS(s). The applications can be processed using either one combined Draft EIS, or one Draft EIS for each petition. If two (2) EIS's are used, there will be duplication; however, it would allow the Board to more easily a~t. on t~ese appl!cations indcpel!~ently. If the Board fee.ls that a denial <:>r approval of one petitIOn WIll result In the same deCISIOn for the other, then It would be senSible to review both petitions under the framework of one Draft EIS. Please bring this matter to the Board's attention, and advise the applicant and our office of the Board's feelings on this matter. The question of whether an'action may be significant is not always easy to answer. Frequen Iy, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determir significance may have little or no formal knowledge of the environment or may be technically e.xpert in environment. analysis, In addition, many who have knowledge in one particular area may not be aware of the broader concerns affectin the question of significance. The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determinatio process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a project or actiOr Full EAF Components: The full EAF is comprised of three parts: Part 1: Provides objective data and information about a given project and its site. By identifying basic proje. data, it assists a reviewer in the analysis that takes place in Parts 2 and 3: Part 2: Focuses on identifying the range of possible impacts that may Occur from a project or actio'n. It provide guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentiall~ large impact. The form also identifies whether an impact can be mitigated or reduced. Part 3: If any impact in Part 2 is identified as potentially-large, then Part 3 is used to evaluate whether or not tho impact is actually important. The LEAF Part II, evaluates the project impacts and their magnitude. This section of the LEAF is intended to provide additional information on the importance of the impacts of the proposed project on the environment, in order to form the basis for the adoption of a determination of significance. The LEAF Part III is prepared if one or more impacts are considered as being potentially large, as identified in the LEAF Part II. In the case of the subject proposal, the Town Board of the Town of Southold has received an application for a Change of Zoning on a parcel of land from "A-C" Agricultural- Conservation District, to "U" Light Industrial District. The project involves a 2.0 acre parcel of land, located in an area of the Town which is presently surrounded by "A-CO Agricultural- Conservation District zoning. The proposed action involves a change of zone from "A-C' Agricultural-Conservation District to "U" light Industry District for a 2 acre land parcel, located on the north side of Middle Road (C.R. 48) ap~roximately 600 feet east of Cox Lane. The site habitat can currently be charactenzed as that of an abandoned field. Generally, the "A-C' Agricultural-Conservation District zoned areas of the Town are associated with rural open space character which provide sroundwater recharge areas, and lie on prime agricultural soils. The "A-C" District areas within Southold Town have been established for the preservation of land resources, under more stringent regulations than other Town zoning districts. The "U" Light Industrial District allows for business and industrial land uses on smaller land parcels than other Town zoning districts. If the Town Board acts favorably upon this change of zone, physical change to the project site is expected based upon the allowable uses within the proposed zoning district. The "U" District allows for a variety of business and industrial uses, some of which could present a potential environmental threat. The conceptual site plan which accompanies the Thomas Thompson Change of Zone petition proposes two buildings, a driveway, an on-site sanitary system, and a private water supply well. The exact business and/or industrial use is not revealed on the sketch plan or within any document reviewed that pertains to the site. Further information regarding the exact use of the land under the proposed zoning is needed to completely assess the impacts; however, the proposed zoning district in itself is expected to result in a significant physical change in the land use potential of the site. · The proposed action will alTect groundwater quality. The proposed action is located in Groundwater Management Zone IV. Potable water is proposed to be obtained from an on site well, located in the southern portion of the property. Qepth to grouQdwater at this site is approximately 35 feet. The "A-C" zoned lands within the Town of Southold are primarily areas which provide important groundwater recharge. A change of zone from "A-C' to "U" could alter the quality of recharge which the site contributes. Any land use occurring on the subject site will require an on-site sanitary system. On the conceptual site plan, the proposed cesspools are to be located approximately 150 . feet northeast of the proposed well. The subject parcel is north of the regional groundwater divide, mdicating that in the horizontal plane, flow is generally toward the north. Review of land use in the area finds that existing residences lie to the north of the site. Recharge quality must be maintained and carefully monitored in order to provide future private water supply in the area of the subject application. If the change of zone is granted the effects to the existing air quality caused by this one action are unknown, due to insufficient site use information. This impact only potentially large depending upon the proposed use of the site. It is expected that this impact can be mitigated depending upon use and air pollution technology. · The proposed action will affect agricultural land resources. The subject I?arcel is currently zoned" A-C" Agricultural-Conservation District. These land areas WIthin the Town of Southold have been established to control development and preserve agriculturally valuable land. A change of zone to "U" Light IndustI)' District will result in an Immediate loss of 2 acres of agriculturally zoned land Within the Town. This loss of "A-C" zoned land may result in additional requests to re-zone this land classification for other use, thereby creating a precedent in addition to the direct impacts of the action. · The proposed action will affect aesthetic resources. The subject site is presently vacant land. The current character of this site is that of abandoned field habitat. The subject site consists of low lying vegetation and provides the area with scenic open space. Surrounding uses are of op'en space, agricultural, and residential. A change of zone from "A-C" to "U" Will result in a permanent loss to ~hese aesthetic qualities. It is recognized that the site is privately owned land; however, the potential uses and continuance of aesthetically desirable site character, as related to zoning and potential uses, warrants consideration of the potential change in aesthetic character relating to the change of zoning. . The proposed action will affect the quantity of existing open space. Southold Town is an area of Long Island that has remained rural and provides open space appreciation to the community. The site currently provides open space to residents and travellers along Middle Road (County Road 48). The site is located on the north side of Middle Road (County Road 48). This road is a moderately traveled east-west roadway which is an important corridor in the area. A change of zone from "A.C' to "U" may lead to a further increase of the industrial zone, the use of which would increase the amount of commercial and industrial traffic in the area. The potential impacts of this project in conjunction with existing and future traffic increases should be analyzed and considered in conjunction with the proposed zone change. * The proposed action will affect the character of the existing community. The Town of Southold has recently completed Master Planning initiatives, with implementing efforts reflected in the present Town Zoning Map adopted in accordance with the Master Plan UI?date (adoption date January 10, 1989). The proposed action contradicts the zomng map by extending the industrial zoned land east of the consolidated districts designated to promote appropriate industrial development. The action, if approved, would set a precedent for other future actions, thereby undermining the integnty of the recently amended zoning patterns of the Town. The "A.C' Agricultural-Conservation District totals slightly less than 10,000 acres. The "A-C' zoned lands possess prime farming soils and provide aesthetic and open space opportunities. Preservation of these lands should be regarded as a high priority and non-farm related development should be discouraged. The "A-C" category has been established within the Town of Southold in an effort to retain farmland, encourage agricultural uses, and maintain the existing rural quality of the Town of Southold. If a change of zone for the subject parcel is granted, these goals of the existing land use designation of the subject site would not be realized. An industrial use of this land may further degrade the site by causing significant impacts to the environment that are attributable to industrial uses. The parcel is entirely surrounded by "A-C' Agricultural-Conservation District lands. The proposed "U" Light Industrial District zoning for this 2 acre parcel is therefore out of character with adjacent land use and is expected to cause an impact on the immediately surrounding community, as well as the area. CONCLUSION The proposed action is expected to have a significant impact upon the environment, as discussed above.
